The article analyzes the impact of modern digital technologies used in the information society on democracy, human rights, and the rule of law in general. Both positive and negative aspects of such impact are considered. The importance of this topic is due to the need for further deepening of scientific knowledge related to the development of the rule of law in the information society and insufficient research from the legal point of view of current theoretical problems of the rule of (...) law in the digital era. The purpose of this article is to study the rule of law as a principle of the modern state of the 21st century and to study the problems in matters of human rights that have arisen with the development of modern digital technologies. The study of this issue is quite relevant, considering the conclusions, made as a result of our work, can be taken into account in further theoretical developments of international and national human rights protection aimed at improving the effectiveness of human rights judicial protection and improving current legislation. The problem of combinatorial optimization is considered in relation to the choice of the location of the location of power supplies when solving the problem of the development of urban distribution networks of power supply. Two methods have been developed for placing power supplies and assigning consumers to them to solve this problem. The first developed method consists in placing power supplies of the same standard sizes, and the second - of different standard sizes. The fundamental difference between the created (...) methods and the existing ones is that the proposed methods take into account all the material of the problem and have specialized methods for coding possible solutions, modified operators of crossing and selection. The proposed methods effectively solve the problem of low inheritance, topological unfeasibility of the found solutions, as a result of which the execution time is significantly reduced and the accuracy of calculations is increased. In the developed methods, the lack of taking into account the restrictions on the placement of new power supplies is realized, which made it possible to solve the problem of applying the methods for a narrow range of problems. A comparative analysis of the results obtained by placing power supplies of the same standard sizes and known methods was carried out, and it was found that the developed method works faster than the known methods. It is shown that the proposed approach ensures stable convergence of the search process by an acceptable number of steps without artificial limitation of the search space and the use of additional expert information on the feasibility of possible solutions. The results obtained allow us to propose effective methods to improve the quality of decisions made on the choice of the location of power supply facilities in the design of urban electrical. Olmsted was an influential landscape architect whose works include many parks, recreation grounds and more. Inspired by Romantic and transcendentalist thinkers, he developed ‘pastoral transcendentalism’, a style of designing parks that mimicked natural spaces to reproduce their values within cities. Although environmental justice scholars have pointed out how these designs limit access to parks, I argue that environmental philosophers have not adequately discussed Olmsted, particularly his axiology of nature. Reflecting on it reveals how environmental injustice consists not only of restricting (...) access to nature to protect its essential value – for Olmsted, scenery that could induce a contemplative mindset – but in delimiting nature's value without consideration of how people actually appreciate it. Traditionally, the investigation of truth has been anchored in a priori reasoning. Cognitive science deviates from this tradition by adding empirical data on how people understand and use concepts. Building on psychophysics and machine learning methods, we introduce conceptual scaling, an approach to map people's understanding of abstract concepts. This approach, allows computing participant-specific conceptual maps from obtained ordinal comparison data, thereby quantifying perceived similarities among abstract concepts. Using this approach, we investigated individual's alignment with philosophical theories on truth and (...) the predictive capacity of conceptual maps. The obtained results indicated that, while people's understanding of truth is multifaceted and encapsulates notions of coherence and authenticity, alignment is best for the correspondence theory of truth. Furthermore, conceptual maps allowed predicting individual outcomes with an accuracy of roughly 70%. This research demonstrates that conceptual scaling offers accurate descriptions of individual's understanding of abstract concepts, behavioral predictions, and quantification of alignment with theoretical perspectives. This article explores the characteristics of research sites that scientists have called “natural experiments” to understand and develop usable distinctions for the social sciences between “Nature’s or Society’s experiments” and “natural experiments.” In this analysis, natural experiments emerge as the retro-fitting by social scientists of events that have happened in the social world into the traditional forms of field or randomized trial experiments. By contrast, “Society’s experiments” figure as events in the world that happen in circumstances that are already sufficiently (...) “controlled” to be open for direct analysis without reconstruction work. Suppose COVID-19 is the runaway tram in the famous moral thought experiment, known as the “Bystander at the Switch.” Consider