We respond to Autumn Fiester’s critique that our proposed bioethical consensus project amounts to “ethical hegemony,” and evaluate her claim that ethicists should restrict themselves to “mere process” recommendations. We argue that content recommendations are an inescapable aspect of clinical ethics consultation, and our primary concern is that, without standardization of bioethical consensus, our field will vacillate among appeals to the disparate claims in the 22 “Core References,” unsustainable efforts to defend value-neutral process recommendations, or become a practice of Lone (...) Ranger clinical ethicists. We contend that a consensus document that captures the basic moral commitments of patients and careproviders is the next step in the professional evolution of our field. The past thirty years have seen a surge of empirical research into political decision making and the influence of framing effects — the phenomenon that occurs when different but equivalent presentations of a decision problem elicit different judgments or preferences. During the same period, political philosophers have become increasingly interested in democratic theory, particularly in deliberative theories of democracy. Unfortunately, the empirical and philosophical studies of democracy have largely proceeded in isolation from each other. As a result, philosophical treatments of (...) democracy have overlooked recent developments in psychology, while the empirical study of framing effects has ignored much contemporary work in political philosophy. In Framing Democracy, Jamie Terence Kelly bridges this divide by explaining the relevance of framing effects for normative theories of democracy. -/- Employing a behavioral approach, Kelly argues for rejecting the rational actor model of decision making and replacing it with an understanding of choice imported from psychology and social science. After surveying the wide array of theories that go under the name of democratic theory, he argues that a behavioral approach enables a focus on three important concerns: moral reasons for endorsing democracy, feasibility considerations governing particular theories, and implications for institutional design. Amongst intellectuals and activists, neoliberalism has become a potent signifier for the kind of free-market thinking that has dominated politics for the past three decades. Forever associated with the conviction politics of Ronald Reagan and Margaret Thatcher, the free-market project has since become synonymous with the 'Washington consensus' on international development policy and the phenomenon of corporate globalization, where it has come to mean privatization, deregulation, and the opening up of new markets. But beyond its utility as a protest slogan (...) or buzzword as shorthand for the political-economic Zeitgeist, what do we know about where neoliberalism came from and how it spread? Who are the neoliberals, and why do they studiously avoid the label? Constructions of Neoliberal Reason presents a radical critique of the free-market project, from its origins in the first half of the 20th Century through to the recent global economic crisis, from the utopian dreams of Friedrich von Hayek through the dogmatic theories of the Chicago School to the hope and hubris of Obamanomics. The book traces how neoliberalism went from crank science to common sense in the period between the Great Depression and the age of Obama. Constructions of Neoliberal Reason dramatizes the rise of neoliberalism and its uneven spread as an intellectual, political, and cultural project, combining genealogical analysis with situated case studies of formative moments throughout the world, like New York City's bankruptcy, Hurricane Katrina, and the Wall Street crisis of 2008. The book names and tracks some of neoliberalism's key protagonists, as well as some of the less visible bit-part players. Idioms of African religion have enabled African men and women to respond to Christianity and to place their hopes in it. The idioms and new ideas of missions had a tremendous influence on the prophetic, spiritual African churches, helping to ensure that they would emerge as Christian churches rather than as re-statements of African religion. Some African churches did advocate the performance of ancestral rituals but stressed the need for dignity and sobriety in worship on the one hand and the (...) acknowledgement of the cen-trality of preaching and the Bible on the other hand. Noisy ill-disciplined enthusiasm was strongly disapproved and yet the historic mission churches were not averse to experimenting with new ideas of inculturation. (shrink)

