Liberal concepts of democracy envision courts as key institutions for the promotion and protection of democratic regimes. Yet social science scholarship suggests that courts are fundamentally constrained in ways that undermine their ability to do so. Recognizing these constraints, this book argues that courts can influence regime instability by affecting inter-elite conflict. They do so in three ways: by helping leaders credibly reveal their rationales for policy choices that may appear to violate legal rules; by encouraging leaders to less frequently (...) make decisions that raise concerns about rule violations; and by encouraging the opposition to accept potential rule violations. Courts promote the prudent use of power in each of these approaches. This book evaluates the implications of this argument using a century of global data tracking judicial politics and democratic survival. (shrink)

Critics of theological accounts of the nature of morality have argued that such accounts must be rejected, even by theists, because such accounts (i) have the unacceptable implication that nothing is morally wrong in possible worlds in which atheism is true, (ii) render the substantive content of morality arbitrary, and (iii) make it impossible or redundant to attribute moral properties to God or God’s actions. I argue that none of these criticisms constitute good reason for theists to abandon theological accounts (...) of the nature of morality. (shrink)

It is widely thought that God must love each and every human to the same depth and degree. This proposition plays a prominent role in influential versionsof the problem of evil, and in theistic attempts to answer the problem of evil. A common reason cited in support of the idea of God’s loving equally every human is that a perfect being would possess every great-making property and loving equally every human would be a great-making property. It is the argument of (...) this essay, however, that a perfect being cannot in principle equally love every human. This argument is erected upon an unnoticed principle of perfect being theology: for all properties F, if F is a deficiency when had by a human, then F cannot be great-making when had by God. According to doxastic accounts of self-deception, self-deception that P yields belief that P. For doxastic accounts, the self-deceiver really believes what he, in self-deception, professes to believe. I argue that doxastic accounts are contradicted by a phenomenon that often accompanies self-deception. This phenomenon – which I term ‘secondary deception’ – consists in the self-deceiver's defending his professed (deceit-induced) belief to an audience by lying to that audience. In their 2010 article ‘Research Integrity in China: Problems and Prospects’, Zeng and Resnik challenge others to engage in empirical research on research integrity in China. Here we respond to that call in three ways: first, we provide updates to their analysis of regulations and allegations of scientific misconduct; second, we report on two surveys conducted in Hong Kong that provide empirical backing to describe ways in which problems and prospects that Zeng and Resnik identify are being explored; and third, (...) we continue the discussion started by Zeng and Resnik, pointing to ways in which China's high-profile participation in international academic research presents concerns about research integrity. According to our research, based upon searches of both English and Chinese language literature and policies, and two surveys conducted in Hong Kong, academic faculty and research post-graduate students in Hong Kong are aware of and have a positive attitude towards responsible conduct of research. Although Hong Kong is but one small part of China, we present this research as a response to concerns Zeng and Resnik introduce and as a call for a continued conversation. (shrink)

Some particularists have argued that even virtue properties can exhibit a form of holism or context variance, e.g. sometimes an act is worse for being kind, say. But, on a common conception of virtuous acts, one derived from Aristotle, claims of virtue holism will be shown to be false. I argue, perhaps surprisingly, that on this conception the virtuousness of an act is not a reason to do it, and hence this conception of virtuous acts presents no challenge to particularist (...) claims about the context variance of reasons. Still, I argue that the virtues nevertheless have important implications for our understanding of the particularism debate. Specifically, we can accept the particularist claim that reasons do not need to be principled in order to have the normative status that they do have, while still maintaining that sound moral thought and judgement has a principled structure understood in terms of the virtues. In the paper it is argued that the conceptual resources of Christianity topple the hiddenness argument. According to the author, the variability of the divine love cast doubt on the soundness of Schellenberg’s reasoning. If we understood a perfect love as a maximal and equal concern and identification with all and for all, then a divine love would entail divine impartiality, but because of conflicts of interest between human beings the perfect, divine love cannot be maximal.

