In April 2004 the Irish Government commissioned Judge Maureen Harding Clark to compile a report to ascertain the rate of caesarean hysterectomies at Our Lady of Lourdes Hospital in Drogheda, Republic of Ireland. The report came about as a result of complaints by midwives into questionable practices that were mainly (but not solely) attributed to one particular obstetrician. In this article we examine the findings of this Report through a feminist lens in order to explore what a feminist reading of (...) the Report and the events that led to the inquiry will bring to light. We consider how sex and gender feature in the Lourdes case, draw attention to the deeply gendered asymmetries of power and privilege that existed between the men and women at the centre of this inquiry, and explore the impact such asymmetries had on this particular situation. This research uses a survey to analyze types of benefits sought by partners in cross-sector collaborations in Spain and to test and build upon theories that indicate prior collaboration experience and partner alignment will positively affect value creation through the collaboration. Using exploratory factor analysis to operationalize a broad range of potential benefits into more specific concepts, the results of this study identify distinct factors that characterize the types of benefits sought by non-profit organizations and businesses engaged in cross-sector collaborations. (...) Findings show that prior experience and alignment positively affect each factor for value creation. Prior experience is also found to influence the type of benefits sought from cross-sector collaborations and to positively affect alignment in terms of mission and strategy. The National Institutes of Health and other federal health agencies are considering establishing a national biobank to study the roles of genes and environment in human health. A preliminary public engagement study was conducted to assess public attitudes and concerns about the proposed biobank, including the expectations for return of individual research results. A total of 141 adults of different ages, incomes, genders, ethnicities, and races participated in 16 focus groups in six locations across the country. Focus group participants voiced (...) a strong desire to be able to access individual research results. Recognizing the wide range of possible research results from a large cohort study, they repeatedly and spontaneously suggested that cohort study participants be given ongoing choices as to which results they received. In honor of William Wainwright, this article takes up his interest in interreligious dialogue. It pursues two goals simultaneously: One is to provide a better model for understanding philosophy of religion. Terrence Tilley claims that there is the standard model which is mistaken in that it takes arguing for religious beliefs to be equivalent to justifying commitment to a religion. He promotes a practical model, which has its ancestry in the writings of Michel de Montaigne and Blaise Pascal. This model (...) begins with the lived practices of religion and justifies its intellectual content as explanation for the rightness of this way of life. Wainwright’s work fits into the practical model, but Tilley provides a description and a stronger basis for it. The second goal is to provide much more adequate epistemological resources than those used by the standard model, with contributions from Catholic modernist theologian George Tyrrell, recent philosopher of science Imre Lakatos, and Alasdair MacIntyre, who became interested in evaluating traditions, in science, in moral reasoning, and finally what he came to call large-scale traditions. The problem he needed to overcome is the fact that such traditions carry their own, often different, concepts of reasoning. The possibility of fruitful rational conversation between religions is illustrated here by an account of dialogue between Christianity and Shi’ia Islam, as exemplified in David Burrell’s ability to use conversation with Islamic thought to clarify for Christians their own doctrines of the Trinity, the mediation of Christ, and original sin. In many ways, we live in propitious times for gay and lesbian people. In 1996, the Supreme Court struck down Colorado law prohibiting any kind of protected status based on sexual orientation. In 2003, the Supreme Court held that states may not criminalize sexual conduct between consenting adults of the same sex in private, so long as no money changes hands. In 2010, the Congress repealed the “Don't Ask, Don't Tell” policy that excluded openly gay men and lesbians from military (...) service. In 2013, the Supreme Court struck down key elements of the Defense of Marriage Act that prohibited any federal recognition of same‐sex marriage. Most states do not allow same‐sex marriage, but more and more states are joining the fold. Likewise, most U.S. states do not forbid discrimination based on sexual orientation, but the number that does is increasing. Arguably, no other social minority has made as much legal progress in so short a time. Despite these advances, the story of gay and lesbian people and the law is not yet finished, and the meaning of homosexuality for bioethics is still being written too. Concerns about gay and lesbian people remain important to bioethics in key domains, especially in seeing to the conferral of optimal health care benefits and in sorting through the priorities and social effects of research. Progress in these domains still involves lifting certain burdens of medical and social misjudgments about same‐sex attraction. (shrink)

