President Trump’s decision to move his official state of residence from high-tax New York to no (income)-tax Florida has brought public attention to an issue that has long troubled scholars, designers and administrators of income tax systems: how the interaction of tax rules deferring the taxation of income and tax rules based on residency allows taxpayers to reduce and even avoid taxation of their deferred income. These discontinuities in tax treatment may lead to excessive migration, as well as reductions in (...) state income tax revenues and distortions in the design of state taxing mechanisms. This Article explains what states would have to do to eliminate these avoidance opportunities. However, it also points out that many of these policy changes would create other tax discontinuities. Ultimately, it leaves open the question whether making any of these changes would lead to fewer financial and behavioral distortions. (shrink)

In Anti‐Oedipus, Deleuze and Guattari aim to describe schizophrenia in a positive manner. According to them, the schizophrenic lives on the intensive order. To fully comprehend what this means, it is key to address some of Deleuze's insights regarding the notion of intensity in relation to experience and cognition. This is why I will combine ideas from Anti‐Oedipus with theory from Difference and Repetition, in order to explain Deleuze and Guattari's conception of intensity in its relation to common sense and (...) to schizophrenia. According to this conception (a), intensity is the condition of possibility and limit for the sensible; (b) it becomes covered over by the organizing principles of common sense, which make our affects more workable and recognizable; and (c) this process of organization must hang together with the codification of desire through Oedipus, the main organizational principle of the socius. On the back of these theoretical considerations, I will explain what it means to say that the schizophrenic lives amongst intensities: (a) this involves a lack of codification of desire and thus of common sense, meaning an absence of organizational principles; and (b) this perspective leads to a different understanding of the schizophrenic's experience and expression, with very concrete implications for a clinical approach to schizophrenia. IntroductionMilitary personnel and Veterans are at increased risk of mental and physical health conditions, which can impact their families. Spouses often perform a vital role in caring for service members and Veterans facing illness or injury, which can lead to caregiver burden. In turn, this may contribute to relationship issues. Research suggests that ensuring that spouses are well supported can alleviate some of these negative effects. The current study examined whether social support received by spouses of newly released Veterans buffers (...) the impact of Veterans’ health on caregiver burden, subsequently impacting spouses’ relationship satisfaction.MethodsData were collected as part of the Canadian Armed Forces Transition and Well-being Survey. The sample included N = 595 spouses of Regular Force Veterans who released in 2016 with at least 2 years of service. We examined Veterans’ mental and physical health and spouses’ caregiver burden, social support, and relationship satisfaction. A moderated mediation model was tested using structural equation modeling.ResultsThere was a significant indirect association between Veterans’ health and spouses’ relationship satisfaction through caregiver burden. Furthermore, social support moderated the association, as evidenced by a weaker association between Veterans’ health and caregiver burden at low levels of social support compared to high levels.ImplicationsFindings suggest additional efforts should be made to ensure sufficient support is provided to spouses, especially when they are caring for a service member or Veteran facing illness or injury, to strengthen their families’ well-being. Sankey shows how civic participation in the ECCC has played a key role in surfacing the gendered harms of separation and starvation. Turan highlights the problems with ICC exclusion of the experience of men and boys from sexual violence. Peroni expresses her hesitations over the Istanbul Convention given an association (...) between assumed vulnerability and migrant women, while admiring its uncoupling of violence and culture. Cruz’s interview with Wendy Brown contextualizes and expands on these themes as they consider, with other participants, the future of feminist theory in the context of neo-liberal capturing of rights and legal space. Thinking more about internationalism and commitment in this context also helps us hold a mirror up to ourselves as we reflect more critically on our own naming of FLS as an ‘international’ journal. Together these contributions, and the reviews of new work, play a role in fleshing out an editorial commitment to enacting the journal as a living thing that ‘hangs together somehow’ even as it is known differently in different places. Nous nous attachons à comparer (...) le rôle que Hobbes et Spinoza font jouer aux passions dans l’élaboration de leurs doctrines politiques : tandis que Hobbes témoigne d’un souci constant des passions, tout en les mettant à l’écart lorsqu’il s’agit de penser la construction et le fonctionnement de l’édifice politique, Spinoza permet de penser deux groupes de passions – celles qui résistent nécessairement au corps politique et celles qui lui font obstacle ponctuellement. Ces dernières constituent tout à la fois des facteurs de décomposition et de recomposition du corps collectif. Cette approche du politique à partir des causes de sa dissolution permet d’apporter un éclairage à la signification du droit naturel moderne tel qu’il se construit chez Hobbes et chez Spinoza. This experiment uses quantitative and qualitative measures to address the effect of two syllabus statements on academic misconduct: one based on prohibitions and one on academic integrity. Students expressed favorable attitudes toward the statements, showed an increase in guilt compared to a control group, but showed no decrease in intentions to cheat. Including only a standard academic misconduct statement in one's syllabus is not sufficient to alter behavior, which should be acknowledged by faculty.