Mathematical investigation, when done well, can confer understanding. This bare observation shouldn’t be controversial; where obstacles appear is rather in the effort to engage this observation with epistemology. The complexity of the issue of course precludes addressing it tout court in one paper, and I’ll just be laying some early foundations here. To this end I’ll narrow the field in two ways. First, I’ll address a specific account of explanation and understanding that applies naturally to mathematical reasoning: the view proposed (...) by Philip Kitcher and Michael Friedman of explanation or understanding as involving the unification of theories that had antecedently appeared heterogeneous. For the second narrowing, I’ll take up one specific feature (among many) of theories and their basic concepts that is sometimes taken to make the theories and concepts preferred: in some fields, for some problems, what is counted as understanding a problem may involve finding a way to represent the problem so that it (or some aspect of it) can be visualized. The final section develops a case study which exemplifies the way that this consideration – the potential for visualizability – can rationally inform decisions as to what the proper framework and axioms should be. The discussion of unification (in sections 3 and 4) leads to a mathematical analogue of Goodman’s problem of identifying a principled basis for distinguishing grue and green. Just as there is a philosophical issue about how we arrive at the predicates we should use when making empirical predictions, so too there is an issue about what properties best support many kinds of mathematical reasoning that are especially valuable to us. The issue becomes pressing via an examination of some physical and mathematical cases that make it seem unlikely that treatments of unification can be as straightforward as the philosophical literature has hoped. Though unification accounts have a grain of truth (since a phenomenon (or cluster of phenomena) called “unification” is in fact important in many cases) we are far from an analysis of what “unification” is.. In this work, Jamie Mayerfeld undertakes a careful inquiry into the meaning and moral significance of suffering. Understanding suffering in hedonistic terms as an affliction of feeling, he claims that it is an objective psychological condition, amenable to measurement and interpersonal comparison, although its accurate assessment is never easy. Mayerfeld goes on to examine the content of the duty to prevent suffering and the weight it has relative to other moral considerations. He argues that the prevention of suffering is (...) morally more important than the promotion of happiness, and that the duty to relieve suffering is much stronger than most of us acknowledge. The paper describes the problem for robust moral realism of explaining the supervenience of the moral on the non-moral, and examines five objections to the argument: The moral does not supervene on the descriptive, because we may owe different obligations to duplicates. If the supervenience thesis is repaired to block, it becomes trivial and easy to explain. Supervenience is a moral doctrine and should get an explanation from within normative ethics rather than metaethics. Supervenience is a conceptual truth and should (...) be explained by the nature of our concepts rather than by a metaphysical theory. The moral does not supervene on the descriptive, because moral principles are not metaphysically necessary. It concludes that none of these objections is successful, so Robust Realists do have an explanatory debt to worry about. (shrink)

This paper surveys some ways of distinguishing Quasi-Realism in metaethics from Non-naturalist Realism, including ‘Explanationist’ methods of distinguishing, which characterize the Real by its explanatory role, and Inferentialist methods. Rather than seeking the One True Distinction, the paper adopts an irenic and pragmatist perspective, allowing that different ways of drawing the line are best for different purposes.

Although business and society scholars have sought to demonstrate that corporate social performance (CSP) leads to corporate financial performance (CFP), a complete model of the pathway from CSP to CFP has not been substantiated. One suggestion is that certain indicators of CSP are noticed by stakeholders, who then act in ways that ultimately affect the firm's CFP. The present study focused on the first step in this path: identifying the factors that initially lead a stakeholder group to target a particular (...) firm. Existing theory from the literature on the environmental movement, stakeholder theory, and CSP fostered the development of eight propositions regarding corporate environmental performance. Case studies of five environmental non-governmental organizations (ENGOs) are used to address the propositions. The case studies also supply additional insight into ENGO targeting of particular firms, unrelated to the propositions, thereby facilitating the development of a theoretical model. (shrink)

Feyerabend is infamous for his defense of pluralism, which he extends to every topic he discusses. Disagreement, a by-product of this pluralism, becomes a sign of flourishing critical communities. In Feyerabend’s political works, he extends this pluralism from science to democratic societies and incorporates his earlier work on scientific methodology into a procedure for designing just policy. However, a description and analysis of Feyerabend’s conception of disagreement is lacking. In this paper, I reconstruct and assess Feyerabend’s conception of disagreement, with (...) a particular emphasis on the role of experts, and its role in the formation of science policy. I go on to assess this argument in light of recent literature on manufactured disagreement on politically contentious science policy. I conclude by suggesting some prospects and problems for de-idealizing Feyerabend’s position on disagreement to see whether it may be plausibly implemented. (shrink)

It is widely believed that some puzzling and provocative remarks that Frege makes in his late writings indicate he rejected independence arguments in geometry, particularly arguments for the independence of the parallels axiom. I show that this is mistaken: Frege distinguished two approaches to independence arguments and his puzzling remarks apply only to one of them. Not only did Frege not reject independence arguments across the board, but also he had an interesting positive proposal about the logical structure of correct (...) independence arguments, deriving from the geometrical principle of duality and the associated idea of substitution invariance. The discussion also serves as a useful focal point for independently interesting details of Frege's mathematical environment. This feeds into a currently active scholarly debate because Frege's supposed attitude to independence arguments has been taken to support a widely accepted thesis (proposed by Ricketts among others) concerning Frege's attitude toward metatheory in general. I show that this thesis gains no support from Frege's puzzling remarks about independence arguments. (shrink)

