Does a global economy render the traditional nation-state obsolete? Does globalization threaten democratic life, or offer it new forms of expression? The German philosopher and social theorist Jurgen Habermas addresses these and other questions in this work.

Since its appearance in English translation in 1996, Jurgen Habermas's Between Facts and Norms has become the focus of a productive dialogue between German and Anglo-American legal and political theorists. The present volume contains ten essays that provide an overview of Habermas's political thought since the original appearance of Between Facts and Norms in 1992 and extend his model of deliberative democracy in novel ways to issues untreated in the earlier work. Habermas's theory of democracy has at least three features (...) that set it apart from competing positions. First, it combines a concern with questions of normative justification with an empirical analysis of the social conditions necessary for the realization of democratic institutions. Second, at the heart of his model is the assertion of an internal relationship between liberalism and democracy. Finally, Habermas defends a conception of universal human rights that is not only sensitive to cultural differences but also calls for legal and political institutions that facilitate the cultivation of cultural and religious identities within pluralistic societies. These essays demonstrate the extraordinary power of Habermas's theory of democracy through a further engagement with Rawls's political liberalism and through original contributions to current debates over nationalism, multiculturalism, and the viability of supranational political institutions. BackgroundThe COVID-19 pandemic has created ethical challenges for intensive care unit (ICU) professionals, potentially causing moral distress. This study explored the levels and causes of moral distress and the ethical climate in Dutch ICUs during COVID-19.MethodsAn extended version of the Measurement of Moral Distress for Healthcare Professionals (MMD-HP) and Ethical Decision Making Climate Questionnaire (EDMCQ) were online distributed among all 84 ICUs. Moral distress scores in nurses and intensivists were compared with the historical control group one year before COVID-19. ResultsThree (...) hundred forty-five nurses (70.7%), 40 intensivists (8.2%), and 103 supporting staff (21.1%) completed the survey. Moral distress levels were higher for nurses than supporting staff. Moral distress levels in intensivists did not differ significantly from those of nurses and supporting staff. “Inadequate emotional support for patients and their families” was the highest-ranked cause of moral distress for all groups of professionals. Of all factors, all professions rated the ethical climate most positively regarding the culture of mutual respect, ethical awareness and support. “Culture of not avoiding end-of-life-decisions” and “Self-reflective and empowering leadership” received the lowest mean scores. Moral distress scores during COVID-19 were significantly lower for ICU nurses (p < 0.001) and intensivists (p < 0.05) compared to one year prior.ConclusionLevels and causes of moral distress vary between ICU professionals and differ from the historical control group. Targeted interventions that address moral distress during a crisis are desirable to improve the mental health and retention of ICU professionals and the quality of patient care. (shrink)