This paper supports the burgeoning movement that looks to find affinities between Hans urs von Balthasar's theology and various liberation theologies. It does so by offering a “recontextualization” of Balthasar's thought. Specifically, it provocatively looks to recontextualize Balthasar as a theologian of the street. The argument proceeds in three stages: First, the meaning of “context,” and so the possibility of recontextualization, is discussed. While the term has become commonplace in contemporary “contextual theologies,”, the most rigorous analysis of context is found (...) not in theology, but in literary theory. Second, the particular locale of this particular recontextualization is discussed: the street. As sign, the street is ideologically and metonymically overdetermined. Here, Derrida, Goizueta, and Maeseneer are given as examples of thinkers who think with or from the street, who are contextualized by the street. Finally, the paper turns to specific instances in Balthasar's text that demonstrate his street contextualization: namely, his criticism of Rahner's martyrless Christianity and his discussion of the saints, particularly Joan of Arc. This section rejects those claims, epitomized by Murphy, that Balthasar's name signs a totally conservative context, and so completes my project of freeing space for the aforementioned liberatory movement to continue blossoming. Some writers have defended extremely demanding principles, while others have argued that only principles with limited demands are acceptable. In this paper I su ggest that we 100k at the demands 0f beneficencc in a different way; 0ur concern should not just be with the extent of (...) the demands faced by individual agents. Instead, we should consider how the demands imposed Ol'] an agent by a principle of beneiiccncc are affected by the level of compliance with the principle by others. Act—consequ@ntia.lism, for example, in effect requires each complying agent to shoulder her share of the demands of bcncficcnce plus as many of the shares of noncomplying agents as would be optimal. I suggest that we focus OH this feature ofconsequentialism, and not just on the very high demands it can impose Ol'] individual agents. Thus I defend the View that principles of beneiicence should not demand more of agents as expected compliance by othcr agents decreases, and formulate a principle of bencficcnce that meets this condition. This View about beneiicence and compliance is supported by a particular conception 0f beneiiccnce. Rather than as an aim we each have as individuals, benciicence could be understood as a cooperative project, where each of us aims to promote the good together with others. It seems to be a widely shared view that any defensible desire-fulfillment theory of welfare must be framed not in terms of what an agent, in fact, desires but rather in terms of what an agent would desire under hypothetical conditions that include improved information. Unfortunately, though, such accounts are subject to serious criticisms. In this paper I show that in the face of these criticisms the best response is to jettison any appeal to idealized information conditions: the considerations put (...) forward in support of the appeal to what would be desired in hypothetical circumstances of improved information do not, in fact, give adequate reason to make that appeal. This study examines how our personal values influence our judgment of the morality of some workplace behaviours. Sixty-nine undergraduates were asked to rank order separately Rokeach''s instrumental and terminal values in terms of their importance as guiding principles in their life. Subjects then read four scenarios, each of which described ethically questionable behaviour of the sort that might be encountered in business. They were then asked to rate whether or not the behaviour of the person described in the scenario was (...) ethical, and whether or not they had any intentions to rectify the situation. People with different value hierarchies perceived the targeted behaviours differently. For example, subjects who valued honesty perceived the behaviour as more immoral than subjects who did not value honesty. While the ranking of the instrumental valuehonesty was the best predictor of people''s judgments about the morality of the behaviour, their ranking of the instrumental valueambition was the best predictor of their behavioural intentions. For thousands of years, people have used nature to justify their political, moral, and social judgments. Such appeals to the moral authority of nature are still very much with us today, as heated debates over genetically modified organisms and human cloning testify. The Moral Authority of Nature offers a wide-ranging account of how people have used nature to think about what counts as good, beautiful, just, or valuable. To learn whether criticism and regulation of research practices have been followed by a reduction of deception or use of more acceptable approaches to deception, the contents of all 1969, 1978, 1986, and 1992 issues of the Journal of Personality and Social Psychology were examined. Deception research was coded according to type of (non)informing (e.g., false informing, consent to deception, no informing), possible harmfulness of deception employed (e.g., powerfulness of induction, morality of the behavior induced, privacy of behavior), method of (...) deception (e.g., bogus device or role, false purpose of study, false feedback), and debriefing employed. Use of confederates has been partly replaced by uses of computers. "Consent" with false informing declined after 1969, then rose in 1992. Changes in the topics studied (e.g., attribution, socialization, personality) largely accounted for the decline in deception in 1978 and 1986. More attention needs to be given to ways of respecting subjects' autonomy, to appropriate debriefing and desensitizing, and to selecting the most valid and least objectionable deception methods. Ethics is normative; ethics indicates, in broad terms, what researchers should do. For example, researchers should respect human participants. Empirical study tells us what actually happens. Empirical research is often needed to fine-tune the best ways to achieve normative objectives, for example, to discover how best to achieve the dual aims of gaining important knowledge and respecting participants. Ethical decision making by scientists and institutional review boards should not be based on hunches and anecdotes (e.g., about such matters as what (...) information potential research participants would want to know and what they understand, or what they consider to be acceptable risks). These questions should be answered through empirical research. Some of the preceding articles in this special issue illustrate uses of empirical research on research ethics. This article places empirical research on research ethics into broader perspective and challenges investigators to use the tools of their disciplines to proactively solve ethical problems for which there currently exist no empirically proven solutions. Ernest Sosa and others have proposed a safety condition on knowledge: If S knows p, then in the nearest (non-actual) worlds in which S believes p, p is true.1 Colloquially, this is the idea that knowing requires not being easily mistaken. Here, I will argue that like another condition requiring a counterfactual relation between a subject’s belief and the world, viz. Robert Nozick’s sensitivity condition, safety leads, in certain cases, to the unacceptable result that knowledge is not closed under known (...) implication. (shrink)

