The role of chance in producing a picture by snapping a shutter release before a complex and quickly changing scene weakens the bond between the historic action photograph and the meanings it is routinely asked to bear. To appreciate this problem and to understand the array of popular notions that have been marshaled to finesse or suppress the role of chance in photographic production, I consider the case of Joe Rosenthal’s 1945 photograph of American servicemen raising a flag on Iwo (...) Jima. The analysis pushes the production of this famous photograph through a series of zoological analogies: Is it like a fisherman reeling in a trophy catch? Like a cat pouncing on a mouse or a spider setting a trap for a fly? Like a pig pushing its snout through the dirt? Like chimpanzees banging at typewriters? These analogies are playful but also serious. We need new models for understanding the production of the historic action photograph because the predominant modern and postmodern approaches to that production have suppressed the role of chance. Whereas the modern regime tends to understand the historic action photograph as an inspired flash of history, the postmodern regime tends to understand it as a discursive effect. Entertaining the notion that such a photograph is instead a stochastic result leads to a new conception of photography and its relationship to history. Chance emerges as a third kind of photographic madness, alongside the industrial madness decried by Charles Baudelaire and the indexical madness that moved Roland Barthes. (shrink)

On the traditional reading, Schopenhauer claims that compassion is the recognition of deep metaphysical unity. In this paper, I defend and develop the traditional reading. I begin by addressing three recent criticisms of that reading from Sandra Shapshay: that it fails to accommodate Schopenhauer's restriction to sentient beings, that it cannot explain his moral ranking of egoism over malice, and that Schopenhauer requires some level of distinction to remain in compassion. Against Shapshay, I argue that Schopenhauer does not restrict compassion (...) to sentient beings and that a more metaphysically refined version of the traditional reading can accommodate both Schopenhauer's moral ranking of characters and allow for some level of distinction in compassion. I then turn to four further questions for the traditional reading: what the relation is between the feeling of compassionate pain and the recognition of metaphysical unity, how cognitions mediate compassion, whether compassion is limited to the present, and how the feeling of compassion relates to Schopenhauer's fundamental moral principle. I conclude by explaining how, in a reductive vein, the traditional reading can also allow for compassion to have normative content. (shrink)

In this chapter, I argue that Kant can be read as holding that "ought" judgments follow from certain "is" judgments by mere analysis. More specifically, I defend an interpretation according to which (1) Kant holds that “S ought to F” is analytically equivalent to “If, as it can and would were there no other influences on the will, S’s faculty of reason determined S’s willing, S would F” and (2) Kant’s notions of reason, the will, and freedom are all fundamentally (...) non-normative. Not only does this reading have significant textual support, but, I claim, it also sheds light on why Kant takes freedom and morality to mutually imply one another. Moreover, while Kant does take there to be a gap between moral judgments and empirical descriptive statements, that gap is consistent with the analysis in question. I conclude by arguing that this rejection of the is-ought gap is not as philosophically implausible as it might seem, with a focus on G.E. Moore and Hume’s arguments for certain ‘gaps’ between the normative and the non-normative. (shrink)

