Schürmann’s procedure follows the imperative by which Greek science defined its specific task: ‘To save the phenomena.’ If that which manifests itself is always originarily a singular, which the different ‘hegemonic fantasms’ force to become in its appearing a particular case of their own law—then, the retrieval of the phenomena will be brought about by an epic of the singular, (...) which alone is capable of establishing us in the ‘tragic condition’ that forms the basis of our relation to appearing. Ethics review committees have become a common institution in English-speaking research communities, and are now increasingly being adopted in a variety of research environments. In light of existing debates on the aptness of ethics review boards for assessing research work in the social sciences, this article investigates the ways in which researchers navigate issues of research ethics in the absence of a formal review procedure or of an ethics review board. Through the analysis of qualitative and quantitative data, the article (...) questions the overall utility of ethics review boards. Highlighting the importance of space for sharing, the authors argue for the development of a new type of structure that takes into account researchers’ ‘ethos of responsibility’ as an adequate ethical compass for research in the social sciences. This article begins with an explanation of how moral development for organizations has parallels to Kohlberg's categorization of the levels of individual moral development. Then the levels of organizational moral development are integrated into the literature on corporate social performance by relating them to different stakeholder orientations. Finally, the authors propose a model of organizational moral development that emphasizes the role of top management in creating organizational processes that shape the organizational and institutional components of corporate social performance. The possible relationship between widespread unauthorized copying of microcomputer software (also known as software piracy) and level of moral judgment is examined through analysis of over 350 survey questionnaires that included the Defining Issues Test as a measure of moral development. It is hypothesized that the higher one''s level of moral judgment, the less likely that one will approve of or engage in unauthorized copying. Analysis of the data indicate a high level of tolerance toward unauthorized copying and limited support (...) for the hypothesis. The most plausible explanation for these findings is that software copying is perceived as an issue of low moral intensity. This study calls into question the software industry''s strategy of concentrating exclusively on institutional compliance with copyright rules, rather than working to raise the perceived moral intensity about software piracy at the individual level. As long as the issue remains low in moral intensity, the industry cannot expect significant shifts in copying behaviors. Individuals must become more aware of and concerned about the nature and magnitude of harm to society and to the rightful copyright owners from unauthorized copying before their attitudes and behaviors come to reflect higher levels of moral judgment. In the inaugural issue of this journal, David Tyfield used some recent discussions about "meaning finitism" to conclude that the sociology of scientific knowledge is an intellectually hopeless basis on which to erect an intelligible study of science. In contrast, the authors show that Tyfield's argument rests on some profound misunderstandings of the SSK. They show that his mischaracterization of SSK is in fact systematic and is based on lines of argument that are at best incoherent.

