Nonpharmaceutical interventions to minimize the transmission of the severe acute respiratory syndrome coronavirus 2 are necessary because we currently lack a vaccine or specific treatments. Healthcare facilities have adopted visitor restrictions and masking requirements. These interventions should be evaluated as public health measures, focusing on their efficacy, the availability of less-restrictive alternatives, and the minimization of the burdens and their balance with the benefits. These interventions, as well as exceptions, can be justified by the same analysis. For example, visitor restrictions (...) are sound, as are exceptions for women in labor, adults with disabilities, minor children, and individuals who are dying. In implementing these policies, specific rules are preferable to general principles because they are more efficient and reduce possible bias. There should, however, be appeal mechanisms and retrospective review processes. Evaluating requests for medical exemptions to masking requirements is particularly difficult, given the prevalence of nonmedical objections, false claims of medical exemptions, and a lack of objective medical criteria. Requiring written statements by licensed healthcare providers that undergo subsequent substantive review may therefore be justified. (shrink)

A recurring concern within contemporary philosophy of language has been with the ways in which speakers can be illocutionarily silenced, i.e. hindered in their capacity to do things with words. Moving beyond the traditional conception of silencing as uptake failure, Mary Kate McGowan has recently claimed that silencing may also involve other forms of recognition failure. In this paper I first offer a supportive elaboration of McGowan’s claims by developing a social account of speech act performance, according to which the (...) success of an illocutionary act is not only a function of the intentions of and the conventions deployed by the speaker, but partly depends on how the act is recognized or taken up by the hearer. Are wealthy countries' duties towards developing countries grounded in justice or in weaker concerns of charity? Justice in a Globalized World offers both an in-depth critique of the most prominent philosophical answers to this question, and a distinctive approach for addressing it.

This article explores the British anti-slavery writings of the mid- to late 18th century, and the meanings which they gave to the idea of owning a property in the person. It addresses the construction of a particular moral and political landscape where freedom was understood as both a kind of property and as non-domination, and slavery was constructed as a form of theft, and as the exercise of arbitrary power. This created a complex moral space, where possession, commerce, savagery, tyranny (...) and the emergence of race were all caught up with each other and entangled with the concept of consent. The article concludes with the suggestion that our current understandings of slavery continue to be informed by our notions of contract and consent, and so by conceptions of freedom and ownership that take us back to the tensions and debates of the 18th century. In this paper, we identify and examine an overlooked strategy to counter bigoted speech on the spot. Such a strategy we call ‘bending’. To ‘bend’, in our sense, is to deliberately give a distorted response to a speaker’s harmful move – precisely, an ameliorative response, which may turn that move into a different, less harmful, contribution. To substantiate our proposal, we distinguish two ideas of uptake – interpretation and response – and argue for the general claim that a distorted response (...) on the hearer’s part may end up transforming a speaker’s contribution. Patterns of distortion have been analyzed in the literature as unjustly undermining speakers’ agency and exacerbating oppression. Our analysis shows that, under certain circumstances, distortion can be employed to derail bigoted speech and thus serve the purposes of social justice. We close by discussing the virtues and limits of bending vis-à-vis a different, much-discussed, counterspeech strategy, i.e. ‘blocking’ (Langton 2018). (shrink)

Anti-individualists claim that concepts are individuated with an eye to purely external facts about a subject's environment about which she may be ignorant or mistaken. This paper offers a novel reason for thinking that anti-individualistic concepts are an ineliminable part of commonsense psychology. Our commitment to anti-individualism, I argue, is ultimately grounded in a rational epistemic agent's commitment to refining her own representational practices in the light of new and surprising information about her environment. Since anti-individualism is an implicit part (...) of responsible epistemic practices, we cannot abandon it without compromising our own epistemic agency. The story I tell about the regulation of one's own representational practices yields a new account of the identity conditions for anti-individualistic concepts. (shrink)

