This article concerns the implementation of new EU Directives coordinating the procedures for awarding public contracts in European Union Member States. In a number of countries, including Poland, the process of their implementation (Directive 2014/24/eu of the European Parliament and of the Council of 26 February 2014 on public procurement; Directive 2014/25/eu of the European Parliament and of the Council of 26 February 2014 on procurement by entities operating in the water, energy, transport, and postal services sectors; Directive 2014/23/eu of (...) the European Parliament and of the Council of 26 February 2014 on the award of concession contracts) was delayed. In most cases, the modernization of EU regulations on public procurement required a thorough modification of national regulations in this respect. As a result of the introduction of the package of new Directives, the European Union public procurement market has undergone substantial changes. The need to adjust legal regulations to the changing political, social, and economic situations in a better way has resulted in the transposition of the modernized EU Directives concerning public procurement to the Polish legal system, affecting the final shape of the new Polish Public Procurement Law. The implementation of the package of new Directives has significantly affected the functioning of the Polish public procurement market. For the entities operating in this market, this means the necessity to expand their knowledge, so as to become familiar with the new legal solutions in this respect. (shrink)

In recent years, campaigns across the globe have called for the removal of objects symbolic of white supremacy. This paper examines the ethics of altering or removing such objects. Do these strategies sanitize history, destroy heritage and suppress freedom of speech? Or are they important steps towards justice? Does removing monuments and renaming schools reflect a lack of parity and unfairly erase local identities? Or can it sometimes be morally required, as an expression of respect for the memories of people (...) who endured past injustices; a recognition of this history's ongoing legacies; and a repudiation of unjust social hierarchies? In this paper I argue that metalinguistic negotiations are not as common as David Plunkett and Timothy Sundell assume. They make two related controversial claims: the claim that speakers don’t know what they say and the claim that they directly communicate metalinguistic contents. These two claims generate two challenges that the metalinguistic-negotiation view should meet. Firstly, it should clarify why speakers are oblivious to what they are saying and communicating, and secondly, it should explain the mechanism that transforms what seems (...) like a typical object-language disagreement into a metalinguistic dispute. I argue that the way in which Plunkett and Sundell meet these challenges is unsatisfactory. Regarding their answer to the first challenge, I’ll argue that the theoretical cost of postulating massive semantic and pragmatic blindness in otherwise competent speakers is too high. Regarding what they say in relation to the second challenge, I’ll claim that metalinguistic contents can only be conveyed when speakers uttering apparently contradicting claims know that they are using terms with different meanings. If my arguments are correct, then metalinguistic negotiations are certainly not ubiquitous. (shrink)

The concept of biodiversity has played a central role within conservation biology over the last thirty years. Precisely how it should be understood, however, is a matter of ongoing debate. In this paper we defend what we call a classic multidimensional conception of biodiversity. We begin by introducing two arguments for eliminating the concept of biodiversity from conservation biology, both of which have been put forward in a recent paper by Santana. The first argument is against the concept’s scientific usefulness. (...) The other is against its value as a target of conservation. We show that neither of these objections is successful against the classic multidimensional conception of biodiversity. Biodiversity thus understood is important from a scientific perspective, because it plays important explanatory roles within contemporary ecology. Moreover, although it does not encompass all valuable features of the natural world, this does not show that we should abandon it as a target of conservation. Instead, biodiversity should be conceived as one of many grounds of value associated with ecosystems. This is consistent with concluding that a central aim of conservationists should be to protect biodiversity. (shrink)

