Given that the distinction between public and private law has been declared dead for so long, some of its implications prove astonishingly long-lived. Recent developments such as the assumption of human rights obligations for corporations or the challenged position of intermediary forces in the face of an increasing societal plurality call us to think these implications through and turn to their origin: Historically as well as theoretically, the primary function of human rights in Europe was a social one, directed at (...) the abolition of intermediary forces, and providing the basis for a horizontal structure amongst equal subjects. En Político (268d-277a) la historia ficticia de la reversión periódica del universo expresa la existencia en el universo de dos fuerzas o tendencias en concurrencia: la que orienta al mundo y al hombre hacia su télos, que es lo más perfecto, y la tendencia hacia el desorden y la confusión, es decir, la puramente mecánica y azarosa. Finalidad y mecanismo las dos tendencias que están presentes en Timeo, reaparecen en el libro de Leyes bajo la forma de un alma buena (...) y un alma mala. La primera es la que da cuenta del movimiento racional del mundo, en tanto que la segunda es causante de su movimiento alocado e irregular (897c-d). En Político las dos tendencias o fuerzas rectoras del universo alternan su predominancia, están en tensión. Y es la medida de esa alternancia la que salva al mundo de la destrucción y hace que se mantenga el equilibrio. Ese juego de tensiones traduce la existencia de una proporcionalidad en el seno del universo, gracias a la cual el mundo es precisamente un kósmos. En el Timeo el equilibrio resulta de la persuasión que la inteligencia ejerce sobre la necesidad, orientándola hacia lo mejor. El estudio comparativo de la Ley de Prensa de Brasil y la ley de Servicios de Comunicación Audiovisual de Argentina es el análisis empírico de la construcción de un paradigma en la teoría de la comunicación basado en el estudio de la filosofía de G. W. Leibniz, tomando como pilares la filosofía y teoría de la comunicación de Jürgen Habermas y las ideas de complejidad y paradigma de Edgar Morin.

La crítica situación económica actual, ha potenciado que las empresas asuman sus responsabilidades y se instaure la cultura de la Responsabilidad Social. Este concepto se desarrolla tardíamente en España, pero las empresas actualmente son más conscientes de la necesidad de integrarla en su política estratégica. Partiendo de la base de que las empresas, en el desarrollo de su actividad cotidiana, cumplen con las leyes que les afectan, si desarrollan un sistema de gestión de la Responsabilidad Social (RS) adaptado a las (...) características de cada empresa, podrían obtener beneficios adicionales. La Norma Internacional ISO 26000 indica como implantar la RS en las empresas y la RS 10 fija los requisitos de acuerdo con la ISO 26000. En este trabajo se lleva a cabo una comparación crítica. Este escrito surgió de la lectura del libro de M.ª Isabel Lafuente, Libertad, ley y poder. Bien común y Derechos humanos en la obra de Francisco Suárez (Editorial Académica Española, Berlín, 2022, 482 pp.), que se comenta a continuación. El foco de mi comentario en diálogo con este estudio es triple. Primeramente, señalar la importancia que la obra de Francisco Suárez (1548-1617) tuvo principalmente durante los siglos xvii-xviii y la variación de perspectiva y método que la filosofía moderna introdujo con (...) respecto al hacer de la escolástica y de la propia filosofía iusnaturalista de Suárez. En segundo lugar, indicar la recuperación y actualidad de Suárez en el presente. Prepared for an ANU Humanities Research Centre Symposium in early August 2003, these notes may be considered as a comment on Brian Massumi’s proposition that ‘a political ecology would be a social technology of belonging, assuming coexistence and co-becoming as the habitat of practices’.

