In this paper, I explore Kant’s discussion of juridical and ethical laws in the introduction to the Metaphysics of Morals as a whole. Following Marcus Willaschek and early Allen Wood, I pose a dilemma for Kant that I call “the paradox of juridical imperatives”, a dilemma that Willaschek and Wood hold Kant can only avoid by giving up his claim that juridical laws are categorical imperatives. I show how a set of interpretative issues concerning juridical incentives, the content (...) of juridical laws, and the idea of an “indirect” ethical obligations, hang together, and must solved simultaneously in order to address the paradox. I argue, contra Willaschek and Wood, that we can dissolve the paradox, solving the network of issues satisfactorily and affirming the status of juridical laws as categorical imperatives, once we recognize that one can go wrong with respect to a principle while fulfilling the letter of its requirements. The picture that emerges is one on which we can straightforwardly affirm Recht as a moral concept for Kant, while simultaneously representing its distinctive character in his system of morality. In this book, Allen Wood investigates Kant's conception of ethical theory, using it to develop a viable approach to the rights and moral duties of human beings. By remaining closer to Kant's own view of the aims of ethics, Wood's understanding of Kantian ethics differs from the received 'constructivist' interpretation, especially on such matters as the ground and function of ethical principles, the nature of ethical reasoning and autonomy as the ground of ethics. Incivility among physicians, between physicians and learners, and between physicians and nurses or other healthcare professionals has become commonplace. If allowed to continue unchecked by academic leaders and medical educators, incivility can cause personal psychological injury and seriously damage organisational culture. As such, incivility is a potent threat to professionalism. This paper uniquely draws on the history of professional ethics in medicine to provide a historically based, philosophical account of the professional virtue of civility. We use a two-step method of (...) ethical reasoning, namely ethical analysis informed by pertinent prior work, followed by identifying the implications of clearly articulated ethical concepts, to meet these goals. The professional virtue of civility and the related concept of professional etiquette was first described by the English physician-ethicist Thomas Percival (1740–1804). Based on a historically informed philosophical account, we propose that the professional virtue of civility has cognitive, affective, behavioural and social components based on a commitment to excellence in scientific and clinical reasoning. Its practice prevents a dysfunctional organisational culture of incivility and sustains a civility-based organisational culture of professionalism. Medical educators and academic leaders are in a pivotal and powerful position to role model, promote and inculcate the professional virtue of civility as essential to an organisational culture of professionalism. Academic leaders should hold medical educators accountable for discharge of this indispensable professional responsibility. (shrink)

Analytic theology can flourish in the secular academy, and flourish as authentically Christian theology. Analytic Theology and the Academic Study of Religion explains analytic theology to other theologians and scholars of religion, while simultaneously explaining those other fields to analytic theologians. William Wood defends analytic theology from some common criticisms, but also argues that analytic theologians have much to learn from other forms of inquiry. Analytic theology is a legitimate form of theology, and a legitimate form of academic inquiry, (...) and it can be a valuable conversation partner within the wider religious studies academy. Warfare is becoming increasingly automated, from automatic missile defense systems to micro-UAVs (WASPs) that can maneuver through urban environments with ease, and each advance brings with it ethical questions in need of resolving. Proponents of lethal autonomous weapons systems (LAWS) provide varied arguments in their favor; robots are capable of better identifying combatants and civilians, thus reducing "collateral damage"; robots need not protect themselves and so can incur more risks to protect innocents or gather more information before using deadly force; (...) robots can assess situations more quickly and do so without emotion, reducing the likelihood of fatal mistakes due to human error; and sending robots to war protects our own soldiers from harm. However, these arguments only point in favor of autonomous weapons systems, failing to demonstrate why such systems need be made *lethal*. In this paper I argue that if one grants all of the proponents' points in favor of LAWS, then, contrary to what might be expected, this leads to the conclusion that it would be both immoral and illegal to deploy *lethal* autonomous weapons, because the many features that speak in favor of them also undermine the need for them to be programmed to take lives. In particular, I argue that such systems, if lethal, would violate the moral and legal principle of necessity, which forbids the use of weapons that impose superfluous injury or unnecessary harm. I conclude by highlighting that the argument is not against autonomous weapons per se, but only against *lethal* autonomous weapons. (shrink)