This entry summarizes an emerging subdiscipline of both empirical bioethics and experimental philosophy (“x-phi”) which has variously been referred to as experimental philosophical bioethics, experimental bioethics, or simply “bioxphi”. Like empirical bioethics, bioxphi uses data-driven research methods to capture what various stakeholders think (feel, judge, etc.) about moral issues of relevance to bioethics. However, like its other parent discipline of x-phi, bioxphi tends to favor experiment-based designs drawn from the cognitive sciences – including psychology, neuroscience, and behavioral economics – to (...) tease out why and how stakeholders think as they do. In recent years, sport entities have begun to prioritise environmental sustainability initiatives in their business strategies with the aim of minimising their environmental impact and engaging stakeholders within the ES movement. There has been minimal academic consideration of the ES movement in professional sport, particularly outside of North America and Europe. The aim of the present study is to provide an overview of the type and profile of ES initiatives being undertaken and communicated to stakeholders in the Asia-Pacific region by (...) the industry bodies. Further, the study offers a conceptual model of the global-, country-, industry- and organisational-level forces impacting these sporting organisations’ ES practices. Various communication mediums of 114 professional sport teams from seven countries—Australia, India, New Zealand, Japan, China, Taiwan and Korea—were evaluated using content analysis. The results reveal low communication of ES practices by professional sport teams in the Asia-Pacific region compared to North America. Extended findings on the existing global profile of ES engagement provide a descriptive understanding of the ES movement in the Asia-Pacific region, and contribute to the identification of possible antecedents and correlatives to be evaluated in future research. Drawing on findings from the study of prejudice and prejudice reduction, we identify a number of mechanisms through which religious communities may influence the intergroup attitudes of their members. We hypothesize that religious participation could in principle either reduce or promote prejudice with respect to any given target group. A religious community’s influence on intergroup attitudes will depend upon the specific beliefs, attitudes, and practices found within the community, as well as on interactions between the religious community and the larger (...) social environment in which it is embedded. Basing our proposals on findings from the literature on prejudice formation and prejudice reduction allows us to outline useful directions for future studies of religion and prejudice. (shrink)

This study was designed to determine the quality of service through the evaluation of hospitalized patients. An analysis of hospitalized patients’ subjective feelings towards service quality was carried out, in the context of the application of the SERVQUAL method. The pilot study was conducted in a Silesian hospital in a group of 29 young patients diagnosed with kidney disease. The study used a standard sheet of 22 SERVQUAL statements and an analysis of the significance of the 5 areas of quality (...) material important for the patient. According to the respondents, the most important of the 5 features that influence the quality of life is the ability of the ward staff to provide adequate medical services The least important were the aesthetics and ergonomics of rooms. Service quality gaps were seen in all the five dimensions as well as in the overall service quality. Hence, the following conclusions could be made: 1. The SERVQUAL method helps to identify discrepancies between perceptions of patients’ expectations in all the dimensions of quality of medical services. 2. For patients, the least important is the material dimension, whereas the one most affecting them is the dimension associated with the reliability of medical services. 3. An improvement of the level of satisfaction with the quality of medical services requires proper planning and effectiveness of implementation of health care services. 4. Research should be conducted on a larger population of patients. (shrink)

This chapter examines the relevance of the cognitive science of morality to moral epistemology, with special focus on the issue of the reliability of moral judgments. It argues that the kind of empirical evidence of most importance to moral epistemology is at the psychological rather than neural level. The main theories and debates that have dominated the cognitive science of morality are reviewed with an eye to their epistemic significance.

In this response to David Bradnick's and Bradford McCall's defense of Amos Yong's usage of emergence theory, we defend our previous argument regarding the tension between Yong's Pentecostal commitments and the philosophical entailments of emergence theory. We clarify and extend our previous concerns in three ways. First, we explore the difficulties of construing divine action naturalistically. Second, we clarify the problems of employing supervenience in theology. Third, we show why Bradnick's and McCall's advice to Yong to adopt weak emergence is (...) theologically costly. In conclusion, it is suggested that theologians within the science and religion dialogue should not fear, but recover, the language of supernaturalism and dualism. (shrink)

It is known that various complexity-theoretical problems can be translated into some special spectra problems. Thus, questions about complexity classes are translated into questions about the expressive power of some languages. In this paper we investigate the spectra of some logics with Henkin quantifiers in the empty vocabulary.

The livestock sector is under increasing pressure to respond to numerous sustainability and health challenges related to the production and consumption of livestock products. However, political and market barriers and conflicting worldviews and values across the environmental, socio-economic and political domains have led to considerable sector inertia, and government inaction. The processes that lead to the formulation of perspectives in this space, and that shape action (or inaction), are currently under-researched. This paper presents results of a mixed methods exploration of (...) the influence of environmental worldviews, values, and demographic factors on perspectives towards the future of the livestock sector. The approach combines survey and interview data derived from a sample of livestock representatives (N = 307). Respondents with higher pro-environmental, ecocentric and relational worldviews and values favour more behaviour-oriented solutions. Those with lower pro-environmental and higher techno-centric worldviews and values favour technological solutions to improve the efficiency of production and to enable continued patterns of meat consumption. Demographic variation and qualitative data emphasise the need to recognise cultural and geographic nuance in narratives. This study improves our understanding of the processes that lead to the formulation of perspectives, enabling the development of more holistic solutions that acknowledge all voices in an increasingly polarised debate. Adopting more pluralistic, relational methodologies will therefore be paramount in developing solutions for sustainable livestock futures. (shrink)

