The paper discusses the problem of translating selected Civil Procedure terminology from Greek into Polish and from Polish into Greek. The research material includes corpora of normative acts and more precisely those, which regulate Civil Procedure of Poland, Greece and the Republic of Cyprus. The research methodology is based on the concept of parameterisation, according to which the legal linguistic reality becomes axiomatic. Then the set of relevant dimensions and parameters is extracted. The set of parameters are a tool where (...) certain information is given: yes/no/none and thus a clear result of comparison between legal system bond terminology can be drawn up. The results of this comparative analysis provide highly regulated and available translation equivalents, which are essential when legal translation is performed within the frame of legal reality. Selected examples of use of these equivalents are given when discussing the results. (shrink)

The theory of speech acts, formulated by Austin and developed by Searle, is widely applied to analyse and classify various speech acts. In this paper it is assumed that legal texts, especially normative acts i.e. constitutions and statutes, are direct speech acts. Normative acts are linguistic entities and they do not exist outside the language, thus the theory of speech acts may be applied to examine them. They are also considered to be performative utterances according to Austin’s classification. In this (...) paper the intention is to compare Cypriot, Greek and Polish normative acts on the basis of the so-called classical theory of speech acts and typology of performativity exponents. The author will compare various methods of expressing performativity in reference to the meaning conveyed by them. Furthermore, other exponents of performativity occurring in the analysed texts shall also be compared. The results obtained while performing the analysis and comparison may be significant for scholars, lawyers and translators. (shrink)

The article proposes a new solution to the long-standing problem of the universality of essences in Spinoza's ontology. It argues that, according to Spinoza, particular things in nature possess unique essences, but that these essences coexist with more general, mind-dependent species-essences, constructed by finite minds on the basis of similarities that obtain among the properties of formally-real particulars. This account provides the best fit both with the textual evidence and with Spinoza's other metaphysical and epistemological commitments. The article offers new (...) readings of how Spinoza understands not just the nature of essence, but also the nature of being, reason, striving, definitions, and different kinds of knowledge. The article presents partial results of nationwide research devoted to teaching ethics. It discusses the place of ethics in the Polish education system and the development trends visible since its introduction (1991). When it comes to legislature, acts and ordinances of the Minister of National Education were analyzed. Next to legal acts also judgments of the Constitutional Tribunal, regulating the principles of teaching and assessing the subject of ethics, were discussed. An important aspect of these regulations, due to their practical (...) consequences, is the positioning of ethics as an alternative to the religious education. Statistical data were also analyzed, allowing for a nationwide assessment of the development of interest in the ethics as a subject of school teaching – an increase in the number of schools in which the subject of ethics is taught (depending on the stage of education and the type of school), as well as an increase in the number of full-time equivalent for ethics teachers. The last-mentioned increase, although significant since 2014, is nevertheless small in absolute numbers; ethics still remains a niche subject. Over the years, one can observe an improvement in its status and an increase in social demand. However, the current definition of ethics as an optional subject means that the level of participation still remains low. (shrink)

In the following paper sources of a constitution are put in question in general, and more specifically, the constitutional culture of the European Union Law is being investigated in-depth with regard to principles of deliberative democracy and rulings of the Court of Justice of the European Union. The change of a law application paradigm as well as the change of a legal systems’ nature are taken into account.

The paper presents the question of relations between Galileo Galilei and the polish establishment and cultural world. Taking the departure from the classical essay by Biliński, and preserving its structure, the present paper describes these relations in the larger perspective of recent polish publications dedicated to this question.

The article explores the idea that according to Spinoza finite thought and substantial thought represent reality in different ways. It challenges “acosmic” readings of Spinoza's metaphysics, put forth by readers like Hegel, according to which only an infinite, undifferentiated substance genuinely exists, and all representations of finite things are illusory. Such representations essentially involve negation with respect to a more general kind. The article shows that several common responses to the charge of acosmism fail. It then argues that we must (...) distinguish the well-founded ideality of representations of finite things from mere illusoriness, insofar as for Spinoza we can have true knowledge of what is known only abstractly. Finite things can be seen as well-founded beings of reason. The article also proposes that within Spinoza's framework it is possible to represent a finite thing without drawing on representations of mind-dependent entities. (shrink)

According to the Principle of Conditional Non-Contradiction (CNC), conditionals of the form “If p, q” and “If p, not q” cannot both be true, unless p is inconsistent. This principle is widely regarded as an adequacy constraint on any semantics that attributes truth conditions to conditionals. Gibbard has presented an example of a pair of conditionals that, in the context he describes, appear to violate CNC. He concluded from this that conditionals lack truth conditions. We argue that this conclusion is (...) rash by proposing a new diagnosis of what is going on in Gibbard’s argument. We also provide empirical evidence in support of our proposal. (shrink)

The paper offers a new account of Spinoza's conception of “substance”, the fundamental building block of reality. It shows that it can be demonstrated apriori within Spinoza's metaphysical framework that (i) contrary to Idealist readings, for Spinoza there can be no substance that is not determined or modified by some other entity produced by substance; and that (ii) there can be no substance (and hence no being) that is not a thinking substance.