The provider–patient relationship is typically regarded as an expert-to-novice relationship, and with good reason. Providers have extensive education and experience that have developed in them the competence to treat conditions better and with fewer harms than anyone else. However, some researchers argue that many patients with long-term conditions (LTCs), such as arthritis and chronic pain, have become “experts” at managing their LTC. Unfortunately, there is no generally agreed-upon conception of “patient expertise” or what it implies for the provider–patient relationship. I (...) review three prominent accounts of patient expertise and argue that all face serious objections. I contend, however, that a plausible account of patient expertise is available and that it provides a framework both for further empirical studies and for enhancing the provider–patient relationship. In the present study, I sought to more fully understand stakeholder organizations’ strategies for influencing business firms. I conducted interviews with 28 representatives of four environmental non-governmental organizations (ENGOs): Natural Resources Defense Council (NRDC), Greenpeace, Environmental Defense (ED), and Union of Concerned Scientists (UCS). Qualitative methods were used to analyze this data, and additional data in the form of reviews of websites and other documents was conducted when provided by interviewees or needed to more fully comprehend interviewee’s comments. Six propositions (...) derived from Frooman (1999) formed the basis for the initial data analysis; all six propositions were supported to some extent. Perhaps more interestingly, the data revealed that Frooman’s model is too parsimonious to adequately describe stakeholder influence strategies and related alliances, necessitating the development of an alternative theoretical model grounded in the data collected. Bioinformatics – the so-called shotgun marriage between biology and computer science – is an interdiscipline. Despite interdisciplinarity being seen as a virtue, for having the capacity to solve complex problems and foster innovation, it has the potential to place projects and people in anomalous categories. For example, valorised ‘outputs’ in academia are often defined and rewarded by discipline. Bioinformatics, as an interdisciplinary bricolage, incorporates experts from various disciplinary cultures with their own distinct ways of working. Perceived problems of interdisciplinarity include (...) difficulties of making explicit knowledge that is practical, theoretical, or cognitive. But successful interdisciplinary research also depends on an understanding of disciplinary cultures and value systems, often only tacitly understood by members of the communities in question. In bioinformatics, the ‘parent’ disciplines have different value systems; for example, what is considered worthwhile research by computer scientists can be thought of as trivial by biologists, and vice versa. This paper concentrates on the problems of reward and recognition described by scientists working in academic bioinformatics in the United Kingdom. We highlight problems that are a consequence of its cross-cultural make-up, recognising that the mismatches in knowledge in this borderland take place not just at the level of the practical, theoretical, or epistemological, but also at the cultural level too. The trend in big, interdisciplinary science is towards multiple authors on a single paper; in bioinformatics this has created hybrid or fractional scientists who find they are being positioned not just in-between established disciplines but also in-between as middle authors or, worse still, left off papers altogether. This article develops a normative theory of the status of ‘internally displaced persons’. Political theorists working on forced migration have paid little attention to internally displaced persons, but internally displaced persons bear a distinctive normative status that implies a set of rights that its bearer can claim and correlate duties that others owe. This article develops a practice-based account of justice in internal displacement, which aims to answer the questions of who counts as an internally displaced person and what is (...) owed to internally displaced persons (and by whom). The first section addresses the question of who counts as an internally displaced person by offering an interpretation of the conditions of non-alienage and involuntariness. The second section articulates an account of what is owed to internally displaced persons that draws on and refines the idea of ‘occupancy rights’. The third section sets out an account of the role of the international community in supplementing the protection of internally displaced persons by their own states. (shrink)

