While the fundamental laws of physics are time-reversal invariant, most macroscopic processes are irreversible. Given that the fundamental laws are taken to underpin all other processes, how can the fundamental time-symmetry be reconciled with the asymmetry manifest elsewhere? In statistical mechanics, progress can be made with this question. What I dub the ‘Zwanzig–Zeh–Wallace framework’ can be used to construct the irreversible equations of SM from the underlying microdynamics. Yet this framework uses coarse-graining, a procedure that has faced much criticism. I (...) focus on two objections in the literature: claims that coarse-graining makes time-asymmetry ‘illusory’ and ‘anthropocentric’. I argue that these objections arise from an unsatisfactory justification of coarse-graining prevalent in the literature, rather than from coarse-graining itself. This justification relies on the idea of measurement imprecision. By considering the role that abstraction and autonomy play, I provide an alternative justification and offer replies to the illusory and anthropocentric objections. Recently in environmental ethics some theorists have advocated narrative accounts of value, according to which the value of environmental goods is given by the role that they play in our narratives. I first sketch the basic theoretical features of a narrative accounts of value and then go on to raise some problems for such views. I claim that they require an evaluative standard in order to distinguish the valuable from the merely valued and that the project of constructing such a (...) standard faces significant problems. I conclude by questioning whether narrative accounts of value really offer advantages over other pluralistic and context-sensitive accounts of value. (shrink)

This article takes a speculative and design fiction approach to the critical analysis of the role of smart and autonomous vehicles (AVs) in the context of smart cities. The article explores arguments that these cars of the future will have decisive impacts on mobility, sustainability and road safety. The article examines the main parameters of smart city and smart car developments and then focuses on the visions of increasing AI-driven autonomy. The article demonstrates how these debates are linked to speculative (...) design as full autonomy does not currently exist but takes a speculative position as to what the critical issues are that face smart/autonomous city visions (enhanced surveillance and data mining) and considers the potentially hazardous ethical dilemmas that AVs may encounter once fully rolled out onto city roads. From a design fiction perspective, the article envisions the viability of AV prioritizing public rather than private transport as a means by which the ‘techno-utopic’ visions of smart city/AV integration can be realized and make positive impacts to enhance urban living in rendering future cities as more sustainable, efficiently mobile and safer urban spaces. Not only does this book represent the canon of Cannon's best work; the book itself directly addresses the issues of canon formation and canon reformation. Cannon canonizes a literary tradition and directly addresses both oppression and liberation of African American women. Now in an expanded 25th-anniversary edition, Katie's Canon still packs firepower.

In this paper we consider persuasion in the context of practical reasoning, and discuss the problems associated with construing reasoning about actions in a manner similar to reasoning about beliefs. We propose a perspective on practical reasoning as presumptive justification of a course of action, along with critical questions of this justification, building on the account of Walton. From this perspective, we articulate an interaction protocol, which we call PARMA, for dialogues over proposed actions based on this theory. We outline (...) an axiomatic semantics for the PARMA Protocol, and discuss two implementations which use this protocol to mediate a discussion between humans. We then show how our proposal can be made computational within the framework of agents based on the Belief-Desire-Intention model, and illustrate this proposal with an example debate within a multi agent system. Internet protocol development is a social process, and resulting protocols are shaped by their developers’ politics and values. This article argues that the work of protocol development poses barriers to developers’ reflection upon values and politics in protocol design. A participant observation of a team developing internet protocols revealed that difficulties defining the stakeholders in an infrastructure and tensions between local and global viewpoints both complicated values reflection. Further, Internet architects tended to equate a core value of interoperability with values (...) neutrality. The article describes how particular work practices within infrastructure development overcame these challenges by engaging developers in praxis: situated, lived experience of the social nature of technology. Richard Rudner famously argues that the communication of scientific advice to policy makers involves ethical value judgments. His argument has, however, been rightly criticized. This article revives Rudner’s conclusion, by strengthening both his lines of argument: we generalize his initial assumption regarding the form in which scientists must communicate their results and complete his ‘backup’ argument by appealing to the difference between private and public decisions. Our conclusion that science advisors must, for deep-seated pragmatic reasons, make value judgments is further (...) bolstered by reflections on how the scientific contribution to policy is far less straightforward than the Rudner-style model suggests. Background: Exploring the concept of ethical competence in the context of healthcare is essential as it pertains to better quality of care. The concept still lacks a comprehensive definition covering the aspects of ethical expertise, ethical knowledge and action of a health professional. Objective: This article aims to report an analysis of the concept of ethical competence. Method: A modified strategy suggested by Walker and Avant was used to analyse the concept. Results: As a result, the concept of ethical competence (...) can be defined in terms of character strength, ethical awareness, moral judgement skills and willingness to do good. Virtuous professional, experience of a professional, human communication, ethical knowledge and supporting surroundings in the organisation can be seen as prerequisites for ethical competence. Ethical competence results in the best possible solutions for the patient, reduced moral distress at work and development and democratisation of society. Conclusion: The results of the analysis establish a basis for an instrument to evaluate health professionals’ ethical competence. It will guide educators, as well as managers in healthcare, to support the development of ethical conduct in healthcare. (shrink)

