This text is a kind of sketch and presents some simple ideas. The aim of this article is to carry out a critical and reflexive analysis of Roman Ingarden's philosophy of responsibility. Being a member of the phenomenological current, Ingarden mainly studied the ontological bases or conditions of responsibility by identifying different situations of responsibility. In this paper situations of responsibility have been analysed in the semantic contexts in which the word "responsibility" appears. Legally, the prescriptive contexts of using the (...) word "responsibility" are particularly important since they are usually either ignored or inadequately separated from descriptive contexts. Roman Ingarden's views were supplemented by Alf Ross's aspects of responsibility. As a result, the elementary ways of understanding responsibility have been reconstructed; they are the basis for reflections on moral responsibility as well as legal responsibility. (shrink)

This paper analyses the Verlagsanzeige of the humanist, mathematician, astronomer and publisher Johannes Regiomontanus. How is humanism expressed in this famous document from German early printing and what is its relationship to philosophy? The article shows that Regiomontanus advocated a special form of humanism that went beyond the standard humanism that he valued, with ‘truth’ as its most important aspect. From the epistemological perspective of the history of philosophy in Regiomontanus’s publishing programme, the ‘truth’ of mathematics is seen, analogous to (...) some predecessors, as a paradigm of programmatic testimony. What might it be to write a post-colonial social science? And how might the intellectual legacy of Chinese classical philosophy—for instance Sun Tzu and Lao Tzu—contribute to such a project? Reversing the more usual social science practice in which EuroAmerican concepts are applied in other global locations, this paper instead considers how a “Chinese” term, _shi_ might be used to explore the UK’s 2001 foot-and-mouth epidemic. Drawing on anthropological insights into mis/translation between different worlds and their alternative ways of knowing (...) and being, the paper explores that epidemic in three differently inspired _shi_-inflected “empirical” accounts. The first uses Sun Tzu’s strategic understanding of _shi_ to tell a conventionally representational story. The second resists the causes and background factors implied in standard social science by offering a “light” and _shi_-inflected form of knowing. And the third combines the referentiality of social science with a Lao Tzu-informed commitment to the paradoxes of normative epigram. This third narrative thus illustrates the possible features of a situated and _shi_-inflected social science that recognizes that it participates in the contexted and immanent flows and counterflows of things in the world. The paper concludes by noting that such a _shi_-inflected social science is experimental, and suggests that it is important to explore a range of ways of reversing the flow of concepts between EuroAmerica and other global locations. Music reflects subjectivity and identity: that idea is now deeply ingrained in both musicology and popular media commentary. The study of music across cultures and practices often addresses the enactment of subjectivity "in" music - how music expresses or represents "an' individual or "a" group. However, a sense of selfhood is also formed and continually reformed through musical practices, not least performance. How does this take place? How might the work of practitioners reveal aspects of this process? In what sense (...) is subjectivity performed in and through musical practices? In the last two decades in Brazil, indigenous peoples have been struggling for their rights through the practice of what they call “retomada de terras” (reappropriation of lands), which consists of reoccupying ancestral lands that were invaded by farmers or other explorers. Inspired by indigenous perspectives, new social movements are struggling for land and territory. After years of reclaiming the legal demarcation of indigenous lands or agrarian reform without a resolution from the State, they decided to act directly in the (...) building of their territories. Within this process, there is also a production of another space, another ecology, another relationship to the land. If Carl Schmitt is right when he says that the original movement that makes law arise is the taking of land, which produces an ordering of space and defines borders that establish internal and external relations, what happens when lands are retaken and borders are reshaped? If we conceive of law in a very modern and technical conception, solely linked to an institutional image, it cannot help us to answer this question. The practice of “retomada” by the Tupinambá people and the agroecological experience of the Web of the People (Teia dos Povos) in Brazil can be an interesting path to investigate how the conditions of existence can be produced beyond abstract rights and more-than-human arrangements can change the way we live together. These practices produce justice spatially in a given territory and bring conceptions of rights rooted in the entanglements of bodies and their territories. (shrink)

Taking hints from the Italian writer and comedian Paolo Villaggio’s works having the unlucky-to-the-utmost accountant Fantozzi as their hero, the essay tackles the issue of the role, and the possible foundations, of the law in the theoretical scenario of a perfectly deterministic world, where everything is determined by pre-set nexuses of cause-and-effect. Fantozzi is condemned by such an inescapable law of causation (Fate) to meet constant failure, in a social context structured along stiff hierarchies which are completely independent from individual (...) merits, where law enforcement always sides with the lucky ones. Within such a context, the law cannot be grounded on rational foundations-thinking, since the only possible rational conclusion is that the law is completely useless. At the same time, the law cannot be considered an outcome of power, since any power different from that of Fate is mere illusion. The essay wonders whether, in such a theoretical setting, there is the possibility of finding an alternative foundation for the law on non-objectifying thinking, starting from imagination and the idea of justice. Is it possible to imagine reliable rules based on imagination? (shrink)

The article examines the ideas of divine command and divine law in their Quranic and Muslim legal contexts. It suggests a strong connection between western and Muslim values based on linkages developed in medieval times through Latin appropriation of Arabic studies of Classical philosophy. It also traces the need to address common, contemporary concerns such as poverty, through a shared ethical stance.

EDITOR’S ABSTRACTThis article argues that Shang Yang’s philosophy of law was not only a means to enrich the state and strengthen its army, but also envisioned the orderly rule of all All-under-Heaven. Through a fair, universal, and reliable use of rewards, punishments, and also teaching, this vision of laws could ultimately lead to the promotion of moral values, popular consensus, and people’s self-governance.
