This article discusses successive positions of the Frankfurt School, contrasts them to the unfolding ideas of Castoriadis and argues for a critical theory centred on a concept of autonomy, but aware of the obstacles and complications inherent in social–historical reality and its modern configuration. To clarify this perspective, we need a concept of society that distances itself from the Parsonian paradigm, more so than recent theorists of the Frankfurt School have done. The critique of over-integrated images of society, developed by (...) various sociologists in the 1970s and 1980s but not properly assimilated by the mainstream of the discipline and never taken on board by Frankfurt theorists, is an important source of reference, and it can be taken further in the light of Castoriadis’s reflections on the social–historical. The result is a definition of autonomy as a capacity of explicit and unlimited interrogation, confronted with its own hubristic temptations in the context of a multidimensional social world. Human oversight has become a key mechanism for the governance of artificial intelligence (“AI”). Human overseers are supposed to increase the accuracy and safety of AI systems, uphold human values, and build trust in the technology. Empirical research suggests, however, that humans are not reliable in fulfilling their oversight tasks. They may be lacking in competence or be harmfully incentivised. This creates a challenge for human oversight to be effective. In addressing this challenge, this article aims to make three contributions. (...) First, it surveys the emerging laws of oversight, most importantly the European Union’s Artificial Intelligence Act (“AIA”). It will be shown that while the AIA is concerned with the competence of human overseers, it does not provide much guidance on how to achieve effective oversight and leaves oversight obligations for AI developers underdefined. Second, this article presents a novel taxonomy of human oversight roles, differentiated along whether human intervention is constitutive to, or corrective of a decision made or supported by an AI. The taxonomy allows to propose suggestions for improving effectiveness tailored to the type of oversight in question. Third, drawing on scholarship within democratic theory, this article formulates six normative principles which institutionalise distrust in human oversight of AI. The institutionalisation of distrust has historically been practised in democratic governance. Applied for the first time to AI governance, the principles anticipate the fallibility of human overseers and seek to mitigate them at the level of institutional design. They aim to directly increase the trustworthiness of human oversight and to indirectly inspire well-placed trust in AI governance. (shrink)

The novel coronavirus – officially named severe acute respiratory syndrome coronavirus 2, causing a disease which has flu-like symptoms – seems to be responsible for the current global lockdown or maybe one can even refer to it as a global event. Neither the virus nor the disease that it causes is truly novel, as the virus is part of the SARS virus family and therefore known, and likewise the symptoms of the disease are also well known, even flu-like, and therefore (...) also not novel. Yet, what is truly novel about the virus or the disease it causes is its effect, not specifically referring to the health effect, but its global socio-economic and political effect. It is for the first time in the history of humanity that such drastic global lockdown measures have been taken and that governments have taken the conscious decisions to ‘lay lame’ their economies. Such a radical decision is truly novel. Besides the economic ‘lockdown’, there are numerous socio-economic repercussions; for example, in a single day, millions of citizens in the United States file for unemployment, and similarly in many other countries. Covid-19 is a challenge to the economies of the world, to society at large, to the poor and vulnerable in particular, and to individuals who are ‘locked safely’ in their homes. Religious institutions, which traditionally provide collective meaning, can no longer gather in public places, and offer communal solace. Covid-19 maybe challenges what being human means, or at least, what one has come to believe concerning the meaning of being human. In this article, this question of being human in the time of Covid-19 will be explored. (shrink)

Zugleich berührt das Werk ein Kernproblem von Fichtes praktischer Philosophie: Wie läßt sich die freie Selbsttätigkeit der Einzelnen mit der alle auf ein Ideal verpflichtenden Hoheit des Vernunftsstaates vereinigen?

Ibn KhaldØun’s theory of history has been extensively discussed and interpreted in widely divergent ways by Western scholars. In the context of present debates, it seems most appropriate to read his work as an original and comprehensive version of civilizational analysis (the key concept of ‘umran is crucial to this line of interpretation), and to reconstruct his model in terms of relations between religious, political and economic dimensions of the human condition. A specific relationship between state formation and the broader (...) context of civilizational processes appears as the most central theme. This civilizational approach is then contrasted with the most influential recent Western interpretation, put forward by Ernest Gellner. Gellner translates Ibn KhaldØun’s analysis into functionalist terms and thus tones down its historical and civilizational specificity. The consequences are most obvious when it comes to discussing the unity and diversity of the Islamic world, especially with regard to the Ottoman Empire. (shrink)