Despite the bad press that retributivism often receives, the basic assumptions on which this theory of punishment rests are generally regarded as being attractive and compelling. First of these is the assumption that persons are morally responsible agents and that social practices, such as criminal punishment, must acknowledge that fact. Additionally, retributivism is committed to the claim that punishment must be proportionate to the crime, and not determined by such utilitarian concerns as the welfare of society, or the hope of (...) deterring other criminals. Because the most commonly discussed version of retributivism is developed from Kant's moral and legal theory, I will refer to it as Kantian Retributivism. Despite its appeal, Kantian Retributivism cannot provide a satisfactory response to a kind of case that is receiving increasingly serious consideration in philosophical literature. The case is this: Many crimes are committed by individuals profoundly disadvantaged by unjust social institutions, such as racism, classism, and/or sexism. If such individuals commit crimes, the retributivist is placed in a very difficult position: Either she must claim that the individual has willfully committed a crime and for that reason deserves punishment, seeming to ignore entirely the social background of the individual, or she can claim that the individual—in virtue of being disadvantaged by social injustices(s)—does not deserve punishment because such punishment would be unfair. Isaiah Berlin's (1909-97) standing in twentieth-century intellectual history rests primarily upon his post-Second World War writings in political theory and the history of ideas. Berlin's investigations into the antagonistic traditions of Enlightenment and Counter-Enlightenment thought, and his advocacy of liberal responses to the conflicts between values, which, he believed, were an unavoidable feature of the human condition, have been the subject of extensive discussion. Less has been written, however, about Berlin's formative experiences of analytic philosophy during the 1930s and late (...) 1940s. It is often assumed that Berlin 'abandoned' philosophy after the war in favour of the history of ideas. As such, there is a tendency in much of the existing literature to underestimate the influence of Berlin's early analytical work on his later historical and political writings. Indeed, Berlin's work is regularly thought to be marked by a fracture at which point the study of philosophy is relinquished for that of history and political theory. The present article will aim to challenge this reading of Berlin's work. The article will advance two main claims. Firstly, it will be argued that not only is Berlin's early work in analytic philosophy of interest to those concerned with the development of his thought as a whole but also that it is highly edifying for any understanding of the nature of the outlook contained in his later writings. Secondly, the article will maintain that there exists a degree of continuity in Berlin's thought that connects his earlier and later work in a manner reflecting a greater level of coherence than is generally assumed. The main theme of continuity emphasized in the article is represented by Berlin's critique of what he terms the 'fallacy of reduction'. (shrink)

ABSTRACT The emerging consensus in the secondary literature on Duhem is that his notion of ‘good sense’ is a virtue of individual scientists that guides them choosie between empirically equal rival theories : 149–159; Ivanova 2010. “Pierre Duhem’s Good Sense as a Guide to Theory Choice.” Studies in History and Philosophy of Science Part A 41 : 58–64; Fairweather 2011. “The Epistemic Value of Good Sense.” Studies in History and Philosophy of Science Part A 43 : 139–146; Bhakthavatsalam. “Duhemian Good (...) Sense and Agent Reliabilism.” Studies in History and Philosophy of Science Part A 64: 22–29). In this paper, I argue that good sense is irrelevant for theory choice within Duhem’s conception of scientific methodology. Theory choice, for Duhem, is either a pseudo-problem or addressed purely by empirical and formal desiderata depending on how it is understood. I go on to provide a positive interpretation of good sense as a feature of scientific communities that undergo particular forms of education that allow scientists to abandon theory pursuit. I conclude by suggesting that this interpretation entails that virtue epistemological readings of Duhem are insufficient for understanding good sense; we must employ a social epistemological perspective. This chapter discusses whether Quasi-Realism gains any advantage over Robust Realism with respect to the problem of explaining supervenience. The chapter starts with a summary of what the supervenience problem is and recounts the history of expressivist thinking about supervenience: the supervenience problem was a challenge raised by expressivist Robust Realists, with the idea that expressivism had an excellent explanation of the phenomenon and realism had none. The chapter then contrasts Quasi-Realism and Robust Realism in order to bring the big (...) problem out in the open, namely that Quasi-Realists have not provided any explanation at all for the phenomenon of supervenience. In this respect they are, it appears, in the same boat as Robust Realists. The chapter maps out the possible paths for Quasi-Realists to travel in pursuit of Quasi-Explananda, and gives some reasons to be optimistic. The chapter ends with a suggestive analogy and a synopsis of the state of the dialectic. (shrink)

This paper addresses the phenomenon of climate-induced displacement. I argue that there is scope for an account of asylum as compensation owed to those displaced by the impacts of climate change which needs only to appeal to minimal normative commitments about the requirements of global justice. I demonstrate the possibility of such an approach through an examination of the work of David Miller. Miller is taken as an exemplar of a broadly ‘international libertarian’ approach to global justice, and his work (...) is a useful vehicle for this project because he has an established view about both responsibility for climate change and about the state’s right to exclude would-be immigrants. In the course of the argument, I set out the relevant aspects of Miller’s views, reconstruct an account of responsibility for the harms faced by climate migrants which is consistent with Miller’s views, and demonstrate why such an account yields an obligation to provide asylum as a form of compensation to ‘climate migrants.’.
