Judith Butler's (2006) account of vulnerability, resonant with other accounts offered by feminist theorists of embodiment (such as Margrit Shildrick [2000] and Rosalyn Diprose [2002]), underscores a "conception of the human . . . in which we are, from the start, given over to the other, one in which we are, from the start, even prior to individuation itself and, by virtue of bodily requirements, given over to some set of primary others" (31). KEY POINTS In Canada, commercial data brokers collect deidentified patient data from pharmacies, private drug insurers, the federal government and medical clinics without patient consent. Although pharmaceutical companies are the data brokers’ primary customers, academics and nonprofit and public entities also use commercial data sets, given the absence of a coordinated public approach to collecting these data across Canada. Risks of commercialized patient data include loss of anonymity, surveillance and marketing, discrimination and violation of Indigenous data sovereignty. Coordinated infrastructure for (...) the collection and coordination of health data across Canada and updated privacy legislation would protect individuals and communities and enable appropriate data uses. Background During the COVID-19 pandemic, virtual visiting technologies were rapidly integrated into the care offered by intensive care units (ICUs) in the UK and across the globe. Today, these technologies offer a necessary adjunct to in-person visits for those with ICU access limited by geography, work/caregiving commitments, or frailty. However, few empirical studies explore the ethical issues associated with virtual visiting. This study aimed to explore the anticipated or unanticipated ethical issues raised by using virtual visiting in the ICU, such (...) that healthcare professionals can be informed about how to carry out virtual visits ethically, safely and productively. Methods We used a descriptive exploratory qualitative research approach recruiting a convenience sample of newly-graduated junior doctors facilitating ICU virtual visits in a tertiary academic centre. Eight newly graduated junior doctors, seven female and one male, aged 23–27, participated in semi-structured interviews. We analysed transcripts using an inductive coding approach. Results Five overarching themes emerged. Two of the themes namely, ‘fulfilling a moral instinct to connect families’ and ‘promoting autonomy’, arose from participants’ descriptions of how virtual visits aligned with healthcare standards and practices they considered ethical. Three further themes, ‘preserving dignity and privacy’, ‘managing emotional distress’, and ‘providing equitable access’ to virtual visiting technologies, highlight how virtual visits might exacerbate ethical issues related to family communications. Conclusion Virtual visiting may potentially both ameliorate and exacerbate aspects of ethical healthcare delivery for ICU patients and family members. ICU team members should consider unique ethical considerations related to using virtual visiting. We recommend virtual communications skills training for staff and advocate for the use of easily accessible educational resources for families who wish to visit critically unwell patients remotely. This paper provides suggestions for educators who have a desire to learn about, or are already committed to, challenging ableism and disablism. As philosophy teachers, we have the opportunity to facilitate student reflection regarding disability, which puts students in a position to make decisions about whether to retain their habitual ways of comporting themselves toward disabled people or to begin the process of forming new perceptual practices. I contend that existential phenomenology, as formulated by Maurice Merleau-Ponty and Linda Martín Alcoff, (...) provides insights regarding the habitual formation of perceptual practices that are useful for thinking about ways that perception may be informed by ableism and disablism. Jessica Cadwallader demonstrates how their insights can be usefully applied to thinking about perceptions of disability. Through analysis of past encounters with people with disabilities, Cadwallader suggests that students change their habitual ways of responding to people with disabilities. While such reflections may be valuable for making habitual perceptual practices explicit, I would suggest that this is only a condition for the possibility of changing ablist perceptual practices rather than the change itself. Students are likely to enter the classroom lacking the insight that they are even engaging in perceptual practices informed by cultural narratives rather than simply perceiving people with impairments as they are. I argue that an approach to teaching on disability that thematizes perceptual practices regarding disability, and takes experiences of disabled people into account, would be more effective than the one Cadwallader describes. Understanding the ways that people with disabilities experience being constructed as a problem through ableist perceptual practices could help students recognize their own potential to impact others in positive and negative ways. Derek Parfit's “reductionist” account of personal identity (including the rejection of anything like a soul) is coupled with the rejection