This article argues for the recovery and re-incorporation of lost voices and debates into the history of political thought by focusing on the issue of sovereignty. It begins by examining why such a narrow understanding of the canon has come to dominate the sub-discipline and argues for critical approaches that treat the past as a “contested terrain” rather than an unfolding plot. It then turns to early twentieth-century Britain as an example of an era when thinkers who have been largely (...) forgotten by today’s political theorists argued loudly about the future of state sovereignty. It next focuses on a 1916 exchange of essays entitled “The Nature of the State in View of Its External Relations” by Delisle Burns, Bertrand Russell, and G.D.H. Cole, as an example of some of the most innovative and radical ideas to emerge from the period. The article concludes by arguing that re-engaging the work of these forgotten thinkers can broaden our conceptual horizons about sovereignty, speak to some of the most urgent issues of our time, and force open the concept of “the political” to radical reinterpretation. This article addresses tensions within the emerging field of animal studies, which have arisen in the process of trying to craft an ethics that is not grounded in humanist rights-frameworks, by--firstly--mapping how these debates are manifested and--secondly--positing Cary Wolfe’s concept of "affirmative biopolitics" as means of overcoming these conceptual rifts. Building on work that attributes these tensions to the influence of posthumanism, it argues that the embrace of posthumanist thought has marginalised critique by framing perspectives such as ecofeminism and critical (...) animal studies as irredeemably humanist. To counter this marginalisation, Wolfe’s recent work on biopolitics is used to create a much-needed conversation between these perspectives. Debates surrounding veganism provide a route into instigating this dialogue, due to it being a contested practice that crystallises the differences between "mainstream" and critical animal studies. This framing of veganism not as a totalising practice but as a form of "affirmative biopolitics," however, is not solely intended to highlight affinities between apparently antagonistic perspectives, but offered as a contribution to broader debates about how a "posthumanist ethics" could be enacted in practice. A caring approach to knowledge production has been portrayed as epistemologically radical, ethically vital and as fostering continuous responsibility between researchers and research-subjects. This article examines these arguments through focusing on the ambivalent role of care within the first large-scale experimental beagle colony, a self-professed ‘beagle utopia’ at the University of California, Davis (1951–86). We argue that care was at the core of the beagle colony; the lived environment was re-shaped in response to animals ‘speaking back’ to researchers, and ‘love’ (...) and ‘kindness’ were important considerations during staff recruitment. Ultimately, however, we show that care relations were used to manufacture compliancy, preventing the predetermined ends of the experiment from being troubled. Rather than suggesting Davis would have been less ethically troubling, or more epistemologically radical, with ‘better’ care, however, we suggest the case troubles existing care theory and argue that greater attention needs to be paid to histories, contexts, and exclusions. This article argues for a new direction in business ethics research. A number of widely discussed concepts popular in the business world today appear to converge around a set of practices that imply a new ethic capable of linking the competitively effective with the morally good. Seizing this opportunity requires that ethicists redirect their attention away from a traditional focus on applying existing moral theories to business practice and adopt instead a "constructivist" focus that works backward from these best practices (...) to construct a new ethic that supports them. This article focuses on the question of whether Social Issues in Management (SIM) is a “field” and, if so, what kind, emphasizing specifically the recent literature on corporate social responsibility and performance (CSR/csp). Fields are defined in part by coherent bodies of knowledge that serve as guideposts for current research, and so the authors construct a simple model of CSR/csp scholarship, illustrating the relevant categories with representative publications. The authors conclude that SIM is a “low-paradigm” field but is not recognized (...) or accepted as a field by many scholars who write about CSR/csp from “outside” the field. This analysis points to the need for SIM scholars to continue to integrate useful ideas from other fields, and also to critique the work of scholars who address “failings” or “gaps” in SIM research without appropriately dealing with the existing SIM literature. The article concludes with some ideas for sustaining the institutional legitimacy of SIM and for challenging those who would “reinvent” a field with a long and fruitful history, including paying careful attention to journal review processes and the content of publications in prominent journals. Thus, it seems a propitious time to reflect on a decade of writing in feminist morality that has focussed on the concept of an ethic of care, and examine its relevance for today's business context. In the past 20 years, experimental philosophers have investigated folk intuitions about free will and moral responsibility, and their compatibility with determinism. To determine whether laypeople are “natural compatibilists” or “natural incompatibilists”, they have used vignettes describing agents living in deterministic universes. However, later research has suggested that participants’ answers to these studies are plagued with comprehension errors: either people fail to really accept that these universes are deterministic, or they confuse determinism with something else. This had led certain experimenters (...) to conclude that maybe folk intuitions about the compatibility of free will with determinism could not be empirically investigated. Here, we propose that we should refrain from embracing this pessimistic conclusion, as scenarios involving time loops might allow experiments to bypass most of these methodological issues. Indeed, scenarios involving time loops belong both to the philosophical literature on free will and to popular culture. As such, they might constitute a bridge between the two worlds. We present the results of five studies using time loops to investigate people’s intuitions about determinism, free will and moral responsibility. The results of these studies allow us to reach two conclusions. The first is that, when people are introduced to determinism through time loops, they do seem to understand what determinism entails. The second is that, at least in the context of time loops, people do not seem to consider determinism to be incompatible with free will and moral responsibility. (shrink)

This article analyses the policies and the use of social rights in France and Germany in relation to the philosophical conception of subjective rights theorised by Catherine Colliot-Thélène. The first part is devoted to the relationship between the innate right and the solidarist conception of social citizenship, which is institutionalised and evolves within the framework of the “labour society” in both countries. The second part deals with the differences and developments in the French and German regimes of social citizenship and (...) policies of access to rights. In recent times, social rights have been redefined as fundamental rights and form part of a renewed conception of citizenship. In the third part, we study the implementation of schemes of access to social rights and their agents in Berlin, Paris and the Paris region, focusing on the case of “poor migrants”. (shrink)