Sonia Kruks' latest book, Retrieving Experience, is a valuable contribution to ongoing debates about the relevance of feminist philosophy in a period of relative political quietism. It also offers timely (...) reminders of historical continuities between phenomenological and postmodern conceptions of subjectivity and political engagement. Drawing on Merleau-Ponty, Beauvoir, Fanon, and the later Sartre, Kruks proposes to "explore women's embodied experiences" and to "ask whether they might not offer some means to help build affective bonds among women who are in many ways radically different from one another" (6). The book approaches this task by means of two secondary issues. First, should feminist thought be oriented by phenomenological or postmodernist theoretical strategies? Second, can women's embodied experience be the conceptual basis for political and epistemological practices that avoid the pitfalls of "identity politics" or an "epistemology of provenance"? The answer to both questions comes through the notion of praxis developed in Sartre's Critique of Dialectical Reason. By thinking of embodiment as praxis or work, a strategy implicit in Beauvoir's idea that "one is not born, but rather becomes, a woman." Kruks seeks to resolve the ethical affront of finding one's individuality reduced to the "generality" of a collective—the ethical affront to which feminists of various generations and theoretical persuasions must respond.Retrieving Experience explores the significance of recognition as a political norm. Legitimating knowledge gained under oppressive conditions formed an important element of African, Southeast Asian, and ultimately African-American and feminist resistance to cultural imperialism. However, Kruks warns, discourses of "recognition" risk placing the blame for group domination on individuals' face-to-face interactions while concealing the role of state and economic institutions in enabling social disdain to systematically damage a group's quality of life. There is currently a gap in our understanding of how figures produced by mechanical imaging techniques play evidential roles: several studies based on close examination of scientific practice show that imaging techniques do not yield data whose significance can simply be read off the image. If image-making technology is not a simple matter of nature re-presenting itself to us in a legible way, just how do the images produced provide support for scientific claims? In this article I will first show (...) that there is a distinct question about the semiotics of mechanically produced images that has not yet been answered. I show that my account of visual representations can do so, and I argue that the role of convention involved in my account is compatible with the view that visual representations produced through mechanized imaging techniques can play genuine evidential roles in scientific reasoning. This raises important questions about the epistemology of genomic research: If analysis of a genome sequence cannot yield information about genes defined both in terms of their products and their DNA sequence, then what could we learn from it? Camp (2009) distinguishes two varieties of conceptual recombination. One of them is full-blown or (as I prefer to call it) spontaneous recombination. The other is causal-counterfactual recombination. She suggests that while human animals recombine their concepts in a full-blown way, many non-human animals are capable of conceptual recombinability but only of the causal-counterfactual kind. In this paper, I argue that there is conceptual space to draw further sub-distinctions on how different animals may recombine their concepts. More specifically, I propose to (...) differentiate between a) narrow causal-counterfactual recombination; b) broad causal-counterfactual recombination; c) lean spontaneous recombination; d) robust spontaneous recombination. Afterwards, I focus on how these distinctions relate to several previous philosophical ideas on the representational capacities of non-human animals. The concept of a circular economy gains more and more popularity for companies and politics. In theory the concept holds not only ecological and social but also several economic advantages for the applying companies. This book addresses the following research questions: How is the concept of the circular economy implemented? What impact has the implementation of circular economy on organizations? What are the challenges deriving from circular economy implementation? A qualitative study with companies from various industries in Europe and America (...) has been conducted. Results show that the theoretical comprehensive benefits cannot yet been found in the economy. This article provides a conceptual framework for studying the influence of mood on managerial ethical decision making. We draw on mood-congruency theory and the affect infusion model to propose that mood influences managerial ethical decision making through deliberate and conscious assessments of the moral intensity of an ethical issue. By accounting for proscriptive and prescriptive morality—i.e., harmful and prosocial behavior, respectively—we demonstrate that positive and negative mood may have asymmetrical and paradoxical effects on ethical decision making. Specifically, our analysis suggests (...) that individuals in a positive mood will be more likely to engage in prosocial behavior but less likely to refrain from activities that have harmful consequences for others, whereas individuals in a negative mood will be more likely to avoid activities that put others at risk or harm but at the same time less prone to engaging in activities that have positive consequences for others. Importantly, we account for the context within which managers make their decisions by examining how situational strength may moderate the influence of mood on managerial ethical decision making. Finally, we discuss how organizations can leverage the double-edged sword effect of mood on ethical decision making and prevent, control and manage the risk of unethical decision making on the part of managers. Background: The concept of dignity can be divided into two main attributes: absolute dignity that calls for recognition of an inner worth of persons and social dignity that can be changeable and can be lost as a result of different social factors and moral behaviours. In this light, the nursing profession has a professional dignity that is to be continually constructed and re-constructed and involves both main attributes of dignity. Objectives: The purpose of this study was to determine how nurses (...) described nursing’s professional dignity in internal medicine and surgery departments in hospital settings. Research design: The research design was qualitative. Ethical considerations: This study was approved by the ethics committees of the healthcare organizations involved. All the participants were provided with information about the purpose and the nature of the study. Participants: A total of 124 nurses participated in this study. Method: The data were collected using 20 focus group sessions in different parts of Italy. The data were analysed by means of a conventional inductive content analysis starting from the information retrieved in order to extract meaning units and sorting the arising phenomena into conceptually meaningful categories and themes. Results: Nursing’s professional dignity was deeply embedded in the innermost part of individuals. Regarding the social part of dignity, a great importance was put on the values that compose nursing’s professional identity, the socio-historical background and the evolution of nursing in the area considered. The social part of dignity was also linked to collaboration with physicians and with healthcare assistants who were thought to have a central role in easing work strain. Equally important, though, was the relationship with peers and senior nurses. Conclusion: The organizational environments under scrutiny with their low staffing levels, overload of work and hierarchical interactions did not promote respect for the dignity of nurses. To understand these professional values, it is pivotal to comprehend the role of different health professions in their cultural milieu and the evolution of the nursing profession in diverse countries. This article examines three cases of mid-20th-century oil media—oil-related imagery, iconographies, and media—in visual culture: a series of popular science books entitled The Story of Oil published in the US, an oil-themed set of Kuwaiti postage stamps (1959), and an art exhibition in Zurich (1956) titled Welt des Erdöls: Junge Maler sehen eine Industrie (World of Petroleum: Young Artists See an Industry). While depicting crude oil in its natural habitat was a common photographic theme in the early 20th-century United States, (...) the material discussed shows that, by the mid-20th century, crude oil no longer had the same visual presence. The iconography of oil in the three case studies came to rely increasingly on images of oil infrastructure and on context-specific depictions of living within petro-modernity or petro-culture, meaning lifestyles fueled by cheap fossil energy. However, it is not just the changes in visual representations of petroleum that matter; any debate about the visibility and invisibility of petroleum has to take into account the very media through which petroleum has become visually communicated—that is, the precise forms of oil's mediatization. The aesthetic negotiation of petroleum through media-based visual representations has been crucial for the dematerialization of fossil matter in its conversion to fossil energy, as well as the decoupling of sites of extraction from sites of production and consumption in the public imagination. As petro-culture has morphed into national or even global culture (rather than representing just one possible energy source among many), oil media has paved the way for our intimate relationship with fossil energy-dependent lifestyles, which is one of the biggest drivers of climate change. There are both externalist and internalist theories of the phenomenal content of conscious experiences. Externalists like Dretske and Tye treat the phenomenal content of conscious states as representations of external properties. Internalists think that phenomenal conscious states are reducible to electrochemical states of the brain in the style of the type-type identity theory. In this paper, we side with the representationalists and visit a dispute between them over the test case of Swampman. Does Swampman have conscious phenomenal states or not? (...) We investigate the hypothesis that our conceptual systems provide two formally distinct ways of representing categories by investigating the manner in which lexical nominals (e.g., tree, picnic table) and phrasal nominals (e.g., black bird, birds that like rice) are interpreted. Four experiments found that lexical nominals may be mapped onto kind representations, whereas phrasal nominals map onto class representations but not kind representations. Experiment 1 found that phrasal nominals, unlike lexical nominals, are mapped onto categories whose members need not be (...) of a single kind. Experiments 2 and 3 found that categories named by lexical nominals enter into both class inclusion and kind hierarchies and thus support both class inclusion (is a) and kind specification (kind of) relations, whereas phrasal nominals map onto class representations which support only class inclusion relations. Experiment 4 showed that the two types of nominals represent hierarchical relations in different ways. Phrasal nominals (e.g., white bear) are mapped onto classes that have criteria of membership in addition to those specified by the class picked out by the head noun of the phrase (e.g., bear). In contrast, lexical nominals (e.g., polar bear) specify one way to meet the criteria specified by the more general kind concept (e.g., bear). Implications for the language–conceptual system interface, representation of hierarchical relations, lexicalization, and theories of conceptual combination are discussed. (shrink)