Michurinist biology was introduced to China in 1948; granted a state supported monopoly in 1952; and reduced to parity with western genetics from 1956. The Soviets exported it through the propaganda agencies Sino Soviet Friendship Association and VOKS. China’s Ministry of Agriculture achieved broad public awareness and acceptance of Michurinist biology through a translation, publication, and Soviet guest speakers campaign – all managed by a team of agriculturalists led by Luo Tianyu, a veteran CCP cadre. The campaign grew exponentially, but (...) did not affect university or Chinese Academy of Sciences biology. Luo Tianyu’s failed attempt to force Michurinist biology on a Beijing university triggered its second stage: monopoly status and a ban on “Mendelist-Morganist” biology in teaching, research, and publication. The CCP Central Committee supported this policy believing that Michurinst biology would increase agricultural production for the forthcoming first Five Year Plan; whereas, western genetics had no practical value. Michurinist biology flourished at all levels of education, research, and science literature; Western genetics was completely shut down. This only began to change when the CCP Central Committee became wary of China’s dependency on Soviet technical expertise and failure to fully utilize that of China. Change was further promoted by significant attacks on Michurinist biology by Soviet and East German biologists. Soon, these developments informed China’s “genetics question,” which became a test case for larger questions about the definition of science and the relationship between scientists and the state. Under the guidance of Lu Dingyi’s Central Committee Propaganda Department, the CCP eventually decided that, henceforth, science controversies would only be resolved by the science community; and that monopolies or ideological orthodoxies would not be imposed on science. At the same time, the CCP rescinded Michurinist biology’s monopoly and the ban on western genetics. By the mid-1960s western genetics had successfully restored itself, largely due to the leadership of C. C. Tan, a former student of Dobzhansky. Michurinist biology’s presence shrank and it became marginalized. (shrink)

Rachel Carson begins her revolutionary book Silent Spring with a quote from E.B. White that reads ‘we would stand a better chance of survival if we accommodated ourselves to this planet and viewed it appreciatively’. While White's advice can account for an instrumental relationship towards nature, I believe that the more important relationship offered in his recommendation is one of appreciation or gratitude. But how are we to understand gratitude as appreciating Nature non-instrumentally when it has traditionally always been understood (...) as a response to a benefit received? My motivation is to modify our traditional conception of gratitude alongside Simon Hailwood's account of the ‘Otherness of Nature’ to see how we can truly show gratitude for Nature rather than simply reflecting on how Nature serves human interests. : In this paper, I investigate Leibniz's conception of final causation. I focus especially on the role that Leibnizian final causes play in intentional action, and I argue that for Leibniz, final causes are a species of efficient causation. It is the intentional nature of final causation that distinguishes it from mechanical efficient causation. I conclude by highlighting some of the implications of Leibniz's conception of final causation for his views on human freedom, and on the unconscious activity of substances.

This introductory article orients the reader to the topic of this volume – the religious hermeneutics of violence – and situates the individual articles within the wider discussion of the role of religion in acts of violence. Summarising the state of modern scholarship on key debates concerning religion and violence, this article encourages the careful study of how individuals or groups in peculiar historical circumstances interact with their sacred texts and beliefs in a way that facilitates violence or oppression. With complex buyer-driven global production networks and a labour-intensive manufacturing process, the fashion industry has become a focal point for debates on the social responsibility of business. Utilising an interview methodology with influential actors from seven export garment manufacturers in Sri Lanka, we explore the situated knowledge at one nodal point of the production network. We conceptualise factory management perspectives on the implementation of corporate social responsibility in terms of the strategic balancing of ethical considerations against the commercial pressures of (...) cost and lead time. Factory managers framed CSR in terms of compliance, rather than going above and beyond regulatory requirements; seeing it as a strategic competitive imperative and less a developmental mechanism. Sri Lankan manufacturers maintain that they have benefitted from a unique combination of factors, including strict national labour laws, an educated workforce, the characteristics of the garments produced, industrial upgrading, and long-term non-adversarial buyer–supplier relationships, which they argue has supported the establishment and maintenance of CSR practices. The paper thus provides managerial implications that relate CSR activities to CSR outcomes which include both reputational and production benefits. Such insights will be of strategic relevance for lead retail buyers as well as apparel producers keen to invest in CSR to partly mitigate against increasing price-based competition. (shrink)