Two key themes in contemporary social theory are particularly relevant to the interpretation and critique of figurational sociology. On the one hand, some recent critiques of the sociological tradition — Touraine's attempt to deconstruct the received image of society is the most important example — have called into question a dominant paradigm that underlies both Marxist and structural-functional theories. Norbert Elias has not only anticipated some of the most important criticisms but also suggested correctives to some of the currently fashionable (...) alternatives. More specifically, his relationship to the sociological traditions and to its contemporary offshoots can be described in terms of six antitheses: his approach is anti-economistic, anti-normativistic, anti-reductionistic, anti-functionalist, anti-structuralist and anti-individualistic. On the other hand, the impact of all these critical strategies is somewhat blunted by the one-sided emphasis on power. A more balanced version of figurational sociology would need a concept of culture to match and counter-balance Elias's insights into the problematic of power. Further exploration of this issue could draw both on the classics (especially Weber) and on post-Parsonian debates about cultural power and their interconnections. Cultural interpretations of power are the most important link between those two dimensions of social life; although Elias has never explicitly thematized them, his recent writings touch upon some aspects of their specifically modern variants. Both, bioconservatives and bioliberals, should seek a discussion about ideas of human perfection, making explicit their underlying assumptions about what makes for a good human life. This is relevant, because these basic, and often implicit ideas, inform and influence judgements and choices about human enhancement interventions. Both neglect, and polemical but inconsistent use of the complex ideas of perfection are leading to confusion within the ethical debate about human enhancement interventions, that can be avoided by tackling the notion of perfection (...) directly. In the recent debates, bioconservatives have prominently argued against the ‘pursuit of perfection’ by biotechnological means. In the first part of this paper, we show that—paradoxically—bioconservatives themselves explicitly embrace specific conceptions of human perfection and perfectionist assumptions about the good human life in order to argue against the use of enhancement technologies. Yet, we argue that the bioconservative position contains an untenable ambiguity between criticising and endorsing ideas of human perfection. Hence, they stand in need of clarifying their stance on human perfection. In the second part of the paper, we ask whether bioliberals in fact (implicitly) advocate a particular conception of perfection, or whether they are right in holding that they do not, and that discussing perfection is obsolete anyway. We show that bioliberals also rely on a specific idea of human perfection, based on the idea of autonomy. Hence, their denial of the relevance of perfection in the debate is unconvincing and has to be revised. (shrink)

