Patient decision aids enable patients to be better informed about the potential benefits and harms of their healthcare options. Certification of patient decision aids at the national level in the United States is a critical step towards responsible governance—primarily as a quality measure that increases patients’ safety, as mandated in the U.S. Patient Protection and Affordable Care Act (PPACA). Certification would provide a verification process to identify conflicts of interest that may otherwise bias the scientific evidence presented in decision aids. (...) Certification also benefits clinicians who may otherwise face malpractice claims based on harm to patients caused by possible reliance on patient decision aids that are inaccurate, incomplete, or presented in a manner that biases the patient’s decision. Existing work by the International Patient Decision Aid Standards Collaboration could guide the establishment of a certification process within the U.S. This article argues for national certification of patient decision aids and discusses how that may be achieved. This article responds to William Scheuerman’s analysis of Edward Snowden as someone whose acts fit within John Rawls’ account of civil disobedience understood as a public, non-violent, conscientious breach of law performed with overall fidelity to law and a willingness to accept punishment. It rejects the narrow Rawlsian notion in favour of a broader notion of civil disobedience understood as a constrained, conscientious and communicative breach of law that demonstrates opposition to law or policy and a desire for lasting (...) change. The article shows that, according to Rawls’ unduly narrow conception, Edward Snowden is not a civil disobedient. But, according to the more plausible, broader conception, he is. It then identifies some advantages of the broader conception in contemporary analyses of new forms of disobedience, including globalized disobedience and digital disobedience. (shrink)

The man responsible for bringing these four cases, Roanoke U.S. Attorney John Brownlee, has defended his actions (Rocktown Weekly, April 27-May 3, 2006, p. 11): “We have to properly track money going overseas so it’s not going to the wrong places.” But, this could be done without this law. Even though 12 agencies investigated these money transfers, led by the FBI, none charged that any (...) went to terrorist groups. “We know you are not the bad guys,” another prosecuting attorney has said. A group of agencies went looking for Middle Eastern Muslim terrorists around here after 9/11. Not finding any, they arrested four anti-Saddam Muslim Kurds, just like autoworkers went after a Chinese-American when they could not find any Japanese to beat up. This is an appalling travesty of justice. These men helped neighbors who needed to send money to families for medical care when there was no other way to do so, there being no banking system in Iraq. These men are all civic-minded, translating for schools, hospitals, and the courts since arriving here. They are being prosecuted for helping their neighbors in times of trouble. In their initial investigations, the FBI inquired whether these men knew Saddam Hussein or Osama bin Laden. This makes as much sense as Abraham Lincoln ordering Union troops to investigate runaway slaves in the North to find out their knowledge of Jefferson Davis or John Singleton Mosby and then prosecuting them for sending money to their families in the South via an illegal method. Citizens of Harrisonburg should express their support for these four men and demand that these charges be dropped. The FBI and the U.S. Attorney’s office in Roanoke should get back to what they are supposed to be doing and stop degrading our American system with such outrageous prosecutions. (shrink)

What is the difference between civil and uncivil disobedience? How can illegal protest be compatible with a democratic regime based on the rule of law? Is Edward Snowden a civil disobedient? This book follows the philosophical debate around these and other issues, showing how the notion of civil disobedience has evolved from a form of passive resistance against injustice, to an active way to engage with the political life of the community. The author presents the major contributions in political and (...) legal philosophy, ranging from John Rawls' seminal account in 1971, to the recent views advanced by Kimberley Brownlee, David Lefkowitz and William Smith. In the last chapter, the author proposes a novel account of civil disobedience, able to meet some of the unresolved challenges. The author argues that, to make sense of civil disobedience, we should expand our conception of political obligation, so to include acts that, despite being illegal, may reveal the agent's civility. Fresnel's theory of light was (a) impressively predictively successful yet (b) was based on an "entity" (the elastic-solid ether) that we now "know" does not exist. Does this case "confute" scientific realism as Laudan suggested? Previous attempts (by Hardin and Rosenberg and by Kitcher) to defuse the episode's anti-realist impact. The strongest form of realism compatible with this case of theory-rejection is in fact structural realism. This view was developed by Poincare who also provided reasons to think that it is (...) the only realist view of theories that really makes sense. (shrink)