Background: Nurse managers are responsible for solving work-related ethical problems to promote a positive ethical culture in healthcare organizations. Objectives: The aim of this study was to describe the activities that nurse managers use to solve work-related ethical problems. The ultimate aim was to enhance the ethical awareness of all nurse managers. Research Design: The data for this descriptive cross-sectional survey were analyzed through inductive content analysis and quantification. Participants and research context: The data were collected in 2011 using a (...) questionnaire that included an open-ended question and background factors. Participants were nurse managers working in Finnish healthcare organizations (n = 122). Ethical considerations: Permission for the study was given by the Finnish Association of Academic Managers and Experts of Health Sciences. Findings: Nurse managers identified a variety of activities they use to solve work-related ethical problems: discussion (30%), cooperation (25%), work organization (17%), intervention (10%), personal values (9%), operational models (4%), statistics and feedback (4%), and personal examples (1%). However, these activities did not follow any common or systematic model. Discussion and conclusion: In the future, nurse managers need a more systematic approach to solve ethical problems. It is important to establish new kinds of ethics structures in organizations, such as a common, systematic ethical decision-making model and an ethics club for nurse manager problems, to support nurse managers in solving work-related ethical problems. In recent years, discussion around memory modification interventions has gained attention. However, discussion around the use of memory interventions in the criminal justice system has been mostly absent. In this paper we start by highlighting the importance memory has for human well-being and personal identity, as well as its role within the criminal forensic setting; in particular, for claiming and accepting legal responsibility, for moral learning, and for retribution. We provide examples of memory interventions that are currently available for medical (...) purposes, but that in the future could be used in the forensic setting to modify criminal offenders’ memories. In this section we contrast the cases of dampening and enhancing memories of criminal offenders. We then present from a pragmatic approach some pressing ethical issues associated with these types of memory interventions. The paper ends up highlighting how these pragmatic considerations can help establish ethically justified criteria regarding the possibility of interventions aimed at modifying criminal offenders’ memories. In this article, I shall analyze Schopenhauer's conception of Buddhism in the context of the Western reception of Buddhism from the seventeenth century onwards. I will focus on Schopenhauer's notion of the Buddhist palingenesis and provide an overview of the Buddhist sources Schopenhauer read before the publication of the second edition of his main work The World as Will and Representation in 1844.

