BackgroundDelirium is highly prevalent in the general hospital patient population, characterized by acute onset, fluctuating levels of consciousness, and global impairment of cognitive functioning. Mental capacity, its assessment and subsequent consent are therefore prominent within this cohort, yet under-explored.AimThis study of patients with delirium sought to determine the processes by which consent to medical treatment was attempted, how capacity was assessed, and any subsequent actions thereafter.MethodA retrospective documentation review of patients identified as having a delirium for the twelve months February (...) 2013 to January 2014 was undertaken. Inclusion and exclusion criteria were used; demographic and descriptive data collected. A total of n=1153 patients were identified with n=310 meeting inclusion criteria.ResultA random sample of one hundred patients were subsequently reviewed. One third of patients had documentation relating to consent, while four patients had documentation relating to capacity. Median delirium duration was three days, with treatment refusal occurring in twenty-two patients and “duty of care” being used as an apparent beneficent related treatment framework in twelve patients.ConclusionsWhile impaired decision-making was indicated, the review was unable to indicate what patient characteristics flag the need for capacity assessment. Documentation relating to consent processes appeared deficient for this cohort. (shrink)

The theories of belief change developed within the AGM-tradition are not logics in the proper sense, but rather informal axiomatic theories of belief change. Instead of characterizing the models of belief and belief change in a formalized object language, the AGM-approach uses a natural language — ordinary mathematical English — to characterize the mathematical structures that are under study. Recently, however, various authors such as Johan van Benthem and Maarten de Rijke have suggested representing doxastic change within a formal logical (...) language: a dynamic modal logic. Inspired by these suggestions Krister Segerberg has developed a very general logical framework for reasoning about doxastic change: dynamic doxastic logic (DDL). This framework may be seen as an extension of standard Hintikka-style doxastic logic with dynamic operators representing various kinds of transformations of the agent's doxastic state. Basic DDL describes an agent that has opinions about the external world and an ability to change these opinions in the light of new information. Such an agent is non-introspective in the sense that he lacks opinions about his own belief states. Here we are going to discuss various possibilities for developing a dynamic doxastic logic for introspective agents: full DDL or DDL unlimited. The project of constructing such a logic is faced with difficulties due to the fact that the agent’s own doxastic state now becomes a part of the reality that he is trying to explore: when an introspective agent learns more about the world, then the reality he holds beliefs about undergoes a change. But then his introspective (higher-order) beliefs have to be adjusted accordingly. In the paper we shall consider various ways of solving this problem. (shrink)

This study explores the practical implications of the paradox of moral education, focusing on how Swedish social study teachers (civics, geography, history, and religious education) navigate conflicting responsibilities to convey values and facilitate critical thinking when addressing controversial issues in their classrooms. Through qualitative interviews and observations, teachers were found to often lead by example, maintaining neutrality and presenting diverse perspectives. This approach appears to foster students towards embracing liberal values, promoting independent decision-making and personal responsibility, but it may come (...) at the cost of critically evaluating these very ideals, norms, and values. The absence of official guidelines in the Swedish school system underscores the significance of understanding how teachers balance these conflicting responsibilities in their pedagogical practices. The study sheds light on the practical strategies employed by teachers, contributing valuable insights to a discourse traditionally centred on theoretical solutions to the paradox of moral education. Traditional courtship norms delineate distinct gendered behaviors for men and women based on the model of a dominant, breadwinning male and a passive, dependent female. Previous research shows, however, that as women have increased their access to earned income, there has been a rising ideological and behavioral commitment to egalitarian relationships. Drawing on in-depth interviews with 38 college-educated women, this article explores how women negotiate these seemingly contradictory beliefs in order to understand how and why gendered courtship conventions persist even (...) as heterosexual romantic relationships become more egalitarian. My findings show that while the women reference essentialist beliefs about men’s “nature” to explain their commitment to courtship conventions, they draw on narratives of choice, individualism, and personal autonomy to assert that the symbolic gendering of courtship will not interfere with their desire for an egalitarian marriage. However, women’s behaviors and narratives reinforce notions of gender difference, potentially providing support for other forms of gender inequality. (shrink)