Originally published by Goethe's friend and personal secretary, Johann Peter Eckermann in German in 1836, this work comprises Eckermann's recollections of his conversations with the German writer and philosopher during the last nine years of his life. Eckermann published a further volume in 1848 using both his own memories and material from the journals of Swiss scientist Frédéric Soret, who was also a close acquaintance of Goethe. The work initially sold poorly in Germany, but quickly became popular internationally, and (...) contributed to the rehabilitation of Goethe's scholarly reputation both within Germany and throughout the world. This edition, translated by British playwright and translator John Oxenford was published in two volumes in London in 1850. Oxenford combined the original three volumes, putting the conversations in chronological order. The topics discussed include religion, politics, literature, poetry and natural sciences. This article investigates the palimpsest reception of Pseudo-Dionysius (ca. 500) in the metaphysics of Nicholas of Cusa (1401–1464). The article covers Cusa’s political theory and metaphysics, which are intertwined. Reading Cusa against the backdrop of an analysis of Pseudo-Dionysius’ metaphysics in a preceding article, the author, in a synthetic conclusion, isolates seven Dionysic ‘trails’ (S1 to S7) in Cusa’s metaphysics: the interpretation of transcendence as bound to immanence; the affirmation of God’s transcendence in the world (or a metaphysics of ‘creation (...) as teophany’); the radical transcendence and simultaneous radical immanence of God (that is, God as ‘Beingness’); fundamental restrictions of language and the analogical ‘Naming’ of God; creation as a system of dialectical symbols about God; the analogical participation of the subject in creation; and unification (reditus, the ‘flowing of things back to God’). The Dionysic trails in Cusa’s metaphysics are described as a noteworthy, if not important, palimpsest in the corpus of late Medieval philosophy and is indicative of what the author puts forward as ‘discursive memory’, which is presented as a modern-critical concept. In the winter of 1807, while Berlin was occupied by French troops, the philosopher Johann Gottlieb Fichte presented fourteen public lectures that have long been studied as a major statement of modern nationalism. Yet Fichte's _Addresses to the German Nation_ have also been interpreted by many as a vision of a cosmopolitan alternative to nationalism. The objective of this article is to present an overview, based on the most recent specialist research, of Neoplatonist developments in the Cologne tradition of the later Middle Ages, with specific reference to a unique Proclian commentary presented by the German Albertist Dominican, Berthold of Moosburg (ca. 1300–1361). Situating Berthold in the post-Eckhart Dominican crisis of the 1340s and 1350s, his rehabilitating initiative of presenting this extensive (nine-volume) commentary on the Neoplatonist Proclus Lycaeus’ (412–485) Elements of Theology in his Expositio (...) super Elementationem theologicam Procli, the only of its kind from the Middle Ages, is contextualised with reference to Berthold’s discursive indebtedness to his Dominican predecessors, Albert the Great (ca. 1200–1280), Ulrich of Strasbourg (ca. 1220–1277) and Dietrich of Freiberg (ca.1250 – ca.1310), as well as two Dutch-Cologne successors, the Albertist Heymeric of Camp (1395–1460) and the Carthusian Thomist Denys de Leeuwis (1402–1471). Berthold’s unique contribution to the philosophical discourse of the Middle Ages is indicated therein that the Expositio provided a synthesis of the late Medieval version of Neoplatonism and contemporaneous German–Dominican theories. By contextualising the work of his Cologne predecessors and successors in the broad idea-historical landscape of antiquity and Neoplatonism, the article argues that Berthold succeeded in linking the Neoplatonic legacy with Cologne Albertism and provided an impetus for the overall consolidating ability of the Cologne tradition. By juxtaposing Berthold and his Expositio with the more conventional legacies of Ulrich, Dietrich, Heymeric and Denys, this exceptional Latin-Western intellectual tradition from Cologne is expanded and enriched with regard to its notable Neoplatonic contributions to philosophy in the later Middle Ages. Contribution: This article contributes to scholarship in Medieval philosophy by presenting an overview of Neoplatonist developments in the Cologne tradition of the later Middle Ages, with specific reference to the Proclian commentary presented by the German Albertist Dominican, Berthold of Moosburg (ca. 1300–1361). This article responds to a critical research challenge in Medieval philosophy scholarship regarding the internal periodisation of the register. By arguing the case for ‘post-scholasticism’ as an internal period indicator (1349–1464, the era between the deaths of William of Ockham and Nicholas of Cusa), defined as ‘the transformation of high scholasticism on the basis of a selective departure thereof’, the article specifies a predisposition in the majority of introductions to and commentaries in Medieval philosophy to proceed straight from 1349 to (...) 1464, understating 115 years of pertinent Medieval philosophical discourse. It is argued that in the modern account of Medieval philosophy, this understatement is manifested in either a predating of Renaissance philosophy to close the gap between 1349 and 1464 as far as possible or in proceeding straight from 1349 to Renaissance philosophy. The article presents five unique philosophical themes from this delicate period, indicating that ‘post-scholasticism’ was indeed a productive period in late Medieval philosophy, which should not be bypassed as an inconsequential entrance to Renaissance philosophy. The period 1349–1464 should accordingly be appreciated for its idiosyncratic contributions to the history of ideas in the late-14th and early-15th centuries, with reference to the political intensification of the via moderna, the pivotal separation of philosophy and theology and the resulting independence of the natural sciences, in res critique of institutions, transforming pragmatics and the rise of philosophical materialism. Contribution: This article contributes to methodological development in Medieval philosophy by responding to a critical research challenge regarding the internal periodisation of the later Middle Ages. Arguing the case for ‘post-scholasticism’ as an internal period indicator (1349 to 1464 in Medieval philosophy, the article presents unique philosophical themes from the period, indicating that it was a productive stage in late Medieval philosophy which should not be bypassed as an inconsequential entrance to Renaissance philosophy. The affinity which the English Leviathan evinces for Independency is the focus of Johann Sommerville's article. Among the links the author traces is a concern to stress that clergymen have no independent jurisdiction over the laity, in contrast to positions shared by Catholics, Presbyterians and Anglicans. But, Hobbes has no doubt that the Independents themselves were fanatics, prescribing religious duties that might conflict with those of the lawful sovereign. Independents also taught resistance to the sovereign, while it is a (...) key aspect of Hobbes's political theory to teach submission to political authority. To summarize, while Leviathan agrees with the Independents in rejecting divine right theories of church government, it cannot be read as a defense of Independent thinking in general. (shrink)

The idea of negative Platonism, first formulated by Jan Patočka in the early 1950s, can be understood as an interpretation of the history of philosophy, with particular reference to its Greek beginnings, as well as a strategy for critical engagement with the metaphysical tradition and a reformulation of central phenomenological themes. Patočka reconstructs the Greek road to metaphysics as a shift from a non-objectifying comprehension of the world as a totality to a quest for systematic knowledge of ultimate reality. In (...) light of this reclaimed background, he then proposes a new reading of Plato: the realm of ideas, separate from empirical reality, becomes a symbol of human freedom, understood as an ability to transcend the world and in so doing grasp it as a totalizing horizon. The concept of freedom thus links a submerged theme of metaphysics to more explicit concerns of contemporary thought. (shrink)

