Spoofing—placing orders on financial exchanges intending to withdraw them prior to execution—is widely legally prohibited. I argue instead on two main grounds that spoofing should be permitted and legalised. The first is that spoofing as a form of bluffing remains within the market practice of making legally binding offers—as opposed to lying or betraying trust—and primarily concerns the spoofer’s personal information. As a form of bluffing spoofing helps prevent financial speculators, in particular high-frequency algorithmic traders, from easily profiting by other (...) market actors reliably revealing their underlying preferences through their market activity. The second is that at the systemic level permitting spoofing would benefit non-speculative actors who place orders to hedge economic risk and whose activities provide the raison d’être for financial exchanges, differentiating them from simple forums for gambling. I also address potential concerns that legalised spoofing would drive speculators out of financial markets entirely and, therefore, undermine market liquidity. This work contributes to the wider debate in business ethics regarding bluffing by illustrating the acceptability of bluffs which do not betray counterparty trust or reliance on testimony by remaining within the framework of market practices. Farklı boyutlarıyla bütün bu tartışmalar özerklik-özgürlük, insanlık onuru ve kendilik bilinci açısından çocuk-ebeveyn ilişkisinin doğum öncesi-sonrası fiziksel süreçler, temel eğitim ve (...) aile, ebeveyn konumları açısından yeni bir çalışma yöntemiyle birlikte araştırmacıların gündemini şekillendirmektedir. While interest in the impact of imprisonment on families has been increasing, there is still limited knowledge regarding the social, cultural, and relational aspects of the experiences of families of convicted individuals in the Turkish context. This study examines the experiences of families affected by imprisonment in Ankara. Focusing particularly on the effects of a parent’s incarceration on the family, the research employs a qualitative design, with in-depth semi-structured interviews conducted with 17 spouses of convicted individuals. The findings reveal that (...) families of convicted individuals face significant psychosocial and economic challenges, experience hardships throughout the incarceration process, and receive insufficient social support during this period. The study highlights that women, in particular, endure greater difficulties due to cultural pressures stemming from gender roles and social stigmatization. These challenges make it difficult for women to make sense of their experiences and to seek support. Additionally, the geographical location of prisons, often distant from city centers, coupled with stringent security measures, hinders families from maintaining communication and emotional bonds with their incarcerated relatives. This research fills a gap in the literature on the experiences of families of convicted individuals in Turkey, addressing their experiences from a human rights and social justice perspective. Rasûlullâh demek, Allah’tan aldığı bilgiyi insanlara ileten elçi, haberci demektir. Bu nedenle Peygamberlerden bize ulaşan dini bilgiye de haber ya da haber-i resûl denilmiştir. Rasûlullâh’tan teşrî’ ile ilgili gelen her haber, duyanlar ve tevâtür yoluyla ulaşılanlar için bila şek vela ihtilâf, kesinkes doğru ve bağlayıcıdır. Ancak bazı haberlerin Rasûlullâh’a nisbeti kesin olmadığı için ya da nisbeti kesin olsa da delâleti kesin olmadığı için (...) o haberlerin ifade ettiği bilgi de kesin değil, zannîdir. Kimi güdümlü veya meselenin mâhiyetinden bihaber bazı kişilerin; dinde zanla amel edilmez gibi temelsiz iddialarını bir tarafa bırakacak olursak, zannî bilgi, kesin bilgi mucibince bağlayıcıdır. Zannî bilginin, birden çok ihtimal barındırıp ictihad alanı olması bu durumu değiştirmez. Nitekim furû-i fıkhın çoğu zannî bilgi ifade eden haber-i vâhid ve ictihada mebnidir. Sınırlı naslarla, sınırsız ihtiyaç ve sorunlara çözüm bulabilmenin yegâne yolu ictihattır. Aynı zamanda ictihat, İslam’ın kıyamete kadar her çağda ve her toplumda yaşanabilmesinin de temelidir. The current study investigated whether there are significant relationships between life satisfaction and meaning in life, hope and COVID-19 fear and the extent to which life satisfaction is predicted by these variables. The study group of this research consists of 1,186 adults with the mean age of 41.04. Study group participants are consists of different cities of different regions of Turkey. As the data collection tools, the life satisfaction scale, the meaning in life scale, the dispositional hope scale and the (...) COVID-19 fear scale were used. The results of the analyses have revealed that meaning in life, hope are significant predictors of life satisfaction as positively. Besides, it is seen COVID-19 fear, age, gender and the presence of people infected with COVID-19 around aren’t significant predictors of life satisfaction in adults. (shrink)