Despite an efflorescence of historical scholarship on the theme of monarchy in nineteenth-century Britain, the views of the great Victorian man of letters Thomas Carlyle (1795–1881) in this regard have been explored only in fragmentary and incomplete fashion. The present article aims to offer a comprehensive survey of Carlyle's thought regarding monarchy, arguing that on the whole, Carlyle was strongly and consistently opposed to monarchy on the hereditary principle, claiming that this had become an absurd anachronism in the modern (democratic) (...) world. Instead, Carlyle strongly and consistently promoted a merit-based aristocracy of talent, in which the ‘best’ man would rule, regardless of heredity or social origin. Indeed, in his historical writings, he was quite prepared to endorse regicide as a means to replacing inept hereditary monarchs with low-born men of destiny such as Oliver Cromwell. Although Carlyle refrained from publicly demanding the abolition of the monarchy in contemporary Britain, his private correspondence and conversation were replete with sneers and snide asides regarding Queen Victoria and her predecessors. Ghost variables are variables in program languages that do not correspond to physical entities. This special issue, based on a panel on “Race as a Ghost Variable” at the 2017 Meeting of the Society for Social Studies of Science, traces ideas of “race” in particular niches of science, technology, and medicine where it is submerged and disavowed, yet wields power. Each paper is a case study exploring ghosts that emerge through the resonance among things as heterogeneous as hair patterns, hormone (...) levels, food tastes, drug use, clinic locations, proximity to disaster, job classifications, and social belonging and suspicion, all of which vibrate with meanings accumulated over long racial histories. Together, the papers further elaborate methods and analytic models for identifying the operations of race—the relations and processes that make it, the effects that it has. A chief appeal of the metaphor of the ghost is that it brings the importance of history to the fore. Ghosts are simultaneously history and the present, not just an accretion of earlier experiences, but the palimpsest left when one tries to erase them. Sometimes faint and hard to discern, sometimes rambunctious and disruptive, ghosts refuse our attempts to simply move on. (shrink)

Through 1886 to 1889 understanding of the mechanism of telephone transmission was transformed from an electrostatic and traditional view to an electrodynamic one conforming with Maxwell's scheme. Observed at the level of commercial application this painful adjustment occurred via a sequence of controversies connected with self-induction—on techniques of telephony, on electrical measurement, on lightning conductors and on matters of professional ethics—in which the parts played by evidence, by theory, and by authority were strangely mixed. The well-known confrontation of O. Heaviside (...) and W. H. Preece was at the centre of the debate. An open division between traditionalists and progressives amongst electrical engineers was provoked, and the effectiveness of mathematical theory as against pure pragmatism at the practical level had in the end to be conceded. This paper examines some ethical issues arising from whole-genome association studies for multigenic diseases, focusing on the case of autism. Events occurring following the announcement of a genetic test for autism in France (2005–2009) are described to exemplify the ethical controversies that can arise when genetic testing for autism is applied prematurely and inappropriately promoted by biotech companies. The authors argue that genetic tests assessing one or a few genes involved in highly multigenic disorders can only be useful if: (1) (...) the genetic linkage found in the scientific study must be statistically convincing, reproducible and also applicable to the population to which the individual considered belongs (scientific validity); (2) the relative risk conferred by the ‘high-risk’ allele should be high enough to be significant to the patient (significant impact); (3) use of the test should lead to some improvement of outcome for the patient, resulting from adapted treatment if available, or at least from adjustment of lifestyle (or life goals) prompted by the new knowledge generated (clinical utility). Decisions concerning genetic testing for autism involve scientific judgement, value judgement and good knowledge of a constantly evolving therapeutic environment. The implementation of genetic tests for highly multigenic diseases thus requires strong mechanisms to ensure that they are used in a fashion that can benefit patients, and these mechanisms must be able to cope with rapid progress in scientific knowledge and therapeutic intervention. Recently, Walter Sinott-Armstrong and Justin Snedegar have argued for a general contrastivist theory of reasons. According to the contrastivist account of reasons, all reasons claims should be understood as a relation with an additional place for a contrast class. For example, rather than X being a reason for A to P simpliciter, the contrastivist claims that X is a reason for A to P out of {P,Q,R…}. The main goal of this paper is to argue that the contrastivist account of (...) reasons will be ill-fitted for accommodating certain features of moral reasons. In brief, the reason why the contrastivist analysis fails is that it cannot adequately allow for cases of morally correct whole-hearted action—cases where consideration of any alternate course of action would be misguided. But, if all consideration of alternate courses of action is misguided, then it is hard to see how one can set the relevant contrast class that is essential to the contrastivist view—any contrast class will seem out of place. In addition, I address some of the arguments that have been given in favor of the contrastivist account of reasons and argue that there are at least two ways that the non-contrastivist can respond to these arguments. A crucial part of William Rowe’s evidential argument from evil implies that God, like a loving parent, would ensure that every suffering person would be aware of his comforting presence. Rowe’s use of the “loving parent” analogy however fails to survive scrutiny as it implies that God maximally loves all persons. It is the argument of this paper that no one could maximally love every person; and whatever variation there is in the divine love undercuts the claim that every suffering (...) person would be aware of the divine presence. This article contends that social policy faces a crisis over whether a viable collective order can be constructed out of individual choices. The neo-liberal paradigm is now challenged by neo-conservatives, who argue for policies derived from traditional moral, religious and patriotic values. This raises issues about the nature of social bonds, the institutional order and collective life itself. The article argues that it provides an opportunity for social theorists and policy analysts to co-operate in re-examining these questions. However, these debates (...) indicate a need for social theorists to confront their relationship with Enlightenment accounts of how commerce and private property enable liberty and consensual government. In the face of recent evidence of ‘stalled well-being’ within increasing prosperity, the article argues for a new analysis of choice and solidarity. (shrink)

