This study examined the influence of two organizational context variables, codes of conduct and supervisor advice, on personnel decisions in an experimental simulation. Specifically, we studied personnel evaluations and decisions in a situation where codes of conduct conflict with supervisor advice. Past studies showed that supervisors’ advice to prefer ingroup over outgroup candidates leads to discriminatory personnel selection decisions. We extended this line of research by studying how codes of conduct and code enforcement may reduce this form of discrimination. Eighty (...) German managers evaluated and selected candidates from an applicant pool including Germans (ingroup members) and foreigners (outgroup members). Supervisor advice to prefer ingroup members lowered suitability ratings of outgroup members as well as their chances to be selected for an interview. Ethical codes of conduct referring to equal opportunities limited this form of discrimination, but only when codes were enforced by sanctions and integrated into organizational every-day practice. Companies have been experiencing increasing pressure from NGOs to overcome unethical and unsustainable behaviours. The purpose of this research was to study the interplay between supply chain transparency and NGO pressure. The analysis builds on the literature on supply chain transparency and institutional pressures. We conducted a time-lagged, multi-level regression analysis that included data from 270 fashion companies over a 5-year period to investigate the effect of NGO pressure on transparency and vice versa. The results revealed that companies with higher (...) levels of transparency are more likely to be pressured by NGOs than less transparent companies. Furthermore, our findings show that, depending on the number of campaigns, NGO power and communication about campaigns, NGO pressure can either stimulate corporate transparency or turn into a negative effect that leads to lower levels of transparency. Plotkin suggested using a polymorphic dual intuitionistic/linear type theory as a metalanguage for parametric polymorphism and recursion. In recent work the first two authors and R.L. Petersen have defined a notion of parametric LAPL-structure, which are models of image, in which one can reason using parametricity and, for example, solve a large class of domain equations, as suggested by Plotkin.In this paper, we show how an interpretation of a strict version of Bierman, Pitts and Russo’s language image into synthetic (...) domain theory presented by Simpson and Rosolini gives rise to a parametric LAPL-structure. This adds to the evidence that the notion of LAPL-structure is a general notion, suitable for treating many different parametric models, and it provides formal proofs of consequences of parametricity expected to hold for the interpretation. Finally, we show how these results, in combination with Rosolini and Simpson’s computational adequacy result, can be used to prove consequences of parametricity for image. In particular, we show that one can solve domain equations in image up to ground contextual equivalence. (shrink)

The initial premise of this paper is that the structure of a proof is inherent in the definition of the proof. Side conditions to deal with the discharging of assumptions means that this does not hold for systems of natural deduction, where proofs are given by monotone inductive definitions. We discuss the idea of using higher order definitions and the notion of a functional closure as a foundation to avoid these problems. In order to focus on structural issues we introduce (...) a more abstract perspective, where a structural proof theory becomes part of a more general theory of functional closures. The coronavirus pandemic made the biopolitics of infection control the core object of states around the world. Globally, states governed spheres usually free of state control, implementing various restrictions, closing down society in the process. This is possible due to the state's capacities to act through and over society, grounded in the state's powers. I argue that while the pandemic has led to useful and interesting state-centric Foucauldian literature on the politics of COVID-19, this literature has not fully taken the (...) theoretical lessons of the pandemic into account. Explicating these lessons, I discuss how the pandemic invites us to reconsider the Foucauldian approach to the state. The purpose of this article is to combine the Foucauldian theory of power with a Weberian state theory based on Michael Mann's work on the state and the sources of power, so to lay the foundations for a Weberian-Foucauldian theory of the state. According to Niklas Luhmann, causality is both an impossibility and a necessity in education. On the one hand, the task of the teacher is an impossible one, because teaching as communication is a closed system that cannot determine the learning of pupils' psychical system in any causal sense. On the other hand, one cannot practice as a teacher without a belief in causality, i.e., in a causal connection between teaching and learning. In his article “The Child as the Medium of (...) Education,” Luhmann focuses on the enablement of education, despite its impossibility. His answer is that one thing that makes education possible is the emergence of the symbolically generalized medium “the child.” In this article, Lars Qvortrup focuses on Luhmann's understanding of causality. According to Luhmann, causality is not a simple, ontological fact, but the result of the attribution of certain causes to certain effects. The conclusion is that causality as an attribution category — and not causality as an ontological fact — is another thing that makes education possible. Qvortrup also concludes, however, that Luhmann is not alone in criticizing the traditional, mechanical concept of causality. Other contemporary philosophers and sociologists have pointed out that in order to analyze causality in complex social systems, one has to select some causal factors and ignore others. While others do this based on seemingly pure scientific and statistical criteria, Luhmann focuses on attribution as a social construction of causality. (shrink)