Within the field of virtue and vice epistemology open-mindedness is usually considered an archetypal virtue. Nevertheless, there is ongoing disagreement over how exactly it should be defined. In this paper I propose a novel definition of open-mindedness as a process of impartial belief revision and use it to argue that we should shift our normative assessments away from the trait itself to the context in which it is exercised. My definition works by three sequential stages: not screening new claims, impartially (...) weighing the evidential strength of claims, and updating beliefs accordingly. Using this definition I argue for a focus on agents’ particular circumstances to determine what degrees of credulity, open-, or closed-mindedness are appropriate in any given situation. As well as providing conceptual clarity regarding the concept of open-mindedness this paper indicates the benefits of this contextual approach for our everyday epistemic attitudes. In particular it enables us to recognise, without stigma, when ourselves or others deviate from open-mindedness for appropriate reasons. (shrink)

The marketplace of ideas is a colourful metaphor with a long history of being used to argue for freedom of speech. This paper draws on its historical antecedents to begin with an orthodox understanding of the metaphor whereby the absence of substantive regulation is taken to be conducive to the good functioning of both economic markets and public discourse. This anti-regulation reading is then challenged by analysing a series of legal cases showcasing prohibitions on misrepresentation and fraud. These speech regulations (...) are explained by the economics literature on information asymmetry, which illustrates how honesty regulations maintain good market functioning by facilitating credible reliance by market participants on one another’s assertions. What is thereby proposed is a re-imagining of the marketplace of ideas metaphor which lends support to honesty regulations in the realm of public speech. One potential analogue for these legal and economic findings is identified in the work of Shiffrin and her arguments for deontological sincerity requirements in the public sphere. (shrink)

This article takes as its starting point the moral requirement to include persons with serious cognitive impairments in democratic decision‐making. That said, including such persons poses particular practical challenges to effective democratic participation. Nussbaum has set out the most extensive proposals for inclusion based on a model of guardianship, but we find they fall short due to not suitably respecting and facilitating the subjective decision‐making of impaired persons. Instead, we argue for a model of co‐constitution, whereby aides work within a (...) supported decision‐making paradigm to arrive at political choices in collaboration with impaired persons. To flesh out this model, we propose collaboration be based on three ideal types of interaction – expert, Socratic, and deliberative – designed to accommodate differing degrees and types of cognitive impairments. We further argue that the aide should have a relationship of detached professionalism with the impaired person and therefore should not be the person’s carer. Finally, we conclude that this separation be combined with transparent and regular invigilation of the aide’s decision‐making process to best safeguard the process from abuse or error. (shrink)

Im Vordergrund steht die Frage nach der Rolle und Funktion der supplicatio als Distinktionsmerkmal im Wettkampf um honos und honores. Die Genehmigung einer supplicatio sah für die erfolgreichen Feldherren eine besonders prominente Rolle innerhalb des Rituals vor und hob sie zugleich aus dem Kreis ihrer Konkurrenten hervor. Das hohe Interesse der Feldherren (...) an einer supplicatio wird bei der Untersuchung derjenigen Dankfeste deutlich, die vom Senat abgelehnt wurden: Schließlich stellte die supplicatio einen Zwischenschritt nach der Verleihung des imperator-Titels, aber vor der Genehmigung des Triumphs dar. How do the flexibilized scenes of cruel optimism crystallize and resonate with the situational displays of crises as a governmental oversight? Centering around this question, the paper aims to offer a critical fulcrum for problematic attachments toward future-mediated fantasies in the aftermath of the Kahramanmaras earthquakes. It starts with evaluating how the pastoral mode was applied as a cruel diagram of positivity by the Turkish government through the omnipresent prowess of the media, which presents an ‘ordinaryizing’ affect in regularizing the (...) fatalistic discourses and relief efforts. It then continues to analyze the retributive discourses by the politicians and officials that triggered the oscillatory porosity among varied (de)subjectivities, toggling between sovereign misrecognitions and exclusions, as well as spiritually vivifying the optimistic barriers of cruelty. Lastly, it discusses in what ways the hopeful projections reconciled with the preemption by the dominant scientific narratives paradoxically prolong the preexistence of uncertainty and trust. Background: Some patients are stigmatised as difficult patients by healthcare