Carl Schmitt is one of the most widely read and influential German thinkers of the twentieth century. His fundamental works on friend and enemy, legality and legitimacy, dictatorship, political theology and the concept of the political are read today with great interest by everyone from conservative Catholic theologians to radical political thinkers on the left. In his private life, however, Schmitt was haunted by the demons of his wild anti-Semitism, his self-destructive and compulsive sexuality and his deep-seated resentment against the (...) complacency of bourgeois life. As a young man from a modest background, full of social envy, he succeeded in making his way to the top of the academic discipline of law in Germany through his exceptional intellectual prowess. And yet he never felt at home in the academic establishment and among those of high social standing. In his works, Schmitt unmasked the liberal Rechtsstaat as a constitutional façade and reflected on the legitimacy of dictatorship. When the Nazis seized power Schmitt was susceptible to their ideology. He broke with his Jewish friends, joined the Nazi Party in May 1933 and lent a helping hand to Hitler, thereby becoming deeply entangled with the regime. Schmitt was irrevocably compromised by his role as the ‘crown jurist’ of the Third Reich. But by 1936 he had already lost his influential position. After the war, he led a secluded life in his home town in the Sauerland and became a key background figure in the intellectual scene of postwar Germany. Reinhard Mehring’s outstanding biography is the most comprehensive work available on the life and work of Carl Schmitt. John Law left a remarkable legacy of economic concepts from a time when economic conceptualization was very much at an embryonic stage. Yet he is best known--and generally dismissed--today as a rake, duellist, and gambler. This intellectual biography offers a new approach to Law, one that shows him to have been a significant economic theorist with a vision that he attempted to implement as policy in early-eighteenth-century Europe. Law's style, marked by a clarity and use of modern terminology, stands (...) out starkly against the turgid prose of many of his contemporaries. His vision of a monetary and financial system was certainly one of a later age, for Law believed in an economy of banknotes and credit where specie had no role to play. Ultimately Law failed as a policy-maker, in part because of the entrenchment of the financiers and their aristocratic backers and in part because of theoretical flaws in his vision. His struggle for power took place against the background of Europe's first major stock boom and collapse. The collapse of the Mississippi System, which he had conceived, and the South Sea Bubble led to a lasting impression of Law as a failure. It is this impression that Antoin Murphy seeks to dispel. Besides the introduction and epilogue, its three chapters cover politics, philosophy, and theology, respectively. Sharing a disdain for the Labour Party's embrace of a "reformed capitalism" and welfare state politics with other members of the New Left such as Charles Taylor, MacIntyre connected this political stance with a theoretical critique of utilitarianism, foreshadowing his later criticisms of bureaucracy in After Virtue. Perreau-Saussine not only insightfully explains the contrasting views of MacIntyre and Taylor in terms of their estimation of the prospects inherent within postwar liberal politics but also explains how MacIntyre's pessimistic take on postwar politics led him to embrace elements of conservatism, especially the theme of the individual as "embedded" within a community and tradition, which thus provide an essential context for understanding individual freedom. As such, the author argues, for MacIntyre, Burke and Marx come together in their critique of the abstractions of liberalism. However, "[u]nlike Burke's conservatism," the author argues, "MacIntyre's is not a liberal conservatism but one that tends toward an antiliberal conservatism." We might also note that this skepticism of the market places MacIntyre in opposition to many contemporary conservatives. Yolton's John Locke and the Way of Ideas, J. W. Gough's, Locke's Political Philosophy, and W. v.Leyden's publication of the Essays on the Law of Nature. In 1827, the Scottish historian, Thomas Carlyle, who believed history was an impressive gallery of great men, wrote that the life of the Jewish philosopher from Berlin, Moses Mendelssohn, was "full of encouragement for all lovers of self improvement." This was just one more stone in the edifice of the Mendelssohnian myth, whose foundations had already been laid during Mendelssohn's lifetime, and which continued to grow after his death, until he became an icon of culture. For the Jews Mendelssohn was a source of pride, proof that Jews could become integrated into the life of liberal Europe and contribute to its culture without assimilating.Moses Samuel (1795-1860), the Jewish scholar from Bristol who earned his living as a watchmaker and silversmith, was undoubtedly one of Mendelssohn's most fervent admirers. Like others before him, who were inspired by the fact that Mendelssohn had the same first name as the biblical Moses, Samuel depicted him as a giant with a redemptive mission in Jewish history, deserving of credit for the entrance of Jews into the modern age: "Like his prototype and namesake Moses, Mendelssohn delivered his people from the bondage of their benighted taskmasters; like him, he led them forty years through the desert of ignorance and superstition, during which he sustained them with the manna of his wisdom" (vol. 1, 112-13). The biography Samuel published in London in 1825 was the first book on Mendelssohn written in English. Making no attempt to conceal his intent to depict an illustrious, exemplary personality, he even omitted facts that might have flawed the perfection of the Mendelssohnian myth. But this in no way detracts