This chapter analyzes several key themes in Kant’s views about modality. We begin with the pre-critical Only Possible Argument in Support of a Demonstration of the Existence of God, in which Kant distinguishes between formal and material elements of possibility, claims that all possibility requires an actual ground, and argues for the existence of a single necessary being. We then briefly consider how Kant’s views change in his mature period, especially concerning the role of form and thought in defining modality. (...) Kant’s mature views, however, present two difficult interpretive puzzles. The first puzzle concerns whether Kant has a generally reductive view of modality. While Kant’s views on logical modality, the role of actuality in grounding possibility, and the relation of modality to cognition all suggest reduction, we argue that the categorial status of modal concepts and the difficulty in even identifying amodal grounds for modal facts all suggest a non-reductive view. The second puzzle concerns whether Kant accepts modal facts or properties at the noumenal level. While Kant’s appeal to noumenal necessary connections, the contingency of noumenal willing, and the idea of a necessary noumenal being suggest that he endorses noumenal modality, his claims that modal concepts express only relations to the faculty of cognition and his claim that modal concepts arise from our distinctive psychological structures, we argue, suggest that he rejects noumenal modality. Funding organizations around the world are adopting open science policies, resulting in a pressing need for open science programs. In response to the 2011 decadal survey, NASA sought to expand and accelerate omics research, releasing its GeneLab Strategic Plan in 2014. GeneLab is an open science data repository and analysis portal for spaceflight and space-relevant omics data. GeneLab’s output has been outstanding, but its full potential as a way to transform space biology has not yet been achieved. Doubtless, the conscious brain integrates masses of information. But declaring that consciousness simply “emerges” when enough has accumulated, doesn't really explain how first person experience is implemented by neurons. Moreover, empirical observations challenge integrated information theory's (IIT) reliance on thalamo–cortical interactions as the information integrator. More likely, the cortex streams processed information to a still-enigmatic consciousness generator, one perhaps located in the brainstem.

If doing good is often beyond the call of duty, instances of the All or Nothing Problem abound. I have argued elsewhere that we should solve this problem by accepting a principle that I call Optimific Altruism, which has interesting implications both for the correct account of supererogation and for our obligations to give to charity. However, Theron Pummer and Daniel Muñoz have argued that we should instead solve this problem by rejecting an inference rule that I call Conditional Obligation. (...) I argue that Kant's Critique of Pure Reason offers a positive metaphysical account of the thinking self. Previous interpreters have overlooked this account, I believe, because they have held that any metaphysical view of the self would be incompatible with both Kant's insistence on the limitations of cognition and with his project in the Paralogisms. Closer examination, however, shows that neither of those aspects of the Critique precludes a metaphysical account of the self, and that other aspects (namely, the structure (...) of Kant's overall project and the commitments of his claims in the Transcendental Deduction) require such an account. Drawing on a principle of 'effect-relative composition,' I argue that Kant's self is neither an activity, a form, nor a representation, but instead an individual constituted by the thing or things that bring about the unity of a course of experience. Kant makes a striking reference to Spinoza in the 1788 Critique of Practical Reason. This chapter begins by investigating whether Kant directly concerned himself with Spinoza, focusing on Omri Boehm's recent affirmative argument. Kant thinks the objective principle yields radical metaphysical conclusions only in conjunction with further claims about specific conditioning relations. Kant's privileging of Spinozism among realist views seems generally detached from Spinoza's actual thought. The chapter deals with points of convergence or near‐convergence between Kant and Spinoza. It identifies (...) two philosophically interesting points on which Spinoza's and Kant's views come surprisingly close: their arguments for the limitations of our sensory knowledge and their arguments for the timelessness of the mind. Spinoza's official argument for the timelessness of the mind appeals to his doctrines of the body's eternal essence, the parallel between bodies and ideas, and the identity of the human mind with God's idea of the human body. This paper explores the relationship between declining organizations and unethical behavior. Data from a four month long management simulation indicate that declining organizations demonstrate a greater propensity for unethical activities than do more successful companies. The results indicate that: 1) organizations in decline are more likely to be involved in unethical activities; 2) the more severe the decline is, the more unethical the behavior is likely to be; and 3) it is organizational decline and not initial propensities toward unethical conduct (...) that explains the unethical behavior. This book addresses the problem of how to make democratically-legitimate public policy on issues of contentious bioethical debate. It focuses on ethical contests about research and their legitimate resolution, while addressing questions of political legitimacy. How should states make public policy on issues where there is ethical disagreement, not only about appropriate outcomes, but even what values are at stake? What constitutes justified, democratic policy in such conflicted domains? Case studies from Canada and Australia demonstrate that two countries sharing historical (...) and institutional characteristics can reach different policy responses. This book is of interest to policymakers, bioethicists, and philosophers, and will deepen our understanding of the interactions between large-scale socio-political forces and detailed policy problems in bioethics. Whether inference is supported by evidence, and whether classification is correct may be questions of law. In the past two decades, much work on Kant has aimed to delimit and evaluate the bedrock assumptions of Kant's mature Critical philosophy. This volume brings together leading Kant scholars to address this issue in conversation with each other, articulating and interrogating Kant's critical assumptions.