Feminist peace theories that find hope for peace in the ideal of the caretaking woman are grounded in patriarchal gender distinctions, fail to challenge adequately the patriarchal dualism that constitutes the self by devaluing the other, and the practice of caretaking about which they speak may be easily co-opted into the service of war. Feminist peace theory should address the devaluation of "others," in order to undermine this justification and motivation for war.

Recent developments in biogerontology—the study of the biology of ageing—suggest that it may eventually be possible to intervene in the human ageing process. This, in turn, offers the prospect of significantly postponing the onset of age-related diseases. The biogerontological project, however, has met with strong resistance, especially by deontologists. They consider the act of intervening in the ageing process impermissible on the grounds that it would (most probably) bring about an extended maximum lifespan—a state of affairs that they deem intrinsically (...) bad. In a bid to convince their deontological opponents of the permissibility of this act, proponents of biogerontology invoke an argument which is grounded in the doctrine of double effect. Surprisingly, their argument, which we refer to as the ‘double effect argument’, has gone unnoticed. This article exposes and critically evaluates this ‘double effect argument’. To this end, we first review a series of excerpts from the ethical debate on biogerontology in order to substantiate the presence of double effect reasoning. Next, we attempt to determine the role that the ‘double effect argument’ is meant to fulfil within this debate. Finally, we assess whether the act of intervening in ageing actually can be justified using double effect reasoning. (shrink)

The mathematical centerpiece of many physical theories is a Lagrangian. So let’s imagine that there’s some Lagrangian we trust. Should that induce us to endorse an ontology? If so, what ontology, and how is it related to our trustworthy Lagrangian? I’ll examine these questions in the context of quantum field theoretic Lagrangians. When these Lagrangians are understood as “merely effective,” a variety of approximations figure in the physics they frame. So do distinctive grounds for trusting those Lagrangians, grounds recent literature (...) has adduced in support of a novel variety of scientific realism known as _Effective Realism_. This essay attempts to undermine those grounds, and to do so without presupposing extensive prior knowledge of quantum field theories. (shrink)

The Dedekind cuts in an ordered set form a set in the sense of constructive Zermelo—Fraenkel set theory. We deduce this statement from the principle of refinement, which we distill before from the axiom of fullness. Together with exponentiation, refinement is equivalent to fullness. None of the defining properties of an ordering is needed, and only refinement for two—element coverings is used. In particular, the Dedekind reals form a set; whence we have also refined an earlier result by Aczel and (...) Rathjen, who invoked the full form of fullness. To further generalise this, we look at Richman's method to complete an arbitrary metric space without sequences, which he designed to avoid countable choice. The completion of a separable metric space turns out to be a set even if the original space is a proper class; in particular, every complete separable metric space automatically is a set. (shrink)

