In this engaging study, the authors put casuistry into its historical context, tracing the origin of moral reasoning in antiquity, its peak during the sixteenth and early seventeenth century, and its subsequent fall into disrepute from the mid-seventeenth century.

Business school faculty have begun to increase ethics instruction, but very little has been done to assess the effectiveness of this instruction. Curricula-wide studies present conflicting results of the effect of ethics integration into the business curricula. Several studies suggest that courses like business ethics and business and society might have an effect on the ethical awareness or ethical reasoning of business students. A belief of many individuals interested in business ethics is that students must be exposed to ethical awareness (...) and ethical reasoning in business ethics and business and society-type courses and this should be supplemented by discussions of these topics in various business courses such as Accounting, Finance, Marketing, and others.This study reports the results of integrating a unit of business ethics into eleven accounting classes at two universities. An approach for measuring the effect of ethics integration into accounting and other business courses is suggested, and an assessment is made of the impact of ethics integration on students in accounting classes. Results indicate that the principles on which students rely when making moral decisions were affected by ethics integration. After ethics integration, students relied more heavily on the disclosure rule, the golden rule, and the professional ethic. (shrink)

The responsible corporate officer doctrine is, as a formal matter, an instance of strict criminal liability: the government need not prove the defendant’s mens rea in order to obtain a conviction, and the defendant may not escape conviction by proving lack of mens rea. Formal strict liability is sometimes consistent with retributive principles, especially when the strict liability pertains to the grading of an offense. But is strict liability consistent with retributive principles when it pertains, not to grading, but to (...) whether the defendant has crossed the threshold from noncriminal to criminal conduct? In this essay, I review the two most plausible arguments supporting an affirmative answer in the context of the RCO doctrine. First, perhaps this doctrine reflects a rule-like form of negligence, akin to a rule that prohibits selling alcohol to a minor. Second, perhaps this doctrine expresses a duty to use extraordinary care to prevent a harm. Neither argument is persuasive. The first argument, although valid in some circumstances, fails to explain and justify the RCO doctrine. The second argument, a duty to use extraordinary care, is also inadequate. If “extraordinary care” simply means a flexibly applied negligence standard that considers the burdens and benefits of taking a precaution, it is problematic in premising criminal liability on ordinary negligence. If instead it refers to a higher duty or standard of care, it has many possible forms, such as requiring only a very slight deviation from a permissible or justifiable standard of conduct, placing a “thumb” on the scale of the Learned Hand test, identifying an epistemic standard more demanding than a reasonable person test, or recognizing a standard that is insensitive to individual capacities. However, some of these variations present a gratuitous or incoherent understanding of “negligence,” and none of them sufficiently explain and justify the RCO doctrine. (shrink)

Max Scheler seems to present two distinct approaches to philosophy of culture. In the early period of his Formalismus in der Ethik und die materiale Wertethik and “Ordo Amoris,” he describes cultures as being defined by their distinct order of value preferencings. In his later period of his “Probleme einer Soziologie des Wissens,” however, Scheler explains the dynamics of culture in terms of the interaction of what he calls “real” and “ideal sociological factors,” rooted in various drives and spirit, respectively. (...) These approaches are fully compatible and complementary, the former describing culture’s vertical structure and the latter, its horizontal structure. Together these two approaches offer a comprehensive philosophy of culture, deserving greater attention. (shrink)

The opening of the archives for the pontificate of Pius XII makes it possible to see the history of the drafting of the encyclical _Humani generis_, the first document in which the universal magisterium of the Catholic Church addressed the question of evolution. Although its acknowledgment that the question of the evolutionary origin of the human body was, provisionally, theologically open generated no controversy at the drafting commission, the definitiveness of its reservations about monophyletic polygenism generated a disagreement resolved only (...) by Pope Pius. An incident in 1955 reinforces these conclusions about the proper interpretation of the encyclical. (shrink)

This narrative symposium examines the relationship of bioethics practice to personal experiences of illness. A call for stories was developed by Tod Chambers, the symposium editor, and editorial staff and was sent to several commonly used bioethics listservs and posted on the Narrative Inquiry in Bioethics website. The call asked authors to relate a personal story of being ill or caring for a person who is ill, and to describe how this affected how they think about bioethical questions and the (...) practice of medicine. Eighteen individuals were invited to submit full stories based on review of their proposals. Twelve stories are published in this symposium, and six supplemental stories are published online only through Project MUSE. Authors explore themes of vulnerability, suffering, communication, voluntariness, cultural barriers, and flaws in local healthcare systems through stories about their own illnesses or about caring for children, partners, parents and grandparents. Commentary articles by Arthur Frank, Bradley Lewis, and Carol Taylor follow the collection of personal narratives. (shrink)