of a commonsensical intuition of essential self-unity, as in his defense of the counter-intuitive claim that “identity does not matter.” His argument for this claim is based on reflection on the possibility of personal fission. To the contrary, Simon Blackburn claims that the “unity reaction” to fission has an absolute grip on practical reasoning. Now David Lewis denied Parfit's claim that (...) reductionism contravenes common sense, so I revisit the debate between Parfit and Lewis, showing why Parfit wins it. Is reductionism about persons then inherently at odds with the unity reaction? Not necessarily; David Velleman presents a reductionist theory according to which fission does not conflict with the unity reaction. Nonetheless, relying on the distinction between person level descriptions of first-person states and the first-person perspective itself, I argue that Velleman's theory does not eliminate fission-based conflict with the unity reaction. When subjects violate epistemic standards or norms, we sometimes judge them blameworthy rather than blameless. For instance, we might judge a subject blameworthy for dogmatically continuing to believe a claim even after receiving evidence which undermines it. Indeed, the idea that one may be blameworthy for belief is appealed to throughout the contemporary epistemic literature. In some cases, a subject seems blameworthy for believing as she does even though it seems prima facie implausible that she is morally blameworthy or professionally (...) blameworthy. Such cases raise the question of whether one can be blameworthy for a belief in a specifically epistemic sense rather than in some already recognised sense, such as being morally or professionally blameworthy. A number of authors have recently argued that there is a moral or social sense in which one ought to conform one’s beliefs to the evidence. In this paper, I argue that even while accepting that there are moral and social norms governing belief, there are cases in which a subject is blameworthy for a belief but isn’t plausibly morally or socially blameworthy. If this latter view is correct, then we may need to develop a new account of blame which can be applied to beliefs which are not morally or socially blameworthy. (shrink)

Healthcare systems across the globe are struggling with increasing costs and worsening outcomes. This presents those responsible for overseeing healthcare with a challenge. Increasingly, policymakers, politicians, clinical entrepreneurs and computer and data scientists argue that a key part of the solution will be ‘Artificial Intelligence’ (AI) – particularly Machine Learning (ML). This argument stems not from the belief that all healthcare needs will soon be taken care of by “robot doctors.” Instead, it is an argument that rests on the classic (...) counterfactual definition of AI as an umbrella term for a range of techniques that can be used to make machines complete tasks in a way that would be considered intelligent were they to be completed by a human. Automation of this nature could offer great opportunities for the improvement of healthcare services and ultimately patients’ health by significantly improving human clinical capabilities in diagnosis, drug discovery, epidemiology, personalised medicine, and operational efficiency. However, if these AI solutions are to be embedded in clinical practice, then at least three issues need to be considered: the technical possibilities and limitations; the ethical, regulatory and legal framework; and the governance framework. In this article, we report on the results of a systematic analysis designed to provide a clear overview of the second of these elements: the ethical, regulatory and legal framework. We find that ethical issues arise at six levels of abstraction (individual, interpersonal, group, institutional, sectoral, and societal) and can be categorised as epistemic, normative, or overarching. We conclude by stressing how important it is that the ethical challenges raised by implementing AI in healthcare settings are tackled proactively rather than reactively and map the key considerations for policymakers to each of the ethical concerns highlighted. In this paper, I argue that although Kant’s account of empirical schemata in the Critique of Pure Reason is primarily used to explain the shared content of intuitions and empirical concepts, it is also informed by methodological problems in natural history. I argue that empirical schemata, which are rules for determining the spatiotemporal form of objects, not only serve to connect individual intuitions with concepts, but also concern the very features of objects on the basis of which they were connected (...) and ordered in taxonomic systems based on similarity of form. I then suggest that Kant likely had scientific illustrations in mind in his discussion of empirical images in the Schematism chapter and that his account of schemata can help explain the epistemic function of these images in early modern science. Ethics review processes are frequently perceived as extending from codes and protocols rooted in biomedical disciplines. As a result, many researchers in the humanities and social sciences (HASS) find these processes to be misaligned, if not outrightly obstructive to their research. This leads some