In this Matters Arising article, we outline how the recent article “The impact on patients of objections by institutions to assisted dying: a qualitative study of family caregivers’ perceptions” (White et al., 2023 Mar 13;24(1):22) informed Voluntary Assisted Dying (VAD) implementation in our large Australian public health setting, where objections do not emanate from, but within, the institution. In reporting the harms to patients and caregivers created by institutional objection, White et al. provide an evidenced-based road map for (...) potential potholes or risks associated with VAD implementation. We discuss the complexities emerging from the diverse views of health professionals and the ethical tensions arising from such, especially within certain specialties, and how we developed systemic strategies that support patients, caregivers and staff alike. We highlighted the need to shift from “Do you support VAD?“ to “How can we support you as healthcare professionals to integrate VAD into your practice, in a way that complies with the legislation, meets the needs of patients and caregivers, and feels safe and does not compromise your moral stance?“. In a recent article, Ethan Bradley and Mark Navin (2021) argue that vaccine refusal is not akin to free riding. Here, I defend one connection between vaccine refusal and free riding and suggest that, when viewed in conjunction with their other arguments, this might constitute a reason to mandate Covid-19 vaccination.

At this stage of the COVID-19 pandemic, two policy aims are imperative: avoiding the need for a general lockdown of the population, with all its economic, social and health costs, and preventing the healthcare system from being overwhelmed by the unchecked spread of infection. Achieving these two aims requires the consideration of unpalatable measures. Julian Savulescu and James Cameron argue that mandatory isolation of the elderly is justified under these circumstances, as they are at increased risk of becoming severely ill (...) from COVID-19, and are thus likely to put disproportionate strain on limited healthcare resources. However, their arguments for this strategy are contingent on the lack of viable alternatives. We suggest that there is a possible alternative: a mandatory, centralised contact-tracing app. We argue that this strategy is ethically preferable to the selective isolation of the elderly, because it does not target members of a certain group, relying instead on the movements of each individual, and because it avoids the extended isolation of certain members of the society. Although this type of contact-tracing app has its drawbacks, we contend that this measure warrants serious consideration. (shrink)

Supererogation has gained attention as a means of explaining the voluntary behaviours of individuals and organizations that are done for the benefit of others and which go above what is required of legislation and what may be expected by society. Whilst the emerging literature has made some significant headway in exploring supererogation as an ethical lens for the study of business there remain several important issues that require attention. These comprise, the lack of primary evidence upon which such examinations have (...) been made, attention has been given to only singular pro-social acts of organizations, and the focus has been upon the actions of large organizations. Furthermore, Heyd’s (Supererogation, Cambridge University Press, 1982) original taxonomy of six supererogatory acts, comprising Moral Heroism, Beneficence, Volunteering, Favour, Forgiveness and Forbearance, has been considered to be complete and other forms of supererogatory acts have not yet been explored. In order to address these gaps this study poses the research questions: First, it studies how a single, contemporary SME performs multiple supererogatory acts in its attempts to address its social and environmental goals that go beyond CSR. Second, it seeks to gain a deeper theoretical understanding of Heyd’s (Supererogation, Cambridge University Press, 1982) taxonomy of six forms of supererogation through the capture of primary data. This research makes a three-year case study examination of a single SME that has been formally recognized for its work in addressing social and environmental issues at local, national and global levels. Primary data are acquired of the supererogatory acts that it performs through a three-year participant observation case study, utilizing 61 interviews and 3 focus groups with internal and external stakeholders. In doing so, it addresses the empirical limitations of the extant research, substantiates each of the forms that supererogatory acts may take, and makes a contribution to the theory of supererogation by identifying a further class of act that is ‘Sharing’. In this paper I take issue with Rainer Forst's claim that his account of the demand for justification that is at the core of the idea of justice provides our political thinking with a final “fundamentum inconcussum”.

