Critique of the writings of Aurobindo Ghose, 1872-1950.

What does it mean to assert or deny the existence of a legal system? How can one determine whether a given law belongs to a certain legal system? What kind of structure do these systems have, that is--what necessary relations obtain between their laws? The examination of these problems in this volume leads to a new approach to traditional jurisprudential question, though the conclusions are based on a critical appraisal, particularly those of Bentham, Austin, Kelsen, and Hart.

Using the accounts of Gewirth and Griffin as examples, the article criticises accounts of human rights as those are understood in human rights practices, which regard them as rights all human beings have in virtue of their humanity. Instead it suggests that (with Rawls) human rights set the limits to the sovereignty of the state, but criticises Rawls conflation of sovereignty with legitimate authority. The resulting conception takes human rights, like other rights, to be contingent on social conditions, and in (...) particular on the nature of the international system. (shrink)

The paper distinguishes between instrumental reasons and instrumental rationality. It argues that instrumental reasons are not reasons to take the means to our ends. It further argues that there is no distinct form of instrumental reasoning or of instrumental rationality. In part the argument proceeds through a sympathetic examination of suggestions made by M. Bratman, J. Broome, and J. Wallace, though the accounts of instrumental rationality offered by the last two are criticised.

Human agents act for reasons that contribute to their good. However, in our explanation of why agents act for reasons that depend on what they value, we encounter the problem of situations in which goods are neither better than others nor are of equal value. The incommensurability of value can then be seen to lead to an incommensurability of reasons for action. Examining rationalist and classical conceptions of human agency, Raz uses the presence of incommensurability to understand how this affects (...) the relation between reasons and the will, and its effects on our practical reasoning and deliberation. A proper understanding of human agency will take for granted that the goodness of options are incommensurate and that explanations concerning what we want cannot solely be accomplished in terms of reasons. What do appeals to case studies accomplish? Consider the dilemma: On the one hand, if the case is selected because it exemplifies the philosophical point, then it is not clear that the historical data hasn't been manipulated to fit the point. On the other hand, if one starts with a case study, it is not clear where to go from there—for it is unreasonable to generalize from one case or even two or three.

The Pastoral Constitution, Gaudium et Spes, is a key document for fundamental theology. In it, for the first time, the Church openly discusses the anthropological question as a specific theme. It explains what Christian anthropology is and in what way the mystery of Christ sheds light on the mystery of man. From the point of view of fundamental theology, the document shows how theological reason is closely related to anthropological meaning. The privilege of having three sets of extensive and hard-hitting comments on one's work is as welcome as it is rare, and especially so on this occasion as the lectures were, for me, but thefirst (well, not entirely first) stab at a subject I hope to explore at greater length. The reflectionsthat follow will respond to some of the criticisms, but will not be a point by point reply. I will use the occasion to clarify some obscurities in the lectures, (...) and to contrast my view with some of my critics' own positions. I will proceed thematically, starting with some observations about method and about ontology, proceeding to explore several questions about the relations between social dependence and relativism, between genre, value, and normativity, and concluding with a fewwords on pluralism and liberal values. BackgroundRecently there have been growing concerns about problematic mobile phone use by adolescent populations. This study aimed to address this concern through a study of severity and correlates of problematic mobile phone use with a sample of Hong Kong adolescents.MethodsData were collected from a sample of adolescents from three local secondary schools using a measuring scale designated for Chinese adolescents. Participants were allocated into groups of “problematic users” and “non-problematic users” based on the number of occurrence of symptoms due to (...) excessive and maladaptive use of mobile phone and possible functional impairments caused by problematic mobile phone use. A group of “at-risk users” was identified. A sample-based examination on distribution of these three groups of users was conducted via frequency counts and percentage calculation. A series of t-test were performed to make comparisons between “problematic” and “non-problematic” groups on selected personality and health related variable. Risk and protective factors were identified via correlational analysis and logistic regression analysis.ResultsUnder a more stringent cut-off criterion of four or more reported symptoms plus one or more reported functional impairments, 22.9% of the adolescents participating in this study could be classified as problematic mobile phone users. However, a more lenient criterion reported a substantially more severe prevalence rate. A new group of “at-risk” adolescents was identified with such a discrepancy of prevalence rate. Gender difference, some risk and protective factors were also identified for developing this technology-related problem.Discussion and ConclusionsAdolescents who are vulnerable to suffer from this technology-related problem deserve more attention from helping professionals. Results of this study throw some insights on how to identify problematic mobile phone user applying a criterion-referenced approach. This study echoes a recent call for adopting a developmental perspective in understanding this problem and conducting research in this area. Anchored on present findings, effective interventions to tackle this rising problem among adolescents are suggested. (shrink)

