Legal texts are in the focus of both lawyers and translators. This paper discusses the binary opposition of these two views especially in the light of contract law. There is one crucial epistemic difference between the point of view of the translator and the lawyer when it comes to the interpretation of legal texts. In the translator’s view legal text is traditionally conceived as static as to its nature; something that already exists in the form of text. Traditionally, the translator (...) is interested in the text itself as it was written down in a document, i.e. the translator needs to go back to the frozen moment when a legal document was constructed and finalised. The lawyer, in contrast, is very much interested not only in the text of the legal document but also in the contextual surroundings of the text. In fact, for legal interpretation, sometimes the key-elements for the interpretation come from outside of the text itself. This paper concludes that legal translation is in many cases closer to transcreation than it is to traditionally understood translation. (shrink)

Jaakko Hintikka was born on January 12th, 1929. He received his doctorate from the University of Helsinki under the supervision of Professor G. H. von Wright at the age of 24 in 1953. Hintikka was appointed Professor of philosophy at the University of Helsinki in 1959. Since the late 50s, he has shared his time between Finland and the U.S.A. He was appointed Professor of philosophy at Stanford University in 1964. As from 1970 Hintikka has been permanent research professor (...) of the Academy of Finland. He has published 13 books and about 200 articles, not to mention the various editorial and organizational activities he has played an active role in. The present collection of essays has been edited to honour Jaakko Hintikka on the occasion of his fiftieth birthday. By dedicating a Festschrift to Jaakko Hintikka, the contributors wish to pay homage to this remarkable man whom they see not only as a scholar of prodigious energy and insight, but as a friend, colleague and former teacher. The contributors hope the essays collected here will bring pleasure to the man they are intended to honour. All of the essays touch upon topics Hintikka has taken an direct or indirect interest in, ranging from technical problems of mathematical logic and applications of formal methods through philosophical logic, philosophy of language, epistemology and history of philosophy to philosophical aesthetics. A novel theory of comparative risk is developed and defended. Extant theories are criticized for failing the tests of extensional and formal adequacy. A unified diagnosis is proposed: extant theories consider risk to be a univariable function, but risk is a multivariate function. According to the theory proposed, which we call the unified theory of risk, the riskiness of a proposition is a function of both the proportion and the modal closeness of the possible worlds at which the proposition holds. In the present day and age, it seems that every constructivist philosopher of mathematics and her brother wants to be known as an intuitionist. In this paper, It will be shown that such a self-identification is in most cases mistaken. For one thing, not any old (or new) constructivism is intuitionism because not any old relevant construction is carried out mentally in intuition, as Brouwer envisaged. (edited).

According to moral encroachment facts about epistemic justification can vary with moral factors that are unrelated to the truth of the belief. Most of the literature on this topic has focused on how beliefs can wrong, and whether the data that moral encroachers offer in support of their view can be explained within a purist framework. A largely neglected question has been what kind of consequences moral encroachment would have for epistemic justification if the thesis were true. According to the modal account of luck it is a matter of luck that p if p is true at the actual world, but false in a wide‐range of nearby worlds. According to the modal account of risk, it is risky that p if p is true at some close world. I argue that the modal accounts of luck and risk do not mesh well together. The views entail that p can be both maximally risky and maximally lucky, but there (...) is nothing which is both maximally lucky and maximally risky. I offer a novel theory of risk that fits together with the modal account of luck and demonstrate that it is both extensionally and formally superior to extant proposals. (shrink)

According to Kant, “mathematical knowledge is the knowledge gained by reason from the construction of concepts.” In this paper, I shall make a few suggestions as to how this characterization of the mathematical method is to be understood.