This article is a reply to Marsha Enright's essay “The Problem with Selfishness.” Enright argues that “selfishness” is not the correct designation for living according to the Objectivist ethics. This article defends Rand's use of “selfishness,” on three grounds. First, the self is central to Rand's ethics, because a person must value his self before he can value anything or anyone. Second, immoral people are selfless, because organisms that function at the perceptual level of awareness do not have a self. (...) Third, Rand has identified the exact meaning of “selfishness,” whether or not her definition accords with dictionary definitions. (shrink)

Michel Foucault's Les Mots et les choses correctly asserts that the attempts of the human sciences of the past five hundred years to represent the world in language have failed because these sciences did not recognize the opacity or thingness of language itself. Foucault pretends to have written a plotless anti-history of the human sciences which stresses the discontinuities that characterize the succession of one "'episteme" by another. In fact, he has explained these vicissitudes by the changes of tropological strategy (...) that underlie epistemic shifts. Although he disavows the movement, Foucault's interest in revealing the poetic basis of all linguistic representations of reality places him in the eschatological wing of the structuralist establishment. Leandra Medine indicates that she wants the Man Repeller multi-author blog to ‘serve as an open forum for women to draw their own conclusions’ instead of making ‘any sort of feministic statement’. Medine renders feminism as amorphous and an individual choice but she has been widely lauded for offering a feminist engagement in fashion. Her practices and position, as I argue throughout this article, allow her to fashion feminism, including associating feminism with the man repeller style and replacing aspects of (...) second wave and rights-based feminisms with the purportedly more equitable and liberating website ethos of choice and equality feminism. Yet in replacing ‘feministic’ critiques with promises of stylish cultural change and clothing that reportedly repels men, Medine and other Man Repeller authors elide how systemic oppression functions. This ambivalent relationship to feminism, and dearth of intersectional advocacy, prompted a backlash in 2020. Critics interrogated Medine's facile statement about #BlackLivesMatter, the company's lack of diversity and the unsuccessful restructuring of the blog. As a means of analysing Man Repeller, I employ textual analysis, feminist and queer literature and media theory. I define fashioning feminism as a collaborative and ongoing process of producing feminist positions and thinking, including the negation of certain forms of feminism. I assert that attending to the fashioning of feminism can foreground central and developing feminist theories; the appeal, unstylishness and effacement of feminism; and the connection between style and politics. This includes readers’ interrogations of Man Repeller's politics, which are occurring along with contemporary examinations of racism. Since fashioning feminism is a collaborative and ongoing process of producing feminist positions and thought, engaging with its concepts and debates can further the critical study of feminism, nurture feminist conversations and advocate for social change. The structural-systematic philosophy requires a moral theory. This essay seeks to determine whether either of two recent works, Joshua Greene’s Moral Tribes and Michael Tomasello’s A Natural History of Human Morality, should influence that theory. It first argues that Greene’s fails to make its case for utilitarianism over deontology. It then argues that Tomasello’s thesis that early humans developed moralities of sympathy and fairness, particularly when taken in conjunction with aspects of Alan Gewirth’s moral theory, fits well with the moral (...) theory envisaged by extant works on the structural-systematic philosophy. In physics, the temporal dimension has units of infinitesimally brief duration. Given this, how is it possible to perceive things, such as motion, music, and vibrotactile stimulation, that involve extension across many units of time? To address this problem, it is proposed that there is what is termed an “information construct of happening” (ICOH), a simultaneous representation of recent, temporally differentiated perceptual information on the millisecond time scale. The main features of the ICOH are (i) time marking, semantic labeling of (...) all information in the ICOH with ordinal temporal information and distance from what is informationally identified as the present moment, (ii) vector informational features that specify kind, direction, and rate of change for every feature in a percept, and (iii) connectives, information relating vector informational features at adjacent temporal locations in the ICOH. The ICOH integrates products of perceptual processing with recent historical information in sensory memory on the subsecond time scale. Perceptual information about happening in informational sensory memory is encoded in semantic form that preserves connected semantic trails of vector and timing information. The basic properties of the ICOH must be supported by a general and widespread timing mechanism that generates ordinal and interval timing information and it is suggested that state‐dependent networks may suffice for that purpose. Happening, therefore, is perceived at a moment and is constituted by an information structure of connected recent historical information. (shrink)

Alan Gewirth’s work on moral and political philosophy attracted a great deal of attention between 1978 and 2000, but has received very little attention since then. This essay aims to revive interest in Gewirth’s work by providing a more direct and straightforward version of his core argument for objective moral rights and duties and clarifying how a Gewirthian moral and political theory can proceed beyond the conclusion of the core argument.

