The emerging concept of systems medicine (or ‘P4 medicine’—predictive, preventive, personalized and participatory) is at the vanguard of the post-genomic movement towards ‘precision medicine’. It is the medical application of systems biology, the biological study of wholes. Of particular interest, P4 systems medicine is currently promised as a revolutionary new biomedical approach that is holistic rather than reductionist. This article analyzes its concept of holism, both with regard to methods and conceptualization of health and disease. Rather than representing a medical (...) holism associated with basic humanistic ideas, we find a technoscientific holism resulting from altered technological and theoretical circumstances in biology. We argue that this holism, which is aimed at disease prevention and health optimization, points towards an expanded form of medicalization, which we call ‘holistic medicalization’: Each person’s whole life process is defined in biomedical, technoscientific terms as quantifiable and controllable and underlain a regime of medical control that is holistic in that it is all-encompassing. It is directed at all levels of functioning, from the molecular to the social, continual throughout life and aimed at managing the whole continuum from cure of disease to optimization of health. We argue that this medicalization is a very concrete materialization of a broader trend in medicine and society, which we call ‘the medicalization of health and life itself’. We explicate this holistic medicalization, discuss potential harms and conclude by calling for preventive measures aimed at avoiding eventual harmful effects of overmedicalization in systems medicine (quaternary prevention). In 1935, when the U.S. Supreme Court’s new building opened and displayed the phrase “Equal Justice Under Law,” racial segregation was commonplace, as were barriers limiting opportunities for men and women of all colors to participate in economic and political life. The justices on the Court and the lawyers appearing before them reflected those facts; almost all were white men. Today, the Supreme Court’s inscription has become its motto, read as if it always referenced an understanding of equality that has (...) become central to the identity and the legitimacy of courts. The judiciary “looks” somewhat different than it did and, in a sense, has become more “representative” of the range of people appearing in courts. Given the role that courts had played in sustaining discrimination, the impression that courts ought to welcome everyone is a major achievement. Yet, to assess the impact of new judicial demographics requires analysis of other major alterations in U.S. courts—the influx of diverse litigants newly entitled to pursue legal claims; the economic barriers facing many claimants; the emergence of judiciaries as agency-like promoters of agendas; and the displacement of public adjudication through the privatization of dispute resolution. Studies of women as judges focus mostly on their rulings, but probing the “difference that difference makes” requires looking beyond judicial opinions. Courts in the United States have developed structural capacities to propose rules and legislation, create education programs, commission research and task forces, and lobby for resources. When women of all colors and men of color became lawyers and judges, they created affinity organizations and pressed courts to research court-based bias and to revise rules of ethics, doctrine, and practice. Those changes are part of the impact of diversification within the legal profession, as is the backlash against affirmative efforts to reform practices. Another difference of the last decades is that new rights have brought into court many claimants with limited means. Participatory participation remains elusive, while the “justice gap” is pervasive. Worse yet, in some jurisdictions, courts have served as “revenue centers,” using court-imposed assessments as income. Failure to pay “legal financial obligations” can result in suspension of driver’s licenses, the loss of voting rights, and other sanctions levied disproportionately on people who are poor and of color. Instead of being seen as fonts of fairness, courts are coming to be identified as sites of inequality. In addition, many courts have embraced alternative forms of dispute resolution that make both processes and outcomes less visible to the public. Through doctrine and rules, U.S. courts have shifted their own practices as well as enforced mandates imposed on consumers and employers that push them out of court and out of class or joint actions. In sum, the new faces on the bench ought not to obscure that the project of representation, inclusion, and equality is far from complete. The vivid inequalities in courts are problems for courts because such disparities undermine their ability to be places of justice. (shrink)