Antoine Arnauld is well known as a passionate defender of Jansenism, specifically Jansen’s view on the relation between freedom and grace. Jansen and, early in his career Arnauld, advance compatibilist views of human freedom. The heart of their theories is that salvation depends on both the irresistible grace of God and the free acts of created things. Yet, in Arnauld’s mature writings, his position on freedom seems to undergo a significant shift. And, by 1689, his account of freedom no longer (...) seems Jansenist. In this paper, we offer an interpretation of Arnauld’s mature view on freedom, with a focus on his claim that freedom requires a “power to the opposite.” In order to see what he means by this, we look to several under-examined texts in his corpus for clues about how he understands the related topics of “infallible determination,” habit, and primo-primi motus. We argue that Arnauld’s mature view on freedom should be understood as libertarian. (shrink)

The field of nanoscience and nanotechnology is expanding rapidly, promising great benefits for society in the form of better medicine, more efficient energy production, new types of materials, etc. Naturally, in order for the science and technology to live up to these promises, it is important to continue scientific research and development, but equally important is the ethical dimension. Giving attention to the social, ethical and legal aspects of the field, among others, will help in developing a fully responsible—and thereby (...) capable—science and technology. Nanoethics has emerged as a field concerned with such ethical issues related to nanoscience and nanotechnology. Even though this field is relatively new, a significant amount of literature has already been published. This paper focuses on three of the major issues which are discussed in the literature of nanoethics, and also points to a certain bias in this literature. Each quite different in nature, these issues are: (1) The naming and (2) the timing of and approach to the field, as well as (3) the issue of safety. As will be seen, these issues are almost exclusively discussed by ethicists, (throughout the article, the term’ethicist’ is used in a broad definition covering philosophers, social and political scientists as well as philosophers of science) thus having no direct influence on the work being carried out by scientists. One can argue, therefore, that this bias creates a distortion of the ethical debate, making it insufficient and misleading. Ultimately, this bias is caused by the lack of communication and collaboration between ethicists on the one hand, and nanoscientists on the other. Thus, an argument is made for the different disciplines to begin collaborating, so as to more effectively and responsibly develop the field of nanoscience. (shrink)

This article discusses the discourses of disability through a parallel `disabling' of its own text. It draws on literary as well as sociological sources in order to interrogate the nature and relations of the `tragic', the `heroic' and the `comic'. The authors offer the conclusion that the comic is never quite absent from the discourse of tragedy (after Kundera), and turn that insight back on their own text, in an attempt to refuse the solemnities and closures of their own narrative.

Surprise – these much-publicized rules are not the least bit reassuring to people who specialize in the study of ethics. While attention to ethics is certainly welcome, these ethical codes provide a too-easy cop-out, a way to neatly dispose of attention to nagging and pervasive problems. The typical professional code is little more than a checklist of rules that enables professionals of any stripe to give lip service to ethical behavior without engaging in continuing dialogue on ethical dilemmas. Neatly packaged (...) commandments short-circuit development of the reasoning tools to work through ethical challenges meaningfully and with long-lasting impact on the actual behavior in any field. The U.S. Supreme Court recently held that a parody by the rap group 2 Live Crew of Ray Orbison's song "Oh, Pretty Woman" was "fair use" and thus did not infringe the copyright. Although the court insisted that it was not evaluating the quality of the parody, I argue that it does in fact make several aesthetic evaluations and sometimes even seems to praise the content of the parody. I first consider the stated reasons for the claimed refusal of the (...) court to evaluate aesthetic quality. Second, I examine the evaluations which the court in fact does make, at least some of which are clearly aesthetic evaluations. I then argue that aesthetic value judgments are both necessary and possible for determinations of "fair use" for such works as the "Pretty Woman" parody. (shrink)

When the Argonauts reach the island of Lemnos, Apollonius of Rhodes tells us, they send their herald Aethalides to the ruler of the island. Such a means of establishing contact and requesting safe passage was the norm in the Homeric world; there heralds acted as intermediaries between commanders and subordinates or between groups of people. In preliterate societies, heralds facilitated communication: messages were transmitted through memorization and repetition rather than by means of writing. While verbatim repetition was no doubt a (...) necessary feature of this form of communication, its wholesale transference into Homeric poetry was not necessarily the logical corollary. Nonetheless, we know of such repetitions precisely because of their appearance in the Homeric poems. It is now widely accepted that such passages are a result of the oral style of composition in which the oral poet repeats passages just as he uses shorter formulaic phrases. The debate embedded in the A-scholia of the Iliad suggests that repeated passages were a source of contention already in antiquity. While it is more common to see the scholiasts trying to decide which passage is ‘correct’ and which should be athetized, this provides evidence that athetization was not a unanimous impulse. The scholiast defends 2.60–71, part of which is repeated for the third time, against Zenodotus. (shrink)