The freedom to create and disseminate pornography has often been defended based on a liberal claim that the free speech of pornographers would be violated if pornography were censored. The classic defense of free speech, given by John Stuart Mill, is often invoked to defend this position. In opposition, many feminist theorists have advocated arguments for regulatory measures against pornography. Some of these authors have also utilized the writings of Mill. They have argued that, contrary to the liberal defense of (...) free speech, Mill’s arguments are compatible with, or even require, the forced regulation of pornography. Logically, unless Mill’s writings are contradictory, they should not be invoked to support diametrically opposed positions. This paper investigates this apparent dilemma and argues that, contrary to the antipornography feminist position, Mill’s writings do not support pornography regulation. In fact, in a surprising twist, the arguments of anti-pornography feminists can, using the writings of Mill, be seen as strongly supporting the liberal anti-censorship position. (shrink)

In this paper there are two claims that I wish to defend. One is that in Socrates’ much discussed “causal” theory concrete particulars are more central than Forms. The other is that these concrete particulars are held by Plato to be not simply bundles of characteristics, not mere meeting-points of Forms, but independent individuals, existing in their own right.It will not, I believe, be questioned that from one point of view the prime concern of the Phaedo is with concrete particulars; (...) not with Forms, characteristics, or anything else. For, the overriding aim of the dialogue is, surely, to persuade us each to care for his own soul; it is for this reason that arguments are put forward to show that souls are indestructible. But there is no doubt that these souls are particulars. (shrink)

We examine a series of disputations which Luther participated in towards the end of his career: we argue that these disputations show that Luther was very familiar with the tools of medieval formal logic, and continued to make positive theological use of them until the end of his life.

This paper defends certain of Andrew Davis’s arguments on assessment from critique by John Gingell and Christopher Winch. It emphasises the role of personal acquaintance in assessing ‘rich’ understanding, criticises Antony Flew’s claim that assessment is a necessary part of teaching, and rejects the argument that public assessment is necessary for purposes of accountability. It also suggests that parents’ monitoring of their young children’s progress could act as a yardstick, suitably modified, for what might be done in formal education. In On the Origin of Species, Charles Darwin put forward his theory of natural selection. Conventionally, Darwin's argument for this theory has been understood as based on an analogy with artificial selection. But there has been no consensus on how, exactly, this analogical argument is supposed to work – and some suspicion too that analogical arguments on the whole are embarrassingly weak. Drawing on new insights into the history of analogical argumentation from the ancient Greeks onward, as well as on (...) in-depth studies of Darwin's public and private writings, this book offers an original perspective on Darwin's argument, restoring to view the intellectual traditions which Darwin took for granted in arguing as he did. From this perspective come new appreciations not only of Darwin's argument but of the metaphors based on it, the range of wider traditions the argument touched upon, and its legacies for science after the Origin. Of course you know the movie, just by cultural assimilation if not by having seen it. There’s this young elephant, Dumbo, who has laughably big ears and has been pitiably separated from his mom. He’s aided by a friendly talking mouse2 into translating those otherwise hapless ears into the power of flight, which he eventually uses to rescue his mom and live happily ever after. The way the wily mouse gets Dumbo to believe that he could fly is to give (...) him a “magic feather” which, held in his trunk, demonstrably imparts the gift of flight. Naturally the mouse believes throughout all this that Dumbo can fly anyway, but he also knows that Dumbo needs the feather as a confidence-builder to do so. At the critical juncture of the tale Dumbo loses the feather after being pushed off a precipice, and he thus plummets perilously towards earth—only to find at the last moment that he can indeed fly on his own. The correspondence view is consistent with a theory of direct remembering that assumes continuity between perception and memory. Two implications of direct remembering for correspondence are suggested. It is assumed that forgetting is exponential, and that remembering at one time is independent of factors influencing remembering at another. Elaboration of the correspondence view in the same terms as perception offers a novel approach to the study of memory.