The so-called New Theory of Reference (Marcus, Kripke etc.) is inspired by the insight that in modal and intensional contexts quantifiers presuppose nondescriptive unanalyzable identity criteria which do not reduce to any descriptive conditions. From this valid insight the New Theorists fallaciously move to the idea that free singular terms can exhibit a built-in direct reference and that there is even a special class of singular terms (proper names) necessarily exhibiting direct reference. This fallacious move has been encouraged by a (...) mistaken belief in the substitutional interpretation of quantifiers, by the myth of thede re reference, and a mistaken assimilation of direct reference to ostensive (perspectival) identification. Thede dicto vs.de re contrast does not involve direct reference, being merely a matter of rule-ordering (scope).The New Theorists' thesis of the necessity of identities of directly referred-to individuals is a consequence of an unmotivated and arbitrary restriction they tacitly impose on the identification of individuals. This book, written by one of philosophy's pre-eminent logicians, argues that many of the basic assumptions common to logic, philosophy of mathematics and metaphysics are in need of change. It is therefore a book of critical importance to logical theory. Jaakko Hintikka proposes a new basic first-order logic and uses it to explore the foundations of mathematics. This new logic enables logicians to express on the first-order level such concepts as equicardinality, infinity, and truth in the same language. The (...) famous impossibility results by Gödel and Tarski that have dominated the field for the last sixty years turn out to be much less significant than has been thought. All of ordinary mathematics can in principle be done on this first-order level, thus dispensing with the existence of sets and other higher-order entities. (shrink)

Most current work in epistemology deals with the evaluation and justification of information already acquired. In this book, Jaakko Hintikka instead discusses the more important problem of how knowledge is acquired in the first place. His model of information-seeking is the old Socratic method of questioning, which has been generalized and brought up-to-date through the logical theory of questions and answers that he has developed. Hintikka also argues that philosophers' quest for a definition of knowledge is ill-conceived and that (...) the entire notion of knowledge should be replaced by the concept of information. He offers an analysis of the different meanings of the concept of information and of their interrelations. The result is a new and illuminating approach to the field of epistemology. (shrink)

The main question of metasemantics, or foundational semantics, is why an expression token has the meaning (semantic value) that it in fact has. In his reading of Ludwig Wittgenstein’s later work, Saul Kripke presented a skeptical challenge that threatened to make the foundational question unanswerable. My first contention in this paper is that the skeptical challenge indeed poses an insoluble paradox, but only for a certain kind of metasemantic theory, against which the challenge effectively works as a reductio ad absurdum (...) argument. My second contention is that as a result of rejecting the theory which entails a paradoxical outcome, we will see that the foundational question essentially involves a temporal dimension. After arguing that the skeptical challenge gives us a strong reason to adopt a historical view of meaning, I shall further argue against certain authors who claim that meanings not only have histories but futures as well, or that the meaning of a word may change retroactively in time as a consequence of counterfactual change in its future use. The major aim of the paper is thus to bring together the arguably interrelated debates about the skeptical challenge and temporal externalism in philosophy of language. (shrink)

In Jaakko Hintikka's interrogative model of inquiry, the strategic principles governing empirical inquiry turn out to be closely related to those governing deductive reasoning. Hence it is important to study the precise analogies which obtain between deductive logic and interrogative inquiry. The basic concept of the interrogative model is the relation of model consequence $\text{M}\colon \text{T}\vdash \text{C}$. It is said to obtain iff C can be derived from T by means of an interrogative process in the model M. We (...) prove here a counterpart of Craig 's interpolation theorem for the concept of model consequence. The interrogative analogue to definability is a logical generalization of methodologists' concept of identifiability. For this concept, we prove an analogue to Beth's theorem. Some further philosophical consequences of these results are mentioned. For instance, identifiability is a good rational reconstruction of the idea of observability. (shrink)