Refugee migration to Europe reached peak levels in 2015. During this time, more than 260,000 children applied for asylum in Germany; over 40,000 of whom arrived without parents or other legal guardians. This article takes a broadly descriptive legal approach to focus on the resulting legal and ethical problems in Germany, and to highlight a variety of ethically relevant issues within the legal system. In particular, refugee children below the legal age of 18, have special needs with regard to health (...) care, guardianship and appropriate custody, but the legal framework produces questionable inequalities that require further research. In a reply to my recent paper “The Cost of Denying Intrinsic Value in Nature,” Rut Vinterkvist raises an important objection to my claim that environmentalists must ascribe intrinsic value to some natural entities to consistently defend the protectionist views I believe many of them have. To defend this claim, I provided three hypothetical cases, involving threatened natural entities, designed to show that only an intrinsic value of these respective entities could explain a reason to protect them. My claim was (...) that, even in these cases, environmentalists would generally find the natural entities in question protection-worthy. Against this claim, Vinterkvist argues that environmentalists can consistently opt for protection of these entities without ascribing any intrinsic value to them, the idea being that we can argue for protection of the entities on the basis that other people care for them (for whatever reasons, if any). We should protect them, not for their own sake, but for the sake of those who care for them. In this response, I explain why I believe her suggestion—challenging to my argument as it is—does not provide a proper option for environmentalists who want to argue for protection in these and similar cases. In her latest book _Spying Through a Glass Darkly: The Ethics of Espionage and Counter-Intelligence_, Cécile Fabre suggests that the deception of third parties during an infiltration operation can be justified as a foreseen but unintended side effect. In this essay, I criticize this view. Such deception, I argue, is better justified paternalistically as a means of preventing third parties from becoming wrongful threats. In the second part of the article, I show that Fabre ignores an important moral complication in (...) deception operations where agents intentionally allow others to be harmed as a means of protecting a secret. I argue that intentionally allowing harm to others as a means is a particularly problematic mode of agency which must be addressed in a normative account of espionage. (shrink)

This paper argues that it is possible to develop a new conceptual framework based on the tradition of philosophical hermeneutics to address what one could call “the human factor” within knowledge creation in organisations. This is done firstly through a review of the epistemological roots of three main theories of knowledge creation in organisations. We examine these theories along two axes: a) their understanding of the relation between person and language, and b) the controllability of knowledge creation. Secondly, we restate (...) the question of knowledge creation in organisations from the perspective of philosophical hermeneutics, arguing that knowledge creation takes place as an event in language, that is as an uncontrollable process which nonetheless requires courage, trust, and persistence and thereby requires that certain “ethical actions” should happen. This, finally, leads us to develop a model for knowledge creation called LUGS, which insists on the intrinsic relation between epistemology and practice, i.e. between what people come to know and how they decide to be – and it is this intrinsic relation between knowledge and being that we take as the “message” of this article. This paper discusses evaluations of distributive justice in two different situations. Focal point is the so-called equity axiom which lies at the heart of Rawls’ second principle of justice, the maximin rule. Our investigation which was run at a German university spans over a period of fifteen years. It seems to us that consideration for the worst-off (group) in society has become considerably weaker over the years. This and related observations are tested by using a probit model including several demographic (...) characteristics of the probands. The supposed time trend proves to be statistically robust. Several reasons for this observation are given. Obviously, depending on the underlying context, evaluations are to some degree influenced by current topics, including the ongoing discussion about the German educational system as well as about recent economic problems. We also briefly refer to findings that we obtained in the Baltics and in Israel. (shrink)

When considering the introduction of a new intervention in a budget constrained healthcare system, priority setting based on fair principles is fundamental. In many jurisdictions, a multi-criteria approach with several different considerations is employed, including severity and cost-effectiveness. Such multi-criteria approaches raise questions about how to balance different considerations against each other, and how to understand the logical or normative relations between them. For example, some jurisdictions make explicit reference to a large patient benefit as such a consideration. However, since (...) patient benefit is part of a cost-effectiveness assessment it is not clear how to balance considerations of greater patient benefit against considerations of severity and cost-effectiveness. The aim of this paper is to explore the role of a large patient benefit as an independent criterion for priority setting in a healthcare system also considering severity and cost-effectiveness. By taking the opportunity cost of new interventions (i.e., the health forgone in patients already receiving treatment) into account, we argue that patient benefit has a complex relationship to priority setting. More specifically, it cannot be reasonably concluded that large patient benefits should be given priority if severity, cost-effectiveness, and opportunity costs are held constant. Since we cannot find general support for taking patient benefit into account as an independent criterion from any of the most discussed theories about distributive justice: utilitarianism, prioritarianism, telic egalitarianism and sufficientarianism, it is reasonable to avoid doing so. Hence, given the complexity of the role of patient benefit, we conclude that in priority practice, a large patient benefit should not be considered as an independent criterion, on top of considerations of severity and cost-effectiveness. Martin Heidegger’s Sein und Zeit presents one of the most striking reflexions on human facticity, i.e. the fact that Dasein fundamentally exists in a world letting Dasein and world be co-extensive. By quoting two central personages in theology, Pascal and Augustine, Heidegger refers to a concept of love that is constitutive for Dasein’s facticity to truth and to knowledge. By investigating the claim that love is as good as absent from Sein und Zeit, the article intends to show that the (...) scanty references to love nevertheless have a central role in Heidegger’s early work and, furthermore, why Heidegger returns to it in his later thinking. Interesting in this regard is the connection between the theological concept of love and Heidegger’s concept of ‘world’. The article places Heidegger’s Destruktion of the metaphysical tradition in the realms of his Dasein analysis focussing on facticity. Taking its methodological cues from Giorgio Agamben and Jacques Derrida, the article shows how the concepts of possibility and impotentiality (Ohnmacht) become essential in Heidegger via his reference to love. Lastly, the article examines to what extent Heidegger’s Sein und Zeit paraphrases the old angelology letting the Dasein concept become its secularisation. (shrink)