MOST of us feel an aversion to lying and believe that it always stands in need of justification. One expression of this is to say that there is a prima facie duty not to lie. Another is Sissela Bok's "Principle of Veracity" which holds that lying has an "initial negative weight" so that there is always a presumption against telling a particular lie. Still a third variation can be found in Arnold Isenberg's "constancy principle" which holds that what is inherently (...) bad in any lie is the same for all, constant from one lie to the next. While these sorts of view are plausible, the literature on lying provides little in the way of a specific account for the negative weight inherent in all lies--their common disvalue. What follows is proposed as such an account, one which should also help clarify why some lies are worse than others, why some are excusable and others justifiable. Without presuming to be exhaustive, the view offered maintains that there are at least two inherent negative components of all lies; further, each of these inherent disvalues disposes the liar toward a particular, contingent harm. The inherent disvalues and the harms they threaten collectively constitute sufficient grounds for the presumption against lying. (shrink)

The authors propose the integrity capacity construct with its four dimensions (process, judgment, development and system dimensions) as a framework for analyzing and resolving behavioral, moral and legal complexity in business ethics' issues at the individual and collective levels. They claim that moral progress in business comes about through the increase in stakeholders who regularly handle moral complexity by demonstrating process, judgment, developmental and system integrity capacity domestically and globally.