Several of the so-called “fallacies” in Aristotle are not in fact mistaken inference-types, but mistakes or breaches of rules in the questioning games which were practiced in the Academy and in the Lyceum. Hence the entire Aristotelian theory of “fallacies” ought to be studied by reference to the author's interrogative model of inquiry, based on his theory of questions and answers, rather than as a part of the theory of inference. Most of the “fallacies” mentioned by Aristotle can in fact (...) be diagnosed by means of the interrogative model, including petitio principii, multiple questions, “babbling’, etc., and so can Aristotle's alleged anticipation of the fallacy of argumentum ad hominem. The entire Aristotelian conception of inquiry is an interrogative one. Deductive conclusions caught Aristotle's attention in the form of answers that every rational interlocutor must give, assuming only his own earlier answers. Several features of Aristotle's methodology can be understood by means of the interrogative model, including the role of endoxa in it. Theoretically, there is also considerable leeway as to whether “fallacies” are conceived of as mistakes in questioning or as breaches of the rules that govern questioning games. (shrink)

Some externalists have recently argued that the unity of theoretical and practical reason implies that epistemic justification is factive. It is argued that arguments for the factivity of epistemic justification either (i) equate two actions that are in fact different, or (ii) make the unwarranted assumption that the by-relation transmits justification. The unity of reason does not imply that epistemic justification is factive.

R. G. Collingwood saw one of the main tasks of philosophers and of historians of human thought in uncovering what he called the ultimate presuppositions of different thinkers, of different philosophical movements and of entire eras of intellectual history. He also noted that such ultimate presuppositions usually remain tacit at first, and are discovered only by subsequent reflection. Collingwood would have been delighted by the contrast that constitutes the overall theme of the essays collected in this volume. Not only has (...) this dichotomy ofviews been one ofthe mostcrucial watersheds in the entire twentieth-century philosophical thought. Not only has it remained largely implicit in the writings of the philosophers for whom it mattered most. It is a truly Collingwoodian presupposition also in that it is not apremise assumed by different thinkers in their argumentation. It is the presupposition of a question, an assumption to the effect that a certain general question can be raised and answered. Its role is not belied by the fact that several philosophers who answered it one way or the other seem to be largely unaware that the other answer also makes sense - if it does. This Collingwoodian question can be formulated in a first rough approximation by asking whether language - our actual working language, Tarski's "colloquiallanguage" - is universal in the sense of being inescapable. This formulation needs all sorts of explanations, however. (shrink)

The article argues for the epistemic rationale of triangulation, namely, the use of multiple and independent sources of evidence. It claims that triangulation is to be understood as causal reasoning from data to phenomenon, and it rationalizes its epistemic value in terms of controlling for likely errors and biases of particular data-generating procedures. This perspective is employed to address objections against triangulation concerning the fallibility and scope of the inference, as well as problems of independence, incomparability, and discordance of evidence. In this paper, I assess some recent critical realist constructive criticisms of Theodor Adorno, one of the leading thinkers of the Frankfurt School tradition of critical theory. I argue that while there are similarities between Adorno’s treatment of causality and the critical realist notion of powers, these connections should not be taken to imply that Adorno’s conception of critique requires a critical realist powers ontology. I show that Bhaskar’s transcendental realism is at odds with the basic commitments of Adorno’s historical (...) materialism. I go on to clarify such materialism and show that to Adorno, capital is the historical compulsion characteristic of modernity. (shrink)

Mixed methods research - the combination of qualitative and quantitative data within the same design to strengthen causal inference - is gaining prominence in the social sciences but its benefits are contested. There remains confusion over which methods to mix and what is the point of mixing them. We argue that variety of evidence is what matters, not the data or methods, and that distinct epistemic principles underlie its added value for causal inference. The centrality of evidential variety also implies (...) that strong causal pluralism is untenable as a foundation for mixed methods research. (shrink)

