Since its appearance in English translation in 1996, Jurgen Habermas's Between Facts and Norms has become the focus of a productive dialogue between German and Anglo-American legal and political theorists. The present volume contains ten essays that provide an overview of Habermas's political thought since the original appearance of Between Facts and Norms in 1992 and extend his model of deliberative democracy in novel ways to issues untreated in the earlier work. Habermas's theory of democracy has at least three features (...) that set it apart from competing positions. First, it combines a concern with questions of normative justification with an empirical analysis of the social conditions necessary for the realization of democratic institutions. Second, at the heart of his model is the assertion of an internal relationship between liberalism and democracy. Finally, Habermas defends a conception of universal human rights that is not only sensitive to cultural differences but also calls for legal and political institutions that facilitate the cultivation of cultural and religious identities within pluralistic societies. These essays demonstrate the extraordinary power of Habermas's theory of democracy through a further engagement with Rawls's political liberalism and through original contributions to current debates over nationalism, multiculturalism, and the viability of supranational political institutions. Der Laureatus dieser Schrift hatte 1986 Hans Jonas eröffnet, daß er an einer Politischen Philosophie arbeite, aus der, wie die Autoren dieses Bandes wissen, nichts geworden ist und von der man auch sonst nicht viel vernommen hat. Jonas wandte damals ein: "Wie wollen Sie der Politischen Vernunft auf die Beine helfen? Das Wissen über die politischen Bewußtseinsvoraussetzungen in uns und ihre Struktur in Gesellschaften ist in esoterische Teilbestände und exoterische politische Religionen, Ideologien und Denkschulen zerfallen. Diese Angelegenheit müßte einer umfassenden (...) Kritik unterzogen werden. Außerdem müßten alle gescheiterten Restitutionsversuche von Platon bis heute auf ihre Prägnanz hin durchgegangen werden. Er nannte Thomas von Aquin, Spinoza, Kant, Hegel, Arendt, Strauss, Voegelin und sich selbst. Sie müßten die Erfahrungen und die Maßstäbe, aus denen das politische Bewußtsein sich ernährt und aufrichtet und die, die es vergiften, frei legen." Im nachfolgenden Gespräch über verschiedene Denker und ihre Texte zur politischen Philosophie tauchten metaphorisch die "leuchtenden Fünkchen" oder "Goldklümpchen" auf, in denen Jonas und der Laureatus lebendige Reste der Politischen Vernunft und die menschheitliche Erinnerung an sie erkannten. "Wir sind womöglich aus einer Jeremiade herausgekommen …" lautete der verheißungsvolle Schlußpunkt des kurzen Gesprächs. Der Laureatus, Jurist und Politikwissenschaftler, konnte während seiner Lehr- und Forschungstätigkeit einige Anregungen für "philosophische Fragestellungen" zu den grotesken und verflachten Formationen des politischen Denkens unserer Zeit geben. The intuitive Variety of Evidence Thesis states that, ceteris paribus, more varied evidence for a hypothesis confirms it more strongly than less varied evidence. Recent Bayesian analyses have raised serious doubts in its validity. Claveau suggests the existence of a novel type of counter-example to this thesis: a gradual increase in source independence can lead to a decrease in hypothesis confirmation. I show that Claveau’s measure of gradual source independence suffers from two unsuspected types of inconsistencies. I hence put forward (...) a more natural measure of gradual source independence which is not plagued by inconsistencies. Claveau’s counter-examples to the variety of evidence thesis disappear with the measure I suggest. I hence argue that my measure is preferable and that this thesis does at least not seem to be troubled by Claveau’s arguments. (shrink)

Arming uninhabited vehicles (UVs) is an increasing trend. Widespread deployment can bring dangers for arms-control agreements and international humanitarian law (IHL). Armed UVs can destabilise the situation between potential opponents. Smaller systems can be used for terrorism. Using a systematic definition existing international regulation of armed UVs in the fields of arms control, export control and transparency measures is reviewed; these partly include armed UVs, but leave large gaps. For preventive arms control a general prohibition of armed UVs would be (...) best. If that is unattainable, several measures should be taken. An explicit prohibition of autonomous attack, that is without a human decision, should be added to IHL. Concerning armed UVs remotely controlled by a human soldier, recommendations differ according to type or mission. New kinds of uninhabited nuclear-weapon carriers should be banned. Space weapons should be prohibited in general. UVs smaller than 0.2–0.5 m should be banned. Bigger remotely controlled armed UVs not equipped with weapons of mass destruction should be subject to numerical limitations in various categories. For these the Treaty on Conventional Armed Forces in Europe is an important precedent. (shrink)