scholars to advocate against HASS participation in institutional review processes as they currently stand, or in their entirety. While ethics review processes can present a challenge to HASS researchers, these are not insurmountable and, in fact, present (...) opportunities for ethics review boards (ERBs) to mediate their practices to better attend to the concerns of the HASS disciplines. By highlighting the potential value of the ethics review process in recognising the nuances and specificity across different forms of research, this article explores the generative possibilities of greater collaboration between HASS researchers and ERBs. Remaining cognisant of the epistemic and methodological differences that mark different disciplinary formations in turn will benefit the ethical conduct of all researchers. (shrink)

One of the major adaptations during the evolution of Homo sapiens was an increase in brain size. Here we present evidence that a significant and substantial proportion of variation in brain size may be related to changes in temperature. Based on a sample of 109 fossilized hominid skulls, we found that cranial capacities were highly correlated with paleoclimatic changes in temperature, as indexed by oxygen isotope data and sea-surface temperature. Indeed, as much as 52% of the variance in the cranial (...) capacity of these skulls could be accounted for by temperature variation at 100 ka intervals. As an index of more short-term seasonal fluctuations in temperature, we examined the latitude of the sites from which the crania originated. More than 22% of the variance in cranial capacity of these skulls could be accounted for by variation in equatorial distance. (shrink)

Many contemporary philosophers accept a strong generalization of Hume's denial of necessary causal connections, in the form of Hume's dictum (HD), according to which there are no metaphysically necessary connections between distinct, intrinsically typed entities. Hume's version of his dictum occurs during his investigation into the source of the idea of causal connection. The most powerful role that HD plays in Lewis's system concerns its providing a basis for, as Lewis puts it, a "principle of plentitude" that will guarantee "that (...) the worlds are abundant, and logical space is somehow complete". Lewis's combinatorialism promises to provide a principled, extensionally adequate, and reductive generator of metaphysical modal space. Beyond combinatorialism, there are many other accounts of metaphysical modality that need to be considered, not just with an eye to extensional adequacy but also to the clear desideratum to provide an account of the space of metaphysical modality that is principled. Disability through the Lens of Justice offers a contextual framework for considering the limitations that disability places on individuals. Specifically, those that prevent individuals from having control in certain domains of their life, by restricting the availability of acceptable options or the ability to choose between them. Begon argues that our theory of justice should be concerned with the lives individuals can lead, and not with whether their bodies and minds function typically. The problem that disability raises is not the (...) mere fact of difference, but the ways in which that difference is accommodated (or not) and the limitations it may cause. In Disability Through the Lens of Justice, Begon offers a new framework to the disability and justice model. She argues that achieving justice does not require 'normalisation', or the elimination of difference, but through implementating a model which enables all individuals to control their lives as they choose. Ethical questions posed by emerging technologies call for greater understanding of their societal, economic, and environmental aspects by policymakers, citizens, and the engineers and applied scientists at the heart of their development and application. This article reports on the efforts of one research project that assessed the growth of critical thinking and awareness of these multiple aspects in undergraduate engineering and applied science students, with specific regard to nanotechnology. Students in two required courses, a first-year writing and engineering ethics course (...) and a second-year social science course, went through nanotechnology modules as a part of their regular coursework. In the first-year humanities course, we observed self-reported increases in risk awareness, significant educational impact of the module, and a greater awareness of nanotechnology’s applications and social context. In the second-year social science course, we noted changes in risk/benefit analysis as well as in the character and depth of students’ historical analysis, but no change in comparative awareness of other topics, including labor issues and corporate motivations. In higher education, the conventional design of educational programs emphasises imparting knowledge and skills, in line with traditional Western epistemology. This emphasis is particularly evident in the design and implementation of many undergraduate programs in which bodies of knowledge and skills are decontextualised from the practices to which they belong. In contrast, the notion of knowledge as foundational and absolute has been extensively