From the perspective of a contemporary German reader, one consideration is particularly important from the start. Illumination of the political conduct of Martin Heidegger cannot and should not serve the purpose of a global depreciation of his thought. As a personality of recent history, Heidegger comes, like every other such personality, under the judgment of the historian. In Farias’ book as well, actions and courses of conduct are presented that suggest a detached evaluation of Heidegger’s character. But in general, as (...) members of a later generation who cannot know how we would have acted under conditions of a political dictatorship, we do well to refrain from moral judgments on actions and omissions from the Nazi era. Karl Jaspers, a friend and contemporary of Heidegger, was in a different position. In a report that the denazification committee of the University of Freiburg at the end of 1945, he passed judgment on Heidegger’s “mode of thinking”: it seemed to him “in its essence unfree, dictatorial, uncommunicative.”7 This judgment is itself no less informative about Jaspers than about Heidegger. In making evaluations of this sort Jaspers, as can be seen from his book on Friedrich Schelling, was guided by the strict maxim that whatever truth a philosophical doctrine contains must be mirrored in the mentality and lifestyle of the philosopher. This rigorous conception of the unity of work and person seems to me inadequate to the autonomy of thought and, indeed, to the general history of the reception and influence of philosophical thought. I do not mean by this to deny all internal connection between philosophical works and the biographical contexts from which they come—or to limit the responsibility attached to an author, who during his lifetime can always react to unintended consequences of his utterances. 7. This paper highlights the role of Lewis’ Principal Principle and certain auxiliary conditions on admissibility as serving to explicate normal informal standards of what is reasonable. These considerations motivate the presuppositions of the argument that the Principal Principle implies the Principle of Indifference, put forward by Hawthorne et al.. They also suggest a line of response to recent criticisms of that argument, due to Pettigrew and Titelbaum and Hart, 621–632, 2020). The paper also shows that related concerns of Hart and (...) BackgroundA patient who fulfils the due diligence requirements for euthanasia, and is medically suitable, is able to donate his organs after euthanasia in Belgium, the Netherlands and Canada. Since 2012, more than 70 patients have undergone this combined procedure in the Netherlands. Even though all patients who undergo euthanasia are suffering hopelessly and unbearably, some of these patients are nevertheless willing to help others in need of an organ. Organ donation after euthanasia is a so-called donation after circulatory death (DCD), (...) Maastricht category III procedure, which takes place following cardiac arrest, comparable to donation after withdrawal of life sustaining therapy in critically ill patients. To minimize the period of organ ischemia, the patient is transported to the operating room immediately after the legally mandated no-touch period of 5 min following circulatory arrest. This means that the organ donation procedure following euthanasia must take place in the hospital, which appears to be insurmountable to many patients who are willing to donate, since they already spent a lot of time in the hospital. Case presentationThis article describes the procedure of organ donation after euthanasia starting at home (ODAEH) following anesthesia in a former health care professional suffering from multiple system atrophy. This case is unique for at least two reasons. He spent his last conscious hours surrounded by his family at home, after which he underwent general anaesthesia and was intubated, before being transported to the hospital for euthanasia and organ donation. In addition, the patient explicitly requested the euthanasia to be performed in the preparation room, next to the operating room, in order to limit the period of organ ischemia due to transport time from the intensive care unit to the operating room. The medical, legal and ethical considerations related to this illustrative case are subsequently discussed.ConclusionsOrgan donation after euthanasia is a pure act of altruism. This combined procedure can also be performed after the patient has been anesthetized at home and during transportation to the hospital. (shrink)

The ArgumentIn this paper I present and argue for a model of conceptual development in science and apply it to the transition from classical to modern physics associated with Einstein. The model claims a continuous and rational transition between incompatible subsequent conceptual systems in mathematical science and explains its mechanism. The model was developed in a study of the transition from preclassical to classical mechanics. I argue for a strong structural analogy between the transition from preclassical to classical mechanics on (...) the one hand and from classical to modern physics on the other. The first transition is briefly sketched here by reference to Galileo and his disciples; in the second transition Planck and Lorentz on the one hand and Einstein on the other play the respective roles.A detailed and documented reconstruction of the transition from preclassical to classical mechanics on the basis of this model has already been published and is only briefly referred to in the paper. The transition from classical to modern physics is portrayed here much more extensively—though of course merely in broad brush strokes. Einstein–s role in this transition is reconstructed in the light of a conceptualization of his scientific knowledge as an active structure of thought, shaped by his intellectual experience. In this way, the development of his individual thinking is shown to be part of the overall process of conceptual transformation from classical to modern physics. The reconstruction sketched in this paper is to be considered as a proposal to be substantiated, reformed, and improved by future detailed studies. (shrink)

Recently, Brass and Dix showed 143–165) that the well founded semantics WFS can be defined as a confluent calculus of transformation rules. This led not only to a simple extension to disjunctive programs 167–213), but also to a new computation of the well-founded semantics which is linear for a broad class of programs. We take this approach as a starting point and generalize it considerably by developing a general theory of Confluent LP-systems CS . Such a system CS is a (...) rewriting system on the set of all logic programs over a fixed signature L and it induces in a natural way a canonical semantics. Moreover, we show four important applications of this theory: most of the well-known semantics are induced by confluent LP-systems , there are many more transformation rules that lead to confluent LP-systems , semantics induced by such systems can be used to model aggregation , the new systems can be used to construct interesting counterexamples to some conjectures about the space of well-behaved semantics.
