In her latest writing on the trolley problem, 'Turning the Trolley,' Judith Jarvis Thomson defends the following counter-intuitive position: if confronted with a choice of allowing a trolley to hit and kill five innocent people on the track straight ahead, or turning it onto one innocent person on a side-track, a bystander must allow it to hit the five straight ahead. In contrast, Thomson claims, the driver of the trolley has a duty to turn it from the five onto (...) the one. Thomson’s argument is fundamentally flawed in several important ways. We explain her argument and identify its major flaws. Our aims are: (a) to show that Thomson has not provided reason to think such an act is not permissible, and (b) to use the process of exposing the weaknesses in different parts of her argument to demonstrate the importance of undertaking what we call a Hohfeldian analysis of the 'mechanics' of the rights in play. A Hohfeldian 'mechanics' of rights extends the distinctions that Hohfeld first introduced to take into account the pro tanto normative 'forces' at work on an agent, the balance of which determines who in the end has what kind of right. Judith Jarvis Thomson recently argued that it is impermissible for a bystander to turn a runaway trolley from five onto one. But she also argues that a trolley driver is required to do just that. We believe that her argument is flawed in three important ways. She fails to give proper weight to (a) an agent¹s claims not to be required to act in ways he does not want to, (b) impartiality in the weighing of competing patient-claims, and (c) (...) the role of patient-claims in determining agent-duties. All three of these failures can be understood in terms of what we call the Mechanics of Claims, an approach we develop for identifying and balancing competing claims in determining rights. Using that framework, one can see both why Thomson's most recent argument is mistaken, and how to think more clearly about deontological choices generally. (shrink)

While procreation is ubiquitous, attention to the ethical issues involved in creating children is relatively rare. In Debating Procreation, David Benatar and David Wasserman take opposing views on this important question. David Benatar argues for the anti-natalist view that it is always wrong to bring new people into existence. He argues that coming into existence is always a serious harm and that even if it were not always so, the risk of serious harm is sufficiently great to make procreation (...) wrong. In addition to these "philanthropic" arguments, he advances the "misanthropic" one that because humans are so defective and cause vast amounts of harm, it is wrong to create more of them.David Wasserman defends procreation against the anti-natalist challenge. He outlines a variety of moderate pro-natalist positions, which all see procreation as often permissible but never required. After criticizing the main anti-natalist arguments, he reviews those pronatalist positions. He argues that constraints on procreation are best understood in terms of the role morality of prospective parents, considers different views of that role morality, and argues for one that imposes only limited constraints based on the well-being of the future child. He then argues that the expected good of a future child and of the parent-child relationship can provide a strong justification for procreation in the face of expected adversities without giving individuals any moral reason to procreate. The paper presents a set of games of competition between two or three players in which reward is jointly determined by a stochastic biased mechanism and players’ choices. More specifically, a resource can be found with unequal probabilities in one of two locations. The first agent is rewarded only if it finds the resource and avoids being found by the next agent in line; the latter is rewarded only if it finds the former. Five benchmarks, based on different psychological and (...) game-theoretic assumptions are derived and their predictions compared to actual behavior of 120, 40, and 48 participants playing repeatedly. Of the five benchmarks—the unique (Nash) equilibrium, reinforcement learning, trust-based efficiency, maximum unpredictability, and regret-based (Impulse Balance) equilibrium—regret for missed opportunities best accounts for the qualitative aspect of participants’ behavior and regret attenuated by randomization best accounts for the quantitative aspect of behavior. Hannah Arendt began her scholarly career with an exploration of Saint Augustine's concept of _caritas_, or neighborly love, written under the direction of Karl Jaspers and the influence of Martin Heidegger. After her German academic life came to a halt in 1933, Arendt carried her dissertation into exile in France, and years later took the same battered and stained copy to New York. During the late 1950s and early 1960s, as she was completing or reworking her most influential studies of (...) political life, Arendt was simultaneously annotating and revising her dissertation on Augustine, amplifying its argument with terms and concepts she was using in her political works of the same period. The disseration became a bridge over which Arendt traveled back and forth between 1929 Heidelberg and 1960s New York, carrying with her Augustine's question about the possibility of social life in an age of rapid political and moral change. In _Love and Saint Augustine_, Joanna Vecchiarelli Scott and Judith Chelius Stark make this important early work accessible for the first time. Here is a completely corrected and revised English translation that incorporates Arendt's own substantial revisions and provides additional notes based on letters, contracts, and other documents as well as the recollections of Arendt's friends and colleagues during her later years. This article examines three terms associated with the take-up of Foucault’s analysis of the biopolitical, namely identity, nature and life. It argues that Foucault opposes their reduction respectively to sameness, to origin, or to some primordial force. These reductions not only fall into species of metaphysics, they fail to recognize the integration of difference and of constitutive relationality in Foucault’s conceptualization of the process of subjectivation and becoming as historically dynamic and mobile. The article emphasizes the importance of historicization and (...) of a constructive genealogy in Foucault’s approach, running counter to metaphysics, and opening new avenues for political action based on the recognition of the interiority of resistance to dispositifs of power and of the creative force in individuation. This article posits that in Foucault’s later work we find not a forgetting of literature, but a reformulation of the role that literature had come to occupy in his work, and that, in this later work, there is a trace of the texts on literary thought that he wrote from the 1960s to the mid-1970s. Drawing upon Foucault’s later work, I reconsider the key question: What relationship does literature, as literature, have with the political dimension of discourses? RESUMEN El presente texto expone los resultados de un estudio prospectivo, del tipo de intervención comunitaria aplicado en la Clínica Estomatológica Docente La Vigía, provincia Camagüey, con el objetivo de instrumentar una estrategia educativa en pacientes con bruxismo y disfunción temporomandibular en el período de enero de 2017 a enero de 2018. Se diseñó y aplicó una estrategia educativa según la metodología utilizada por la Maestría Nacional de Educación para la salud. Predominó el sexo femenino y las edades comprendidas entre (...) los 24 y 29 años, así como el nivel escolar universitario. Al finalizar la intervención, el nivel de conocimientos fue evaluado de bueno en casi todos los pacientes, la apertura bucal limitada, el dolor muscular y articular aparecieron en menos de la mitad de los individuos; el nivel de satisfacción respecto a la intervención fue alto. Se concluyó que la estrategia generó un impacto positivo en los pacientes estudiados. ABSTRACT The present text exhibits the results of a pilot study, of the type of community intervention applied in the Dentistry University Clinic La Vigía, Camagüey province, with the objective to arrange an educational strategy in patients with bruxism and temporomandibular dysfunction in the period from January, 2017 until January, 2018. It was designed and applied an educational strategy as the methodology used by the National Mastery of Education for the health. It predominated over the feminine sex and the ages understood between 24 and 29 years, as well as over the university school level. On having finished the intervention, the knowledge level was evaluated of good in almost all the patients, the limited mouth opening, the muscular pain and to articulate appeared in less than half of the individuals; the satisfaction level with regard to the intervention was high. It was concluded that the strategy generated a positive impact in the studied patients. (shrink)