the two differentiated responses of governments around the world to this new threat, namely the option of quarantine/lockdown and herd immunity. Can we contrast the hypothetical with the real scenario? What do the institutional decisions and strategies for dealing with the virus, in the beginning of 2020, signify in a normative moral framework? This paper investigates these possibilities in order to (...) highlight the similarities and, more importantly, the differences that exist between utilitarianism and Kantian ethics. Analysis shows that the hypothetical scenario can never be fully compared to the complex multifactorial nature of the real world. But if a comparison is attempted, the most obvious difference between the two governmental strategies is the concept of duty within the Kantian perspective. Ultimately, it is a matter of comparing freedom and life. Attributing a moral “priority ticket” to one or the other can be analysed through interpersonal aggregation. (shrink)

Mainstream views of medical research tell us it should be a fact-based, value-free endeavor: what a scientist (or her funding source) wants or cares about should not influence her findings. At the same time, we also sometimes criticize medical research for failing to embody certain values, e.g. when we criticize pharmaceutical companies for largely ignoring the diseases that affect the global poor. This chapter seeks to reconcile these perspectives by distinguishing appropriate from inappropriate influences of values on medical research. It (...) divides this broad question into two narrower ones, the Role Question (at what points in the research process is value influence potentially acceptable?) and the Content Question (when value influence is potentially acceptable, what specific values should researchers use?), and then draws on the philosophical literature on values in science to explore answers to each of them. Hegel’s idealism is generally perceived as a system of rational sublation (Aufhebung) of all empirical contingencies: nothing resists notional mediation which, in a movement of negation of negation, establishes a rational totality. Already Schelling opposed to this complete sublation an “indivisible remainder” of empirical contingency. However, a close reading of Hegel makes it clear that the concluding moment of a dialectical movement of sublation is an empirical remainder which totalizes it, like the body of Christ in Christianity. And the same (...) goes for the process of “negation of negation”: it concludes with a failure of negation, and its ultimate form is a failed suicide where the subject survives as a living dead. Such a reading of Hegel makes him a thinker of our time which is the time of a failed negation: most of us live as survivors of our death, with life dragging on in depressive apathy. (shrink)

Martin Buber has always made it clear that his dialogic principle is not to be treated as an abstract conception but an ontological reality. But admittedly, in I And Thou he could only point to such reality and could not properly present it in discursive prose. However there are instances in the text where he strives to do the latter. One particular instance is where he elaborates the emergence of consciousness of “I”. Through this elaboration, what Buber has tried to (...) point at is the bringing forth of the primary word ‘I-It’ forming part of his dialogic principle, as it ‘emerges round about’ the perceptual consciousness realised in body as some sort of a ‘primitive function of knowledge’. However, this still amounts only to an abstract conception, and not to a description of ontological reality as Buber would have aspired for. Hence the thought: what if there exists an endeavour carried out independently of Buber’s work, nevertheless in the same spirit as Buber but without his notorious mixing up of philosophy and religion? There indeed has been such an Existential-phenomenological take on embodiment and perception by the French phenomenologist Maurice Merleau-Ponty, as is laid out in his magnum opus Phenomenology of Perception. In the present paper we will explicate this interesting coincidence, thereby honouring Buber’s aspiration for ontological status to his dialogic principle, at the same time demonstrating how existentially resonating and ontologically converging the thought of these two great thinkers’ have been, though they had totally different intellectual pursuits and concerns. The article is devoted to the search for the nature of the ontology of an art work on the example of a literary work. Tradition viewed a work of art as the discovery of a higher truth. Analytical philosophy deprived literature of the status of truth in general, and thereby deprived it of any ontological dimension. Heidegger’s attempt to return this dimension to literature through its relationship with being did not find continuation in philosophy. The author proposes to consider a (...) literary work as a model of the world, primarily the social world. This approach makes liken a literary work to a mathematical theory. A mathematical theory is built as a correlation of simple elements; in a literary work such elements are characters (sometimes things). A mathematical theory is built on clearly defined axioms, a literary work is also built on axioms, but they do not have an explicit expression within the work and cannot always be perceived intuitively. The author shows that the mathematical theory never fully meets the specified conditions, and the mathematicians themselves note that in the future they will largely lose their strength. Thus, a literary work is of the same nature as a mathematical theory, only it presents a more complex case. The problem of truth serves as the way to find the ontological dimension. Analysis shows that in mathematics it is solved not by reducing a hypothesis to axioms, but by recognizing a theory through its effectiveness or applicability. For a work of art, such a criterion is its perception by its readers. In both cases, the ontological dimension is in the mind of the reader. (shrink)