Malice that cannot speak its name, cold-blooded but secret hostility, impotent desire, hidden rancor and spite--all cluster at the center of envy. Envy clouds thought, writes Joseph Epstein, clobbers generosity, precludes any hope of serenity, and ends in shriveling the heart. Of the seven deadly sins, he concludes, only envy is no fun at all. He reveals that envy has a strong touch of malice behind it--the envious want to destroy the happiness of others. He suggests that envy of the astonishing success of Jews in Germany and Austria may have lurked behind the virulent anti-Semitism of the Nazis. As he proved in his best-selling Snobbery, Joseph Epstein has an unmatched ability to highlight our failings in a way that is thoughtful, provocative, and entertaining. My topic is the possibility of acting in the belief that the action is bad and for the reason that it is, as the agent believes, bad. On route, I examine another question – namely whether agents can, without having any relevant false beliefs, perform actions motivated by the badness of those actions. The main worry is the compatibility of action for the sake of the bad with the thesis of the Guise of the Good. The examina-tion is helped by (...) considering the way reason explanations and the more widely understood normative explanations can explain actions, in light of the conditions for the rationality of actions and the bearing of masking beliefs on the explanation of their actions. The discussion leads to consideration of the possibility of various conceptual mistakes. Given the variety of human motivations, I focus on the interpretation of one case: the Luciferian motive, understood, roughly, as the drive to defy the limits of thought or of rational thought. Kockelmans provides a clear and systematic treatment of the central themes and topics of Heidegger's later writings, focusing on the all-important question of the relationship of truth and Being. If we are to understand Heidegger's thought, Kockelmans explains, we must conceive it as a path or way, rather than as a finished system. Adopting this approach himself, Kockelmans leads us with scholarly care through the wide range of issues that Heidegger wrote about between roughly 1935 and 1965. (...) Popper’s popular critics – Kuhn, Feyerabend, and Lakatos – replace his older, Wittgenstein-style critics, now defunct. His new critics played with the idea of criticism as beneficial, in vain search of variants of these that could better appeal to the public. Some of their criticism of Popper is valid but marginal for the dispute about rationality. He was Fallibilist; they hedged about it. He viewed learning from experience as learning from error; they were unclear about it. His view resembles Freud’s (...) reality principle; they hedged about this too, as they defended the stupid idea of constructive criticism. He stressed his criticism of the view of science as inductive; they endorsed it. They differed from him significantly regarding their intended readers: he had addressed those who readily admit criticism and his popular critics addressed those who find it hard to admit openly that criticism upsets them somewhat. Current popular criticism of Popper’s ideas shows yet again the logical relation between the critical attitude and liberalism: liberalism without critically mindedness is permissible, scarcely the other way around. Hence, we better read the objection that Popper’s popular critics have launched against him not as criticism proper, but as somewhat reasonable protest against his use of the highest standards in his relentless advocacy of liberalism and of criticism in his valuation of science and of democracy as joint. This study investigates factors impacting perceptions of ethical conduct of peers of 293 students in four US universities. Self-reported ethical behavior and recognition of emotions in others (a dimension of emotional intelligence) impacted perception of ethical behavior of peers. None of the other dimensions of emotional intelligence were significant. Age, Race, Sex, GPA, or type of major (business versus nonbusiness) did not impact perception of ethical behavior of peers. Actions for which we are responsible constitute our engagement with the world as rational agents. What is the relationship between such actions and our capacities for rational agency? I take this to be a question about responsibility in a particular use of that term, which I shall call ‘responsibility2’. We are not responsible2 for all our intentional actions (actions under hypnosis, for example), but we can nevertheless be responsible2 for actions we do not adequately control, for negligent actions, and for (...) non-intentional omissions. Appreciating this helps show that familiar principles of responsibility are false: those which delimit responsibility to intentional actions or to actions and outcomes under our control. In the attempt to fashion an alternative principle, cases of negligence prove pivotal. We hold ourselves and others responsible2 for conduct within our respective ‘domains of secure competence’, (i.e. that within which we are confident of doing what we set ourselves to do, barring events which defeat our competence), even when actions within that domain fail. The significance of this practice of holding ourselves and others responsible2 lies in the way it maintains our sense of who we are and of how we are related to the world in which we act.1. (shrink)

Economics is a science - at least positive economics must be. And science is in part applied mathematics, in part empirical observations and tests. Looking at the history of economics, one cannot find much testing done before the twentieth century, and even the collection of data, even in the manner Marx engaged in, was not common in his day. It is true that economic policy is an older field, and in that field much information is deployed for the purpose of (...) prescribing a course of action. But this is not to say that the information procured for that purpose is either based on observation or has been tested. In the seventeenth century some alchemists and economists hoped to boost the economy by manufacturing gold, others feared inflation; and the British Parliament legislated against manufacturing gold. David Hume proved in the eighteenth century - quite a priori - that doubling the quantity of gold will only double the price of each commodity and he thus set things at rest for a while. Later the question was opened again when Marx, for example, showed historically how the gold robbed from the Americas started Europe's boom. Yet the theory - the quantity theory of money, as it is called - which Hume proved a priori, is still contested and still hardly tested to economists' satisfaction: is the price level fixed mainly by the amount of available money? This article suggests that Rawls's break with early utilitarians is not so much over the greatest happiness principle as it is over the relation of the institution of private property to justice. In this respect Rawls is very close to John Stuart Mill, arguing for a cleansed or tamed version of the institution. That said, Rawls's defense of private property remains very thin and highly idealized, again following Mill. If Hume and Bentham fail to demonstrate their claims, Rawls and Mill (...) do little better. Rawls, like Mill, has constructed a challenging standard, admits to severe limitations on our empirical knowledge, and remains deeply ambivalent over the role of private property. (shrink)