What can be learnt from Paul B. Preciado’s ecological framing of trans* and migrant world-making in An Apartment on Uranus? How might trans* and migrant solidarities affirm life in the context of capitogenic climate catastrophe and what Françoise Vergès has named the ‘racial capitalocene’? Through these guiding questions, I connect recent calls to ‘decolonize trans* imaginaries’ with translocal hispanophone knowledges that reaffirm the plurality of gender/sexuality in las Amé ricas before the conquest by braiding together strands of Preciado’s writing with (...) Latin American decolonial transfeminists such as María Lugones and Gloria Anzaldúa, among others. Reviewing recent debates on how ‘border imperialism’ unevenly shapes and restricts trans* and migrant mobility, I address criticisms of Preciado’s analogies between trans* and migrant experiences, by considering how his writings on these themes offer an intersectional reflection on the multiple cracks of the nation-state, the fictions of race and regimes of binary gender to reveal the cracks of capitalism. Due to the growing importance of local pro-development attitudes and non-governmental organizations for development, it is important to look at their activities in different subregions. In this work the author presents the results of research carried out in the Leszno subregion on the presence of elements of social capital, the organizational and financial sustainability of NGOs, and their cooperation with public administration in the context of their impact on local development. In addition, through a comparative analysis of selected issues, it (...) recalls the good practices of NGOs in Switzerland which, because of the long tradition of their operation and the experience gained, can also be used in Polish settings. Ruchy środowiskowe zyskują na popularności, a ich podział i rodzaje przedstawiono za pomocą dwóch klasyfikacji zaproponowanych przez: 1) socjologa M. Castellsa oraz 2) społeczno-środowiskową organizację Earth5R. Wybór tematu został podyktowany tym, iż w obliczu pogarszającego się stanu środowiska na świecie ruchy środowiskowe przyczyniają się do rozwijania świadomości środowiskowej u pozostałych członków społeczeństwa. Ze swoim przekazem trafiają do szerokiego grona odbiorców.

At least many conditionals seem to convey the existence of a link between their antecedent and consequent. We draw on a recently proposed typology of conditionals to revive an old philosophical idea according to which the link is inferential in nature. We show that the proposal has explanatory force by presenting empirical results on two Dutch linguistic markers.

The paper analyzes the collection of the Northern Irish poet Frank Ormsby entitled A Northern Spring published in 1986. On the basis of selected poems, the author of this paper aims to examine the poet’s reflections about World War II, the lives of the soldiers, and the things that remain after a military combat, which are both physical and illusive. The poems included in the volume present the author’s reflections upon the senselessness of war and dying, short lives of the (...) soldiers, the awareness of their own meaninglessness in comparison to the broader picture, and the contradictory and desperate need to be remembered nevertheless. In the teaching of John Paul II’s the need of solidarity globalization is particularly stressed out as well as that of humanization of globalization processes. With the aim of doing it, one should be guided by unchanging social values: the truth, freedom, justice, solidarity, subsidiarity, love. The globalization has two faces: ▪ the benefits which it brings to the world, individual countries and its main beneficiaries, that is international corporations. ▪ negative effects which the developing countries and all people of (...) the world experience (climatic changes, emission of harmful substances, drug addiction, moral nihilism, gradual decrease of human importance). It happens that complex processes caused by economical globalization make their way towards changing a human being into an element of a market, a bartered good or a factor devoid of meaning for decisive choices. As a consequence, a person may feel annihilated by impersonal mechanisms on a world’s scale and may gradually lose his own identity and personal dignity. Key words. (shrink)

Motives of espionage against ones own country in the light of idiographic studies The money is perceived as the common denominator among people who have spied against their own country. This assumption is common sense and appears to be self-evident truth. But do we have any hard evidences to prove the validity of such a statement? What method could be applied to determine it? This article is a review of the motives behind one's resorting to spying activity which is a (...) complex and multifarious process. I decided to present only the phenomenon of spying for another country. The studies on the motives behind taking up spying activity are idiographic in character. One of the basic methodological problems to be faced by the researchers of this problem is an inaccessibility of a control group. (shrink)