In this paper, we present a particular role for abductive reasoning in law by applying it in the context of an argumentation scheme for practical reasoning. We present a particular scheme, based on an established scheme for practical reasoning, that can be used to reason abductively about how an agent might have acted to reach a particular scenario, and the motivations for doing so. Plausibility here depends on a satisfactory explanation of why this particular agent followed these motivations in the (...) particular situation. The scheme is given a formal grounding in terms of action-based alternating transition systems and we illustrate the approach with a running legal example. Forms characteristic of the earth itself are inherent in the design of man. Man's being emerged out of a cosmic matrix whose morphic aspects man himself expresses. These forms and their functional interrelationships are the very conditions of consciousness. This paper proposes that the relationship between human consciousness and its complete environment should be the subject matter of an emerging discipline, the ecology of consciousness. Constructs useful in the ecology of plants and animals should be coordinated to psychological constructs. These (...) coordinating constructs should be based upon study of the most pervasive morphic regularities at the biophysical level. An analysis of the design of man suggests many possibilities, especially when one considers the known neurophysiological and biochemical conditioners of consciousness. Educational (experiential) strategies for the transformation of consciousness should also be explored. These might include the manipulation of variables such as volume, duration, and intensity of sensory stimulation, including various combinations of modalities. A systematic effort should be made to state the fundamental problems to which a scientific ecology of consciousness might address itself. New methods must be devised. A preliminary program for an ecology of consciousness is proposed. (shrink)

Nathaniel J.P. Barron offers the first book length account in English of Ernst Bloch's contribution to a Marxist philosophy of language. It is ambitious both in situating Bloch's ideas in the broader Marxist engagement with language as it currently exists, and in using Bloch's utopian categories to challenge that engagement. In particular, Barron reads Voloshinov's insights into language through Bloch's categories, and argues that Bloch advances on Voloshinov by offering an understanding of the social materiality of language which (...) is more useful for challenging fascist forms of utterance. Objectives: To explore opinions and attitudes regarding the current information-giving practices in research involving adults with intellectual disabilities.Design: Qualitative focus group study with a purposive sample.Setting: An intellectual disabilities service within the NHSParticipants: A sample of 26 individuals including adults with mild intellectual disability, carers, clinicians, care managers and the charitable sector.Results: Three main themes were identified: process, format, and content. There was agreement that there is a need for improvement in the process and quality of information giving. With regard (...) to the content of information, there was little discrepancy between the study findings and existing guidance.Conclusions: Information should be presented in different formats and prepared with input from appropriate professions. Doug Walton, who died in January 2020, was a prolific author whose work in informal logic and argumentation had a profound influence on Artificial Intelligence, including Artificial Intelligence and Law. He was also very interested in interdisciplinary work, and a frequent and generous collaborator. In this paper seven leading researchers in AI and Law, all past programme chairs of the International Conference on AI and Law who have worked with him, describe his influence on their work.