At the end of his life, Michel Foucault wrote of ‘problematization’ as what he had done all along. Yet some commentators see a ‘new’ Foucault emerging together with this term. This essay accepts the last hypothesis and connects it with the French scene, where problematization was already familiar, and its use under tension. Starting with Bachelard, problematization was related with a polemic epistemological stance, but its reprise by Gilles Deleuze turned it into an affirmative theme dramatizing the creation of problems. (...) Situating Foucault’s problematization in this philosophical line permits us to develop the relation he proposed between problematization and the test of contemporary reality on the thinker. This paper will put problematization itself to the test of our present, that is, to the prospect of the social-ecological devastation associated with climate disorder. Both following and betraying Foucault with the help of Whitehead and Haraway, problematization will then be related to the power of sensible events, a power which requires allowing oneself to be touched, and allowing what touches us the power to modify the relation we entertain to our own reasons. An innovative, multifaceted approach to scientific experiments as designed by and shaped through interaction with the modeling process The role of scientific modeling in mediation between theories and phenomena is a critical topic within the philosophy of science, touching on issues from climate modeling to synthetic models in biology, high energy particle physics, and cognitive sciences. Offering a radically new conception of the role of data in the scientific modeling process as well as a new awareness of the problematic aspects (...) of data, this cutting-edge volume offers a multifaceted view on experiments as designed and shaped in interaction with the modeling process. Recent years have seen a notable increase in the production of scientific expertise by large multidisciplinary groups. The issue we address is how reports may be written by such groups in spite of their size and of formidable obstacles: complexity of subject matter, uncertainty, and scientific disagreement. Our focus is on the International Panel on Climate Change, unquestionably the best-known case of such collective scientific expertise. What we show is that the organization of work within the IPCC aims to make (...) it possible to produce documents that are indeed expert reports. To do so, we first put forward the epistemic norms that apply to expert reports in general, that is, the properties that reports should have in order to be useful and to help decision-making. Section 2 claims that these properties are: intelligibility, relevance and accuracy. Based on this analysis, section 3 points to the difficulties of having IPCC reports indeed satisfying these norms. We then show how the organization of work within the IPCC aims at and to a large extent secures intelligibility, relevance and accuracy, with the result that IPCC reports can be relied on for decision-making. Section 4 focuses on the fundamentals of IPCC’s work organization--that is, division of labour within the IPCC--while section 5 investigates three frameworks that were introduced over the course of the functioning of the IPCC: the reviewing procedure of IPCC reports, the language that IPCC authors use to express uncertainty and the Coupled Model Intercomparison Project. The question of universalism and relativism is often taken to be a matter of critical reflexivity. This article attempts to present the question instead as a matter of practical, political, and always-situated concern. The attempt starts from the consideration of modern experimental sciences. These sciences usually serve as the stronghold for universalist claims and as such are a target of relativism. It is argued that the specificity of these sciences is not a method but a concern. To be able to (...) claim that they have not unilaterally imposed their definitions on the phenomena they study is the leading concern of experimenters and should be understood in terms of the following achievement: the creation of a very particular “rapport” that authorizes claiming that what is operationally defined “lends itself” to this correlation. Linking knowledge production with a creation of rapports entails a pluralization of sciences along with the pluralization of modes of concern associated with the rapport. However, resisting unilaterally imposed definitions is not enough, since with the coming “knowledge economy” the questions that this article raises will soon be part of a romantic past. Thus it concludes with a speculative touch, which may be a requiem, relating the creation of rapports with an ecology of practices akin to William James's always-under-construction pluriverse. BackgroundThe landscape of clinical research has evolved over the past decade. With technological advances, the practice of using electronic informed consent (eIC) has emerged. However, a number of challenges hinder the successful and widespread deployment of eIC in clinical research. Therefore, we aimed to investigate the views of various stakeholders on the potential advantages and challenges of eIC.MethodsSemi-structured interviews were conducted with 39 participants from 5 stakeholder groups from across 11 European countries. The stakeholder groups included physicians, patient organization representatives, (...) regulator representatives, ethics committee members, and pharmaceutical industry representatives, and all were involved in clinical research. Interviews were analyzed using the framework method.ResultsInterviewees identified that a powerful feature of eIC is its personalized approach as it may increase participant empowerment. However, they identified several ethical and practical challenges, such as ensuring research participants are not overloaded with information and offering the same options to research participants who would prefer a paper-based informed consent rather than eIC. According to the interviewees, eIC has the potential to establish efficient long-term interactions between the research participants and the research team in order to keep the participants informed during and after the study. Interviewees emphasized that a personal interaction with the research team is of utmost importance and this cannot be replaced by an electronic platform. In addition, interviewees across the stakeholder groups supported the idea of having a harmonized eIC approach across the European Member States.ConclusionsInterviewees reported a range of design and implementation challenges which needs to be overcome to foster innovation in informing research participants and obtaining their consent electronically. It was considered important that the implementation of eIC runs alongside the face-to-face contact between research participants and the research team. Moreover, interviewees expect that eIC could offer the opportunity to enable a personalized approach and to strengthen continuous communication over time. If successfully implemented, eIC may facilitate the engagement of research participants in clinical research. (shrink)