Hendricks (2018) has defended an argument that abortion is (usually) immoral, which he calls the impairment argument. This argument purports to apply regardless of the moral status of the fetus. It has recently been bolstered by several amendments from Blackshaw and Hendricks (2021a; 2021b). In this paper, three problems are presented for their Strengthened Impairment Argument (SIA). In the first, it is observed that even with the new modifications the argument, contrary to their insistence, does seem to depend on Marquis’ (...) argument. In order for it not to do so, they would need to provide some other plausible reason why impairing a fetus is wrong that persists in cases of abortion. Because of the restrictions regarding what reasons can be used, they are not entitled to stipulate that some plausible reason can be found. In the second section, the use of an over-ridingness caveat – the most recent modification – is scrutinised. This is shown to either beg the question about the permissibility of abortion by assuming that opposing reasons are insufficient in most cases, or require an entirely separate argument to establish that such reasons are insufficient. Thirdly, I observe that the principle utilised in the latest version of the argument fails to account for undercutting reason, which suggest that the principle, in its current form, is false. Si les figures continuent à faire l'objet de l'attention des linguistes, c'est dans le cadre toujours restreint de l'élocution, en dépit d'ouvertures vers la pragmatique, qui minimisent le détail du fait grammatical. Cette étude les aborde dans une perspective non seulement de rhétorique générale mais aussi de linguistique et de philosophie du langage, ce qui conduit à soulever la question même de leur définition. Elle s'appuie sur une conception souple du langage, considéré non comme un code, mais comme un processus (...) qui admet le flou et l'approximation. Les figures ne constituent pas un écart repérable par rapport à une norme, au demeurant introuvable, mais des agencements de faits grammaticaux qui prennent leur sens dans le contexte où ils se trouvent. On passe ainsi de la notion de figure à celle de configuration, ce qui est loin d'être une simple question de terminologie. Il ne s'agit donc pas de proposer une énième liste de figures aux noms savants, mais de mettre en évidence le jeu de mécanismes inscrits dans le logos, qui, en liaison avec l'ethos du locuteur et le pathos de l'interlocuteur, contribuent à la négociation de la distance entre individus à propos d'une question, où Michel Meyer voit l'essentiel de la rhétorique. Thomas Aquinas famously held that (A) theft is always wrong, and also that (B) it is permissible for a starving man to take the bread he needs, openly or secretly, from another. He reconciled these two positions by claiming that (C) in cases of great need, it is not theft to take someone else’s property when she does not need it herself. On its face, (C) looks like a theoretically costly concession that Aquinas is forced into in order to reconcile (...) (A) and (B). Our first aim is to show that this is not so. We argue that (C) is in fact the only way to accommodate a set of intuitive norms of keeping and taking. Our second aim is to show that (C) has important implications for theories of property more generally: a plausible theory of property must acknowledge a foundational sense of "belong" on which things belong to those who need them. abstract: Moral autonomy might seem to harbor inconsistency. Whereas nomos suggests that moral laws are grounded in our essence or nature (and thus are not up to us), autos suggests that they are grounded in some free act of self-legislation or prescription (and thus are up to us). Latter-day Kantians often respond by compromising on autonomy, deflating either nomos or autos. This investigation reconstructs how Christian Wolff, Kant’s great rationalist predecessor, already forged a path for embracing autonomy without compromise. His (...) reconciliation, I argue, rests on distinguishing different respects in which moral laws stand in need of grounding. I further unravel why no parallel reconciliation is found in Kant. This, I conclude, still leaves open that Kant may similarly seek to embrace autonomy without compromise. (shrink)