While many ambitions remain visionary, steps to personalize medicine are already taken via personalized genomics, mobile health technologies and pilot projects. An important aim of P4 medicine is to enable disease prevention among healthy persons through detection of risk factors. In this paper, we examine the current status of P4 medicine (...) in light of historical and current challenges to predictive and preventive medicine, including overdiagnosis and overtreatment. Moreover, we ask whether it is likely that in silico integration of patient-specific data will be able to better deal such challenges and to turn risk predictions into disease-preventive actions in a wider social context. Given the lack of evidence that P4 medicine can tip the balance between benefits and harms in preventive medicine, we raise concerns about the current promotion of P4 medicine as a solution to the current challenges in public health. Friedrich Wilhelm Joseph Von Schelling (1775-1854) was a colleague of Hegel, Holderlin, Fichte, Goethe, Schlegel, and Schiller. Always a champion of Romanticism, Schelling advocated a philosophy which emphasized intuition over reason, which maintained aesthetics and the creative imagination to be of the highest value. At the same time, Schelling's concerns for the self and the rational make him a major precursor to existentialism and phenomenology. Schelling has exercised a subterranean influence on modern thought. His diverse writings have not given rise (...) to a system or school of thought; rather, individual philosophers have been influenced by the resonance of his ideas and their influence on contemporary ideas and movements. The New Schelling brings together a wide-ranging set of essays which elaborate the connections between Schelling and other thinkers - such as Marx, Nietzsche, Freud, Sartre, Deleuze, and Lacan - and argue for the unexpected modernity of Schelling's work. As feminist theory explicates its fundamental principles – justice for the oppressed – it can lose its essential focus on the situation of women. One example is the inattention to nurses within feminist bioethics. Nurses deserve attention because most are women, but also because their lack of power is paradigmatic of patriarchy. Those examining ethics consultations should discuss whether nurses are allowed to request them. But feminists also need to imagine ways in which nurses can be heard when, for instance, (...) their worklives are “redesigned.” Doing so would also allow attention to other classes of the disempowered. In this article I examine the relation between the philosophies of Maurice Merleau-Ponty and Gilles Deleuze by looking at the way in which they refer to Henri Bergson’s time theory. Although Merleau-Ponty develops some fundamental Bergsonian insights on the nature of time, he presents himself as a critical reader of the latter. I will show that although Merleau-Ponty’s interpretation of Bergson differs fundamentally from Deleuze’s interpretation, Merleau-Ponty’s “corrections” of Bergson’s theory fit Deleuze’s reading of Bergson very well. This indicates a (...) similarity with respect to what is at stake in the philosophies of Merleau-Ponty and Deleuze. Hence the critical reference that Deleuze makes to Merleau-Ponty’s conception of cinema and thus of movement is not justified, but is the result of a selective and prototypical reading of the early Merleau-Ponty. This paper explores the effects of incidental guilt on Socially Responsible Investment (SRI) decisions of retail investors. Do investors who feel guilty invest more in SRIs to clear their conscience? Are guilty investors willing to sacrifice returns to restore their moral selves? Using survey data from an online quasi-experiment among a sample of US retail investors, we find that individuals who experience incidental guilt are willing to invest more in SRI funds than those in a neutral state. We show that (...) this effect, albeit moderate in magnitude, cannot be explained solely by differences in retail investors’ moral reasoning, attitudes towards social responsibility, risk tolerance and demographic factors. When presented with a trade-off between sustainability, risk and return characteristics of the funds, guilty investors are more willing to sacrifice returns for greater sustainability than non-guilty participants. Our research provides new evidence of the effect that incidental guilt has on the sustainable investing decisions of retail investors. (shrink)

Multimedia learning research addresses the question of how to design instructional material effectively. Signaling and adding graphics are typical instructional means that might support constructing a mental model, particularly when learning abstract content from multiple representations. Although signals can help to select relevant aspects of the learning content, additional graphics could help to visualize mentally the subject matter. Learners’ prior knowledge is an important factor for the effectiveness of both types of support: signals and added graphics. Therefore, we conducted an (...) experimental study situated in a university course of computer science with N = 124 participants. In our 2 × 2 factorial design, we investigated the effects of signals and illustrating graphics on learning outcomes and their potential interplay. Based on our regression analysis, we revealed prior knowledge as a significant moderator. Although learners with low levels of prior knowledge can profit from all types of help but still gain rather weak learning outcomes, learners with medium levels of prior knowledge profit from the synergy of both helps. With higher levels of prior knowledge, signals were particularly hampering. To improve the understanding of these supportive or hampering effects, a more fine-grained analysis of these processes and motivational effects is necessary. (shrink)