American Protestant Christianity is often described as a two-party system divided into liberals and conservatives. This book clarifies differences between the intellectual positions of these two groups by advancing the thesis that the philosophy of the modern period is largely responsible for the polarity of Protestant Christian thought. A second thesis is that the modern philosophical positions driving the division between liberals and conservatives have themselves been called into question. It therefore becomes opportune to ask how theology ought to be (...) done in a postmodern era, and to envision a rapprochement between theologians of the left and right. A concluding chapter speculates specifically on the era now dawning and the likelihood that the compulsion to separate the spectrum into two distinct camps will be precluded by the coexistence of a wide range of theological positions from left to right. This paper looks at an argument strategy for assessing the epistemic closure principle. This is the principle that says knowledge is closed under known entailment; or (roughly) if S knows p and S knows that p entails q, then S knows that q. The strategy in question looks to the individual conditions on knowledge to see if they are closed. According to one conjecture, if all the individual conditions are closed, then so too is knowledge. I give a deductive argument (...) for this conjecture. According to a second conjecture, if one (or more) condition is not closed, then neither is knowledge. I give an inductive argument for this conjecture. In sum, I defend the strategy by defending the claim that knowledge is closed if, and only if, all the conditions on knowledge are closed. After making my case, I look at what this means for the debate over whether knowledge is closed. (shrink)

The debate over scientific or critical realism is characterized by confusion, which I claim is a result of approaching the issue from both modern and ‘postmodern’ perspectives. Modern thought is characterized by foundationalism in epistemology and representationalism in philosophy of language, while holism in epistemology and the theory of meaning as use in philosophy of language are postmodern. Typical forms of scientific realism (which seek referents for theoretical terms or correspondence accounts of the truth of scientific theories) are positions at (...) home only in a modern framework. Postmodern presuppositions of other participants in the debate account for the ability of opponents to talk past one another. (shrink)