First collection of essays entirely devoted to the inscription of Diogenes of Oinoanda. The texts of Diogenes of Oinoanda (2nd century AD) who invited his readers to an Epicurean life is the largest ancient inscription ever discovered. Over 70 new finds have increased the number of known wall blocks and fragments to nearly 300, offering new insights into Diogenes' distinctive presentation of philosophy. This collection of essays discusses the philosophical significance of these discoveries and is the first of this kind (...) entirely devoted to Diogenes of Oinoanda. Particular attention is paid to his philosophical aims and polemical strategies. Diogenes was apparently well aware of still ongoing philosophical debates, engaging in polemics against Presocratic philosophers, Platonics, and especially Stoics. His views about important issues like happiness, fear, old age, and the afterlife are explained on the bases of Epicurean physics and theology, ethics, politics, theory of knowledge, and psychology. In den letzten Jahren wird intensiv darüber diskutiert, ob und in welcher Weise das Gewissen im Kontext der Apotheke zu schützen ist. Der Status quo in Deutschland und Österreich sieht keine gesetzliche Regelung für dieses Problem vor. Der ethische Rahmen für eine Bewältigungsstrategie im Umgang mit dem Problem der Gewissensfreiheit in der Apotheke wird deutlich gemacht. Unter Anwendung des rechtsethischen Verhältnismäßigkeitsprinzips wird das Problem mit Berücksichtigung des deutschen und österreichischen Verfassungsrechts sowie der Europäischen Menschenrechtskonvention auf individueller, korporativer und gesellschaftlicher Ebene (...) analysiert. Auf individueller Ebene sind die berechtigten Interessen und Güter des Apothekers einerseits und der Patientin andererseits durch eine grundrechtliche Verhältnismäßigkeitsprüfung zu einem schonenden Ausgleich zu bringen. Auf korporativer Ebene legitimiert das auf der Religions- und Weltanschauungsfreiheit basierende Selbstbestimmungsrecht die ideologisch profilierte Apotheke als Organisation und kann in der Binnenbeziehung der Apotheke einen Loyalitätskonflikt verursachen. Auf gesellschaftlicher Ebene stehen vier Optionen der proaktiven rechtspolitischen Gestaltung der Gewissensproblematik zur Verfügung: sozialstaatlich, libertär, professionsbezogen und kommunitär. Wie Konflikte auf individueller oder korporativer Ebene gelöst werden können, hängt von den Optionen ab, die auf gesellschaftlicher Ebene gewählt werden. Für den Fall einer Änderung des Status quo wird für zwei Lösungsansätze argumentiert: a) die Einführung einer qualifizierten Gewissensklausel für Apotheker (mit Beratungs-, Verweis-, Notfall- und Verständigungspflicht); b) die auf einen Kompromiss zwischen ideologisch profilierter pharmazeutischer Korporation (Apotheke oder Apothekervereinigung) und Sozialstaat abzielende „weiche“ kommunitäre Option. Beide Ansätze werden einem schonenden Ausgleich berechtigter Güter gerecht. (shrink)

Die öffentliche Wahrnehmung der Forschung mit extrakorporalen Embryonen bildet den Kern des vorliegenden Beitrags. Hierzu wurden über 400 Personen schriftlich befragt. Die Art der Embryonengewinnung (künstliche Erzeugung vs. überzählige Embryonen) wird als bedeutsam für die Bewertung der Forschung angesehen. Mehrheitlich besteht der Wunsch nach rechtlich klaren Grenzen. Die größte Ambivalenz zeigt sich hinsichtlich der Frage nach einer gesetzlichen Erlaubnis der Embryonenforschung. Umgekehrt hat die Bevölkerung eine eindeutigere Meinung zum Verbot von Embryonenforschung und zur Einführung strikter rechtlicher Regelungen. Die Wahl der (...) Mittelkategorie bei der Untersuchung der Einstellung ist durch das Ausmaß der Ambivalenz mitbestimmt. Es konnte nachgewiesen werden, dass Laien das Dilemma der Embryonenforschung ähnlich bewerten wie Experten. Der Wunsch nach einer Freigabe der Forschung mit Embryonen besteht bei einer Teilgruppe, jedoch ist dieser Wunsch von einem hohen Ausmaß an Ambivalenz begleitet. (shrink)