The organisation of mammalian mitochondrial DNA (mtDNA) is more complex than usually assumed. Despite often being depicted as a simple circle, the topology of mtDNA can vary from supercoiled monomeric circles over catenanes and oligomers to complex multimeric networks. Replication of mtDNA is also not clear cut. Two different mechanisms of replication have been found in cultured cells and in most tissues: a strand‐asynchronous mode involving temporary RNA coverage of one strand, and a strand‐coupled mode rather resembling conventional nuclear DNA (...) replication. In addition, a recombination‐initiated replication mechanism is likely to be associated with the multimeric mtDNA networks found in human heart. Although an insight into the general principles and key factors of mtDNA organisation and maintenance has been gained over the last few years, there are many open questions regarding replication initiation, termination and physiological factors determining mtDNA organisation and replication mode. However, common themes in mtDNA maintenance across eukaryotic kingdoms can provide valuable lessons for future work. (shrink)

According to the safety condition, a subject knows that p only if she would believe that p only if p was true. The safety condition has been a very popular necessary condition for knowledge of late. However, it is well documented that the safety condition is trivially satisfied in cases where the subject believes in a necessary truth. This is for the simple reason that a necessary truth is true in all possible worlds, and therefore it is true in all (...) possible worlds where it is believed. But clearly, all beliefs concerning necessary truths do not amount to knowledge. The safety theorists have attempted to deal with the problem caused by necessary truths by restricting the safety condition to purely contingent truths and by globalizing the safety condition to a set of propositions. Both of these solutions are problematic. The principal aim of this paper is to develop a version of the safety condition that is able to deal with cases featuring necessary truths. (shrink)

An evening discussion between professors Jaakko Hintikka and Simo Knuuttila on September 2, 2007, at the Helsinki conference: Knuuttila: Ladies and gentlemen. Thank you for inviting us to this event and for this opportunity to discuss the latest volume of the Library of Living Philosophers, which was published last spring. The title of the volume is “The Philosophy of Jaakko Hintikka”. Probably most people here know this series, which was founded in 1939 by P. A. Schilpp. The idea (...) of the volumes is to invite some prominent philosophers to describe their lives and ideas and then ask other philosophers to write and comment on topics which the first author has written about. Then the philosopher to whom the book is dedicated answers and discusses these other people’s papers about his or her philosophy. These volumes gradually became a very popular series which most philosophical libraries wanted to have. It was considered such a good idea, giving rise to one of the most prestigious series in philosophy. It is also considered as a kind of philosophical honor for the philosopher to be chosen to be among these living philosophers. The books always have the same structure; first, an intellectual autobiography, pretty extensive, then the papers on the basic author’s philosophy and, last, the papers are answered separately. So there is a kind of discussion going on. The book on Jaakko Hintikka’s philosophy consists of almost 1000 pages. It is also available as a paperback. Now, I have prepared some questions. (shrink)

Robert Sugden argues that robustness analysis cannot play an epistemic role in grounding model-world relationships because the procedure is only a matter of comparing models with each other. We posit that this argument is based on a view of models as being surrogate systems in too literal a sense. In contrast, the epistemic importance of robustness analysis is easy to explicate if modelling is viewed as extended cognition, as inference from assumptions to conclusions. Robustness analysis is about assessing the reliability (...) of our extended inferences, and when our confidence in these inferences changes, so does our confidence in the results. Furthermore, we argue that Sugden’s inductive account relies tacitly on robustness considerations. (shrink)

We mobilise contemporary philosophy of science to further clarify observations on economic modelling made by Gilboa et al. (2023). We adopt a normative stance towards these modelling practices to identify the extent to which they are epistemically justified. Our message is simple: many of the distinctions proposed by Gilboa et al. (2023) are useful, but without the proper qualifications, too much flexibility in choosing the right interpretation risks downplaying the crucial role that empirical evidence should play in any modelling endeavour.