from the value of that interesting and comprehensive cultural work that Samuel created in England of the 1820s and '30s, which has now been printed in its entirety in an attractive, three-volume edition, edited by James Schmidt.Far more than a biography intended to expand the camp of Mendelssohn's admirers, it was a scholarly attempt, accompanied by notes and detailed explanations, to acquaint English readers with the Jewish philosopher through some of his major works on Judaism. The first volume contains the biography along with important appendices, including a list of all of Mendelssohn's writings in Hebrew and German, Samuel's scholarly notes and biographical sketches of some of the key figures in Mendelssohn's life, such as Thomas Abbt, Johann Caspar Lavater, and Gotthold Ephraim Lessing. The second and third volumes contain a selection of the writings that Samuel saw fit to translate, and these were published in 1838. This was not a random selection. Mendelssohn, the philosopher who made a contribution to the contemporary German Enlightenment and regarded Leibnitz and Wolf as his main mentors, was not the figure Samuel wanted to present to his readers. Instead he wanted to present Mendelssohn's position on Judaism and Christianity. Jean Bodin was a figure of great importance in European intellectual history, known as a jurist, associate of kings and courtiers in sixteenth-century France, and author of influential works in the fields of constitutional and social thought, historical writing, witchcraft, and a great deal else besides. Best known for his contribution to formulating the modern doctrine of sovereignty, Bodin was a scholar of exceptional range, whose works provoked controversy in his own time and have continued to do so down the (...) centuries. Hugh Trevor-Roper described him as 'the Aristotle, the Montesquieu of the sixteenth century, the prophet of comparative history, of political theory, of the philosophy of law, of the quantitative theory of money, and of so much else'. This address at the Hart Centenary Conference in Cambridge in July 2007 reflects on foundational elements in Hart's method in legal philosophy. It argues that his understanding of what it is to adopt an internal point of view was flawed by (a) inattention to the difference between descriptive history (or biography or detection) and descriptive general theory of human affairs, (b) inattention to practical reason as argument from premises, some factual but others normative (evaluative) in their content, and (c) (...) relative inattention to the deliberations of law-makers as distinct from subjects of the law. These flaws contributed to a concept or theory of law that so truncated its account of the juridical, and of the sources of legal reasoning, that it could provide little or no guidance in situations of legal difficulty. The paper suggests that these flaws result, to some significant extent, from the skeptical doubts about morality evident particularly in his later work. By any measure, Oliver Wendell Holmes, Jr., led a full and remarkable life. He was tall and exceptionally attractive, especially as he aged, with piercing eyes, a shock of white hair, and prominent moustache. He was the son of a famous father, a thrice-wounded veteran of the Civil War, a Harvard-educated member of Brahmin Boston, the acquaintance of Longfellow, Lowell, and Emerson, and for a time a close friend of William James. He wrote one of the classic works of American (...) legal scholarship, The Common Law, and he served with distinction on the Supreme Court of the United States. He was actively involved in the Court's work into his nineties. In Justice Oliver Wendell Holmes, G. Edward White, the acclaimed biographer of Earl Warren and one of America's most esteemed legal scholars, provides a rounded portrait of this remarkable jurist. We see Holmes's early life in Boston and at Harvard, his ambivalent relationship with his father, and his harrowing service during the Civil War. White examines Holmes's curious, childless marriage and he includes new information on Holmes's relationship with Clare Castletown. White not only provides a vivid portrait of Holmes's life, but examines in depth the inner life and thought of this preeminent legal figure. For some time it has been fashionable in literary circles to reject what is called scornfully the biographical method. It was inevitable. No mode lasts forever. Sooner or later, there is a change. This method was the law for too long. It had no rival. Under its tutelage the motto for teaching literature was “the man, his work”. It was by its authority that students were taught that La Fontaine was in charge of waterways and forests and master of the (...) hunt before writing his Fables, that they had to learn by heart; or that Beaumarchais had been a clockmaker, musician, secret agent and business man before inventing the character of Figaro, proposed for their admiration. There has been a reaction. Our irreverent and contentious age has put an end to that absolute sovereignty. For a good quarter of a century this practice and the assumptions on which it rests has been on trial, in the name of the various and at times even contradictory conceptions and theories about the nature of literature. These have in common, however, the belief in the independence of literature with regard to the human being who was the instrument of its creation, as well as the anathema cast by this fact on what is commonly accepted as “referential illusion”. Pre-eminent among European political philosophers, Norberto Bobbio has throughout his career turned to the political theory of Thomas Hobbes. Gathered here for the first time are the most important of his essays which together provide both a valuable introduction to Hobbes's thought and a fresh understanding of Hobbes's place in the theory of modern politics. Tracing Hobbes's work through _De Cive_ and _Leviathan_, Bobbio identifies the philosopher's relation to the