During an initial palliative care assessment, a dying man discloses that he had killed several people whilst a young man. The junior doctor, to whom he revealed his story, consulted with senior palliative care colleagues. It was agreed that legal advice would be sought on the issue of breaching the man’s confidentiality. Two legal opinions conflicted with each other. This book reformulates the central questions of ethics in economic thought. It reconsiders the purpose of economic activity, the ethical values of entrepreneurs, and the Aristotelian dilemma of differentiating between needs and desires to better understand the rise of consumerism. The book also examines cultural factors, the role of religion, and the significance of informal institutions, ultimately showing how less developed countries can increase opportunities for all of their citizens.

We introduce an Automatic Theorem Prover (ATP) of a dual tableau system for a relational logic for order of magnitude qualitative reasoning, which allows us to deal with relations such as negligibility, non-closeness and distance. Dual tableau systems are validity checkers that can serve as a tool for verification of a variety of tasks in order of magnitude reasoning, such as the use of qualitative sum of some classes of numbers. In the design of our ATP, we have introduced some (...) heuristics, such as the so called phantom variables, which improve the efficiency of the selection of variables used un the proof. (shrink)

The paper studies semiotic values in advertisements appearing in German Catholic periodicals in Silesia in the second half of the nineteenth and early twentieth centuries. The study is grounded in the Tartu School of Semiotics and shows shifts and hierarchies in the semiotic valuations of particular commodities. Collected advertisements were classified into four main groups: (1) books, (2) church art, (3) church and devotional accessories, (4) everyday life commodities. We motivate the claim that the group (2) of the advertisements in (...) the Catholic press we analyzed was the driver for the introduction of the remaining two categories of ads, hence the study of this group is pivotal for our analysis. The parameters of center, periphery, and “border,” as between the sacred and the profane are also taken into account, within the structural interrelation of Sr (religious system) (cf. Zaliźniak et al. 1975 [1962]) and Sc (commercial code). Assuming the usefulness of explanatory mechanisms, in conclusion a heuristic interpretation is provided in terms of the relations of semiotic primes. (shrink)

The review discusses the book The Origin of Concepts by Susan Carey, in which she presents three main theses — the innateness of some kind of conceptual representations, the presence of a qualitative change during conceptual development and the existence of a special learning mechanism that achieves that discontinuity called bootstrapping. The general reception of the work is positive. Minor doubts are presented regarding two claims: first, the speculation about the iconic format of core cognition representations, which seems to be (...) underdeveloped and slightly unclear, second, the claim that core cognition representations are innate, which seems to be insufficiently supported by empirical data presented. Niezdaniowe akty mowy to przynajmniej pozornie niezdaniowe wypowiedzi, za których pomocą mówiący dokonują pewnych aktów illokucyjnych: stwierdzają, pytają, proszą itp. Wśród teoretyków zajmujących się takimi wypowiedziami można wskazać zwolenników podejścia, które głosi, że większość takich wypowiedzi tojednak — wbrew pozorom — wypowiedzi zdaniowe (elipsy), oraz zwolenników stanowiska, zgodnie z którym treść takich wypowiedzi musi być bezpośrednio wzbogacona z kontekstu za pomocą procesów pragmatycznych niekontrolowanych semantycznie. W pierwszej części tej pracy przyglądam się bliżej stanowisku traktującemu wypowiedzi niezdaniowe jako elipsy i zastanowiam (...) się, czy można uznać, że kontekst pozajęzy- kowy może wyznaczać sposób uzupełnienia wyrażenia do pełnego zdania w taki sposób, że pierwotna wypowiedź niezdaniowa może być uznana za elipsę. Następnie przedstawiam stanowisko, zgodnie z którym wypowiedzi niezdaniowe to udane akty illokucyjne niewymagające wzbogacenia pragmatycznego. Argumentuję, że taki pogląd nie jest adekwatny, ponieważ na jego gruncie wypowiedzi niezdaniowych nie można uznać za pełnoprawne akty mowy. W dalszej części pracy proponuję wersję stanowiska pragmatycznego, opartą na relatywizmie umiarkowanym Franęois Recanatiego. Proponowana przeze mnie koncepcja pozwala uznać, że mimo iż wypowiedzi niezdaniowe semantycznie nie wyrażają sądów i nie mają wartości logicznej, to po odpowiednim wzbogaceniu z kontekstu pozajęzykowego mają na tyle określoną treść (i moc), że mogą być uznane za udane akty illokucyjne. Koncepcja ta pozwala również odpowiedzieć na zarzut ze zgodności gramatycznej, który jest jednym z najpoważniejszych zarzutów, z jakimi muszą się zmierzyć wszystkie koncepcje pragmatyczne. (shrink)