It has been argued, by Penrose and others, that Gödel's proof of his first incompleteness theorem shows that human mathematics cannot be captured by a formal system F: the Gödel sentence G(F) of F can be proved by a (human) mathematician but is not provable in F. To this argment it has been objected that the mathematician can prove G(F) only if (s)he can prove that F is consistent, which is unlikely if F is complicated. Penrose has invented a new (...) argument intended to avoid this objection. In the paper I try to show that Penrose's new argument is inconclusive. (shrink)

It is commonly agreed that the well-known Lucas-Penrose arguments and even Penrose's 'new argument' in [Penrose, R. (1994): Shadows of the Mind, Oxford University Press] are inconclusive. It is, perhaps, less clear exactly why at least the latter is inconclusive. This note continues the discussion in [Lindström, P. (2001): Penrose's new argument, J. Philos. Logic 30, 241-250; Shapiro, S.(2003): Mechanism, truth, and Penrose's new argument, J. Philos. Logic 32, 19-42] and elsewhere of this question.

In earlier papers (Lindström & Rabinowicz, 1989. 1990), we proposed a generalization of the AGM approach to belief revision. Our proposal was to view belief revision as a relation rather thanas a function on theories (or belief sets). The idea was to allow for there being several equally reasonable revisions of a theory with a given proposition. In the present paper, we show that the relational approach is the natural result of generalizing in a certain way an approach to belief (...) revision due to Adam Grove. In his (1988) paper, Grove presents two closely related modelings of functional belief revision, one in terms of a family of "spheres" around the agent's theory G and the other in terms of an epistemic entrenchment ordering of propositions. The "sphere"-terminology is natural when one looks upon theories and propositions as being represented by sets of possible worlds. Grove's spheres may be thought of as possible "fallback" theories relative to the agent's original theory: theories that he may reach by deleting propositions that are not "sufficiently" entrenched (according to standards of sufficient entrenchment of varying stringency). To put it differently, fallbacks are theories that are closed upwards under entrenchment The entrenchment ordering can be recovered from the family of fallbacks by the definition: A is at least as entrenched as B iff A belongs to every fallback to which B belongs. To revise a theory T with a proposition A, we go to the smallest sphere that contain A-worlds and intersect it with A. The relational notion of belief revision that we are interested in, results from weakening epistemic entrenchment by not assuming it to be connected. I.e., we want to allow that some propositions may be incomparable with respect to epistemic entrenchment. As a result, the family of fallbacks around a given theory will no longer have to be nested. This change opens up the possibility for several different ways of revising a theory with a given proposition. (shrink)

Epistemic conditionals have often been thought to satisfy the Ramsey test : If A, then B is acceptable in a belief state G if and only if B should be accepted upon revising G with A. But as Peter Gärdenfors has shown, RT conflicts with the intuitively plausible condition of Preservation on belief revision. We investigate what happens if RT is retained while Preservation is weakened, or vice versa. We also generalize Gärdenfors' approach by treating belief revision as a relation (...) rather than as a function.In our semantic approach, the same relation is used to model belief revision and to give truth-conditions for conditionals. The approach validates a weak version of the Ramsey Test — essentially, a restriction of RT to maximally consistent belief states. (shrink)

Principles of distributive justice are normative principles designed to guide the allocation of the benefits and burdens of economic activity.

This article presents a remarkable cache of five Attic curse tablets, four of which are published here for the first time. Excavated in situ in a pyre-grave outside the Athenian Long Walls, the texts employ very similar versions of a single binding curse. After situating the cache in its archaeological context, all texts are edited with a full epigraphic commentary. A discussion then follows, in which the most striking features of the texts are highlighted: in addition to the peculiar “first (...) four-year period” that the curses were meant to outlast, and the unparalleled term κυνωτόν, these texts are unusual in that they preserve over a full line of dactylic hexameter. The metrical formulae, combined with the presence of deictic language, may suggest that parts of the archetype curse underpinning these texts once circulated orally, in performative ritual contexts. The cache affords a singular glimpse into the process of curse-creation around 400 BCE, especially the ways in which a curse-writer could customize a fixed template spell to suit a client’s needs and circumstances. These tablets illuminate the shadowy process behind the creation of Athenian curse tablets, and the growing traffic in “magic” by the end of the fifth century BCE. (shrink)

We present a decision procedure for the ∀∃ theory of the lattice of Σ1 sentences of Peano Arithmetic.