challenged. A transformation and pluralisation has occurred: knowledge has come to be seen as situated and localized into (...) various 'knowledges', and the status of the body has taken on renewed significance in epistemological debates. Rather than thinking of knowledge as transcending the body, the embodiment of knowledge has become a key factor in understanding the nature of knowledge and what it means to know. In this paper, we adopt a phenomenological perspective in exploring the notion of embodied knowing as it relates to higher education programs and, more specifically, the ways in which information and communication technologies (ICTs) are used in these programs. This article situates the work of East India Company servant Alexander Dow (1735–1779), principally his writings on the history and future state of India, in contemporary debates about empire, religion and enlightened government. To do so it offers a sustained analysis of his 1772 essay ‘A Dissertation Concerning the Origin and Nature of Despotism in Hindostan’, as well as his proposals for the restoration of Bengal, both of which played an influential part in shaping the preoccupations with Mughal history that (...) dominated the contemporary crisis in the Company’s legitimacy. By linking these texts to his earlier work on ‘Hindoo’ religion, it will argue that Dow’s analysis of the relationship between certain religious cultures and their civic qualities was rooted in a deist perspective. It doing so it restores the enlightenment components of Dow’s thought, and their impact on the ideology of empire, in a crucial period of British expansion in India. (shrink)

This paper discusses the notion of necessity in the light of results from contemporary mathematical practice. Two descriptions of necessity are considered. According to the first, necessarily true statements are true because they describe ‘unchangeable properties of unchangeable objects’. The result that I present is argued to provide a counterexample to this description, as it concerns a case where objects are moved from one category to another in order to change the properties of these objects. The second description concerns necessary (...) ‘structural properties’. Although I grant that mathematical statements could be considered as necessarily true in this sense, I question whether this justifies the claim that mathematics as a whole is necessary. (shrink)

Many liberal egalitarians support laws that prevent people from making exploitative and unconscionable contracts. These contracts may include low-wage labor agreements or payday loans, for example. I argue that liberal egalitarians should rethink their support for laws that limit the freedom to make these illiberal contracts, as long as the contracts are voluntary and do not violate people’s other enforceable rights. Paternalistic considerations cannot justify limits on illiberal contracts because they are not only likely to misfire; they also express condescending (...) and inegalitarian judgments of citizens. I then consider Seana Shiffrin’s argument that officials may avoid paternalism while still deterring illiberal contracts if they instead refuse to use public institutions to accommodate contracts that are contrary to the fundamental values on which those institutions are based. This argument encounters a dilemma. Officials may refuse to enforce illiberal contracts and ban private enforcement of illiberal contracts, but this strategy encounters the charges of paternalism it aimed to avoid. Or, officials may refuse to enforce illiberal contracts but tolerate private enforcement, but this approach would make the worst off members of society even more vulnerable and marginalized. Therefore, liberal egalitarians should support public enforcement of illiberal contracts because the alternatives are worse. (shrink)

Indecent Theology has provided both Feminist Theology and Liberation Theology with new contours for rethinking bodies, power, dominance, and submission. With regard to the logic of dominance that radically pushes the margins of the margins into a form of inexistent living, I suggest a material turn to rethink the contours that are evoked with Indecent Theology. Materialism has long stood as a philosophy opposing the overwhelming dominance of language and the poststructuralist emphasis that has emerged as the ‘linguistic turn’. Considering (...) ‘new materialism’ as a theoretical platform to reread Indecent Theology provides theologies and ethics an opportunity to re-imagine indecent methodologies through indecency, a sort of ethical perversion. I suggest an indecent turn in mobilizing materialism and kink as theories to reread indecent theology for a productive queer materialist sexual theology. The feminist liberation theology of Marcella Althaus-Reid pushes both feminism and liberation into new contours of power and submission and initiates new contours of queer sexuality into the discourse. When analysing Althaus-Reid’s work, we are brought to attention to the margins of the margins, an awareness of the struggle for power and control by those deemed less than. There are contours of power at and in the margins of the margins, those who occupy ‘bottom space’. From a kink/bdsm orientation, I propose to reread Alrhaus-Read’s feminist liberation