„Rechtsgefühl“ kann das individuelle Gerechtigkeitsempfinden, das Judiz der Richterin im Entscheidungsfindungsprozess, das emotionale Aufbäumen der unterlegenen Partei nach der Entscheidung, eine kollektive Rechtsüberzeugung bezeichnen. Verweise auf das „Rechtsgefühl“ werden oft genutzt, um Rechtssysteme oder einzelne Rechtsakte von innen oder von außen zu legitimieren oder zu delegitimieren. Als sozialer Kompass und normative Rechtfertigung versagt „Rechtsgefühl“ dagegen, wenn es mit zahlreichen gegenläufigen Rechtsgefühlen konkurriert. Personality-disordered individuals of certain types tend to exhibit behaviors that cause particular problems for the Ethics and Compliance (E&C) function inorganizations. This paper defines personality-disordered individuals and focuses on three types that might create such problems: the psychopath, the narcissist, and the obsessivecompulsive personality. We provide a working hypothesis about the problems that they may cause in organizations and then report the results of an exploratory study of E&C personnel. The paper concludes with recommendations for managers and for future research.

Epistemic entrenchment, as presented by Gärdenfors and Makinson (1988) and Gärdenfors (1988), is a formalisation of the intuition that, when forced to choose between two beliefs, an agent will giveup the less entrenched one. While their formalisation satisfactorilycaptures the intuitive notion of the entrenchment of beliefs in a number ofaspects, the requirement that all wffs be comparable has drawn criticismfrom various quarters. We define a set of refined versions of theirentrenchment orderings that are not subject to the same criticism, andinvestigate (...) the relationship between the refined entrenched orderings,the entrenchment orderings of Gärdenfors and Makinson, and AGM theorycontraction (Alchourrón et al., 1985). The prevailing pedagogical approach in business ethics generally underestimates or even ignores the powerful influences of situational factors on ethical analysis and decision-making. This is due largely to the predominance of philosophy-oriented teaching materials. Social psychology offers relevant concepts and experiments that can broaden pedagogy to help students understand more fully the influence of situational contexts and role expectations in ethical analysis. Zimbardo's Stanford Prison Experiment is used to illustrate the relevance of social psychology experiments for business ethics instruction.

This article critically reviews a new collection on Pyrrhonism edited by Diego Machuca, Pyrrhonism in Ancient, Modern, and Contemporary Philosophy, which fits within the recent focus on the systematic, philosophical import of Pyrrhonism. In this article I both situate and summarize the problems posed by the authors regarding the Pyrrhonist's position (concerning its coherence, its theoretical motivation, and its practical motivation), and indicate to what extent Pyrrhonists might be able to meet them. I conclude that, so far, Pyrrhonism, i.e. the (...) view which propagates global suspension of belief, remains a promising option. (shrink)

Robert Brandom makes several mistakes in his discussion of Sellars's "Two-Ply" account of observation. Brandom does not recognize the difference in "level" between observation reports concerning physical objects and 'looks'-statements. He also denies that 'looks'-statements are reports or even make claims. They then demonstrate a more correct reading of Sellars on 'looks'-statements.

We develop an approach to automatically identify the most probable multiword constructions used in children’s utterances, given syntactically annotated utterances from the Brown corpus of CHILDES. The found constructions cover many interesting linguistic phenomena from the language acquisition literature and show a progression from very concrete toward abstract constructions. We show quantitatively that for all children of the Brown corpus grammatical abstraction, defined as the relative number of variable slots in the productive units of their grammar, increases globally with age.

Thanks to the particularly penetrating analysis of André Martinet, we now know that the complementary existence of two levels of different articulation is one of the most remarkable specific characteristics of language. To the first level belong all facts concerning significant units, the meaning and inflection of words, syntactic groupings and the composition of a discourse; the second articulation is that of non-significant elements that we call phonemes. In other words, it is at the second level that we pronounce articulate (...) sounds, while to the first we owe the possibility of formulating groups with meaning. The first articulation could be visualized as the molecular and cellular level in which the simplest elements, having a very limited autonomy, are organized according to affinities having the force of law; the second articulation would thus represent the atomic level, that of elementary particles identified by their role in groups. Today, the linguistic approach offers us an irreplaceable method for the direct study of the constitutive processes of social phenomena (A. Delobelle, 1981). In fact, each social phenomenon is basically inhabited or interpreted by language. It is language processes that give its ramifications to the social and form disstinct sub-groups in it. This is why, when these processes are observed in their formal dynamics, outside their vehiculated “contents,” it is as though we find ourselves faced with the very functioning of (...) the social: as though we have in it a typically experimental terrain for the direct study of social phenomena. This second part continues the search for ways of overcoming the three limitations of the current intellectual and professional division of labor and its knowledge infrastructure, which were shown to be at the root of the present economic, social and environmental crises. A complementary knowledge strategy is proposed to counterbalance the trade of breadth for depth, based on the creation of intellectual maps. One such map is described for engineering, showing how through the process of industrialization people change technology and (...) how through its influence on human life and society, technology changes people. Because industrialization cannot destroy the matter and energy it requires, it also transforms its relations with the biosphere. Once the connections between technology and everything else are mapped, specialists can inquire into the consequences of their design and decision making that fall beyond their domains of expertise, to introduce a preventive orientation into their work to achieve a better ratio of desired to undesired effects. This is shown for materials and production, energy, work, and cities. In subsequent parts, it will become apparent that this example is paradigmatic for other professions, the social sciences, and the university. (shrink)