Many have argued that individuals should receive income in proportion to their contribution to society. Others have believed that it would be fairer if people received income in proportion to the effort they expend in so contributing, since people have much greater control over their level of effort than their productivity. I argue that those who believe this are normally also committed, despite appearances, to increasing the social product — which undermines any sharp distinction between effort- and productivity-based distributive proposals. (...) However, effort-based proposals do emphasise more the importance of people having control over factors affecting their income. The second set of problems I consider is how to implement policies which hold true to this emphasis. I show that there are major problems with the accuracy of using any objective criteria to measure the level of effort a person is expending. Moreover, once any such criteria are employed the problem of ‘moral hazard’arises because people modify their behaviour in such a way as to maximise their income while minimising their effort. This violates the original motivation for using effort. Because of this and other empirical considerations, I argue that productivity may well be a better criterion on which to distribute income even if one is motivated by the same concerns which have prompted effort-based proposals. Using philosophical and theological reflection, this book explores the rational grounding for Christian faith, inquiring into the basis for believing the Christian revelation, and using the answers to give an account of Christian faith itself. Setting the discussion in the context of the history of views on revelation, Divine Faith makes an original contribution to historiography and draws out hitherto unnoticed affinities between Catholic and Protestant thought. Re-examining the question from the beginning by asking how it is that the Christian (...) revelation is made, Lamont then looks at the fundamental philosophical issues concerning the nature of knowledge and the reasonableness of belief in testimony that are crucial to an understanding of Christian belief. Through theological considerations on the relations of grace and the church, and new advances in the philosophy of belief in testimony and how God speaks to communicate the Christian religion, this book offers an original and powerful account of the nature of Christian belief. Courtship conventions are premised on widespread and deeply held cultural beliefs that men and women need and want different things from their romantic relationships. Yet queer relationships challenge the notion of distinct gendered behaviors in romantic relationships, and queer people often explicitly seek to undermine conventional relationship practices. Using interview data from 40 LGBTQ-identified respondents, I examine how queer people negotiate culturally dominant gendered dating and courtship practices. My findings show that, rather than replicate heterosexual norms, respondents actively reject them, (...) seeking new and more egalitarian ways of building romantic relationships. Significantly, the narratives drawn on to justify egalitarian dating practices are similar to those used in their committed relationships. Respondents emphasized egalitarian, flexible, and non-gendered care work in committed relationships, indicating that how people date may potentially set the stage for the dynamics in their relationships. The importance placed on these alternative norms in queer communities, however, contradicts respondents’ assertions that they can create relationships free from cultural constraints, demonstrating how emerging norms can breed their own pressures for conformity. The article describes different approaches to the semiotic processes in landscapes from the semiological tradition where landscape has been seen as analogous to a text with its language, to more naturalized and phenomenological approaches, as well as ecosemiotic view of landscapes that goes beyond anthropocentric definitions. Special attention is paid to the potential of cultural (...) semiotics of Tartu–Moscow school for the analysis of landscapes and the possibilities held by a dynamic, dialogic and holistic landscape definition for the development of ecosemiotics. Norman Rufus Colin Cohn, a Fellow of the British Academy, wrote three major histories around a single theme. The Pursuit of the Millennium related the apocalyptic beliefs of twentieth-century totalitarian movements, whether Nazi or Communist, to their origins in medieval heresy. Warrant for Genocide established that the key document of a Jewish world conspiracy, The Protocol of the Elders of Zion, was a nineteenth-century Tsarist forgery. Europe's Inner Demons argued that the belief in a Satanic pact was at the heart (...) of witch persecution in early modern Europe. Within a year of retiring as Director of the Columbus Centre, Cohn was invited to Concordia University, Montreal, to help launch an Institute for Genocide Studies. He regarded his three books as tied to the Columbus Centre agenda and as such compatible with Lord Dacre's own search for what it was in Germany's myths and history that Adolf Hitler's mind could have been working upon in his lost years in Vienna. In this article, the author diagnoses the cause of Rand's problematic position on intellectual property. He argues that Rand treats credit as a very thick concept. Rand sees crediting a person with inventing something as granting that person a right to the money embodied in the invention, its sale, and the profits related to licensing reproduction. The author shows that this thick notion of credit leads Rand to make several questionable claims in her arguments for intellectual property rights.