The technical details of Internet architecture affect social debates about privacy and autonomy, intellectual property, cybersecurity, and the basic performance and reliability of Internet services. This paper explores one method for practicing anticipatory ethics in order to understand how a new infrastructure for the Internet might impact these social debates. This paper systematically examines values expressed by an Internet architecture engineering team—the Named Data Networking project—based on data gathered from publications and internal documents. Networking engineers making technical choices also weigh (...) non-technical values when working on Internet infrastructure. Analysis of the team’s documents reveals both values invoked in response to technical constraints and possibilities, such as efficiency and dynamism, as well as values, including privacy, security and anonymity, which stem from a concern for personal liberties. More peripheral communitarian values espoused by the engineers include democratization and trust. The paper considers the contextual and social origins of these values, and then uses them as a method of practicing anticipatory ethics: considering the impact such priorities may have on a future Internet. This collection examines the life and thought of Agnes Heller, who rose to international acclaim as a Marxist dissident in Eastern Europe.

This study identified and described ethical problems encountered by physiotherapists in their practice and physiotherapists’ moral sensitivity in ethical situations. A questionnaire-based survey was constructed to identify ethical problems, and the Moral Sensitivity Questionnaire Revised version was used to measure moral sensitivity. Physiotherapists (n = 116) working in public health services responded to the questionnaire. Based on the results, most of the physiotherapists encounter ethical problems weekly. They concern mainly financial considerations, equality and justice, professionalism, unethical conduct of physiotherapists or (...) other professions and patients’ self-determination. The dimension of moral strength was emphasised in physiotherapists’ self-evaluations of their moral sensitivity. As a conclusion, ethical problems do occur not only at individual level but also at organisational and society level. Physiotherapists seem to have moral strength for speaking on behalf of the patient. Scarce resources make them feel insufficient but much could still be done to provide quality care in co-operation with other health-care professionals. (shrink)

IN examining Herodotos' account of the Samian tyranny, historians have long been disturbed by two considerations. First, it seems strange that the period of settled tyranny should have begun no earlier than the rise of Polykrates and his two brothers c. 533 B.C., even though Samos was among the most advanced cities in Ionia. Yet it seems equally impossible to revise this accession date in an upward direction, at least by any significant margin. Furthermore, there had been at work in (...) Samos from c. 600 or earlier many of the factors which elsewhere in Ionia did in fact lead to a comparatively stable period of tyranny at that date, for instance at Miletos and Ephesos. Secondly, though Herodotos knows of no tyrant before Polykrates, it has been observed that the policies ascribed to him as characteristic were very largely the continuation of policies initiated a generation or more previously. This paper considers a key point of contention between classical and Bayesian statistics that is brought to the fore when examining so-called ‘persistent experimenters’—the issue of stopping rules, or more accurately, outcome spaces, and their influence on statistical analysis. First, a working definition of classical and Bayesian statistical tests is given, which makes clear that (1) once an experimental outcome is recorded, other possible outcomes matter only for classical inference, and (2) full outcome spaces are nevertheless relevant to both the (...) classical and Bayesian approaches, when it comes to planning/choosing a test. The latter point is shown to have important repercussions. Here we argue that it undermines what Bayesians may admit to be a compelling argument against their approach—the Bayesian indifference to persistent experimenters and their optional stopping rules. We acknowledge the prima facie appeal of the pro-classical ‘optional stopping intuition’, even for those who ordinarily have Bayesian sympathies. The final section of the paper, however, provides three error theories that may assist a Bayesian in explaining away the apparent anomaly in their reasoning. (shrink)

Theories of emotion have often maintained artificial boundaries: for instance, that cognition and emotion are separable, and that an emotion concept is separable from the emotional events that comprise its category (e.g. “fear” is distinct from instances of fear). Over the past several years, research has dissolved these artificial boundaries, suggesting instead that conceptual construction is a domain-general process—a process by which the brain makes meaning of the world. The brain constructs emotion concepts, but also cognitions and perceptions, all in (...) the service of guiding action. In this view, concepts are multimodal constructions, dynamically prepared from a set of highly variable instances. This approach obviates old questions (e.g. how does cognition regulate emotion?) but generates new ones (e.g. how does a brain learn emotion concepts?). In this paper, we review this constructionist, predictive coding account of emotion, considering its implications for health and well-being, culture and development. (shrink)