The compilers of the Hippocratic gynaecological treatises often recommend sexual intercourse as part of treatments for women’s diseases. In addition, they often prescribe the use of ingredients that are obvious phallic symbols. This paper argues that the use of sexual therapy in the Hippocratic gynaecological treatises was more extended than previously considered. The Hippocratic sexual therapies involve a series of vegetable ingredients that were sexually connoted in antiquity, but have since lost their sexual connotations. In order to understand the sexual (...) signification of products such as myrtle and barley, one must turn to other ancient texts, and most particularly to Attic comedies. These comedies serve here as a semiotic guide in decoding the Hippocratic gynaecological recipes. However, the sexual connotations attached to animal and vegetable ingredients in these two genres have deeper cultural and religious roots; both genres exploited the cultural material at their disposal. Sexual violence during war varies in extent and takes distinct forms. In some conflicts, sexual violence is widespread, yet in other conflicts—including some cases of ethnic conflict—it is quite limited. In some conflicts, sexual violence takes the form of sexual slavery; in others, torture in detention. I document this variation, particularly its absence in some conflicts and on the part of some groups. In the conclusion, I explore the relationship between strategic choices on the part of armed group leadership, the (...) norms of combatants, dynamics within small units, and the effectiveness of military discipline. USHER In 1843, two years before Henry Thoreau built his cabin at Walden Pond, the Fitchburg Railroad laid down tracks through the woods near the Pond for its line connecting Boston to Fitchburg. The original Fitchburg Line, at 54 miles long, was, until 2010, the longest run in the present -day MBTA Commuter Rail system. And it is one of (...) the oldest railways in New England. By 1900, fortunes swelled and the Fitchburg’s Hoosac Tunnel Line took passengers and goods westward toward Chicago. The Lake Champlain Route connected Boston to points north like Burlington, Vermont. Its tracks pass remarkably close to Walden Pond (Figure 2), and the Fitchburg Line—both its reality and the specter of it—is practically a character in his writing: “I usually go to the village along its causeway, and am, as it were, related to society by this link,” Thoreau writes in “Sounds,” a chapter of Walden that contains what must be one of the most picturesque odes (or laments) to rail travel and commerce in all of American literature: The engine’s whistle, Thoreau complains, pierces the still silence of his idyllic retreat like a screaming hawk circling a farmer’s field, its billows of steam an ominous harbinger of “this travelling demi-god, this cloud-compeller.”1 Thoreau’s frequent, customary walks into Concord along the railroad tracks took him through a heavily excavated stretch of the line known as the Deep Cut, to which he returned again and again each year in early spring, even after leaving the cabin, to observe and to record his observations. The leaf-shaped sand flows and trickling surface erosion caused by melting frost in the banks of the Deep Cut are elaborately described in Thoreau’s chapter in Walden entitled “Spring,” what Laurence Buell calls the “high point of Thoreau’s epic.”2 And yet, in spite of the universal acclaim of this passage as a literary tour de force, it has not received the full attention it deserves. What warrants fresh consideration first and foremost is “Spring”’s deep-rootedness in classical sources. Many classical influences, allusions, and a good deal of etymological word play have gone so far unnoticed. The chapter is also important because it describes, by intimation, what contemporary scientists now call emergence. Emergent phenomena are properties or behaviors that arise in systems as a result of complex, dynamic interactions amongst constituent parts, including changes to a system brought about by human interventions3—not only, e.g., climate change and wildfires, but also traffic patterns and terrorist networks; kidney function in the body; the rings of Saturn. As he tries to capture the essence of the 114 classics and complexity in WALDEN’s “spring” Deep Cut and interpret its significance, Thoreau adumbrates this concept, but also grapples ingeniously with broader issues of perennial concern—the relationship of Nature to Culture, for example, of Wilderness to Civilization, of Science to the Humanities—making “Spring” not only a probing work of eco-criticism and environmental philosophy, but of scientific reflection and poetic experiment as well. In short, Thoreau’s “Spring” is that rare work of classical reception that transmits both literary and scientific insight. Perhaps at this point, in lieu of accolades, it is best to let Thoreau start speaking for himself. What I offer in the following pages is a commentary on the Deep Cut passage from “Spring.” Classical references and aspects of systems theory will be explained and contextualized as they emerge, as it were, from Thoreau’s text. The whole chapter corresponds to pages 289–308 in Cramer’s edition of Walden—26 paragraphs all told, of which only the relevant ones are printed and annotated here. Jacques Derrida's prolific output has been the delight of philosophers and literary theorists for over twenty years. His influence on the way we read theoretical texts continues to be profound. No serious contemporary thinker can fail to come to terms with deconstruction and there have been a number of monographs devoted to his work. Very few, however, have combined a critical edge with a detailed knowledge of his writing. The contributors to this volume were each asked - in the most (...) positive sense - to take just such a critical approach. A companion to ‘Punishment: Consequentialism’, and also ‘Punishment: The Future’, this paper examines various nonconsequentialist attempts to justify punishment, that is, attempts that appeal to claims concerning the innate worth or intrinsic character of punishment, quite apart from any consequential good or benefit punishment may be thought to produce. The paper starts with retributive theories, and turns then to the denunciation and expressive theories, before considering combined communicative–retributive theories.