Economist Amartya Sen’s and philosopher Martha Nussbaum’s capabilities approach to economic development enjoys global attention, and there has been considerable interest in connections between it and pragmatism. 1 This paper argues, first, that there are indeed strong, productive affinities between Sen’s and Nussbaum’s understanding of ‘capabilities’ in rethinking how economies are to be developed and measured, on the one hand, and John Dewey’s notion of ‘growth’ and applications of pragmatism to economics, by economists such as Thorstein Veblen, John Commons, and, (...) more recently, Daniel Bromley, to rethink and to reconstruct their discipline, on the other. Second, the paper suggests that Dewey’s notion of ‘growth’ can do much to strengthen and to deepen Sen’s and Nussbaum’s “capabilities approaches” to economics. Third, it suggests that Dewey enriches notions of ‘science’ and ‘democracy’, which are largely underdeveloped in capabilities approaches. (shrink)

In accepting the invitation of your society to discuss some aspects of the philosophy of science, particularly as they might bear on the problems of an experimental psychologist, I should like from the start to make it very clear that I do not consider myself a philosopher, not even an amateur one. Like most empirical scientists, particularly of the laboratory variety, I usually take it for granted that my world is real and that the things I perceive as existing in (...) it can be investigated by my empirical methods. I seem to get along quite well with this unpremeditated, common-sense realism, and, for the most part, I go along minding my own experimental business. As the psychologists among you may know, however, every once in a while I seem to have to abandon this happy, naive state and let myself get involved in questions about my science, the kinds of questions that are more properly the business of the philosopher of science. This chapter discusses the problematic reception of Pragmatism in Europe, especially Germany, in the early twentieth century. It examines the important role played by American Pragmatism, especially Charles Sanders Peirce and William James, in the development of the sociology of knowledge and reflects on what lessons one might learn from such an historical investigation for social constructivist thought today. It looks into Max Scheler's complex reaction to the works of Peirce and James as their versions of Pragmatism relate to Scheler's (...) own sociology of knowledge. The chapter discusses some of the reasons German scholars have been slow to engage Dewey's ideas, and demonstrates some of the ways in which problems of translation still affect international studies in Pragmatism. While the idea of worker-owned cooperatives is centuries-old, the network of over 300 such enterprises in the Basque region of Spain and founded upon Catholic social justice teachings, is the most successful and impressive in history. The central claim of this paper is that the worker-owned, Mondragon cooperatives demonstrate not only how economic institutions can be structured so as to promote the common good but also how participation in them can engender a concern for the common good among individual participants (...) in those institutions, which spills over into their broader participation as citizens in the larger community. The paper advances this thesis by, first, providing a brief history of the Mondragon cooperatives, from their founding in the 1950s by Father Jose Arizmendiarrieta, the parish priest in the village of Mondragon, trained in economics. Second, it outlines the central principles of Catholic social justice teachings regarding economy that form the foundation for the Mondragon cooperatives and how those teachings have been institutionalized in the cooperatives’ democratic managerial practices and their creative financial structures. While Father Arizmendiarrieta drew mainly from Pope Leo XIII’s Rerum Novarum, this paper shows how Mondragon’s policies and practices are also in keeping with later Church teachings, as put forward especially by Popes John Paul II, Benedict XVI, and Francis I. Third, the paper contrasts the understanding of the common good in Catholic social teachings and the Mondragon cooperatives, on the one hand, to the notion of the common good found in mainstream classical and neoclassical economics. The latter sees society as merely the sum of its individual members and hence the common good as but the sum of individual goods, or aggregate utility. The former, by contrast, sees society as a living organism, the whole of which is greater than the sum of its parts, and hence it understands the common good as greater than the sum of individual goods, but also including the organic relationships among individuals. Fourth, the paper describes how participation in the cooperatives engenders, cultivates, and deepens worker-members’ sense and understanding of the common good and their commitment to it. (shrink)

from my first courses as an undergraduate in African American studies, I have been concerned about the dynamics by which white and Black1 people discuss race. For one, I was troubled in my undergraduate African American studies courses by the ease with which white students would insert themselves into conversations where, it seemed to me, they simply did not belong, for example, conversations concerning visions for the future of the Black community and strategies for achieving such visions.