In what sense are the special sciences autonomous of fundamental physics? Autonomy is an enduring theme in discussions of the relationship between the special sciences and fundamental physics or, more generally, between higher and lower-level facts. Discussion of ‘autonomy’ often fails to recognise that autonomy admits of degrees; consequently, autonomy is either taken to require full independence, or risk relegation to mere apparent autonomy. In addition, the definition of autonomy used by Fodor, the most famous proponent of the autonomy of (...) the special sciences, has been robustly criticised by Loewer. In this paper I develop a new account of autonomy following Woodward which I dub ‘generalised autonomy’ since it unifies dynamical, causal and nomic autonomy. Autonomy, on this account, can be partial: some lower-level details matter while others do not. To summarise: whilst the detailed lower level is unconditionally relevant, conditionalising on the higher-level facts renders some lower-level details irrelevant. The macrodependencies that the higher-level facts enter into — be they dynamical, causal or nomic — screen off the underlying microdetails. This account helps resolve an explanatory puzzle: if the lower-level facts in some way underpin the higher-level facts, why don’t the lower-level details matter more for the day-to-day practice of the special sciences? The answer will be: the facts uncovered by the special sciences are autonomous in my sense, and so practitioners of these special sciences need not study more fundamental sciences, since these underlying facts are genuinely irrelevant. On the 24th June 2015, Feminist Legal Studies and the London School of Economics Law Department hosted an afternoon event with Professor Wendy Brown, Class of 1936 First Professor of Political Science, University of California. Professor Brown kindly agreed to discuss her scholarship on feminist theory, and its relationship to both the law and neoliberalism. The event included an interview by Dr Katie Cruz and a Q&A session, which are presented here in an edited version of the transcript. Sumi (...) Madhock, Professor of Gender Studies, LSE chaired the interview and discussion and introduced Professor Brown’s work. Katie Cruz asked Wendy Brown to reflect upon topics that span her scholarship and activism, including the state of critical, feminist, and Left approaches to rights, neoliberalism, despair and utopianism, and the future of feminist theory and practice in the context of neoliberalism and current debates about intersectionality. Participants in the discussion asked questions on a wide range of issues, including the limits of feminist engagement with law as a tool for social change, the dominance of neoliberalism, imperialist feminism, Islamophobia, secularism, and our attachment to the figure of homo politicus. Privacy is a critical challenge for corporate social responsibility in the mobile device ecosystem. Mobile application firms can collect granular and largely unregulated data about their consumers, and must make ethical decisions about how and whether to collect, store, and share these data. This paper conducts a discourse analysis of mobile application developer forums to discover when and how privacy conversations, as a representative of larger ethical debates, arise during development. It finds that online forums can be useful spaces for (...) ethical deliberations, as developers use these spaces to define, discuss, and justify their values. It also discovers that ethical discussions in mobile development are prompted by work practices which vary considerably between iOS and Android, today’s two major mobile platforms. For educators, regulators, and managers interested in encouraging more ethical discussion and deliberation in mobile development, these work practices provide a valuable point of entry. But while the triggers for privacy conversations are quite different between platforms, ultimately the justifications for privacy are similar. Developers for both platforms use moral and cautionary tales, moral evaluation, and instrumental and technical rationalization to justify and legitimize privacy as a value in mobile development. Understanding these three forms of justification for privacy is useful to educators, regulators, and managers who wish to promote ethical practices in mobile development. (shrink)

In this paper, we develop a novel response to counterfactual scepticism, the thesis that most ordinary counterfactual claims are false. In the process we aim to shed light on the relationship between debates in the philosophy of science and debates concerning the semantics and pragmatics of counterfactuals. We argue that science is concerned with many domains of inquiry, each with its own characteristic entities and regularities; moreover, statements of scientific law often include an implicit ceteris paribus clause that restricts the (...) scope of the associated regularity to circumstances that are ‘fitting’ to the domain in question. This observation reveals a way of responding to scepticism while, at the same time, doing justice both to the role of counterfactuals in science and to the complexities inherent in ordinary counterfactual discourse and reasoning. In this paper we describe the impact that Walton’s conception of argumentation schemes had on AI and Law research. We will discuss developments in argumentation in AI and Law before Walton’s schemes became known in that community, and the issues that were current in that work. We will then show how Walton’s schemes provided a means of addressing all of those issues, and so supplied a unifying perspective from which to view argumentation in AI and Law.