While education for democracy has been heavily influenced by the deliberative perspective on democracy, a recent turn towards an agonistic perspective on democracy places a great deal of faith in the role of political emotion and conflict. Educational scholars have mostly interpreted agonism in relation to the emotional and conflictual experiences that occur within school. Some scholars draw general pedagogical insights from this perspective, while others use it to propose conflictual approaches to classroom discussions. Overestimating, however, the extent to which (...) experiences of agonism within school applies to politically experienced agonisms beyond the school, is problematic. Such overestimations undermine the core political insights of agonistic theory, concerning the democratic potential of radical collective movements. Agonistic theory acknowledges the psychological need among disgruntled citizens for radical alternatives enabling them to oppose and rearticulate the established power dynamics in society. The purpose of agonistic democracy is to enable rearticulations of hegemony through the institutions of representative democracy, rather than as opposed to them. Important for this paper, however, is the argument that such rearticulations depend on the rhetorical force of collective movements. Emphasizing that we cannot assume the presence of such movements in everyday school life, the paper revisits the following question: What are the didactical implications of an agonistic perspective on democracy? The democratic potential of collective movements is not easily captured through experiences within the pedagogical context alone, but proposals are made as to how this potential can be grasped in other ways. Given resource constraints in healthcare, demands justice and equity require the constant development of material principles for resource distribution. In many cases, such material principles are formulated as mid-level principles, well-adapted to handle healthcare distribution but suffering from aspects outside the healthcare context that affect their application. In healthcare, factors outside the healthcare system will sometimes affect patients’ equal opportunity to receive treatment and achieve health. Examples of such factors might include an individual’s economic means, the cost of drugs, geography, (...) etc. This article explores whether the formal equality principle could help us address such problems. It is argued that the traditional (thin) formal equality principle can aid in priority setting, both as a heuristic tool to aid in consistency and also in handling under-determined cases. However, it appears to be too ‘thin’ to handle problems caused by factors outside the healthcare context. In the article, I explore a more robust version of the formal equality principle and argue that such a principle can be used to address such cases. However, even a more comprehensive formal equality principle will need to consider whether some other actors have a moral responsibility to address the problem or whether the issue could be solved more effectively by others. Furthermore, such a principle needs to consider whether the opportunity cost of achieving ‘thick’ formal equality is acceptable, given the material principles of distribution. (shrink)

Priority setting of scarce resources in healthcare is high on the agenda of most healthcare systems implying a need to develop robust foundations for making fair allocation decisions. One central factor for such decisions in needs-based systems, following both empirical studies and theoretical analyses, is severity. However, it has been noted that severity is an under-theorized concept. One such aspect is how severity should relate to temporality. There is a rich discussion on temporality and distributive justice, however, this discussion needs (...) to be adapted to the practical and ethical requirements of healthcare priority setting principles at mid-level. In this article, we analyze how temporal aspects should be taken into account when assessing severity as a modifier for cost-effectiveness. We argue that when assessing the severity of a condition, we have reason to look at complete conditions from a time-neutral perspective, meaning that we take the full affectable stretch of the condition into account without modifying severity as patients move through the temporal stretch and without discounting the future. We do not find support for taking the ‘shape’ of a condition into account per se, e.g. whether the severity has a declining or inclining curve, or that severity is intermittent rather than continuous. In order to take severity seriously, we argue that we have reason to apply a quantified approach where every difference in severity should impact on priority setting. In conclusion, we find that this approach is practically useful in actual priority setting. (shrink)

Collaborative governance (CG) is becoming the common currency of decision‐making, able to surmount existing institutional constraints to effectively address challenges related to sustainability and social and environmental corporate behavior. CG approaches may however result in institutional complexity. As an illustration of CG in the domain of corporate social responsibility (CSR), the ISO 26000 standard is a legitimate point of reference for organizations worldwide. The standard represents a pluralistic institutional logic that resonates several tensions arising from the domain it tries to (...) standardize, the nature of its development process, its interpretation of CSR and the type of standard it represents. This article aims to identify and examine strategic responses to ISO 26000 by various standards‐related organizations (including national standardization institutes, certification organizations, and service providers) and to contribute to the understanding of strategic responses of organizations to pluralistic institutional logics that result from CG.