A major objection to epistemic infinitism is that it seems to make justification impossible. For if there is an infinite chain of reasons, each receiving its justification from its neighbour, then there is no justification to inherit in the first place. Some have argued that the objection arises from misunderstanding the character of justification. Justification is not something that one reason inherits from another; rather it gradually emerges from the chain as a whole. Nowhere however is it made clear what (...) exactly is meant by emergence. The aim of this paper is to fill that lacuna: we describe a detailed procedure for the emergence of justification that enables us to see exactly how justification surfaces from a chain of reasons. C’est que le problème de la vérité, pensé à partir de la manifestation, n’offre pas seulement le reflet fidèle des thèses philosophiques henryennes, il permet en outre de mettre au jour les inflexions et (...) radicalisations critiques que l’auteur de Phénoménologie matérielle fait subir à la méthode phénoménologique elle-même. Avec Henry, ce concept, l’un des principaux et des plus anciens de la métaphysique occidentale, se trouve refondé à partir d’une attention exclusive portée au phénomène, et à ce qui en lui apparaît. Since the 2000s, European open data policies have given a strong boost to commercial meteorology by giving free access to weather observations and models produced by public organizations. This article examines the efforts and challenges met by a French company that developed an offer of weather services based on the commodification of both open weather data and local observations produced by low-cost stations used by farmers. However, the paper shows that such commercialization of stations’ data is hampered both by their (...) material friction with the weather infrastructure and by an economic friction related to data’s heterogeneous valuations. As solving the economic friction generated by data’s valuation is the priority of commercial meteorologists, they finally differentiate their offer using simulated weather data produced by computing models. Finally, the paper claims that the commercial process inherent to the use of this other type of data subordinates weather science to a logic of services: when designing a service for agriculture, the company considered that simulated data were more suited to digital farm advising services. In the end, it is the capacity of weather data to be integrated into private services and tools that valuate them as suited to guide farming practices. (shrink)

Various arguments have been put forward to show that Zeno-like paradoxes are still with us. A particularly interesting one involves a cube composed of colored slabs that geometrically decrease in thickness. We first point out that this argument has already been nullified by Paul Benacerraf. Then we show that nevertheless a further problem remains, one that withstands Benacerraf s critique. We explain that the new problem is isomorphic to two other Zeno-like predicaments: a problem described by Alper and Bridger in (...) 1998 and a modified version of the problem that Benardete introduced in 1964. Finally, we present a solution to the three isomorphic problems. (shrink)

This Open Access book addresses the age-old problem of infinite regresses in epistemology. How can we ever come to know something if knowing requires having good reasons, and reasons can only be good if they are backed by good reasons in turn? The problem has puzzled philosophers ever since antiquity, giving rise to what is often called Agrippa's Trilemma. The current volume approaches the old problem in a provocative and thoroughly contemporary way. Taking seriously the idea that good reasons are (...) typically probabilistic in character, it develops and defends a new solution that challenges venerable philosophical intuitions and explains why they were mistakenly held. Key to the new solution is the phenomenon of fading foundations, according to which distant reasons are less important than those that are nearby. The phenomenon takes the sting out of Agrippa's Trilemma; moreover, since the theory that describes it is general and abstract, it is readily applicable outside epistemology, notably to debates on infinite regresses in metaphysics. The popular view of shareholder activism focuses on shareholder resolutions and the shareholder vote via proxy statements at the annual meeting, which is treated as a "David vs. Goliath" showdown between the small group of socially responsible investors and the powerful corporation. This article goes beyond the popular view to examine where the real action typically occurs-in the Dialogue process where corporations and shareholder activist groups mutually agree to ongoing communications to deal with a serious social issue. Use of the (...) capitalized word "Dialogue" is intended to distinguish this formal process between corporations and shareholders from all the other forms of dialogue or twoway communication exchanged between a corporation and its stakeholders. The phenomenon of Dialogue between a corporation and dissident shareholders has not been analyzed in the academic literature or in the popular press because it occurs behind the scenes and out of sight from media scrutiny. Yet this is where a great deal of social change initiated by shareholder activists is negotiated. This article contributes both theoretically and empirically to the study of Dialogues between shareholder activists and corporations. We explain how Dialogues occur in the context of the shareholder resolution process and examine two Dialogues that focus on international labor issues in two industries. Then data on Dialogues during the period, 1999-2005, from the Interfaith Center on Corporate Responsibility are analyzed. This research contributes to knowledge about the Dialogue process and the emerging literature on corporation-stakeholder engagement. (shrink)