John Passmore was a renowned Australian empirical philosopher and historian of ideas. In this book, which was originally published in 1952, Passmore's intention was to disentangle certain main themes in Hume's philosophy and to show how they relate to Hume's main philosophic purpose. Rather than offering a detailed commentary, the text provides an account based on specificity and critical scholarship, seeking to complement the other more comprehensive works on Hume's philosophy that had become available around the same time. There is a growing consensus in the philosophical literature that sounds differ rather profoundly from colors. Colors are qualities, while sounds are particulars of some sort or other, such as events or pressure waves. A key motivation for this is that sounds seem to be transient, to evolve over time, to begin and end, while colors seem like stable qualities of objects' surfaces. I argue that sounds are indeed, like colors, stable qualities of objects. Sounds are not transient, and they (...) do not seem to be, even though they are typically perceived transiently. In particular, sounds are dispositions of objects to vibrate in response to being stimulated. This stable property view of sounds aligns nicely with, and owes an inspirational debt to, reflectance physicalist accounts of color. The upshot is a unified picture of colors, sounds, and the perception thereof. (shrink)

This chapter reviews a number of related problems in the epistemology of testimony, and suggests some dilemmas for any theory of knowledge that tries to solve them. Here a common theme emerges: It can seem that any theory must make testimonial knowledge either too hard or too easy, and that therefore no adequate account of testimonial knowledge is possible. The chapter then puts forward a proposal for making progress. Specifically, an important function of the concept of knowledge is to govern (...) the acquisition and distribution of quality information within an epistemic community. Testimonial exchanges paradigmatically serve in the distribution role, but sometimes serve in the acquisition role. The resulting position, it is argued, explains why testimonial knowledge is sometimes easy to get, and sometimes much harder. (shrink)

Since the last ice age, when ice enveloped most of the northern continents, the earth has warmed by about five degrees. Within a century, it is likely to warm by another four or five. This revolution in our climate will have immense and mostly harmful effects on the lives of people not yet born. We are inflicting this harm on our descendants by dumping greenhouse gases into the atmosphere. We can mitigate the harm a little by taking measures to control (...) our emissions of these gases, and to adapt to the changes by, for instance, building sea walls around coastlines threatened by rising sea levels. But these measures will be very expensive, and the costs will be born by us, the present generation, whereas the benefits will come to future generations. How much should we sacrifice for the sake of the future? Economists and philosophers have independently worked on the question of our responsibility to future generations. This book brings their work together and applies it to global warming. It suggests a programme for future research on the economic and ethical issues. I defend the unpopular view that inference can create justification. I call this view inferential creationism. Inferential creationism has been favored by infinitists, who think that it supports infinitism. But it doesn’t. Finitists can and should accept creationism.

What is the simplest and most natural axiomatic replacement for the set-theoretic definition of the minimal fixed point on the Kleene scheme in Kripke’s theory of truth? What is the simplest and most natural set of axioms and rules for truth whose adoption by a subject who had never heard the word "true" before would give that subject an understanding of truth for which the minimal fixed point on the Kleene scheme would be a good model? Several axiomatic systems, old (...) and new, are examined and evaluated as candidate answers to these questions, with results of Harvey Friedman playing a significant role in the examination. While philosophy believes it is impossible to have an experience of God without the senses, theology claims that such an experience is possible, though potentially idolatrous. In this engagingly creative book, John Panteleimon Manoussakis ends the impasse by proposing an aesthetic allowing for a sensuous experience of God that is not subordinated to imposed categories or concepts. Manoussakis draws upon the theological traditions of the Eastern Church, including patristic and liturgical resources, to build a theological aesthetic founded on the (...) inverted gaze of icons, the augmented language of hymns, and the reciprocity of touch. This book, first published in 1938, is based upon the Muirhead lectures on political philosophy delivered in the University of Birmingham in January and February of 1938. This title was intended to be of interest to students and scientific workers in the belief that Marxism will prove valuable to them in their scientific work, as well as to a wider audience.

Two seemingly complementary trends stand out currently in school science education in the United States: one is the increased emphasis on inquiry activities in classrooms, and the other is the high level of attention given to student understanding of the nature of science. This essay looks at the range of activities that fall within the first trend, noting, in particular, the growing popularity of inquiry activities that engage students in engineering-type tasks. The potential for public disengagement from science and technology (...) issues is described as a result of the continued juxtaposition of these sorts of inquiry activities with our current, idealized portrayals of the nature of science—the emphasis of the second trend. Drawing on Dewey's instrumental theory of knowledge, an alternative way of thinking about science is offered that would not only provide for a more authentic understanding of science, but also invite much needed public participation in the broad governance of science in modern-day democratic societies.
