In this paper the author criticizes the way Robert Alexy reconstructs the relationship between legal and practical reasoning. The core of Alexy's argumentation (Alexy 1978) is considered the claim that legal argumentation is a “special case” of general practical discourse. In order to question this claim, the author analyzes three different types of argument: (1) that legal reasoning is needed by general practical discourse itself, (2) that there are similarities between legal argumentation and general practical discourse, (3) that there is (...) a correspondence between certain types of argument in general practical discourse and in legal argumentation.**. This paper contributes to a theory of rational choice for decision-makers with incomplete preferences due to partial ignorance, whose beliefs are representable as sets of acceptable priors. We focus on the limiting case of `Complete Ignorance' which can be viewed as reduced form of the general case of partial ignorance. Rationality is conceptualized in terms of a `Principle of Preference-Basedness', according to which rational choice should be isomorphic to asserted preference. The main result characterizes axiomatically a new choice-rule called `Simultaneous (...) Expected Utility Maximization'. It can be interpreted as agreement in a bargaining game (Kalai-Smorodinsky solution) whose players correspond to the (extremal) `acceptable priors' among which the decision maker has suspended judgment. An essential but non-standard feature of Simultaneous Expected Utility choices is their dependence on the entire choice set. This is justified by the conception of optimality as compromise rather than as superiority in pairwise comparisons. (shrink)

Ihm liegt die Überzeugung zugrunde, dass Benjamins Rezeptionstheorie nach wie vor den avanciertesten Beitrag im Umkreis einer historisch-dialektischen Kulturtheorie darstellt. Die erste Abhandlung entfaltet nach einem Rückblick auf das Frühwerk die tragenden Kategorien von Benjamins Rezeptionstheorie mit Blick auf das gesamte Spätwerk am Paradigma des Fuchs-Aufsatzes. Eine zweite Studie »Benjamins Bild des Barock« setzt wiederum ein mit einer Schilderung der weitgehend verunglückten Rezeption des Trauerspielbuchs in der Barockforschung. Eine dritte Abhandlung (...) skizziert in prononcierter Symbiose aus Wirkungsgeschichte und Forschungsbericht wichtige Stationen der Nachgeschichte des Benjaminschen Werkes von seinem Tod bis in die Mitte der 1980er Jahre. Die internationale wissenschaftliche Literatur einschließlich der Übersetzungen des Benjaminschen Werkes wird extensiv dokumentiert. (shrink)

WEGE ZUM SINN WAYS TO SENSE. Generally known seems to be the fact that, somehow, sense and value are involved in purposes, aims and temporality. Less known are the details, the concrete forms of such connections. And even less: the thesis of certain philosophers pretending that values produce sense automatically. Yet: What are 'values'? What is 'sense'? How and why does it happen? Subjectively? Objectively? In situations? By means of Being and Nothing? Due to logics? So many questions!

The present article provides a mereological analysis of Euclid’s planar geometry as presented in the first two books of his Elements. As a standard of comparison, a brief survey of the basic concepts of planar geometry formulated in a set-theoretic framework is given in Section 2. Section 3.2, then, develops the theories of incidence and order using a blend of mereology and convex geometry. Section 3.3 explains Euclid’s “megethology”, i.e., his theory of magnitudes. In Euclid’s system of geometry, megethology takes (...) over the role played by the theory of congruence in modern accounts of geometry. Mereology and megethology are connected by Euclid’s Axiom 5: “The whole is greater than the part.” Section 4 compares Euclid’s theory of polygonal area, based on his “Whole-Greater-Than-Part” principle, to the account provided by Hilbert in his Grundlagen der Geometrie. An hypothesis is set forth why modern treatments of geometry abandon Euclid’s Axiom 5. Finally, in Section 5, the adequacy of atomistic mereology as a framework for a formal reconstruction of Euclid’s system of geometry is discussed. (shrink)

In as far as every philosophy appears at a certain point in time it later inevitably becomes a historical fact. If its content is then to be recognizable, if it is to be reclaimed as philosophy in the present, then we ourselves must have a philosophical conception of history and, furthermore, a conception of philosophy's own historicity. Only since Kant has modern metaphysics expressly and methodically developed such a conception within its systematic claim to truth. Moreover, for the presentday philosophy (...) and its relationship to a completed metaphysics such a conception is indispensable - under the presupposition that the history of philosophy is to be taken seriously as philosophy.