An interdisciplinary fusion between the philosophy of science and the teaching of science can help to eradicate the disciplinary rigidity entrenched in both. In this paper I approach the history of sciencethematically, identifying general themes which transcend the boundaries of individual disciplines. Such conceptual themes can be used as a basis for an interdisciplinary introduction to university science, encouraging certain important cognitive skills not exercised during the disciplinary training emphasised in traditional approaches. Courses which teach themes such as conservation, randomness, (...) and holism/reductionism have already proved successful, and these innovations should encourage philosophers and historians to explore the exciting new possibilities which arise from stepping outside the confines of a single discipline. The risk of tort liability for health maintenance organizations and other managed care plans has dramatically increased in recent years. This is due in part to the growing percentage of health care rendered through managed care plans. The cost-containment mechanisms commonly used by managed care plans, such as limiting access to services and/or choice of providers, creates a climate ripe for disputes that may end up in court. As dissatisfied patients and providers seek recourse in the courts, tort doctrines are (...) extended and new legal theories emerge as needed. For example, the concepts of direct and vicarious tort liability developed in the hospital context have been extended by courts to encompass HMOs. vicarious liability claims, based on ostensible agency or respondeat superior doctrines, have been brought against HMOs and managed care plans for negligent treatment by physicians selected to provide care to members. While public administration research is thriving because of increased attention to social scientific rigor, lingering problems of methods and ethics remain. This article investigates the reporting of ethics approval within public administration publications. Beginning with an overview of ethics requirements regarding research with human participants, I turn to an examination of human participants protections for public administration research. Next, I present the findings of my analysis of articles published in the top five public administration journals over the period from 2000 (...) to 2012, noting the incidences of ethics approval reporting as well as funding reporting. In explicating the importance of ethics reporting for public administration research, as it relates to replication, reputation, and vulnerable populations, I conclude with recommendations for increasing ethics approval reporting in public administration research. Although thick ethical concepts have been neglected in Murdochian scholarship, this article argues that they were central to the thought of Iris Murdoch. In the first section, the article provides a sustained account of thick ethical concepts in Murdoch's philosophy, demonstrating how these concepts align with and illuminate familiar aspects of her philosophical essays. The first section also explores the ways in which Murdoch's alternative account of moral concepts was at the heart of her overall attack on the noncognitivism of (...) her day. In the second section, the article provides a reading of The Black Prince and considers the ways that thick ethical concepts offer new insight into Murdoch's literary activity. It concludes by suggesting that studying Murdoch's philosophy and literature in light of thick ethical concepts reveals a deep unity between her two intellectual projects. (shrink)