Integrating corporate social responsibility (CSR) into a for-profit organization’s business activities is fraught with tensions. This paper reports a case study of a construction company, exploring how different tensions emerged to challenge company-level aspirations for strategic CSR integration. The study identifies three types of persistent CSR tensions and four management practices, discussing how the management practices led the organization to navigate CSR tensions in both active and defensive ways. Furthermore, the study explicates why the case company succeeded in integrating CSR (...) into formal business strategy and shared attitudes but struggled with CSR integration in the domain of day-to-day operations. The paper contributes to the CSR literature by developing a tension-centric perspective on CSR development. It highlights the necessity of tension navigation at both the organizational and the action levels, the key role of active (as opposed to defensive) navigation of CSR tensions, and the importance of alignment between organizational and action levels in navigating tensions for sustaining strategic focus on CSR over time. Odenbaugh and Alexandrova provide a challenging critique of the epistemic benefits of robustness analysis, singling out for particular criticism the account we articulated in Kuorikoski et al.. Odenbaugh and Alexandrova offer two arguments against the confirmatory value of robustness analysis: robust theorems cannot specify causal mechanisms and models are rarely independent in the way required by robustness analysis. We address Odenbaugh and Alexandrova’s criticisms in order to clarify some of our original arguments and to shed further light on the properties (...) of robustness analysis and its epistemic rationale. While various strategic business issues related to product design have been explored by academicians and practitioners, one issue has largely been ignored: how do financial markets assess and evaluate companies’ product design? The purpose of this article is to examine this issue, especially when it comes to the assessments and evaluations made by the most essential actors of contemporary financial markets: investment analysts and institutional investors. I develop propositions concerning the product design-related evaluative schemes and heuristics used by the financial (...) market actors in evaluating companies as investment opportunities. I illustrate my propositions with examples from, e.g., the mobile phone industry as well as with interview excerpts from interviews with investment analysts and institutional investors. Propositions are provided both for assessments of companies’ individual end products (‘design as the end product’ perspective) and for assessments of companies’ design capabilities (‘design as a capability’ perspective). In essence, the propositions highlight that the evaluative schemes used by financial market actors are partly rational, yet involve biases and are likely to lead to overvaluation and undervaluation of certain kinds of product designs by certain kinds of companies. Thus, even from the perspective of profit-maximization, many of the evaluative schemes of the financial market actors are, at most, quasi-rational. Moreover, the evaluative schemes of the financial market actors may motivate company managers to pursue certain kinds of product design rather than others—and may even lead to self-reinforcing (vicious or virtuous) circles of certain kinds of product designs being advocated. Equally surprisingly, Descartes’s paranoid belief was shared by several contemporary mathematicians, among them Isaac Barrow, John Wallis and Edmund Halley. (Huxley 1959, pp. 354-355.) In the light of our fuller knowledge of history it is easy to smile at Descartes. It has even been argued by Netz that analysis was in fact for ancient Greek geometers a method of presenting their results (see Netz 2000). But in a deeper sense Descartes perceived something interesting in the historical record. We are looking (...) in vain in the writings of Greek mathematicians for a full explanation of what this famous method was. And I will argue for an answer to the question why this lacuna is there: Not because Greek geometers wanted to hide this method, but because they did not fully understand it. It is instructive to note the ambivalent attitude of the most rigorous mathematician of the period, Isaac Newton, to the method of analysis. He used it himself in his own mathematical work and in the expositions of that work. Yet when the mathematical push came to physical and cosmological shove, he formulated his Principia entirely in.. How does language represent the world it can be used to talk about? Or does it? A negative answer is maintained by one of the main traditions in language theory that includes Frege, Wittgenstein, Heidegger, Quine and Rorty. A test case is offered by the question whether the critical ''mirroring'' relations, especially the notion of truth, are themselves expressible in language. Tarski's negative thesis seemed to close the issue, but dramatic recent developments have decided the issue in favour of the (...) expressibility of truth. At the same time, the "mirroring" relations are not natural ones, but constituted by rule-governed human activities a la Wittgenstein's language games. These relations are nevertheless objective, because they depend only on the rules of these "games", not on the idiosyncrasies of the players. It also turns out that the "truth games" for a language are the same as the language games that give it its meaning in the first place. Thus truth and meaning are intrinsically intertwined. (shrink)