tradition of natural law. That Hobbes must now be understood in (...) both this tradition as well as in the seemingly contradictory positivist tradition becomes clear for the first time in Bobbio's account. Bobbio also demonstrates that Hobbes cannot be easily labelled "liberal" or "totalitarian"; in Bobbio's provocative analysis of Hobbes's justification of the state, Hobbes emerges as a true conservative. Though his primary concern is to reconstruct the inner logic of Hobbes's thought, Bobbio is also attentive to the philosopher's biography and weaves into his analysis details of Hobbes's life and world—his exile in France, his relation with the Mersenne circle, his disputes with Anglican bishops, and accusations of heresy leveled against him. Jeutner argues that the reasonable person is, at heart, an empathetic perspective-taking device, by tracing the standard of the reasonable person across time, legal fields and countries. Beginning with a review of imaginary legal figures in the legal systems of ancient Egypt, Greece, and Rome, the book explains why the common law's reasonable person emerged amidst the British industrialisation under the influence of Scottish Enlightenment thinking. Following the figure into colonial courts, onto battlefields and into self-driving cars, the book contends (...) that the reasonable person invites judges, jury-members, and lawyers to take another person's perspective when assessing their own or another person's conduct. The perspective of another is taken by means of empathy, by feeling what others might feel in a particular situation. This article considers HLA Hart's influence in the making of John Finnis's book Natural Law and Natural Rights. In the style of an intellectual biography it traces the history of the interaction between the two Oxford legal philosophers using their correspondence as a starting point. It also delves into Finnis's years in Africa—a period of his life both crucial for the writing of the book and utterly unknown. It argues that Hart's role was significant not only insofar as he (...) was behind the idea of the book but also because of the restrained way in which he freely chose to conduct his role as editor despite the extent of the reservations he had regarding Finnis's work, fully revealed here. Given the importance of Natural Law and Natural Rights for what has been called the ‘new natural law theory’ the article concludes by awarding Hart his due credit in the making of one of that theory's main sources of inspiration. Quests for a correct view of the world and tragic mistakes, the polarization of philosophy into mutually exclusive trends, which is sometimes thought of as a permanent scandal in philosophy — these are not merely the searchings and sufferings of individual thinkers. This is the intellectual odyssey of mankind, and those to whom (...) it appears a farce apparently interpret the tragic only as the idols of the theater. But the fact is that antinomies, crises, retracing of steps, the discarding of real truths in favor of erroneous concepts long since refuted but stubbornly taken as true — are these things characteristic of philosophy alone? As others have argued, ancient scholarship found biography to be a useful receptacle for literary history and criticism. In Davis’ reading, the mutually incompatible accounts of Terence’s death yield insights into critical debates about the role of literature in republican Rome and the scholarly practices that underpinned it.Terence’s prologues give us a lively sense of the literary debates of his own day, but his biographers, writing in the period when scripts became texts, asked a different set of questions. Did Terence die at sea, or in Arcadia, far from the sea? Was the destination of his final journey Greece, or Asia? Did he die in poverty and neglect, or was he returning to Rome with a literary treasure, a hundred and eight newly adapted Menandrian plays? And who wrote his plays, anyway? This book brings together essays on themes of human rights and legal history, reflecting the long and distinguished career as academic writer and human rights activist of Brian Simpson. Written by colleagues and friends in the United States and Britain, the essays are intended to reflect Simpson's own legal interests. The collection opens with biography of Simpson's academic life which notes his major contribution to legal thought, and closes with an account of his career in the United States and (...) a bibliography of his writings. As a tribute to Simpson's varied interests in the law, the collection is grouped around themes in human rights, legal philosophy, and legal history. In this article I discuss identity and indiscernibility for person‐stages and persons. Identity through time is not an identity relation (it is a unity relation). Identity is carefully distinguished from persistence. Identity is timeless and necessary. Person‐stages are carefully distinguished from persons. Theories of personal persistence are not theories of identity for persons. I deal not with the persistence of persons through time but with the timeless and necessary identity and indiscernibility of persons. I argue that it is possible that (...) there are non‐identical but indiscernible temporally whole persons. I discuss the biographies of persons and develop the type or token distinction for persons. Twins in symmetrical or eternally recurrent universes are examples of indiscernible persons. I discuss temporal and modal branching, and I end with survival for person‐tokens and eternity for person‐types. (shrink)