Thomas Hobbes argued for absolute sovereignty, and claimed that in Christian countries the sovereign was fully empowered to govern the church as well as the state. There are grounds for seeing Hobbes as a staunch opponent of religious toleration, and a number of scholars support some variation of this position. This chapter examines the case for and against the idea of the tolerant Hobbes, beginning with his views on the clergy, and the historical context of those views, especially in the (...) debates on church–state relations that preoccupied his English contemporaries. Hobbes noted that clerics were commonly funded by tithes, which were a tenth of the incomes of the laity to whom they catered. Many English Protestant supporters of toleration drew the line at tolerating Roman Catholicism. Hobbes contended that “there is Publique, and Private Worship”. The precept that states should establish the uniform, public worship of God stemmed, in his opinion, from reason and nature. (shrink)

Touraine's critique of the sociological tradition has gradually come to focus on the very notion of society and the basic assumptions associated with it: the interpretation of social life as organized around central principles that are embodied in institutions and internalized by individuals, the tendency to subsume social structure and social change under the same determinants, and the rejection or minimization of the distinction between state and society. In the light of this critique, his earlier attempts to construct a systematic (...) theory seem premature. In particular, the key notion of historicity was overshadowed by the more restrictive concept of the “self-production of society” and the model of a “historical system of action”. But on the other hand, the open questions and unresolved problems of the earlier work underline the need for a further radicalization of the critique of the dominant image of society. This would lead to a conceptualization of social life in terms of interrelations and tensions between structures of culture and structures of power, both of which transcend the social field. A more Weberian perspective would thus replace the residual Durkheimianism of Touraine's earlier writings. (shrink)

Johann Gottfried von Herder (1744-1803) is one of the most important German philosophers of the eighteenth century, who had enormous influence on later thinkers such as Hegel, Schleiermacher and Nietzsche. His wide-ranging ideas were formative in the development of linguistics, hermeneutics, anthropology and bible scholarship, and even today they retain their vitality and relevance to an extraordinary degree. There are eleven known manuscripts of Hobbes’s Elements of Law. As they divide on textual grounds into two groups, they are effectively two separate editions, employing two different texts. While two of the manuscripts apparently were Hobbes’s working copies, it also seems clear that he never definitively established the text of the Elements. There are reasons for thinking it unlikely that, as has been suggested, Hobbes intended the work to influence debate in the Short Parliament. More likely, he hoped his (...) patron, Newcastle, would transmit his principles to the monarch and his chief advisors. (shrink)

Contemporary reflections on capitalism as a social-historical formation build on the legacy of classical theorists and comparative analysts. To clarify the main lines of this ongoing debate, it seems useful to distinguish three dichotomies that have been central to interpretations of capitalist development. The question of unity and diversity has been most prominent in the controversies of the past few decades; its ramifications range from micro-economic research on ‘varieties of capitalism’ to less sustained discussions about the place and role of (...) capitalism within the framework of multiple modernities. Another key distinction contrasts systemic perspectives on capitalism with historical ones. In this regard, Schumpeter’s work is particularly interesting, but as an illustration of the problematic rather than an answer to the basic questions. The notion of a spirit of capitalism is most frequently associated with Weber’s work, where the spirit appeared as the source of a dynamic to which it then fell victim. Reconsiderations of the issue have raised questions about more durable versions and more varied expressions of the spirit, less likely to be eliminated by a self-propelling dynamic. Finally, comments on the articles included in the special issue suggest that they all have something to say on all three aspects of the field, but that their most innovative content may consist in attempts to move beyond systemic models of unity. Angesichts der bekannten Problematik, daß Fichte die Wissenschaftslehre in mehr als zehn Fassungen vortrug, selbst jedoch allein die frühe Darstellung der grundlegenden Prinzipien der Wissenschaftslehre von 1794 (PhB 246) zum Druck brachte, ist die hier erstmalig edierte Erlanger Fassung von Bedeutung. Im Unterschied zu der Berliner Fassung von 1804 (PhB 284), die bis dato als die höchstentwickelte und damit verbindlichste Darstellung der Wissenschaftslehre gewertet wird, ist der Text von 1805 im Originalmanuskript von Fichtes Hand erhalten.

In this paper we seek to clarify the question of what exactly is meant by an “autonomous” decision or act by focusing on the most fundamental personal condition for deciding or acting autonomously. This basic personal requirement has often been overlooked in recent debates; where it has been seen, it is characterized in ways that are too demanding. What is meant here is an individual form of self-relation that seems to be constitutive for leading a life as a human and (...) is likely to be acquired very early in life. This significant personal self-relation has three essential aspects: a primal sense of “self-confidence”, a basic form of “self-assertiveness”, and a fundamental form of “self-esteem”. We will call this the “triple S condition” for autonomy. Our main thesis is that any decision or action which is not based on this triple S condition cannot be called “autonomous”. (shrink)