Why do sociological theorists remain uninterested in and resistant to feminist theory? Notwithstanding indications of increasing openness to feminist theory, journals and texts on sociological theory reflect a continuing pattern of neglect. I identify reasons for this pattern, including tensions resulting from the introduction of gender as a central analytical category: Not only does gender challenge the dichotomous categories that define sociology's boundaries and identity, it also displaces the discipline's central problematic of modernity. The significance of this displacement is apparent (...) when the discipline's responses to feminist and postmodernist theory are compared. I discuss the relevance of feminist theoretical work to contemporary issues in sociological theory, with specific attention to the synthetic nature of feminist theorizing, to work on rethinking power, resistance, and oppression, and to efforts to effect a conceptual shift from "either/or" to "both/and" thinking and to establish new grounds for assessing knowledge claims. This paper introduces an extension A of Kleene's axiomatization of Brouwer's intuitionistic analysis, in which the classical arithmetical and analytical hierarchies are faithfully represented as hierarchies of the domains of continuity. A domain of continuity is a relation R(α) on Baire space with the property that every constructive partial functional defined on {α : R(α)} is continuous there. The domains of continuity for A coincide with the stable relations (those equivalent in A to their double negations), while every relation R(α) (...) is equivalent in A to ∃αA(α, β) for some stable A(α, β) (which belongs to the classical analytical hierarchy). The logic of A is intuitionistic. The axioms of A include countable comprehension, bar induction, Troelstra's generalized continuous choice, primitive recursive Markov's Principle and a classical axiom of dependent choices proposed by Krauss. Constructive dependent choices, and constructive and classical countable choice, are theorems, A is maximal with respect to classical Kleene function realizability, which establishes its consistency. The usual disjunction and (recursive) existence properties ensure that A preserves the constructive sense of "or" and "there exists.". (shrink)

In the author's Relative lawlessness in intuitionistic analysis [this JOURNAL. vol. 52 (1987). pp. 68-88] and An intuitionistic theory of lawlike, choice and lawless sequences [Logic Colloquium '90. Springer-Verlag. Berlin. 1993. pp. 191-209] a notion of lawless ness relative to a countable information base was developed for classical and intuitionistic analysis. Here we simplify the predictability property characterizing relatively lawless sequences and derive it from the new axiom of closed data (classically equivalent to open data) together with a natural principle (...) of invariance under finite translation. We characterize relative lawlessness in terms of a notion of forcing. Finally, we study relative lawlessness on an arbitrary fan and show that the collection of lawless binary sequences (which is comeager in the sense of Baire) has probability measure zero. Professors Murphy and Choi use postmodern philosophy to expose an important source of racism and cultural domination. The metaphysics of domination is examined, along with institutions based on this foundation which they regard as repressive. Postmodernism is shown to be useful in conceptualizing and implementing a pluralistic polity.

Arguments for the expansion of formal schooling have long focused on individual outcomes from schooling, including increasing income, reducing poverty, delaying marriage, and improving health, particularly for girls and women. For nearly three decades now, global education agendas have supported girls’ education in an effort to achieve these outcomes. A large body of research analyzes girls’ individual empowerment from schooling, but less attention is given to how schooling is creating change in families and communities, particularly for lowered-caste girls in India. This article places longitudinal data from a three-year qualitative interview study of schoolgirls in Rajasthan alongside qualitative life-history interviews of girls who completed secondary school in Uttarakhand to understand how schooling affects social changes for lower castes. The analysis, using an intersectional and relational approach, illustrates how girls’ schooling shifts kin and caste relations connected to marriage and work but in ways that do not transform the stickiness of caste and gender norms. We argue that educational policies and programs must attend to the ways in which caste is implicated in achieving outcomes of delayed marriage and formal employment for lowered-caste girls in Indian communities if schooling is to create positive social change. Does leftist political thought have a future? American liberalism is being marginalized, European socialism is exhausted, and cultural radicalism has become little more than a sideshow. Contributors to The Left in Search of a Center probe questions of how political community can be imagined and constituted in the contemporary world. Together, they make it apparent that the still-emerging idea of political community is anchored in the pluralistic and cross-cultural nature of late twentieth-century Western societies.

Mandatory reporting laws, which vary slightly from state to state, require reporting by helping professionals when there is reasonable cause to suspect child abuse. Institutional Review Boards (IRBs) require researchers to warn subjects of this duty to report, which may have a chilling effect on subject rapport and candor. Certificates of confidentiality, in conjunction with other precautions, may reduce some barriers to valid research. Attempts to resolve problems created by reporting laws must produce the most valid research, while minimizing harm (...) and distress to research participants, their families, and the researcher and meeting local and federal legal requirements.