Was ist Nachhaltigkeit, was ist ihr Wesen und was bedeutet Nachhaltigkeit für Mensch und Gesellschaft, für Natur und Kultur? Um diese Fragen zu beantworten, lädt Jürgen H. Nikolaus von Kues (1401–1464) – ein Technikphilosoph? Nimmt man die cusanische Philosophie genau unter die Lupe, entdeckt man Erstaunliches: Ohne es explizit so zu nennen, hat sich Nikolaus von Kues durchaus technischen Fragestellungen gewidmet und seine Gedanken sind obendrein erstaunlich modern. Jürgen H. Franz hat die Schriften analysiert und aus ihnen neben einer Technikphilosophie, eine moderne Technikethik, einen Ethikkodex für Ingenieure und Techniker sowie Reflexionen über Nachhaltigkeit entwickelt. Sein Buch lädt ein, historisch einen Schritt zurückzutreten und den Blickwinkel auf die (...) gegenwärtigen Fragen und Probleme in den Bereichen Technik und Nachhaltigkeit um Cusanus’ Perspektive zu erweitern. In 1924, not quite two years after receiving his doctorate from the University of Vienna, Eric Voegelin was named a Laura Spelman Rockefeller Memorial Fellow and thus given the opportunity to pursue postdoctoral studies in the United States. For the next twenty-four months, Voegelin worked with some of the most creative scholars in America and at several of the country's great universities, an experience that undoubtedly influenced his scholarly and personal perspectives throughout his life. A more immediate result was the (...) publication in 1928 of _On the Form of the American Mind,_ the young philosopher's first major work, in which his acute perceptions and analyses combine with a conceptual vocabulary struggling to find its own coherence and form. Voegelin begins his inquiry into the form of the American mind with a complex discussion of the concepts of time and existence in European and American philosophy and continues with an extended interpretation of George Santayana, a study of the Puritan mystic Jonathan Edwards, a presentation on Anglo-American jurisprudence, and a consideration of the historian, economist, and political scientist John R. Commons. Although admitting that this diversity of themes seems only loosely connected," Voegelin demonstrates the actual overall unity of these various subjects: each concerns linguistic expressions of a theoretical nature. Analysis of _On the Form of the American Mind_ indicates that Voegelin integrated the approaches of _Lebensphilosophie_ into what Georg Misch called the "philosophical combination of anthropology and history," which characterized contemporary trends within the discourse of the _Geisteswissenschaften_ and finally resulted in a theoretical paradigm of philosophical anthropology. Jürgen Gebhardt and Barry Cooper provide access to this brilliant study with their two-part introduction. The first part considers _On the Form of the American Mind_ in the context of methodological debates ongoing in Germany at the time Voegelin was writing the book; the second describes Voegelin's American experience and compares his work with similar studies written during the post-World War I period. In Between Facts and Norms, Jürgen Habermas works out the legal and political implications of his Theory of Communicative Action (1981), bringing to fruition the project announced with his publication of The Structural Transformation of the Public Sphere in 1962. This new work is a major contribution to recent debates on the rule of law and the possibilities of democracy in postindustrial societies, but it is much more. The introduction by William Rehg succinctly captures the special nature of the work, (...) noting that it offers a sweeping, sociologically informed conceptualization of law and basic rights, a normative account of the rule of law and the constitutional state, an attempt to bridge normative and empirical approaches to democracy, and an account of the social context required for democracy. Finally, the work frames and caps these arguments with a bold proposal for a new paradigm of law that goes beyond the dichotomies that have afflicted modern political theory from its inception and that still underlie current controversies between so-called liberals and civic republicans. The book includes a postscript written in 1994, which restates the argument in light of its initial reception, and two appendixes, which cover key developments that preceded the book. Habermas himself was actively involved in the translation, adapting the text as necessary to make it more accessible to English-speaking readers. (shrink)

Over the last half decade or so, Jürgen Habermas has increasingly employed the interview format, both as a means of presenting his changing views on philosophical topics in an accessible way, and as a means of debating current social and political issues. This article contains reflections on the further structural transformation of the public sphere, building on the author’s widely-discussed social-historical study, The Structural Transformation of the Public Sphere, which originally appeared in German in 1962 (English translation 1989). The first three sections contain preliminary theoretical reflections on the relationship between normative and empirical theory, the deliberative understanding of democracy, and the demanding preconditions of the stability of democratic societies under conditions of capitalism. The fourth section turns to the implications of digitalisation (...) for the account of the role of the media in the public sphere developed in the original work, specifically to how it is leading to the expansion and fragmentation of the public sphere and is turning all participants into potential authors. The following section presents empirical data from German studies which shows that the rapid expansion of digital media is leading to a marked diminution of the role of the classical print media. The article concludes with observations on the threats that these developments pose for the traditional role of the public sphere in discursive opinion and will formation in democracies. (shrink)

In diesem Beitrag werden die Anfänge der GTA und der Gestalt Theory ab Ende der 1970er Jahre nachgezeichnet. Diese Anfänge waren angesichts der Zerschlagung der Gestaltpsychologie und der Vertreibung eines großen Teils ihrer akademischen Vertreter durch das Nazi Regime überaus schwierig: War mit dem Ende des sog. „Dritten Reiches“ die Nazi-Ideologie in Deutschland noch keineswegs überwunden, was sich u.a. auch darin zeigte, dass man sich nicht erinnern mochte, welche bedeutende international geachteter Richtung mit der Berliner Schule der Gestaltpsychologie vor dem (...) Nazi-Regime die Psychologie in Deutschland prägte, geschweige denn, dass man sich bemüht hätte, führende Vertreter zurück zu gewinnen. Der Fokus der Darstellung ist aber auch auf die beiden Persönlichkeiten Hans-Jürgen Walter und Hilarion Petzold gerichtet, die aus der Gestalttherapie kommend umfassende Konzepte von Psychotherapeutischem Verständnis entwickelten, die unter der Bezeichnung „Gestalttheoretische Psychotherapie“ und „Integrative Therapie“ wichtige Grundsteine auch für heutige Diskurse darstellen. Beide konnten am 25. März 2024 ihren 80. Geburtstag feiern, wobei die Gratulation seitens der GTA auch das Gedenken an Rainer Kästl einschließt, der ebenfalls für die Entwicklung der Gestalttheoretischen Psychotherapie Bedeutendes beigetragen hat, seinen 75. Geburtstag in 2024 aber aufgrund seines frühen Todes (2020) nicht begehen konnte. (shrink)