This article describes the theory and process of global business citizenship (GBC) and applies it in an analysis of characteristics of company codes of business conduct. GBC is distinguished from a commonly used term, “corporate citizenship,” which often denotes corporate community involvement and philanthropy. The GBC process requires (1) a set of fundamental values embedded in the corporate code of conduct and in corporate policies that reflect universal ethical standards; (2) implementation throughout the organization with thoughtful awareness of where the (...) code and policies fit well and where they might not fit with stakeholder expectations; (3) analysis and experimentation to deal with problem cases; and (4) systematic learning processes to communicate the results of implementation and experiments internally and externally. We then identify and illustrate the three attributes of a code of conduct that would reflect a GBC approach. The three attributes are orientation, implementation, and accountability. The various components of these attributes are specified and illustrated, using website examples from six global petroleum companies. (shrink)

Au-delà des pratiques sur les exploitations, « agriculture digitale », « smartfarming » et autres « AgTech » sont devenus des termes quotidiens pour les organismes et les politiques agricoles. The purpose of this paper is to examine how any domain of Meinongian objects can be structured by a special kind of mereology. The basic definition of this mereology is the following: an object is part of another iff every characteristic property of the former is also a characteristic property of the latter. I will show that this kind of mereology ends up being very powerful for dealing with Meinongian objects. Mereological sums and products are not restricted in any way (...) in a domain of Meinongian objects: there is a sum and a product for any pair of Meinongian objects. With the mereological operations of sum, product and complement, and two special Meinongian objects, we can define a full boolean algebra on Meinongian objects. Moreover, this kind of mereology is atomic and extensional: an atom is a Meinongian object having just one characteristic property and two objects are identical iff the same atoms are parts of both of them. A Meinongian object can finally be defined in mereological terms as the sum of the atoms of its characteristic properties. (shrink)

Modal Meinongianism is a form of Meinongianism whose main supporters are Graham Priest and Francesco Berto. The main idea of modal Meinongianism is to restrict the logical deviance of Meinongian non-existent objects to impossible worlds and thus prevent it from “contaminating” the actual world: the round square is round and not round, but not in the actual world, only in an impossible world. In the actual world, supposedly, no contradiction is true. I will show that Priest’s semantics, as originally formulated (...) in Towards Non-being, tell us something different. According to certain models, there are true contradictions in the actual world. Berto and Priest have noticed this unexpected consequence and have suggested a solution, but I will show that their solution is highly questionable. In the last section of this paper, I will introduce a new and simpler version of modal Meinongianism that avoids the problem. (shrink)

Je montrerai en premier lieu comment et pourquoi la sémantique formelle peut être employée comme un outil pour déterminer l’engagement ontologique d’une théorie : je soutiendrai d’une part que la sémantique doit être prise au sérieux comme apte à décrire la vérifaction des formules du langage; d’autre part, que les engagements ontologiques d’une théorie sont déterminés par ses vérifacteurs. De là, j’exposerai une méthode générale permettant, étant donné un certain type d’ontologie, de construire une sémantique dont les engagements ontologiques sont (...) en accord avec celle-ci. Pour cela, je définirai la notion de cadre ontologique : il s’agit d’une structure telle que toute sémantique cons-truite à partir de cette structure aura un certain engagement ontologique déterminé à l’avance. J’exposerai quatre cadres représentant deux types de nominalisme et deux types de réalisme, et j’esquisserai à partir de ces cadres quatre sémantiques pour les langages du premier ordre. (shrink)

This book proposes a taxonomy of jurisprudence and legal practice, based on the discourse theory of Jacques Lacan. In the anglophone academy, the positivist jurisprudence of H.L.A. Hart provides the most influential account of law. But just as positivism ignores the practice of law by lawyers, even within the academy, the majority of professors are also not pursuing Hart's positivist project. Rather, they are engaged in policy-oriented scholarship - that tries to explain law in terms of society's collective goals - (...) or in doctrinal legal scholarship - that does not try to describe what law is, or to supply justifications for it - but which examines the 'internal' logic of law. Lacan's discourse theory has the power to differentiate the various roles of the practicing lawyer and the legal scholar. It is also able to explain the striking lack of communication between diverse schools of legal scholarship and between legal academia and the legal profession. Although extremely influential in Europe and South America, Lacanian theory remains largely unexplored outside of the field of comparative literature. In taking up the jurisprudential ramifications of Lacan's work, _The Four Lacanian Discourses_ thus constitutes an original contribution to current theoretical and practical understandings of law.