Social interactions in daily life necessitate the integration of social signals from different sensory modalities. In the aging literature, it is well established that the recognition of emotion in facial expressions declines with advancing age, and this also occurs with vocal expressions. By contrast, crossmodal integration processing in healthy aging individuals is less documented. Here, we investigated the age-related effects on emotion recognition when faces and voices were presented alone or simultaneously, allowing for crossmodal integration. In this study, 31 young (...) adults (M = 25.8 years) and 31 older adults (M = 67.2 years) were instructed to identify several basic emotions (happiness, sadness, anger, fear, disgust) and a neutral expression, which were displayed as visual (facial expressions), auditory (nonverbal affective vocalizations) or crossmodal (simultaneous, congruent facial and vocal affective expressions) stimuli. The results showed that older adults performed slower and worse than younger adults at recognizing negative emotions from isolated faces and voices. In the crossmodal condition, although slower, older adults were as accurate as younger except for anger. Importantly, additional analyses using the ‘race model’ demonstrate that older adults benefited to the same extent as younger adults from the combination of facial and vocal emotional stimuli. These results help explain some conflicting results in the literature and may clarify emotional abilities related to daily life that are partially spared among older adults. (shrink)

The author offers a comprehensive interpretation of Aquinas's claim that the human intellect is immaterial and assessment of his arguments on behalf of this claim, also positioning Aquinas's thought alongside recent work in hylomorphic metaphysics and philosophy of mind.

Most contemporary interpreters of Aquinas have assumed that Thomas subscribed to a “non-repeatability principle” such that created entities, once destroyed entirely, cannot be “brought back" into existence, even by God's power. Souls persisting in the interim between death and resurrection thus play an essential identity-preserving role between our death and rising again. No separated souls, no resurrection. Two of Aquinas’s best medieval interpreters, however, reject this interpretation. Leaning largely on one of Aquinas’s late quodlibetal questions, they deny that Thomas held (...) any non-repeatability principle strong enough to bar God’s resurrecting us even from complete destruction, souls and all. Here the chapter argues that careful analysis of the quodlibet and other texts largely vindicates the contemporary interpretation. It does so in a surprising way, however, since it turns out Aquinas’s non-repeatability principle applies only to corruptible, material entities like us, and not to incorruptible entities like angels. The reason Aquinas held this view, the chapter argues, is rooted in his theory of individuation. (shrink)

My aim in this paper is to underscore the novelty of Leibniz’s teleology from a historical perspective. I believe this perspective helps deliver a better understanding of the finer details of Leibniz’s employment of final causes. I argue in this paper that Leibniz was taking a stance on three central teleological issues that derive from Aristotle, issues that seem to have occupied nearly every advocate of final causes from Aristotle to Leibniz. I discuss the three Aristotelian issues, and how major (...) thinkers treated them in the medieval period. I argue that Leibniz rejected all of the mainstream Aristotelian teleological views on these issues. I conclude that Leibniz broke with longstanding threads of teleological thinking in ways that were often extreme. (shrink)

Children with specific language impairment (SLI) show a protracted period of inconsistent use of tense/agreement morphemes. The purpose of this investigation was to determine whether this inconsistent use could be attributed to the children's misinterpretations of particular syntactic structures in the input. In Study 1, preschool-aged children with SLI and typically developing peers heard sentences containing novel verbs preceded by auxiliarywasor sentences in which the novel verb formed part of a nonfinite subject-verb sequence within a larger syntactic structure (e.g.We saw (...) the dog relling). The children were then tested on their use of the novel verbs in contexts that obligated use of auxiliaryis. The children with SLI were less accurate than their peers and more likely to produce the novel verb withoutisif the verb had been heard in a nonfinite subject-verb sequence. In Study 2, children with SLI and typically developing peers were tested on their comprehension of sentences such asThe cow sees the horse eating. The children with SLI were less accurate than their peers and were disproportionately influenced by the nonfinite subject-verb clause at the end of the sentence. We interpret these findings within the framework of construction learning. (shrink)

Yet, pointing out the Fluxive Fallacy and giving it a name has a distinct advantage in that it directs one's attention to errors which, without the advantage of a definite name and description, might pass unobserved.

The R-Being is, by definition, that entity which possesses all qualities which, expressed in English adjectives, begin with the letter R. It is of course unknown, at the commencement of our inquiry, whether any such entity exists, but it is nevertheless possible to determine the characteristics which such a being, whether existent or not, must possess.