Background: The aim of this study was to investigate associations between demographic and clinical variables and duration of untreated psychosis (DUP) in a sample of cases of psychosis across an adult early intervention in psychosis service and a child and adolescent community team. Method: Cross-sectional baseline data for cases of psychosis across the two teams on the caseload at a given time point were collected, including age of onset, gender, ethnicity, referral route, and DUP. Results: The median DUP across the (...) entire sample was 91 days, while those patients with initial treatment for psychosis from the child and adolescent team had a median DUP of 69 days. Using multiple linear regression, there were two variables that showed a significant association with DUP: referral route (p < .001), and age of onset, with earlier age of onset associated with shorter DUP (p = .015). Conclusion: These findings are discussed in relation to possible explanatory factors, with particular focus on service-level variables and pathways to care. It is suggested that the involvement of child and adolescent teams is vital to the work of early intervention in psychosis services. (shrink)

One of the themes that this volume brings out is the endurance and contemporary relevance of some of Schopenhauer’s most pressing concerns. In a sense, he is right to be ahistorical: is it not this reaching out of its time that makes a (...) work a classic, eternal even? Principal among these concerns of course is the question of how to respond as plagues overwhelm us (which is Schopenhauer’s description of existence in a normal state, the plague of existence rather than a plague within existence). His famous answer involves the negation of the will, the ascetic denial and rejection of desire. The protagonist of Edith Wharton’s 1904 short story “The Descent of Man” is both scien­tist and satirist. The target of his satire-“false interpreters” of evolutionary theory-allows Wharton to combine analysis of genre with inquiry into the cultural controversy Darwin’s ideas inspired. Anthropocentric anxieties explain popular preference for soothing “pseudo-science” over unsparing accounts of natural selection; they likewise explain widespread obtuseness to Professor Linyard’s ridicule of hazy illogic posing as science. Motivated more strongly by fitness interests than by allegiance to scientific (...) truth, however, the professor becomes complicit in widespread misreading of his own text. He thereby encourages the ignorance he intended to dispel, and Wharton highlights the ironies inherent in this self-sabotage. She insists that susceptibility to evolved adaptations is universal, moreover, and that it often impedes the discovery and promulgation of truth. (shrink)