professionals. This phenomenon has great many negative consequences. The behaviours of healthcare professionals towards difficult patients are important. Objective: To explore the behaviours of all healthcare professionals towards difficult patients. Research Design: This study was based on a cross-sectional research design using structural equation modelling. Participants and Research Context: Two hundred and fifty-four healthcare professionals were involved in the study in Turkey. ‘Participant Information Form’ and the ‘Healthcare Professionals Behaviour Assessment (...) Questionnaire For Difficult Patient’ were used to collect data from participants. Ethical Consideration: Ethical approval was obtained from Gazi University Ethics Committee for the study. Informed consent of the participants in the study was taken and the confidentiality of the participants was ensured. Findings: It was explored that the behaviours of healthcare professionals towards difficult patients were categorised into ethical, supportive and negative. The highest mean score was supportive behaviour and the least mean score was negative. According to structural equation modelling, the most important predictor of difficult encounters was an ethical dimension. One-unit increase in ethical behaviour contributed to 0.92 unit increase in positive patient behaviour. Discussion: Patients generally are perceived as ‘difficult patient’ by the healthcare professionals, so the patients’ treatment and care services are affected negatively due to healthcare professionals’ negative beliefs and attitudes. The healthcare professionals should behave supportively towards difficult patients. Conclusion: Healthcare professionals should be aware of management strategies in dealing with difficult encounters. The behaviours of healthcare professionals should be improved in a positive way and awareness of ethical dimension of difficult encounters should be increased. (shrink)

This context is expected to have an impact not only on the board structure but also on the relationship between board structure and firm performance. Drawing from agency, stewardship and resource dependence theories and emphasising the impact of the societal context in (...) line with macro institutional approaches, hypotheses are developed regarding the board structure/firm performance relationship. School bullying among young adolescents is a globally pervasive problem, but is less common when bystanders are motivated to defend victims. Thus, the focus of this experimental study is on motivation to defend victims of bullying.Methods: A total of 388 students from two Turkish public schools participated in a vignette experiment. Students were randomized to one of two vignettes. Self-report measures of motivation to defend, trait anxiety, depression, and identification with the victim or bully were used.Results: Participants reported more autonomous (...) motivation in the cyberbullying condition, while those who witnessed direct bullying reported higher anxiety and depression.Results also revealed that this type of condition was associated with anxiety and depression, while anxiety was associated with autonomous motivation to defend. Finally, participants in the direct bullying condition were more likely to identify with the bully.Conclusion: Findings advance our understanding of when and why adolescents are motivated to help victims of bullying because they give a richer picture of what they assess when deciding whether or not they should intervene. Mutlak ve mukayyet konusu fıkıh usûlünün lafız bahislerinde ele alınıp derinlemesine incelenen başlıklardan biridir. Konu her ne kadar fıkıh usûlü kitaplarında yeterince açıklanmış gözükse de her teorik meselede olduğu üzere farklı değerlendirmelere açık taraflar da ihtiva etmektedir. Bu iki lafız özellikle mutlakın mukayyede hamli etrafında ele alınmıştır. Usûlcülerin bu konuda verdiği örnekler ayrıca önemlidir. Bu örneklerin incelenmesi mutlak ve mukayyet lafızların daha iyi anlaşılmasına da katkı sağlayacaktır. Bu makalede öncelikle mutlak ve mukayyet lafızların tanımı, mahiyeti ve fıkıh usûlünün diğer konuları (...) ile münasebeti verildikten sonra mutlakın mukayyede hamli ele alınacak ve özellikle; “ıtlak ve takyidin sebebi bir olmakla beraber hükümleri farklı olursa mutlak mukayyede haml edilmez, mutlakla ıtlakı mukayyetle de takyidi üzere amel edilir”, kuralı için verilen örneklerin tatmin edici olmadığı tartışılacaktır. Russell-Meinong tartışması, geçtiğimiz yüzyılın başlarında gerçekleşmiş, nesne sorununu konu eden bir tartışmadır. Tartışmanın odak noktaları; varlığın nasıl anlaşılması gerektiği, nelerin var olduğu, nesne olma koşulları ve bu bağlamda ontoloji-mantık ilişkisidir. Farklı ilkeler ve yöntemler benimseyen iki düşünür, bazı konularda uzlaşı içinde olmakla birlikte çeşitli konularda görüş ayrılıkları içindedir. Russell, temel olarak, varlık-dışı nesneleri içeren önermelerin çelişmezlik ve 3.halin olanaksızlığı ilkelerini çiğnediğini öne sürerek bu nesnelerin ontolojiden elenmesini savunmaktadır. Meinong’un nesne kuramı, özetle, varlık tarzlarını ayırmakta ve mantık ilkelerinin