Marxists claim capitalists unjustly exploit workers, and this exploitation is to show that workers ought to hold more than they do. This paper presents two accounts of exploitation. The Theft Account claims that capitalists steal some of the value to which workers are entitled. The Underpayment Account holds that capitalists are not entitled to pay workers as little as they do, even if the workers are not entitled to the full value they produce. This paper argues that only the Theft (...) Account can explain why workers ought to hold more than they do. The Underpayment Account cannot yield this conclusion. The Theft Account is superior to the Underpayment Account insofar as exploitation is to be an injustice—a wrong that requires the exploited party to hold more. (shrink)

Eric Mack defends a version of John Locke’s proviso. Mack applies his proviso to original appropriations, uses, and systems of private property. His proviso precludes severely disabling the world-interactive powers of others. Mack specifically warns against using concrete features of the natural world as a baseline for determine whether the proviso has been violated. While his proviso is plausible, I argue that he cannot. eschew employing the receptivity of the natural, unowned world to the extent that he suggests. We cannot (...) determine whether one’s powers are disabled or diminished without knowing how receptive the world would be to those powers had a system of private property not arisen. The upshot of this paper is that the requirements of a well-formulated proviso is an empirical matter. (shrink)

Karl Widerquist has recently argued that libertarians face two dilemmas. The first dilemma arises because, contrary to what Widerquist takes libertarians to suggest, there is no conceptual link between robust property rights and the libertarian state. Private property rights can legitimately yield non-libertarian states. Libertarians must thus remain committed either to robust property rights or the libertarian state. I call this the ‘Conceptual Dilemma’. The second dilemma is empirical in nature. Libertarians can try to undermine state property rights by showing (...) that the means by which all present states came to have their property was unjust. However, doing so would presumably undermine almost all the property claims of private individuals. So the dilemma is that libertarians can undermine state property rights only by undermining individual property rights, on the one hand. On the other, libertarians can vindicate private property rights of individuals only by vindicating state property rights. I call this the ‘Empirical Dilemma’. I attempt to defuse both of these dilemmas here. I argue that the Conceptual Dilemma relies on a misunderstanding of the libertarian’s commitments. In particular, I show that libertarians need not think robust property rights can yield states more extensive than Nozick’s minimal state. I then argue that Widerquist ignores libertarian scholarship aimed at meeting the Empirical Dilemma. Many libertarians have attempted to demonstrate that there are legitimate private property rights which are illegitimately disregarded by current states. The upshot of this discussion is that there are no genuine dilemmas posed by Widerquist’s ‘A Dilemma for Libertarians’. (shrink)

The concept of cultural capital has been increasingly used in American sociology to study the impact of cultural reproduction on social reproduction. However, much confusion surrounds this concept. In this essay, we disentangle Bourdieu and Passeron's original work on cultural capital, specifying the theoretical roles cultural capital plays in their model, and the various types of high status signals they are concerned with. We expand on their work by proposing a new definition of cultural capital which focuses on cultural and (...) social exclusion. We note a number of theoretical ambiguities and gaps in the original model, as well as specific methodological problems. In the second section, we shift our attention to the American literature on cultural capital. We discuss its assumptions and compare it with the original work. We also propose a research agenda which focuses on social and cultural selection and decouples cultural capital from the French context in which it was originally conceived to take into consideration the distinctive features of American culture. This agenda consists in 1) assessing the relevance of the concept of legitimate culture in the U.S.; 2) documenting the distinctive American repertoire of high status cultural signals; and 3) analyzing how cultural capital is turned into profits in America. The main objective of this paper is to examine how theories of truth and reference that are in a broad sense Fregean in character are threatened by antinomies; in particular by the Epimenides paradox and versions of the so-called Russell-Myhill antinomy, an intensional analogue of Russell’s more well-known paradox for extensions. Frege’s ontology of propositions and senses has recently received renewed interest in connection with minimalist theories that take propositions (thoughts) and senses (concepts) as the primary bearers of truth and (...) reference. In this paper, I will present a rigorous version of Frege’s theory of sense and denotation and show that it leads to antinomies. I am also going to discuss ways of modifying Frege’s semantical and ontological framework in order to avoid the paradoxes. In this connection, I explore the possibility of giving up the Fregean assumption of a universal domain of absolutely all objects, containing in addition to extensional objects also abstract intensional ones like propositions and singular concepts. I outline a cumulative hierarchy of Fregean propositions and senses, in analogy with Gödel’s hierarchy of constructible sets. In this hierarchy, there is no domain of all objects. Instead, every domain of objects is extendible with new objects that, on pain of contradiction, cannot belong to the given domain. According to this approach, there is no domain containing absolutely all propositions or absolutely all senses. (shrink)