The search for the statistical mechanical underpinning of thermodynamic irreversibility has so far focussed on the spontaneous approach to equilibrium. But this is the search for the underpinning of what Brown and Uffink have dubbed the ‘minus first law’ of thermodynamics. In contrast, the second law tells us that certain interventions on equilibrium states render the initial state ‘irrecoverable’. In this article, I discuss the unusual nature of processes in thermodynamics, and the type of irreversibility that the second law embodies. (...) I then search for the microscopic underpinning or statistical mechanical ‘reductive basis’ of the second law of thermodynamics by taking a functionalist strategy. First, I outline the functional role of the thermodynamic entropy: for a thermally isolated system, the thermodynamic entropy is constant in quasi-static processes, but increasing in non-quasi-static processes. I then search for the statistical mechanical quantity that plays this role—rather than the role of the traditional ‘holy grail’ as described by Callender. I argue that in statistical mechanics, the Gibbs entropy plays this role. (shrink)

The rapid recent expansion of copyright law worldwide has sparked efforts to defend the ‘public domain’ of non-propertized information, often on the ground that an expansive public domain is a condition of a ‘free culture’. Yet questions remain about why the public domain is worth defending, what exactly a free culture is, and what role (if any) authors’ rights might play in relation to it. From the standard liberal perspective shared by many critics of copyright expansionism, the protection of individual (...) expression by means of marketable property rights in authors’ works serves as an engine of progress towards a fully competitive ‘marketplace of ideas’ – though only if balanced by an extensive public domain from which users may draw in the exercise of their own expressivity. This article shows that a significantly different, and arguably richer, conception of what a free culture is and how authors’ rights underpin it emerges from a direct engagement with the philosophy of Immanuel Kant. For Kant, progress towards a fully emancipated (i.e. a ‘mature’ or ‘enlightened’) culture can only be achieved through the critical intellectual activity that public communication demands: individual expressive freedom is only a condition, not constitutive, of this ‘freedom to make public use of one’s reason in all matters’. The main thesis defended in this article is that when Kant’s writings on publicity (critical public debate) are read in relation to his writings on the legal organization of publishing, a necessary connection emerges between authors’ rights – as distinct from copyrights – and what Jürgen Habermas and others have named the public sphere. I conclude that it is the public sphere, and not the public domain as such, that should serve as the key reference point in any evaluation of copyright law’s role in relation to the possibility of a free culture. The second International Knowledge and Discourse Conference, held at the University of Hong Kong in June 2002, was the forum for the long-awaited debate between Bruno Latour and Steve Fuller. Bruno Latour counts beyond two. He places the blame for the emphasis in academia on the subject-object distinction on Kant. Latour wants academics to acknowledge that things act, and suggests we look at other traditions, e.g. the Chinese, for alternatives to the subject-object dichotomy. Steve Fuller concentrated on the moral project (...) of science, which is to draw a distinction between the human and the non-human and, to highlight the fact that, as the culmination of the sciences, social science has a particular responsibility to make this distinction. He accused Bruno Latour of evading the moral issue. The debate can be read as a reiteration of the postions of Bruno Latour and Steve Fuller on the question of heterogeneity at the theoretical level, but it did not address the topic at the practical or research level. In this paper we describe an approach to practical reasoning, reasoning about what it is best for a particular agent to do in a given situation, based on presumptive justifications of action through the instantiation of an argument scheme, which is then subject to examination through a series of critical questions. We identify three particular aspects of practical reasoning which distinguish it from theoretical reasoning. We next provide an argument scheme and an associated set of critical questions which is able (...) to capture these features. In order that both the argument scheme and the critical questions can be given precise interpretations we use the semantic structure of an Action-Based Alternating Transition System as the basis for their definition. We then work through a detailed example to show how this approach to practical reasoning can be applied to a problem solving situation, and briefly describe some other previous applications of the general approach. In a second example we relate our account to the social laws paradigm for co-ordinating multi-agent systems. The contribution of the paper is to provide firm foundations for an approach to practical reasoning based on presumptive argument in terms of a well-known model for representing the effects of actions of a group of agents.