Mark Heim (bio)René Girard has frequently contended that the core of his best known theories is already contained in the Bible, that in the end he is "only a kind of exegete" (Girard and Treguer 1994, 196). To those who object that the Bible had to wait two thousand years to be read as he reads it, he protests (...) that this is a gross exaggeration: "three quarters of what I say can be found in Saint Augustine" (196). In the introduction to I See Satan Fall like Lightning, Girard puts it like this:The Passion accounts reveal a phenomenon that unbeknownst to us generates all human cultures and still warps our human vision in favor of all sorts of exclusions and scapegoating. If this analysis is true, the explanatory power of Jesus's death is much greater than we realize, and Paul's exalted idea of the cross as the source of all knowledge is anthropologically sound.(2001, 3)In other words, Girard's insight comes only in the train of revelation. The revelation in the biblical sources was not perfectly grasped in the religious traditions that flowed from them, and was frequently betrayed through the construction of sacrificial theologies. But Girard insists that its power was in significant measure perceived and effective from the beginning. His view of the meaning of the passion cannot be correct if he is the first one to see it. So it is no minor matter to ask whether in fact early Christians saw the connection of the cross with scapegoating that is so central for Girard.One point that appears to tell against Girard's case is the absence of images of the cross and crucifixion in the first four Christian centuries. A brutal realism about this specific event is the keystone of Girard's understanding of the passion narratives. On this plane, there is no question of the centrality of the cross. Yet no literal depictions of the crucifixion survive in art from the first four Christian centuries. There is no entirely satisfactory explanation of why the cross would figure so centrally in Christian faith and worship, but be visually absent. Representations of Jesus in early Christian art most often display a healer, wonderworker, or teacher. In fact, the early centuries offer an odd inversion in creed and art. Early creeds focus on Jesus's beginnings and endings, "skipping right from 'born of the Virgin Mary' to 'suffered under Pontius Pilate,' with no mention of Jesus's life and work, while the art appears to take an opposite tack" (Jensen 2000, 131–32). Hua-yen Buddhism, the pre-eminent philosophical form of Buddhism in early T'ang dynasty the China, was instrumental in laying the conceptual foundations for virtually all subsequent East Asian Buddhism. This Hua-yen legacy includes Ch' an/Zen and Pure Land, the non-philosophical forms of Buddhism that came to dominance in the centuries to follow. In this sense, Fa-tsang (643-712), the third patriarch and foremost philosopher of Hua-yen, can be considered one of the forefathers of East Asian Buddhism today. By focusing on one element (...) in Fa-tsang's thought, this essay attempts to articulate the overall character of Hua-yen thought and, in the process, to shed light on its connection to other dimensions of the Buddhist tradition. -/- In Fa-tsang's monumental Wu-chiao chang (Treatise on the Five Teachings ), the mental image of a house is taken to model the dharmakãya universe as a whole. On Fa-tsang's account, since any one part of the house - his example is a rafter - is a condition for the house as a whole, that one part through its complex relations encompasses the whole house and is therefore able to reveal it comprehensively. What he calls the "one flavor" of the dharmakãya can be fully tasted in any one part. Adopting Fa-tsang's sytematic principle and taking the concept of bodhicitta as the focal point study, this essay attempts to show the "one flavor" of Fa-tsang's Buddhist thought through the treatment he gives to the traditional idea of the "thought of enlightenment.". I MAKE NO APOLOGIES for writing about this well-worn topic. For, although there has been an enormous amount written about the account Hume gives of the nature of moral evaluation, commentators are as far from agreement as ever. My own contribution to the controversy has, if anything, not only added to the variety of opinions but also has increased the general confusion. For this I must accept some responsibility. I have certainly laid myself open to some misinterpretation, and the view (...) I have so far expressed in print may also need some modification. I shall here attempt to clarify what precisely my view now is, and why I prefer it to some alternative views advanced by those who find my interpretation of this aspect of Hume's philosophy unacceptable. II. Since what I want to defend is in all important respects my earlier interpretation of the Treatise, 2 I shall for the most part, though not exclusively, be concerned with what Hume says in this, his early, but major, work. In this essay, the author analyses Berkeley’s conformity and inference argument against Locke’s theory of percep tion. Both arguments are not as decisive as traditionally has been perceived and fail to engage in Locke’s actual position. The main reason for this is that Berkeley does not see that Locke’s position is compatible with the non-inferential nature of perceptual knowledge.
