This paper offers an account of Susan Haack’s philosophy of law and points out several aspects within the legal pragmatist tradition that deserve further discussion. Firstly, a systematic presentation of legal pragmatism as it is defended by Haack, who follows Justice Oliver W. Holmes here, is given. Secondly, the limits of an evolutionary perspective of law recommended by legal pragmatism are considered. Finally, the paper discusses whether legal pragmatism is able to handle different legal traditions, thereby focusing on (...) Anglo-American common law and European civil law. (shrink)

Isaac Levi is more interested in inquiry and how it progresses than he is in metaphysics. Questions concerning the role of disposition predicates in inquiry are more central to him than those concerning the nature and reality of dispositions. It has not stopped him from giving me and others very useful metaphysical advice. Currently, where empirical metaphysics is in vogue, there is every reason to see whether the two forms of philosophical interest might interlock substantially. Levi has stimulating ideas indeed (...) on the two forms of philosophical interest, and has recently summarized them in the slogan: “The reality of dispositions is a work in progress”. We can learn much about what kinds of dispositions are acceptable from tracing and comparing the histories of successful and less successful disposition predicates in scientific inquiry. Levi explores one route along which dispositions become real. His idea is that the introduction of dispositions facilitates covering law explanation by increasing the number of laws. The successful disposition predicate eventually becomes integrated in scientific theory, much like an ordinary theoretical term, whereas the unsuccessful does not. My impression is that Levi thinks that this is the only way a disposition can become real. To evaluate this claim, an alternative course suggested by Jon Elster is introduced. I then try to bring out the differences between Levi's and Elster's views on dispositions, partly by suggesting that they resemble two aspects of full explanations discussed by Wesley Salmon. The goal of the present article is to contribute to the epistemology and methodology of computer simulations. The central thesis is that the process of simulation modeling takes the form of an explorative cooperation between experimenting and modeling. This characteristic mode of modeling turns simulations into autonomous mediators in a specific way; namely, it makes it possible for the phenomena and the data to exert a direct influence on the model. The thesis addresses the nature of causation. It is argued that causation exists and is as local as its causes and effects. As a consequence, the position advocated is contrary to the as yet prevailing view that no 'causal tie' between cause and effect exists. Moreover, it is suggested that this tie can be perceived. The essay attempts to elucidate the nature of causes, effects, and causal mechanisms. It is argued that they are facts rather than particulars or universals. Furthermore (...) it is suggested that these facts can be conceived of as tropes. Finally, in the light of this thesis a few traditional issues are discussed: what is the relation between causation and explanation? How should we conceive of causal laws? Interdisciplinary research in the fields of forestry and sustainability studies often encounters seemingly incompatible ontological assumptions deriving from natural and social sciences. The perceived incompatibilities might emerge from the epistemological and ontological claims of the theories or models directly employed in the interdisciplinary collaboration, or they might be created by other epistemological and ontological assumptions that these interdisciplinary researchers find no reason to question. In this paper we discuss the benefits and risks of two possible approaches, Popperian optimism and Kuhnian (...) pessimism, to interdisciplinary knowledge integration where epistemological and ontological differences between the sciences involved can be expected. He begins with the observation that beliefs have entered our culture that "draw their plausibility" from a deep and radical revolt (...) against the central tradition of Western thought. That central tradition rested on the "pillars of the social optimism," which had found its fullest expression in the Enlightenment, "that the central problems of men are, in the end, the same throughout history; that they are in principle solvable; and that the solutions form a harmonious whole." 1But these pillars, Berlin notes, "came under attack toward the end of the eighteenth century by a movement first known in Germany as Sturm und Drang, and later in the many varieties of romanticism... and the many contemporary forms of irrationalism of both the right and the left, familiar to everyone today." In our time, in the alleged absence of "objective rules," the new rules are those made up by the rebels: "Ends are not... objective values," and "ends are not discovered at all but made, not found but created." And he concludes: "The prophets of the nineteenth-century predicted many things... but what none of them, so far as I know, predicted was that the last third of the twentieth century would be dominated by... the enthronement of the will of individuals or classes, and the rejection of reason and order as being prison houses of the spirit. Recent controversy about the use of the vertebrate fossil record for external calibration of molecular clocks centers on two issues, the number of dates used for calibration and the reliability of the fossil calibration date. Viewing matters from a palaeontological perspective, we propose three qualitative, phylogenetic criteria that can be used within a comparative framework for the selection of well-constrained calibration dates from the vertebrate fossil record. On the basis of these criteria, we identify three highly suitable new fossil calibration (...) dates for molecular clock estimates: the lungfish–tetrapod split (between 419 and 408 Ma), the bird–crocodile split (between 251 and 243 Ma), and the alligator–caiman split (between 71 and 66 Ma). Together with our previously suggested bird–lizard split (between 252 and 257 Ma), these four fossil dates span a range of very different ages. They are, in our opinion, more suitable for molecular clock calibration than the traditionally used mammal–bird split, which is less well constrained. Proven experience can be shared. Given this, we cannot assume that the character of proven experience is always manifest as a physical token in each individual sharing it. But the token might still exist somewhere. Perhaps that is a condition of the proven experience’s existence. Something similar could have been accepted as true of scientific knowledge, especially if those who argued that scientific claims were only shorthand for more complicated claims about observations had been right. But it seems that they (...) were not. Hence there might be an ontological difference explaining why there will always be a netto divergence between science and proven experience. (shrink)