Integrating artificial intelligence (AI) into critical domains such as healthcare holds immense promise. Nevertheless, significant challenges must be addressed to avoid harm, promote the well-being of individuals and societies, and ensure ethically sound and socially just technology development. Innovative approaches like Embedded Ethics, which refers to integrating ethics and social science into technology development based on interdisciplinary collaboration, are emerging to address issues of bias, transparency, misrepresentation, and more. This paper aims to develop this approach further to enable future projects (...) to effectively deploy it. Based on the practical experience of using ethics and social science methodology in interdisciplinary AI-related healthcare consortia, this paper presents several methods that have proven helpful for embedding ethical and social science analysis and inquiry. They include (1) stakeholder analyses, (2) literature reviews, (3) ethnographic approaches, (4) peer-to-peer interviews, (5) focus groups, (6) interviews with affected groups and external stakeholders, (7) bias analyses, (8) workshops, and (9) interdisciplinary results dissemination. We believe that applying Embedded Ethics offers a pathway to stimulate reflexivity, proactively anticipate social and ethical concerns, and foster interdisciplinary inquiry into such concerns at every stage of technology development. This approach can help shape responsible, inclusive, and ethically aware technology innovation in healthcare and beyond. (shrink)

The task of aligning the philosophical and clinical perspectives on ethics is a challenging one. Clinical practice informs philosophy, not merely by supplying cases, but through shaping and testing philosophical concepts in the reality of the clinical world. In this paper we explore several aspects of the relationship between the philosophical and the clinical within a framework of palliative care for people living with Alzheimer's disease. We suggest that health professionals have a moral obligation to question previous assumptions concerning the (...) quality of life among people with Alzheimer's, and to address the question: does the concept of palliative care properly embrace people with severe dementia? We propose an ethic of palliative care for people with Alzheimer's that is based, not on the traditionally understood principle of autonomy, but on the need to listen to those living with the disease, acknowledging their profound loss of cognitive abilities, with a focus on preventing and relieving suffering, and improving the individual's quality of life. This paper investigates Sellars's complex attitude towards idealism. It distinguishes between the epistemologically-based arguments that led many empiricists to idealism and a different set of more purely metaphysical arguments that came to dominate in German Idealism. Sellars resolutely rejects all of the epistemological arguments for idealism, but shows much greater sympathy with the metaphysical arguments. It is then argued that Sellars introduced his notion of picturing to avoid falling into such an idealism.

Han Bertens' The Idea of the Postmodern is the first introductory overview of postmodernism to succeed in providing a witty and accessibile guide to the sometimes befuddling subject. In clear, straight forward, and always elegant prose, Bertens sets out the interdisciplinary aspects, the critical debates, the historical development and the key theorists of postmodernism. He also explains, in thoughtful and illuminating language, the relationship between postmodernism and poststructuralism, lucidly distinguishing modernism from postmodernism through an examination of the fields of architecture, (...) visual arts, and photography. A major difficulty with these presentations of husserl's time-Theory is that they continue to use theoretically reductionist models for time, Based on a sense of "flow" that is drawn from objective-Physical space and objects extended through such space. Such treatments fail to capture the very heart of (...) the flowing-Processing itself. To clarify this point, This paper investigates the two-Fold description of inner time-Consciousness that gives the primary spatial model of flow--In fact, Of two intersecting flows. Next, It considers the manner in which aspects of immanent temporality are overlooked in this spatial model. The phenomenology of inner temporalizing developed by Edmund Husserl provides a helpful framework for understanding a type of experiencing that can be part of the Post-Traumatic Stress Disorder (PTSD). My paper extrapolates hints from Husserl's work in order to describe those memories — flashbacks — that come so strongly to consciousness as to overtake the experiencer. Husserl's work offers several clues: his view of inner temporalization by which conscious experiences flow in both a serial and a nonserial manner; a characterization (...) of process memory as distinct from representational memory; and the notion of telos, which takes human subjectivity as intrinsically changeable, for example, by means of a retroactive cancellation that would allow the PTSD experiencer to re-process the original meaning of the traumatic experience into a meaning that fits the current situation and thus allows a recovery. Sports organizations face various ethical challenges. To tackle these, ethical codes are becoming increasingly popular instruments. However, a lot of questions remain concerning their effectiveness. There is a particular lack of knowledge when it comes to their form and content, and on the influence of these features on the effectiveness of these codes of ethics. Therefore, we developed a framework to analyze ethical codes and used this to assess codes of ethics in sports clubs from six disciplines. The form and (...) content characteristics of the codes were tested for their impact on the ethical climate of sports clubs. Our results show that most codes focus on the themes of integrity, and on solidarity among the members of sports clubs. Deontological phrasing is dominant in ethical codes in sports clubs. The occurrence of comprehension aids, such as examples, and procedural content, such as the mentioning of sanctions, is low. When it comes to code effectiveness, i.e., the influence on the ethical climate, we see a positive significant effect of the use of consequentialist oriented statements, and of the combination of regulatory and inspirational phrasing. Also the presence of explicit guidelines for the members of the board had a positive significant affect. This shows that codes should be a source of inspiration and stimulate moral awareness, rather than merely guide behavior by simple rules. Other content elements do not influence code effectiveness, suggesting that ethical codes merely have a function of raising ethical awareness in sports clubs. These results help to shed light on what it takes for a code of ethics to become a useful and effective instrument to tackle unethical behavior in sports clubs. (shrink)