belirleyiciliğini sınırlandırmaktadır. Bu (...) düşüncelere cevap verme arayışı, Russell'ın betimlemeler kuramını ortaya koymasını sağlamıştır. Betimlemeler kuramının getirdiği çözümler ve kuramın yalınlığı, yıllar boyunca bu tartışmada haklı olanın Russell olduğunun düşünülmesine neden olmuştur. Ancak metafizik ve mantıktaki çeşitli gelişmeler ile tartışma yeniden ele alınmıştır. Bu yeniden ele alma sayesinde tartışmaya ilişkin yeni yorumların ileri sürülmesinin olanağı ortaya konmuştur. Buna bağlı olarak çeşitli çağdaş metafizik kuramların ortaya çıkması söz konusu olmuştur. Bu çalışmada öncelikle Russell’ın tartışmanın gerçekleştiği dönemdeki düşünceleri serimlenecek ve Meinong’a getirdiği eleştiriler ortaya konacaktır. Daha sonra Meinong’un nesneler kuramı kapsamlı şekilde sergilenecektir. Böylece, iki düşünürün düşünceleri karşılaştırılmaya tabi tutularak aralarındaki görüş benzerlikleri ve farklılıkları saptanacaktır. Bu çerçevede, tartışmaya ilişkin bir değerlendirme sunularak tartışmanın yeniden ele alınmasının nedenleri, tartışmaya dair öne sürülen çeşitli yorumlar ve tartışmanın güncel metafizikteki yansımaları açıklanacaktır. The third century of the hegira represents an extremely important period in terms of the formation process of Islamic sciences and the acquirement of the identity of a systematic school of fiqh madhhabs. In terms of the Zaydiyya madhhab, this century has an identity that affects the next period in terms of both political and scientific studies. Because in this period, the scholars of the madhhab like Kāsim al-Rassî (d. 246/860), Ahmad b. Isā (d. 247/861) and Yahyā b. al-Husayn (d. (...) 298/911), who were in a leading position both in politics and in sciences such as kalām, hadith and fiqh, emerged. Kāsim al-Rassî, who was accepted as the star of the Ahl al-Bayt by Zaydî sources in the first period, was presented as the Plato of Muslims by orientalists in modern studies. The main reason why today's studies on him are mostly about the history of sects and theology, most of Rassî's works are about kalām. However, Kāsim al-Rassî is an important name in the science of fiqh and İslamic legal theory as well as in the science of kalām. According to Abī Tālib Nātik bi’l-Hakk (d. 424/1033), one of the important jurists of the Zaydiyya madhhab, Rassî was a scholar who came to the fore with his ability in fiqh issues; in order to see his ijtihād method, his skill in furû al-fiqh, his mastery in using hadiths and knowing the disagreements of scholars, ‘‘Masā’il al-Dja’far b. Muhammad and Abd Allah b. Hasan” should be consulted. Rassi's epistles named Kitab al-Nāsikh wa’l-Mansūkh, Kitab al-tahāra, Kitab al-salāt al-yevm ve al-Laylā and Kitab al-menāsik are important studies on fiqh that have survived to the present day. In addition, Mueyyed-Billah (d. 411/1021) compiled Kāsim al-Rassî’s and Yahya b. al-Husayn's views on fiqh in his work named al-Tecrîd. Kāsim al-Rassî's views on fiqh are also determinative in later fiqh books such as Tahrîr, al-Cāmi' al-Kāfi, al-Intisār and al-Azhar. In time, the emergence of a jurisprudence sect named Kāsimiyya in Zaydiyya, referring to his name, is also important in terms of revealing his position. Although Rassî's views on fiqh have been referred to a number of studies in our country, no independent study has been found that deals with his views on fiqh. However, considering both of his works on fiqh that have survived to the present day and the early works in which his views are compiled, it is obvious that Kāsim al-Rassî's views on fiqh deserve an independent works. The aim of this study is to reveal Ressî's position within the madhhabs and his perspective on fiqh in general. In this context, in the study, the period in which Ressî lived, his life and works were briefly mentioned, and then the basic views of the fiqh, especially in the field of worship, were discussed in outline. The book under study is "Kitāb al-Uṣūl" and its commentary "Sharḥ al-Uṣūl" written by Ibn Ḥallād al-Basrī, one of Abū Ḥāshim al-Jubbāʾī's leading students. This work is the result of the Mu'tazilite Manuscripts Project conducted by Sabine Schmidtke and D. E. Sklare, and has been published in an edited edition by Camilla Adang, Wilferd Madelung, and Sabine Schmidtke. The study, entitled "-A Critical Edition of the Ziyādāt Sharḥ al-uṣūl by the Zaydī Imām al-Nāṭiq bi-l-ḥaqq Abū Ṭālib Yaḥyā b. al-Ḥusayn b. (...) Hārūn al-Buṭḥānī " begins with quotations from Ibn Ḥallād's Kitāb al-uṣūl or its incomplete commentary, Sharḥ al-uṣūl. This is followed by various quotations written in addition to Ibn Ḥallād's incomplete commentary, which are mostly from Kādī ʿAbd al-Jabbār's Sharḥ. Then the commentary of the Zaydī Imam Nāṭīq-Bilḥāq is added, and finally, the text is completed by the commentary of his student and annotator, Abū al-Ḳāsīm Aḥmad b. Mahdī al-Ḥasan. Although the text does not directly define the usūl al-hamsa, the reader can recognize this progression. Beginning with tawhid, the text moves on to justice, followed by va'd-va'id, and finally concludes with topics such as predestination, sustenance, accident, and fate. (shrink)