Semmelweis’s work predates the discovery of the power of randomization in medicine by almost a century. Although Semmelweis would not have consciously used a randomized controlled trial (RCT), some features of his material—the allocation of patients to the first and second clinics—did involve what was in fact a randomization, though this was not realised at the time. This article begins by explaining why Semmelweis’s methodology, nevertheless, did not amount to the use of a RCT. It then shows why it is (...) descriptively and normatively interesting to compare what he did with the modern approach using RCTs. The argumentation centres on causal inferences and the contrast between Semmelweis’s causal concept and that deployed by many advocates of RCTs. It is argued that Semmelweis’s approach has implications for matters of explanation and medical practice. (shrink)

We claim that adjustable parameters play a crucial role in building and applying simulation models. We analyze that role and illustrate our findings using examples from equations of state in thermodynamics. In building simulation models, two types of experiments, namely, simulation and classical experiments, interact in a feedback loop, in which model parameters are adjusted. A critical discussion of how adjustable parameters function shows that they are boon and bane of simulation. They help to enlarge the scope of simulation far (...) beyond what can be determined by theoretical knowledge, but at the same time undercut the epistemic value of simulation models. (shrink)

This article is about the analogy between inclusive fitness and utility. In behavioral ecology, it is often assumed that individual organisms behave as if they were “striving” to maximize their inclusive fitness—a measure analogue to the kind of utility function that is used to represent the preferences of rational agents. Here, I explore some conceptual puzzles related to this view and question whether the kind of biological utility posited by the advocates of the “maximizing agent analogy” can be adequately interpreted (...) in inclusive fitness terms. The possibility of apparently negative causation has been discussed in a number of recent works on causation, but the discussion has suffered from beingscattered. In this paper, the problem of apparently negative causation and its attemptedsolutions are examined in more detail. I discuss and discard three attempts that have beensuggested in the literature. My conclusion is negative: Negative causation shows that thetraditional cause & effect view is inadequate. A more unified causal perspective is needed.

There is evidence that bidders fall prey to the winner’s curse because they fail to extract information from hypothetical events—like winning an auction. This paper investigates experimentally whether bidders in a common value auction perform better when the requirements for this cognitive issue—also denoted by contingent reasoning—are relaxed, leaving all other parameters unchanged. For my underlying research question, I used a lab experiment with two stages. In stage I, the subjects participate in a non-standard common value auction, called the wallet (...) game, in which a naïve bidding strategy can lead to both winner’s curse and loser’s curse. In stage II, the subjects in the treatment group learn whether their initial bid was the winning bid or not and they get the opportunity to change this bid. In this sense, the bidders face the same decision problems as in stage I again, but the need for hypothetical thinking is reduced in stage II. The overall pattern of the data suggests that the problem of irrational over- and underbidding can be weakened by giving the subjects ex ante feedback about their bid, but unlike related studies I also find negative effects of additional information.