The main aim of this article is to show how the notion of refutation has been changing in logic for the last few years. The idea of refutation was known to Aristotle, but the formal concept was introduced by Jan Łukasiewicz. Afterwards this notion was investigated by the Polish group of logicians headed by Jerzy Słupecki. Several interesting articles about refutation have appeared in the last years. In this article, I present in outline the history of the notion of refutation (...) and I discuss recent applications of refutation systems both in the theoretical and practical approach. (shrink)

De Dreu and Gross offer novel solutions to discouraging attackers via political sanctions. We offer insights from social psychological and criminological research on when such sanctions would work and when they could backfire. We argue that the influence of such sanctioning ultimately rests upon the extent to which such authorities can claim to represent the society that they serve.

When selecting between applicants for a job, when and how should we take into account the reactions that they elicit from others? On one hand, applicants’ “reaction qualifications” often speak to their merit, in which case we seem required to consider them. On the other hand, others’ reactions are often rooted in prejudicial attitudes, in which case considering reaction qualifications can make the hiring process prejudicial. According to a popular view, we should refrain from considering reaction qualifications just in case (...) there are weighty moral reasons against doing so. I argue that this morality-based approach fails. Instead, we should refrain from considering reaction qualifications just in case considering them would render a selection procedure non-transparent or discriminatory. If consideration of a reaction qualification would have either effect, the reaction qualification does not confer merit and so should not be considered by selectors. (shrink)

We live in an era when increasing numbers of babies are conceived through assisted reproduction technologies (ART). Using a comprehensive approach, the present research seeks to contribute to the understanding of gender differences in experiencing and coping with infertility, and in dealing with ART treatment. Our sample consisted of 10 heterosexual couples aged 24 to 43 and the data were collected through semi-structured interviews. In the studied sample, gender differences existed not only in experiences of infertility, but also in understanding (...) it, and in dealing with ART treatment. Responses to stress caused by infertility were stronger in women and they also perceived this stress more intensely than men. For women the central aspect of infertility was the desire for a child, while for men it was perceived more as a socially imposed obligation to fulfill the male role. (shrink)

Numerous scholars, representing various fields of knowledge, have studied the Holocaust and published extensively on this subject since the end of the Second World War. Many original Holocaust documents, diaries and memoirs of victims and survivors have been edited and published, along with numerous historical, philosophical and theological treaties on the Shoah. The goal of this paper is to present psychology’s contribution to the study of the Holocaust. The authors discuss results of empirical research and clinical observations concerning the long-term (...) consequences of this trauma (the KZ/survivor syndrome), adaptation and coping skills of survivors, the phenomenon of transgenerational transmission of trauma and intrapsychic and interpersonal functioning of the children of survivors (the Second Generation). They present epidemiological data and psychological mechanisms of attempted and committed suicide among the Jews during the persecutions and deportations, as well as suicide in the ghettos and concentration camps, and among the Holocaust survivors. In the paper a short description ofpsychotherapy and other forms of psychological help available to the Holocaust survivors and their children is also presented. Last but not least, it is discussed how the knowledge of the psycho-social consequences of the Holocaust can be used by psychologists in their work with victims and survivors of other genocides and traumas. The article examines social and creative capitals and their interconnections. Some authors observe similarities in them as well as areas where they complement each other. Other authors argue that social and creative capitals are still mutually exclusive and cannot be compared. The article analyses various aspects of social and creative capital, searches for similarities and differences between them, and reviews measurement methodologies and issues related to the reliability of measurement indices and criteria. The aim of the paper is to reconsider Habermas’ discourse approach in terms of its usefulness in the realm of public healthcare where, on a microscale, intersubjective communicative situations arise between defined participants, i.e., patients and healthcare providers, patients’ family members, and further eligible contributors to patient-related decision making. A need for more “communicative interaction,” and explicative and practical discourse, is illustrated by two empirical examples of medical decision making which reveal both communicative and discursive deficits. To empower and enable (...) the patient as a rational and autonomous speaker and discourse participant, a Habermasian emancipatory argument and ‘the power of the better argument’ is recalled. The possibility of equal communicative and discursive rights in the light of real inequalities is discussed in the context of a ‘competence gap’ between participants. Further sections focus on the importance of informed consent on the side of the patient and the communicative competences as an important factor of healthcare system. (shrink)