This integrative review aims to provide a synthesis of research findings of health-care professionals’ knowledge, attitudes and behaviours relating to patient capacity to consent to or refuse treatment within the general hospital setting. Search strategies included relevant health databases, hand searching of key journals, ‘snowballing’ and expert recommendations. The review identified various knowledge gaps and attitudinal dispositions of health-care professionals, which influence their behaviours and decision-making in relation to capacity to consent processes. The findings suggest that there is tension between (...) legal, ethical and professional standards relating to the assessment of capacity and consent within health care. Legislation and policy guidance concerning capacity assessment processes are lacking, and this may contribute to inconsistencies in practice. (shrink)

This special issue on the semiotics of perception originates from two workshops arranged in Tartu, Estonia, in February 2009. We are located at the junction of nature and culture, and of semiotics and phenomenology. Can they be reconciled? More particularly, can subfields such as biosemiotics and ecophenomenology be mutually enriching? The authors of the current special issue believe that they can. Semiotic study of life and the living can emerge as properly informed only if it is capable of incorporating observations (...) made in natural science, philosophy and cultural studies. The semiotic study of nature entails an experiential turn in the study of life processes. Perception is—or should be—at the heart of the life sciences. (shrink)

Jennifer Bird-Pollan has recently argued that Nozickians are wrong to oppose the estate tax. Promising to argue from within the Nozickian framework, she presses the fundamental point that the estate tax does not violate anyone’s rights: neither the deceased nor their would-be heirs can claim a right to any holdings subject to the estate tax. This paper shows that Bird-Pollan’s discussion fails on three fronts. First, she frequently misinterprets Nozick, and thus does not defend the estate tax from a Nozickian (...) perspective. Second, even if Bird-Pollan is correct in denying that the deceased and their potential heirs have a right to the holdings in question, it does not follow that the estate tax is licit, because Nozickians can oppose it on other grounds. For example, Nozickians may hold that the enforcement of the estate tax will violate other rights people have. The government’s preemptive claims to holdings subject to estate taxes, along with the force required to enforce those claims, are unjustified. The crucial premise motivating these conclusions is the Nozickian denial that our current state possesses the authority to enforce the estate tax. This is the third front on which Bird-Pollan’s argument fails: she must show that Nozickians ought to believe government has the moral authority to enforce the estate tax, yet she makes no effort to do so. This paper presents a uniform semantic treatment of nonmonotonic inference operations that allow for inferences from infinite sets of premises. The semantics is formulated in terms of selection functions and is a generalization of the preferential semantics of Shoham (1987), (1988), Kraus, Lehman, and Magidor (1990) and Makinson (1989), (1993). A selection function picks out from a given set of possible states (worlds, situations, models) a subset consisting of those states that are, in some sense, the most preferred ones. A (...) proposition α is a nonmonotonic consequence of a set of propositions Γ iff α holds in all the most preferred Γ-states. In the literature on revealed preference theory, there are a number of well-known theorems concerning the representability of selection functions, satisfying certain properties, in terms of underlying preference relations. Such theorems are utilized here to give corresponding representation theorems for nonmonotonic inference operations. At the end of the paper, the connection between nonmonotonic inference and belief revision, in the sense of Alchourrón, Gärdenfors, and Makinson, is explored. In this connection, infinitary belief revision operations that allow for the revision of a theory with a possibly infinite set of propositions are introduced and characterized axiomatically. The paper corrects misrepresentations of Aquinas's understanding of divine simplicity, argues that the reasons he gives for divine simplicity are persuasive ones, and suggests how Aquinas's account of the Trinity can be used to explain how God can be said to exist necessarily. It gives an account of Aquinas's conception of form and individualised form, and shows how Plantinga's criticism of Aquinas's position on divine simplicity rests on a misunderstanding of Aquinas's notion of form. It describes and makes the case (...) for Aquinas's argument that God must be absolutely simply because he is the uncaused cause of all effects, and any real composition in things constitutes an effect. It shows that Brian Davies is mistaken in claiming that Aquinas does not hold God's existence to be logically necessary. It applies Frege's conception of existence to Aquinas's account of God's simplicity and his psychological analogy for the Trinity, in order to explain how God's existence can coherently be said to be logically necessary.