theology as decolonial erotics that helps to generate a productive materialist queer sexuality. The overarching methodology of this article is a quasi-auto ethnographic investigation into the ways in which the contours of race, class, gender, sex, sexuality, and ability affect power and submission and in turn reframes both queer theology and queer sexuality that is rooted in the living out of a very particular theology and ethics, which is rooted in queer relating. Theology can neither materialize in a vacuum nor in isolation. An indecent turn to a queer sexual theology that is rooted in a queer relationality demands attention to the interdependence of queer relating that is materialized through the interdependency of the growing queer desires of bodies, power, dominance, and submission. Evelyn Underhill was one of the most widely read writers in spirituality in the first half of the twentieth century. In addition to her nearly 40 books and hundreds of articles and reviews, Underhill wrote a significant number of letters of spiritual direction and led spiritual retreats in England in the 1920s and 1930s. Darkness and light are recurring themes in both Underhill’s letters of spiritual nurture and in the prayers that she wrote and selected for use when leading retreats. (...) These two themes also operate as a lens for exploring Underhill’s own personal, spiritual journey. In this article, the themes of darkness and light are explored in Underhill’s spiritual journey, in her soul care of others, as revealed through her letters, and in her prayers for retreat leading. Between the Psyche and the Social is the first collection that specifically features the field of psychoanalytic social theory emerging in and between psychoanalysis, feminism, postcolonial studies, and queer theory, and across the disciplines of philosophy, literary, film, and cultural studies. This collection of essays takes the psychoanalytic study of social oppression in some new directions by engaging—indeed, stirring up—unconscious fantasies and ethical tensions at the heart of social subjectivity.

This essay argues for a new, “meta,” level of integrity that is created by the context of structural injustice. The essay will draw from Margaret Walker to bring out a defining social value of integrity, namely, its ability to facilitate reliable response to harms caused by “moral luck.” The essay will then argue that, when bad luck is caused by complex social-structural function, traditional advice for maintaining one's integrity fails to provide adequate guidance; following such advice facilitates unjust social-structural function, (...) and so unreliability in response to harm. The essay will address this problem by arguing that in the context of structural injustice, a “meta-level” meaning of integrity emerges. This new meta-level of integrity, unlike the more traditional first-level integrity, does not instruct an individual to disassociate herself from structural harms; instead, it instructs an individual to manage the way in which she participates in unjust social structures. Meta-level integrity, unlike first-level integrity, does not facilitate an end to structural harm, but it does promote a reliable presence of social-justice movements within unjust structures. The dialogue, as a form of diegetic sound, is probably the next piece of the film they concentrate on, but this only imitates actual experience, since most people understand communication by both watching and listening. Christian (...) Metz, in his influential text Film Language: A Semiotics of the Cinema, describes film as “Born of the fusion of several pre-existing forms of expression, which retain some of their own laws (image, speech, music, and noise),” to which he later adds “written materials” as a fifth component.1 Of these five channels of information included in film, music is the most artificial because in many films the majority of music is nondiegetic. For the audience, it is also the channel most removed from everyday life. While people do interact with images, the spoken word, text, and sound in the normal course of a day, people do not walk around constantly supported by a sensitive soundtrack that follows their emotions and thoughts.Yet despite the artificiality of the musical score in comparison with everyday life, audiences have come to accept film music as an integral part of what it means to watch a film. Films that fail to use much music or fail to use it well often have a problem involving the audience as completely as films that embrace music as a tool that can expose the inner feelings and thoughts of characters and can shape the way that viewers feel about what’s happening on screen. To understand the importance of film music, Stam, Burgoyne, and Flitterman-Lewis further explain why it is important to examine music as a significant channel through which the audience makes meaning of the film: “Metz’s definition of the cinema’s matter of expression as consisting of five tracks—image, dialogue, noise, music, written materials—served to call attention to the soundtrack and thus to undercut the formulaic view of [End Page 81] the cinema as an ‘essentially visual’ medium which was ‘seen’ (not heard) by ‘spectators’ (not auditors).”2 By distinguishing dialogue, noise, and music—all auditory