While it is generally assumed that large corporations today give rhetorical support for basic human rights in public relations documents, skepticism continues toarise about the behavior of these firms. Do company actions support their rhetoric? This paper provides the initial analysis of our study of both rhetoric and practice regarding human rights in a small sample of large U.S. firms. At this point in the analysis, UNGC membership does not appear to have much influence on corporate rhetoric, but may be (...) partially correlated with several measures of corporate performance on human rights issues. A nation is not a creation of the brain but a collective experience. It does not equal the sum of the individuals that compose it but transcends that sum like a global personality that is not only juridical (although there once was a “League of Nations”) but also moral in the highest sense of the word.We may ask ourselves if liberty is indetermination, nonalienation and autonomy in its accomplishment; if it is congenial in the genetic code of the nation for (...) its entire existence or, on the contrary, if there is not a sort of dialectic, that is, historic, aleatory and problematic relationship between these two realities. In fact, there is danger in the desire to find a similarity, even by analogy, between the life of nations and a biological process. The nation is a historical phenomenon appearing through a chain of circumstances in 19th-century Europe, theorized by Europe and often born elsewhere as a reaction to European imperialism. Wilfrid Sellars has often be proclaimed the father of the "theory theory" of psychological knowledge. This article exposes what is true and and what is false in this claim.

This paper discusses prominent examples of what we call “algorithmic anxiety” in artworks engaging with algorithms. In particular, we consider the ways in which artists such as Zach Blas, Adam Harvey and Sterling Crispin design artworks to consider and critique the algorithmic normativities that materialize in facial recognition technologies. Many of the artworks we consider center on the face, and use either camouflage technology or forms of masking to counter the surveillance effects of recognition technologies. Analyzing their works, we argue (...) they on the one hand reiterate and reify a modernist conception of the self when they conjure and imagination of Big Brother surveillance. Yet on the other hand, their emphasis on masks and on camouflage also moves beyond such more conventional critiques of algorithmic normativities, and invites reflection on ways of relating to technology beyond the affirmation of the liberal, privacy-obsessed self. In this way, and in particular by foregrounding the relational modalities of the mask and of camouflage, we argue academic observers of algorithmic recognition technologies can find inspiration in artistic algorithmic imaginaries. Apart from the European colonisation beingexecuted from the south of the continent, South Africa also experienced a migration andinvasion of people groups from the north. The indigenous people groups, inhabiting thecountry long before these two groups arrived there, will be discussed as background to the restof the article. (...) The strengths and weaknesses of current energy planning can be attributed to the limited economic, social, and environmental contexts taken into account as a result of the current intellectual and professional division of labor. A preventive approach is developed by which the ratio of desired to undesired effects can be substantially improved. It takes into account supply-and demand-side options, renewable and nonrenewable sources, and net energy availability. Alternative energy must be considered within such a strategy, which carefully examines its effects (...) on society and the biosphere. The year 2017 is the year in which the Reformation, started by Martin Luther, is celebrating its 500th birthday. This depicts a milestone in the life of the Church of the Reformation and also in the life of Christians worldwide. This is a good time to ponder on the epistemological question of the validity and necessity of the Reformation. If this question is answered in a positive way, then it could bring us to the realisation that the time is ripe (...) for an African Reformation. This article will argue that this is indeed the case. A reformation, transformation and change is needed for the African Christian context. However, the question could well be asked: Who will be the 'second Luther?'. (shrink)