Insights generated in the emerging field of evolutionary psychology offer a useful new framework for examining Edith Wharton's “Xingu.” The satiric wit energizing this well-known short story depends in large measure upon the obtuseness of its central characters, who embrace counterfactual estimations of their gifts and attainments: thwarting the operations of poetic justice in order to protect social reputation and self-image, they become objects of derision. Their behavior illustrates the workings of adaptive mechanisms for self-deception. Insofar as their comically exaggerated (...) commitment to false self-presentation illustrates universal features of evolved human nature, the target of Wharton's scorn is accordingly enlarged. Her narrative spotlights the psychological processes that sustain self-deception and scapegoating, raising serious questions concerning human claims to rational thought and ethical principle. Por isso uma discussão sobre o conceito de Moral e sua relação com Ética é apresentado. Discutir Ética significa entender o conceito na sociedade porque Ética não pode acontecer a uma pessoa sozinha. Pessoas se relacionam na (...) sociedade e Ética é o fundamento básico da vida social. Antes que se possa observar Ética na sociedade como um conjunto, é possível descobrir que Ética começa na vida da família. A escola é o lugar específico na sociedade que ajuda a família a construir a relação entre Ética e Educação. Filósofos e educadores concordam sobre a importância de educar crianças para serem cidadãos éticos, mas os conceitos de Ética que eles possam usar são de algum modo diferente. Ética Relativa e Ética Universal são os principais grupos de conceitos encontrados na literatura. Concluímos que para se tornar inteiramente um ser humano, cada pessoa precisa se sentir integrada à humanidade e isto somente é possível por meio de conceitos universais de ética. This article deals with the idea that it is necessary to identify a concept of Ethics in order to discuss about its relation to Education. Moral is a concept that comes to mind when we think about Ethics. Because of this a discussion about this concept and its relation to Ethics is presented. To discuss Ethics means to understand it in society because it can’t happen to a person alone. People relate themselves in society and Ethics is the basic foundation to social life. Before we can observe Ethics in society as a whole it is possible to discover that Ethics begins in family life. School is the specific place in society that helps family to build the relation between Ethics and Education. Philosophers and educators agree about the importance of educating children to be ethical citizens but concepts of Ethics they may use are somehow different. Relative Ethics and Universal Ethics are the major groups of concepts that we can find in literature. We conclude that to become a whole human being each person needs to feel integrated to humankind and this is only possible through universal concepts of Ethics. 'Community' and 'justice' recur in anthropological, historical, and legal scholarship, yet as concepts they are notoriously slippery. Historians and lawyers look to anthropologists as 'community specialists', but anthropologists often avoid the concept through circumlocution: although much used by historians, legal thinkers, and political philosophers, the term remains strikingly indeterminate and often morally overdetermined. 'Justice', meanwhile, is elusive, alternately invoked as the goal of contemporary political theorizing, and wrapped in obscure philosophical controversy. A conceptual knot emerges in much legal and political (...) thought between law, justice, and community, but theories abound, without any agreement over concepts.The contributors to this volume use empirical case studies to unpick threads of this knot. Local codes from Anglo-Saxon England, north Africa, and medieval Armenia indicate disjunctions between community boundaries and the subjects of local rules and categories; processes of justice from early modern Europe to eastern Tibet suggest new ways of conceptualizing the relationship between law and justice; and practices of exile that recur throughout the world illustrate contingent formulations of community. In the first book in the series, Legalism: Anthropology and History, law was addressed through a focus on local legal categories as conceptual tools. Here this approach is extended to the ideas and ideals of justice and community. Rigorous cross-cultural comparison allows the contributors to avoid normative assumptions, while opening new avenues of inquiry for lawyers, anthropologists, and historians alike. (shrink)

The article follows the hypothesis that the aesthetic dimension of the standpoint of reason provides the main element for an appropriate perspective on how the interplay between rationality and irrationality is able to contribute to practical self-determination as a person. The starting point is formed by the critical discussion of the position considering that it is possible to derive the normative implications of practical reasonableness and self-determination from an abstract momentum of reflective distance. Whilst taking a look on Christine Korsgaard’s (...) version of this idea it becomes clear that it rests on a conception of the practical standpoint that suffers both from a lack of methodological self-reflection and from neglecting the special features and potentials of irrational actions and experiences. The following text shows how the search for an alternative conception, which takes both aspects into account, benefits from a comparison with psychoanalysis, since this discipline is able to methodologically refer back philosophy to the original potential it unfolds in its aesthetic perspectives on practical standpoints. Der Beitrag nimmt aktuelle Annäherungen und Überschneidungen zum Anlass, um das Verhältnis von Kunst und Design neu zu betrachten: In der Gegenüberstellung beider Formen ästhetischer Gemachtheit lässt sich ein besonderes Zusammenspiel von Produktion, Werk und Rezeption herausarbeiten. Dieses öffnet auch den Blick darauf, welche Form ästhetische Selbstvergegenwärtigung als emanzipatorische Praxis annehmen kann. Die Argumentation folgt zwei Überlegungen: Zum einen wird gezeigt, dass das Design seit längerem eine Entwicklung durchläuft, die seine Prägung von Prozessen menschlicher Lebensführung und Subjektivierung deutlich verstärkt. Dies (...) hängt auch damit zusammen, dass das Design gegenüber der Kunst über eigenständige Möglichkeiten verfügt, Produktion und Rezeption miteinander zu verbinden. Zum anderen wird gezeigt, dass gerade die gleichberechtigte Zusammenarbeit von Kunst und Design neue Wege eröffnet, ästhetische Perspektiven auf individuelle und kollektive Problemstellungen zu werfen und neue Praktiken zu entwickeln. Ausgehend von diesen Beobachtungen votiert der Beitrag dafür, ästhetische Theoriebildung im Spannungsfeld von Produktion und Rezeption wie Kunst und Design zu betreiben. (shrink)
