Adversariality in argumentation is typically theorized as inhering in, and applying to, the interactional roles of proponent and opponent that arguers occupy. This paper considers the kinds of adversariality located in the conversational roles arguers perform while arguing—specifically listening. It begins by contending that the maximally adversarial arguer is an arguer who refuses to listen to reason by refusing to listen to another’s reasons. It proceeds to consider a list of lousy listeners in order to illustrate the variety of ways (...) that the conversational role of listener can be performed adversarially. Because conversational roles, while not adversarial by nature, can be enacted adversarially, arguers are properly subject to praise and blame for their performances of these roles. Thus, the paper concludes, argumentation theory stands in need of an articulated normative vocabulary and theory to codify, apply, explain, and justify the norms of listening governing, guiding, and appraising arguers’ performances of listening in argumentation. Uncertainty exerts powerful influences on life history decisions. This has been demonstrated in experiments on nonhumans and in mathematical models. Studies of human populations are suggestive of the effects of uncertainty, but they rely on measures of environmental stress. In this paper, we derive a new measure of uncertainty, upsilon (υ), for use in non-experimental studies. We estimate its association with reproductive behaviors in a longitudinal panel sample of adolescents in the United States. Results show upsilon’s internal structure is consistent (...) with theoretical models of uncertainty. Its associations with reproductive outcomes are also consistent with theoretical predictions. Upsilon seems to have its largest effect on the timing of fertility—increasing the odds of early fertility by a factor of 7, net of the effects of control variables. We discuss our findings for the association between υ and the timing of reproductive effort as well as our future research on υ. (shrink)

Through the lens of Guatemala’s Jorge Carpio Nicolle case I analyze the mechanisms that preserve impunity in Latin American nations struggling to emerge from violent conflict and embrace, the rule of law. I reveal how the infective influence of parallel powers, the ineffectiveness of the judicial process, and obstructive legal doctrine destroy domestic efforts to prosecute those responsible for human rights violations. The Carpio case exposes the role of international courts in providing justice when domestic courts fail to do so, (...) and it demonstrates the importance of human rights groups in pursuing this justice. The conceptual framework of an Interdisciplinary Studies (IDS) program shapes the quality, variety, and results of intellectual inquiry. While there are many viable paradigms for IDS programs, a liberal arts framework particularly enhances interdisciplinary inquiry. Specifically, a liberal arts approach emphasizes integrative thinking, conceptual synthesis, character formation, and coherence across bodies of knowledge. In harmony with the liberal arts, an IDS program equips students to productively wrestle with the inevitable dysfunction and complexity of this world. By situating the task of (...) inquiry among multiple disciplines, interdisciplinarians cultivate ethical-moral discernment alongside fluency in differing modes of academic analysis. Additionally, when oriented towards the liberal arts, an IDS program counters the false pragmatism of careerism and specialization by producing creative critical thinkers who can thrive in a variety of fields. Contextualizing interdisciplinary studies within a liberal arts schema provides students with rich opportunities to unite the mind, the passions, and the will for greater flourishing. (shrink)

Subjective experience suggests that we continuously observe, perceive, and evaluate the environment as we make decisions and intentional actions. The percept of continuity of our cognition, however, is an illusion. In the past decades, ample experimental evidence has been accumulated indicating that cognition evolves through a sequence of discontinuities and transients, and there are discernable neural processes correlating with the cognitive sequences. These discontinuities are crucial in the intentional action-perception cycle, as they mark the cognitive 'aha' moment of deep understanding (...) and conscious insight. Walter Freeman developed a hierarchical model to describe these physiological findings, culminating in the cinematic theory of cognition. Following the traditions of metastability, transient neurodynamics, and brain chaos, discontinuities are described as phase transitions in the cortical neuropil. This approach not only leads to deep theoretical insights of neural correlates of cognition and consciousness, but it also helps to form a conceptual framework to create artificially intelligent devices that are in harmony with humans and serve peaceful development of humanity. In Filartiga v. Pena-Irala (1980), the Second Circuit Court of Appeals ruled that victims of human rights violations could sue their oppressors civilly in US courts under an eighteenth century law now called the Alien Tort Claims Act (ATCA). Controversy raged over the Filartiga decision and the proper interpretation of the ATCA for 24 years. Then in Sosa v. Alvarez-Machain (2004), the Supreme Court issued its first ATCA decision. This essay analyzes the effect of the Sosa decision on the development (...) of human rights law in US courts. I find that while the federal judiciary is responding to some of the Supreme Court’s directives, lower courts still retain a great deal of discretion in handling ATCA cases. (shrink)