The article is a commentary to Susan Haack’s The Whole Truth and Nothing but the Truth. It consists of two parts. In the first one some doubts about Haack’s conception of partiality of truth are formulated. However, Haack’s concept of truth is treated as one of the assumptions and not brought up for discussion. In the second part of the article a simple typology of possible sources of truth’s partiality in science is presented. The list includes deliberate and unintentional omissions, (...) misleading, lack of scientific interest, unattainability, and epistemological problems with truth and realism. (shrink)

The construction of a comprehensive negotiated settlement is at the mercy of conflicting ideologies and influences at the international, national and grassroots levels. This paper examines the Juba peace talks, the major actors in the negotiation process, and tension between prosecution and amnesty.

Według standardowej koncepcji krzywdy, inkorporującej test kontrfaktyczny, osoba B została skrzywdzona, jeśli na skutek działania x osoby A znalazła się w gorszej sytuacji niż ta, w której znajdowałaby się, gdyby osoba A nie zrealizowała tego działania. Zastosowanie tej koncepcji do wyborów prokreacyjnych napotyka jednak dwa poważne problemy teoretyczne: tzw. problem nie-istnienia, będący także istotą spraw sądowych z tytułu „wrongful life”, oraz problem nie-tożsamości, opisany przez Derka Parfita. Problemy te ujawniają, że standardowa koncepcja krzywdy prowadzi do wniosków, które są całkowicie sprzeczne (...) z powszechnie podzielanymi intuicjami dotyczącymi obowiązków moralnych rodziców wobec przyszłych dzieci. Celem niniejszego artykułu jest analiza alternatywnej koncepcji krzywdy – tzw. krzywdy progowej. Wykazane zostanie, że koncepcja ta jest oporna na problem nie-istnienie, ale nie jest w stanie w sposób satysfakcjonujący rozwiązać problemu nie-tożsamości. (shrink)

Major histocompatibility complex (MHC)‐associated mate choice is thought to give offspring a fitness advantage through disease resistance. Primates offer a unique opportunity to understand MHC‐associated mate choice within our own zoological order, while their social diversity provides an exceptional setting to examine the genetic determinants and consequences of mate choice in animal societies. Although mate choice is constrained by social context, increasing evidence shows that MHC‐dependent mate choice occurs across the order in a variety of socio‐sexual systems and favours mates (...) with dissimilar, diverse or specific genotypes non‐exclusively. Recent research has also identified phenotypic indicators of MHC quality. Moreover, novel findings rehabilitate the importance of olfactory cues in signalling MHC genes and influencing primate mating decisions. These findings underline the importance to females of selecting a sexual partner of high genetic quality, as well as the generality of the role of MHC genes in sexual selection. (shrink)

A new form of ethics suggested by the Francophone philosopher M. Onfray concerns, first of all, the resignation from faith in a transcendent God, which is substituted with an undefined sacrum in immanence. This new form of ethics is, today, becoming a popular alternative to religious ethics. However, traditional, and new ethics should not be treated as separate sets, as they do not necessarily compete with each other. Systems of spiritual development related to specific denominations will always provide inspiration even (...) for atheists’ ethics. The latter can indicate that, apart from religion, there is also a spirituality that can develop in a person. Nihilism is not the only alternative to religion, as sometimes the defenders of the old religious order try to show. (shrink)

The analysis of Political Action Committee activities is dominated by the perspective that PAC contributions are a rational investment in political candidates; they yield valuable short-term payoffs. PACs buy access to officeholders and their votes on important legislation. Despite broad acceptance of this morally suspect theory, the evidence upon which it is based is weak. An alternative perspective — what we call the principled approach — both fits the evidence and rejects the morally repugnant interpretation of the relationship between business (...) and politics that permeates the rational investment perspective.