channels of information—as important pieces of film, Stam, Burgoyne, and Flitterman-Lewis support Metz’s assertion “that the cinema possesses various ‘dialects,’ and that each one of these ‘dialects’ can become the subject of a specific analysis.”3 Once audiences and critics consider music as one of the fundamental “dialects” of film, it then makes sense to understand music as an essential part of communication and argument in film.But is the film score more than just a reflection of a character’s sadness or the exciting chase music that exhilarates audiences? While most audiences would certainly be able to cite numerous instances of music reflecting the feelings of characters or the general mood of the film, some people might be surprised by the extent to which film music shapes and affects meaning in film. Stam, Burgoyne, and Flitterman-Lewis define several types of music that can be used in scores: redundant music, which reinforces the emotional tone; contrapuntal music, which runs counter to the dominant emotion; empathetic music, which conveys the emotions of the characters; a-empathetic music, which seems indifferent to the drama; and didactic contrapuntal music, which uses music to distance the audience “in order to elicit a precise, usually ironic, idea in the spectator’s mind.”4 Though these terms can be limiting because music often fulfills more than just one role in a scene, they do demonstrate that music is making an argument or working to convince or persuade the audience, proving that film music is behaving rhetorically. Though film music does often fulfill the basic roles of conveying emotion and suggesting connections or themes in the film, film music also works in more complex roles to affect the meaning in film. Prior research has documented how important it is to patients to be able to trust their physicians. In this essay, we introduce physician perspectives on the importance of earning patients’ trust. We conducted twelve semistructured interviews in late 2022, eleven with physicians and one with a patient‐experience expert. Physicians described earning patients’ trust as crucial for working effectively with patients, with several saying that it was as important as having medical knowledge. Physicians also expressed that feeling a patient trusting them (...) is professionally rewarding and fulfilling. To build trust with patients, physicians reported, they make the medical interaction all about the patient, express their belief in their patients, share their personal experiences, and use other strategies identified in previous literature: communicating effectively, being compassionate, and demonstrating competence. Physicians also reported experiencing challenges in building trust with patients, most often because of patients’ lack of trust in other levels of the health care system and because of having inadequate time to spend with patients. Jessica du Toit wonders if our relationship with our pets can be morally defended.

Common-sense morality seems to tell us that a rescuer who can save either one individual or five other individuals from death has a duty to save the greater number. But contractualism, a moral theory on which principles must be justifiable to individuals, seems to imply that it is permissible to save the one. This is because a commitment to individual justification blocks the possibility of appealing to the aggregate amount of lives saved. Does contractualism really have this implication? If so, (...) should we side with the common-sense approach, or is there any reason to side with the contractualist? In this paper, I first examine a new argument from Jay Wallace which claims to reconcile contractualism with a duty to save the greater number. I find the argument to be unsuccessful. I then suggest that common-sense morality doesn't support a duty to save the greater number as straightforwardly as it might initially seem as it might initially seem. I introduce two mundane cases in which the permissibility of saving either the lesser or greater number is intuitively plausible, and I offer some reasons to think that the permissibility of saving the lesser number coheres with our value judgements more generally. I had the fortune of having Professor Bat-Ami Bar On as my mentor and dissertation supervisor. I engaged with her in sustained dialogue for over four years, from when she welcomed me to the graduate program in social, political, ethical, and legal philosophy at Binghamton University until our last conversation, shortly before her untimely death in November of 2020. I have been retracing in my memory some moments of this journey together, and as I do, I realize that writing this (...) reflection is essentially a way of saying “Thank you” to Ami, or, at least, expressing my gratitude publicly to my teacher and mentor. At the same time, grateful as I am for how she guided and accompanied me, I cannot help feeling that our dialogue was abruptly interrupted and that (as time passes) the list of questions and issues that I would have liked to talk about with her only grows. Ami as a mentor and as a political thinker becomes more and more irreplaceable in my mind; and, as I recall her, I realize how much I would have liked to count on Ami for professional and personal advice in the years to come.