RESUMEN El presente texto expone los resultados de un estudio prospectivo, del tipo de intervención comunitaria aplicado en la Clínica Estomatológica Docente La Vigía, provincia Camagüey, con el objetivo de instrumentar una estrategia educativa en pacientes con bruxismo y disfunción temporomandibular en el período de enero de 2017 a enero de 2018. Se diseñó y aplicó una estrategia educativa según la metodología utilizada por la Maestría Nacional de Educación para la salud. Predominó el sexo femenino y las edades comprendidas entre (...) los 24 y 29 años, así como el nivel escolar universitario. Al finalizar la intervención, el nivel de conocimientos fue evaluado de bueno en casi todos los pacientes, la apertura bucal limitada, el dolor muscular y articular aparecieron en menos de la mitad de los individuos; el nivel de satisfacción respecto a la intervención fue alto. Se concluyó que la estrategia generó un impacto positivo en los pacientes estudiados. ABSTRACT The present text exhibits the results of a pilot study, of the type of community intervention applied in the Dentistry University Clinic La Vigía, Camagüey province, with the objective to arrange an educational strategy in patients with bruxism and temporomandibular dysfunction in the period from January, 2017 until January, 2018. It was designed and applied an educational strategy as the methodology used by the National Mastery of Education for the health. It predominated over the feminine sex and the ages understood between 24 and 29 years, as well as over the university school level. On having finished the intervention, the knowledge level was evaluated of good in almost all the patients, the limited mouth opening, the muscular pain and to articulate appeared in less than half of the individuals; the satisfaction level with regard to the intervention was high. It was concluded that the strategy generated a positive impact in the studied patients. (shrink)

Opening the doors of higher or further education beyond the enrollments in elite or select universities has become a greater necessity. This has spawned a movement to develop or expand institutions that are more affordable, accessible, flexible, and tied to business and industry. Artikkelen drøfter hvordan vi bør forstå kravet om likhet for loven i Grl. § 98. Vi spør hvorvidt en appell til likhet for loven har selvstendig normativ funksjon, og eventuelt hvorfor og hva som kreves for at likhetskravets skal realiseres. Artikkelen tar utgangspunkt i et behov for avklaring av disse spørsmålene, da verken forarbeidene til grunnlovsrevisjonen i 2014 eller etterfølgende rettsvitenskapelig litteratur, i særlig grad avklarer hva likhet for loven betyr. Vi utvikler en teori om at likhetsprinsippet i § 98 (...) er et grunnprinsipp for retten som fastlegger begrunnelsesbyrden ved utformingen av lov og annen regulering, og ved rettsanvendelsen. Likhetsprinsippet innebærer at likebehandling krever i seg selv ingen begrunnelse, mens ulikebehandling må kunne begrunnes i henhold til kravene i andre ledd. De to leddene i paragrafen er derfor etter vårt syn uatskillelige: Første ledd stadfester hva som er utgangspunktet, mens andre ledd presiserer hva som ikke regnes som relevante begrunnelser for ulikhet. Likhetskravet er dermed ikke et krav om likt utfall, men et krav om likeverdighet, som vi hevder er en konstitutiv verdi for verdien av politisk rettferdighet. Den forståelsen av likhetskravet i § 98 som vi utvikler, knytter første og andre ledd i § 98 sammen, og åpner for at også første ledd kan bli mer aktivt brukt av domstolene. (shrink)

Rachel Barney proposes that Plato’s theory of the tripartite soul is plausibly compared to scientific theories today. I depart from Barney by proposing that the tripartite soul is a model and that its status is hypothetical. And I raise four questions: What follows from the Plato-science comparison, as Barney conceives of it? Which questions emerge if science is looked at in the sophisticated mode that Barney employs in her discussion of Plato? Current science invokes a multitude of subsystems relevant to (...) motivation. Why compare it with tripartition? Stoic psychology may share more fundamental ideas with current science, including the premise that all goings-on in the soul are physiological movements. If tripartition is a model, why would one expect it to account for all dimensions of epistemic activity? (shrink)

Talk about evil resonates in ways that are culturally inherited. Historical and religious dimensions of “evil” often seem to be front and center. Nevertheless, we argue that it would be too quick to dismiss the study of evil within secular ethics. We defend an outlook that is inspired by ancient ethics—also called virtue ethics—which accepts the so-called Guise of the Good account of motivation. For an agent to be motivated to perform an action, something about the action must look good (...) to her. We argue that evil actions do not constitute exceptions to the Guise of the Good. To preserve this framework, we entertain a privative account of evil, according to which evil is the absence of the good, and yet appears in a positive light to the agent who performs an evil action. We reject the view that evil is quantitatively extreme badness. An account of evil should permit that some instances of evil are from a third person perspective not extremely bad. On this picture, evil is agent-relative; something can be evil relative to one person without being evil relative to another person. Accordingly, several qualities—rather than only one distinctive quality—can make an action evil. (shrink)