The goal of the following paper is to consider the development and viability of Korsgaard’s latest work, Self-Constitution. More specifically, I show that we should understand this book as a response to difficulties with both Korsgaard’s argument in 1996’s The Sources of Normativity and Korsgaard’s earlier attempts to explain what marks the difference between realist and constructivist approaches to ethical theory. I begin by focusing primarily on her essay “Realism and Constructivism in Twentieth-Century Moral Philosophy.” Here I consider exactly how (...) Korsgaard defines constructivism and what makes constructivism different from realist approaches to ethics. I then examine Korsgaard’s two most influential books – Sources and Self-Constitution – in light of this definition. Looking at Sources I argue that there is a serious problem with Korsgaard’s attempt to develop a constructivist moral theory; more specifically, I expose a tension in Korsgaard’s claim that ethical concepts both are rooted in a philosophy of action and exist only as the solution to a concrete practical problem. I then turn to Self-Constitution. I show that a different account of the distinction between realism and constructivism is proposed, one that not only seems designed to avoid the problems that plagued Sources but also forces Korsgaard to significantly revise and retreat from earlier attempt to distinguish constructivism from realism. The idea that we can perceive absences is becoming increasingly popular in contemporary philosophy of mind, and seeing empty space and hearing silence are alleged to be two paradigmatic examples. In this paper, I remain neutral over the question of whether empty space experiences and experiences of silence are genuinely perceptual phenomena, however, I argue that these experiences do not qualify as absence experiences. AI as decision support supposedly helps human agents make ‘better’decisions more efficiently. However, research shows that it can, sometimes greatly, influence the decisions of its human users. While there has been a fair amount of research on intended AI influence, there seem to be great gaps within both theoretical and practical studies concerning unintended AI influence. In this paper I aim to address some of these gaps, and hope to shed some light on the ethical and moral concerns that arise (...) with unintended AI influence. I argue that unintended AI influence has important implications for the way we perceive and evaluate human-AI interaction. To make this point approachable from both the theoretical and practical side, and to avoid anthropocentricallyladen ambiguities, I introduce the notion of decision points. Based on this, the main argument of this paper will be presented in two consecutive steps: i) unintended AI influence doesn’t allow for an appropriate determination of decision points-this will be introduced as decision-point-dilemma, and ii) this has important implications for the ascription of responsibility. Recent work in animal ethics has advanced principles that are too individualistic to be compatible with a holistic environmental ethic such as the land ethic proposed by Aldo Leopold. J. Baird Callicott, on the other hand, has attempted to reconcile the two ethics by suggesting that sympathy, natural among humanity, as he claims on Humean grounds, does not necessarily terminate at the species barrier. His argument shows minimally that it is not necessary that we abandon ecological ethics in order to (...) view nonhuman animals as morally considerable. I argue instead that it is not sympathy, but hostility/indifference that manifests the reality of life in wild nature, and as such forms a better basis for an all-encompassing ethic. If one accepts that the factual realm suggests the limits of norms and establishes the background and context of normative judgments in this context (as Holmes Roiston, III, for instance, does), then a different line of argument can be developed. I argue that intraspecies and interspecies ethics ought to be different for us because behavior in the wild is different within and without a species. Further, I argue that hostility/indifference coupled with respect form the basis of an approach which embraces a holistic environmental ethic as weil as one concemed with nonhuman animals. (shrink)

In a number of recent articles, the debate on the ethics of fractional reserve “free” banking has been extended to loan maturity mismatching, specifically the banking practice of borrowing short and lending long. Barnett and Block :711–716, 2009; 2010) claim the practice is illicit, because like fractional reserve banking it creates duplicate property titles. They argue there is a continuum in the time dimension between the two kinds of activities. Bagus and Howden :399–406, 2009; 106:295–300, 2012a; Eur J Law Econ, (...) 2012b; Bus Ethics 22:235–245, 2013) maintain that loan maturity mismatching does not create duplicate titles and is not illicit, and that from an economic and legal perspective there is no continuum with fractional reserve banking. Cachanosky and Evans enter the debate from the free-banking standpoint and view both practices as legitimate. In this paper, I agree with the conclusions of Bagus and Howden, but adopt a different approach to support this position. Using the title-transfer theory of contract, I demonstrate from first principles why loan maturity mismatching does not create duplicate property titles and is a legitimate practice. Employing this same theory, I then present a novel argument to show why the contractual arrangements found in fractional reserve banking are logically contradictory and illegitimate. (shrink)