In a time of increasing polarization, how can we address sensitive topics and ensure that university classrooms remain places of healthy discussions and ethical deliberations? This paper addresses this important question by drawing on unique qualitative data from our students’ accounts of their experience in an organizational ethics course. We developed the course using a novel pedagogical strategy centered around the creation of an artistic portfolio. We find that student engagement in an alternative individual space, such as the artistic portfolio, (...) supports them in developing (inter)personal skills in preparation for constructive participation in sensitive discussions and ethical deliberation in the classroom. Additionally, engagement with the artistic portfolio provides them with an alternative means for alleviating tension that arises from these discussions and a space for expressing their opinions. Our findings highlight the role of the portfolio as an individual safe haven that supports teachers in facilitating a positive classroom atmosphere and guides students through challenging discussions and deliberations intrinsic to responsible management education. Considering these new insights, we advocate for a shift from a collective to an individual perspective on safety in academia. This transition liberates the classroom from the constraints and limitations often associated with the establishment of collective safe spaces. (shrink)

In order to be properly applied, criminal law must determine what conduct warrants punitive action. Figuring out exactly how one must act to be criminally liable is a difficulty that faces any legal system. In many jurisdictions criminal recklessness is regarded as an important notion for liability. However, recklessness is difficult to define, and attempts at this exercise have been a problem in legal philosophy since the mid-twentieth century, and persist today. This thesis discusses accounts of recklessness with the aim (...) of defining it in a way that overcomes several problems which have arisen in recent legal history. It is widely accepted, as well as prima facie intuitive, that people can be culpable for acts committed recklessly. Despite this, whether or not a state of mind is reckless is difficult to define, let alone define in a way that is not only conceptually sound, but also pragmatically apt. Recklessness occurs when an agent engages in some risky activity, but factors like the agent’s attitude and whether the risk is foreseen have been cited as relevant when ascertaining their recklessness. I discuss some difficulties in legally framing recklessness, before criticising some definitional manoeuvres made by judges and scholars in the past. With some problems in previous accounts noted, I consider the foundations of culpability in general. I suggest that two accounts of culpability – the agency theory and the choice theory – are both plausible, and each correlates to a prominent contemporary position on recklessness. After serious consideration of both positions, I conclude that the position advocated by Antony Duff, which I see as in keeping with the agency theory of culpability, is both more generally useful for criminal law and much more coherent with our everyday practices of blaming and punishing. Ralph Ellison’s _Invisible Man_ is a violent text. It is unflinching in its confrontation with the violence at the heart of the (African-)American experience. In exploring the central role of violence here – narratively, within the novel; politically, within the culture that the novel explores – the recent work of Slavo Zizek is useful. Zizek posits a critical language which makes an important distinction between systemic violence (of the order of economic and political systems), objective violence (of the order of (...) discriminatory patterns of behaviour), and subjective violence (of the order of individual, often spontaneous, sometimes self-directed acts – which have the effect of misdirecting and obscuring our awareness of these other two more insidious forms of violence). And, in a dialectical spirit of which both Zizek and Ellison might approve, _Invisible Man_ will here reciprocally suggest an interrogation of Zizek’s theories of revolutionary violence. (shrink)

The Vatican palimpsest omits the word enthymemate and leaves a lacuna, thus showing that the scribe found it written as Greek in his exemplar. Now A has been shown to belong to the fourth century, and therefore its authority must be greater than that of the other manuscripts available for this part of Gellius. The same problem occurs in 12.2.14, non pro enthymemate aliquo, where Hertz goes against the Greek of the manuscripts and adopts the reading of Carrio. Yet an (...) examination of the use of the Greek dative in Cicero's Letters will show that it can be used fully as the equivalent of a Latin ablative, can be governed by prepositions taking the ablative in Latin, and can be qualified by a Latin adjective in the ablative.