Abraham Pais's Subtle Is the Lord was a publishing phenomenon: a mathematically sophisticated exposition of the science and the life of Albert Einstein that reached a huge audience and won an American Book Award. Reviewers hailed the book as "a monument to sound scholarship and graceful style", "an extraordinary biography of an extraordinary man", and "a fine book". In this groundbreaking new volume, Pais undertakes a history of the physics of matter and of physical forces since the discovery of (...) x-rays. The book attempts to relate not only what has happened over the last hundred years but why it happened the way it did, what it was like for those scientists involved, and how what at the time may have seemed a series of bizarre or unrelated events, now with hindsight emerges as a logical sequence of events. Pais, a noted physicist, was personally involved in many of the developments he describes, and thus Inward Bound, like his earlier book, is filled with unique insights into the world of big and small physics. Between 1895 and 1983, the period he covers, the smallest distances explored have shrunk a hundred millionfold, Pais notes. Along this incompletely traveled "road inward," scientists have established markers that later generations will rank among the principal monuments of the twentieth century. In alternating technical and nontechnical sections, this magisterial survey richly conveys what has been discovered about the constituents of matter, the laws to which they are subject, and the forces that act on them. The paper explores the semiotic and legal semiotic perspectives related to posthumous digital face. In doing so, the contribution also seeks to explore the complex relationship between AI-generated faces, including deep fakes, mourning, and posthumous rights. The article has five parts. In the introduction, we discuss the challenges of _posthumous existence_ and the issues related to respecting the deceased. We also examine some examples of ‘digital personhood’. In part two, we present three case studies and use semiotics to help us (...) distinguish between _posthumous existence_ and _digital resurrection_. In part three, we provide a semiotic classification of representation in the context of digital faces and our case studies. We suggest that there is a difference between the _phenomenological presence_ of a hologram and the _cognitive value_ of recreating someone’s identity, including their biography, face, and voice. In part four, we explore the topic of digital spectra and mourning, including the concept of _imputability_. In part five, we analyse how the law offers new insights into the ontology of the face of the deceased and posthumous existence in hologram form. Arnold Clapmarius’ ‘Traineeship in politics’. Practical Experience and the Semblance of Practical Experience as a Qualification in the Field of Political Science around the Year 1600. In 1600, Arnold Clapmarius was appointed the first professor for Public Law and Political Science in the Holy Roman Empire by the University of Altdorf. He received this professorship though he had not yet published anything because he was a protégé of Landgrave Maurice the Learned of Hesse-Kassel. Two newly discovered letters which were written (...) by Clapmarius to Maurice show that the young scholar did a traineeship at the Landgrave's court to gather practical experience in politics. This was probably the reason for his appointment in Altdorf. Nevertheless, he hushed up this traineeship because it did not comply to the kind of experience that were expected from a ‘politicus’ at that time, id est military service, educational journeys, foreign languages and regional studies. Thus, this paper fills a gap of Arnold Clapmarius’ biography, and provides a new perspective on the value of practical experience in the field of political science in the Early Modern Period. Vytautas Raudeliūnas is Lithuanian law historian, expert of the history of the Great Duchy of Lithuania, pedagogue and Lithuanian patriot. He spent his youth in exile and finished his studies in Russia and in Vilnius. He worked as a fellow in Lithuanian Science Academy, in the Monument Defence Office, the Institute of Culture, Philosophy and Art. V. Raudeliūnas lectured at Vilnius Pedagogical University. He was one of the establishers and publishers of periodical publications “The monuments of Lithuanian law”, “The studies (...) of Lithuanian law history”. The article describes biography of V. Raudeliūnas, collects and disputes his bibliography and evaluates his contribution to the history of Lithuanian law. The article analyzes V.Raudeliūnas’ biography and scientific activity, as well as the main directions of his research: publications and transcriptions of Lithuanian Statutes; development of law institutes in the Great Duchy of Lithuania; peculiarities of development of Vilnius University. Michael Polanyi was one of the great figures of European intellectual life in the 20th century. A highly acclaimed physical chemist in the first period of his career who became a celebrated philosopher after World War II, Polanyi taught in Germany, England, and the United States and associated with many of the leading intellects of his time. The absence of self in Classical litera­ture and the emergence in the eigh­teenth century of the concept of the unique and individual self asserting its existence and seeking its truth in pri­vate experience and feeling is often touched upon in cultural histories but little explained. Seeking the reasons for and the effects of the change of attitude toward one’s concept of one’s self in the “new” eighteenth-century attitude to­ward history, biography, travel litera­ture, pornography, and the novel, Lyons finds, first, (...) that the term _self _is deceptively vague. It evolved, he notes, to fill the vacuum created by doubt about the existence of the soul. Second, Lyons finds that without a concept of the self—that ineffable something in a human being that to its inventors and their followers was an abstract of pure and intuited natural laws—the revolution and romanticism of the modern age would have been very different from what it has been. More importantly, Lyons concludes that the concept led to monumental error and to bitter disappointments rooted, as his il­luminating history shows, in the im­possibility of defining that which never was.