Background: Understanding is an important goal of the informed consent process in research. We sought to assess the interrater reliability (IRR) and concurrent validity of two measures of understanding in child and young adult subjects and their parents. Methods: We conducted a cross-sectional survey and interview-based study of children and young adults participating in a clinical trial for cancer, along with one parent per child or young adult subject. We estimated the IRR of the Semi-Structured Comprehension Interview (SSCI) and the (...) MacArthur Competence Assessment Tool for Clinical Research (MacCAT-CR). We also estimated concordance between the SSCI, the MacCAT-CR, and the Quality of Informed Consent (QuIC). Results: For our sample of 32 subjects (16 parent–child pairs), IRR estimates were high for total score on the SSCI (intraclass correlation coefficient [ICC] = 0.88, 95% confidence interval [CI] = 0.76–0.94), as well as on the understanding (ICC = 0.93, 95% CI = 0.86–0.97) and reasoning (ICC = 0.97, 95% CI = 0.94–0.98) subscales of the MacCAT-CR. IRR was lower for the appreciation subscale of the MacCAT-CR (ICC = 0.70, 95% CI = 0.47–0.84). Scores on the SSCI were strongly correlated with scores on the understanding subscale of the MacCAT-CR (Spearman's rho = 0.72, 95% CI = 0.48–0.85) and the QuIC (Spearman's rho = 0.66, 95% CI = 0.24–0.87). Mean administration time for the SSCI was 3.1 minutes (95% CI = 2.7–3.5 minutes). Conclusions: The SSCI is a valid and reliable measure of understanding for use with both pediatric and adult research participants. It is easy to administer and score consistently, even by nonprofessional raters. The SSCI is a promising tool for use by clinician-investigators to study, detect, and correct deficiencies in understanding among children, adolescents, and adults making decisions about research participation. The National Institutes of Health and other federal health agencies are considering establishing a national biobank to study the roles of genes and environment in human health. A preliminary public engagement study was conducted to assess public attitudes and concerns about the proposed biobank, including the expectations for return of individual research results. A total of 141 adults of different ages, incomes, genders, ethnicities, and races participated in 16 focus groups in six locations across the country. Focus group participants voiced (...) a strong desire to be able to access individual research results. Recognizing the wide range of possible research results from a large cohort study, they repeatedly and spontaneously suggested that cohort study participants be given ongoing choices as to which results they received. This article discusses what is involved in having full moral status, as opposed to a lesser degree of moral status and surveys different views of the grounds of moral status as well as the arguments for attributing a particular degree of moral status on the basis of those grounds.

Key issues in epistemology for the most part have to do with epistemic values such as justification, truth, and knowledge—that is, values related to the epistemic status of our propositional attitudes, mental events, and states. However, another important issue that is worth examining is the extent to which a subject is in a position to evaluate the strength of her epistemic position. In this paper, I wish to emphasize two properties of our mental states that play a decisive part in (...) that respect: their opacity and transparency. In the following, I will assume that a mental state is opaque whenever it presents itself with no underlying reason, whereas states that are supported by apparent reasons are transparent. One main argument that I will defend is that even when the opacity and transparency of our mental states are not reliable cues, still they remain highly informative. Notably, I draw some implications relative to the externalist/internalist debate in epistemology. I examine the claim that only mental states that are justified are well grounded or justification conferring and the idea that often stands behind, that is, that only states whose reasons are accessible are justified—namely, the Accessibility Requirement. I also examine the source of a recent debate in epistemology: the epistemic status of our intuitive states, as these are perfect instances of opaque mental states. I conclude that intuitive states in some respect are less misleading than states that are supported by apparent reasons. (shrink)

This paper discusses the so-called non-interference assumption (NIA) grounding causal inference in trials in both medicine and the social sciences. It states that for each participant in the experiment, the value of the potential outcome depends only upon whether she or he gets the treatment. Drawing on methodological discussion in clinical trials and laboratory experiments in economics, I defend the necessity of partial forms of blinding as a warrant of the NIA, to control the participants’ expectations and their strategic interactions (...) with the experimenter. On July 5, 2012 the Investigation Committee on the Accident at the Fukushima Nuclear Power Stations of the Tokyo Electric Power Company (TEPCO) issued a final, damning report. Its conclusions show that the human group – constituted by the employees of TEPCO and the control organism – had partial and imperfect epistemic control on the nuclear power plant and its environment. They also testify to a group inertia in decision-making and action. Could it have been otherwise? Is not a collective (...) of human beings, even prepared in the best way against nuclear risk, de facto prone to epistemic imperfection and a kind of inertia? In this article, I focus on the group of engineers who, in research and design offices, design nuclear power plants and model possible nuclear accidents in order to calculate the probability of their occurrence, predict their consequences, and determine the appropriate countermeasures against them. I argue that this group is prone to epistemic imperfection, even when it is highly prepared for adverse nuclear events. (shrink)

From the Supreme Court to the bedroom, privacy is an intensely contested interest in our everyday lives and privacy law. Some people appeal to privacy to protect such critical areas as abortion, sexuality, and personal information. Yet, privacy skeptics argue that there is no such thing as a right to privacy. I argue that we cannot abandon the concept of privacy. If we wish to avoid extending this elusive concept to cover too much of our lives or shrinking it to (...) cover too little, we must come to understand it. After exploring the privacy arguments of philosophers and constitutional and tort privacy law, I argue for a new definition of privacy and an explanation of its value that clarifies and resolves many of our conflicts. Privacy is critical because it allows us to protect a realm in which we can have intimate relations with others. (shrink)