In this paper, I argue that theists are extremely well-situated with respect to developing metaethical accounts that qualify as ‘robust’ versions of moral realism. In the first part of the essay, a number of metaethical desiderata are identified. In the second part, theistic strategies for accommodating those desiderata are explained and defended. The upshot is that, contrary to the received philosophical wisdom, there are good theoretical reasons for theistic philosophers to seek to develop metaethical accounts that ground moral facts in (...) facts about God. Cloth, $99.50.Modern philosophers have shown themselves quite unphilosophical about the academic history of their own discipline. Content with grand stories that move from Plato to themselves, (...) they have treated institutional histories, recent histories, and bibliographical histories as unworthy of attention. John Inglis sets out to change all that for the study of medieval philosophy. He demonstrates by the book’s end that we have failed to recognize our historiographical procedures as conventions—with very particular histories of their own.The first part of the book traces the genealogy of the dominant (one might say, hegemonic) model in recent studies of medieval philosophy. The genealogy is prefaced with two chapters that show how various were the motives for reconstructions of medieval thought before 1850 in authors such as Billuart, Goudin, and Brucker or Hegel, Ritter, and Hauréau. These chapters might be dismissed by contemporary scholars as so much antiquarianism. There can be no dismissing the relevance to contemporary work of Inglis’s main genealogy, which runs with surprising directness from Joseph Kleutgen (1811–1883) and Albert Stöckl (1823–1895) to Norman Kretzmann and Anthony Kenny.It adds to the piquancy of Inglis’s argument that most specialists in medieval philosophy will not even recognize the names of Kleutgen and Stöckl, much less feel kinship with them. But Inglis shows convincingly what Kleutgen and Stöckl did to make the study of medieval philosophy possible in modern universities. Kleutgen mapped the medieval texts onto a system of “spheres,” of fields or topics, recognizable to professors of philosophy. This means that he necessarily privileged epistemology, as he necessarily connected a medieval thinker’s views across the “spheres” into a system—or a failed attempt at one. Kleutgen then emphasized the reason/revelation dichotomy and an allegiance to what he understood as the system of Thomas Aquinas. Put these elements together and you have a surprisingly familiar story. It remained for Stöckl to write it up as an erudite and monumental narration.Inglis follows this „Kleutgen-Stöckl model” through a number of more familiar authors, including De Wulf, Gilson, Boehner, Weinberg, and the editors of the Cambridge [End Page 530] History of Later Medieval Philosophy. Of course, in reducing the genealogy to a list of famous names I ignore two of its great virtues. The first is the detail with which it retells the institutional circumstances and the forgotten intermediaries of the scholarly tradition. Behind the genealogy, around its borders, there stands Inglis’s enormous effort of original research, much of it archival. The genealogy’s second virtue is the dialectical subtlety with which it locates continuities under contradictions. Gilson is usually touted as the antithesis of De Wulf, and Kretzmann of Gilson. Inglis makes such antitheses seem superficial by comparing them with an abiding if tacit agreement about how medieval texts can be appropriated within modern philosophy. To seal the comparison, Inglis suggests in the book’s second part what a real antithesis to the Kleutgen-Stöckl model might be. He reconstructs, in his last two chapters, Thomas’s accounts of human knowledge and of theology’s relations to philosophy in opposition to that model’s prescriptions.No review can represent—or even adequately praise—the enormous learnedness of this book. Moreover, since the book already discusses so much, it must seem ungrateful to suggest that it ought to discuss anything else. Let me end then rather by posing two questions beyond the book’s end. First, does Inglis’s genealogy mean to suggest that the Kleutgen-Stöckl model is now chiefly received in English-speaking philosophy departments? I wonder, for example, how far Inglis might judge Alain de Libera’s Penser au Moyen Age (Paris: Éds. de Seuil, 1991) an alternative to that model. Evidence from research on gaze control indicates, however, that shifts in actual eye position are neither necessary nor sufficient to produce shifts in spatial perception. Deictic context is instead provided by the interaction between two deictic pointers; one representing actual eye position, and the other, intended eye position.