Background Minimal research has been done to determine how well European nursing students understand the core principles of academic integrity and how often they deviate from good academic practice. Aim The aim of this study was to find out what educational needs nursing students have in terms of academic integrity. Research design A quantitative cross-sectional study in the form of a survey of nursing students was conducted via questionnaire in the fall of 2020. Participants The sample was composed of 79 (...) students in the BScN and MScN programs at Zürich University of Applied Sciences. Ethical considerations An application for a non-competence clearance was approved by the Ethics Committee in Zurich (BASEC No. Req-2020-00868). The survey was anonymous, and informed consent was obtained prior to participation. Results The participants had a high level of confidence in their own knowledge but were in many cases unable to correctly identify clear-cut examples of misconduct and to differentiate them from questionable practices. About 13% of the participants admitted that during their university education they had copied shorter passages from other sources into their own text without marking them as quotes. Conclusions The study documents extensive knowledge gaps among nursing students regarding both academic misconduct and questionable practices and indicates a need for improved academic integrity training. Data-driven technologies have come to pervade almost every aspect of business life, extending to employee monitoring and algorithmic management. How can employee privacy be protected in the age of datafication? This article surveys the potential and shortcomings of a number of legal and technical solutions to show the advantages of human rights-based approaches in addressing corporate responsibility to respect privacy and strengthen human agency. Based on this notion, we develop a process-oriented model of Privacy Due Diligence to complement existing frameworks (...) for safeguarding employee privacy in an era of Big Data surveillance. Experimental modeling is the construction of theoretical models hand in hand with experimental activity. As explained in Section 1, experimental modeling starts with claims about phenomena that use abstract concepts, concepts whose conditions of realization are not yet specified; and it ends with a concrete model of the phenomenon, a model that can be tested against data. This paper argues that this process from abstract concepts to concrete models involves judgments of relevance, which are irreducibly normative. In Section 2, we (...) show, on the basis of several case studies, how these judgments contribute to the determination of the conditions of realization of the abstract concepts and, at the same time, of the quantities that characterize the phenomenon under study. Then, in Section 3, we compare this view on modeling with other approaches that also have acknowledged the role of relevance judgments in science. To conclude, in Section 4, we discuss the possibility of a plurality of relevance judgments and introduce a distinction between locally and generally relevant factors. (shrink)

Marie-Agnès Cathiard stands out for her important contributions to research on the imaginaire. Her commitment to interdisciplinarity has opened the door to rare partnerships with the scientific community. Projects such as “Mondes numériques et spectacle vivant (Digital Worlds and Performing Arts)” have led Marie-Agnès to work at the crossroads of scientific research and artistic creation, exploring the multi-sensory aspects of the work of the electro-video artist Lionel Palun and the director Isis Fahmy. His collaboration with Patrick Pajon, illustrated by a (...) project such as “Tech’sens”, brought together seemingly distant fields of research, with the aim of constructing a typology of new models of perception linked to digital tools. Their work addressed the upheavals underway in the fields of creation and imagination, calling for a reassessment of our relationship with the changing world and technology. (shrink)

This memorial to Latour is not an appraisal of his fifty-year research career but the report of a traveling companion with a story to share about the apparent lack of continuity, the sudden, unapologetic, unprincipled changes of position, with which he surprised or scandalized his colleagues and readers. In the first place, was he a sociologist, an anthropologist, a philosopher? Though he did not make lasting commitments of that kind, he did make deeper ones that did not change—above all, never (...) to explain anything in terms of something more general and, thus, never to accept the position of judge. To follow Latour's problematic changes—sometimes referred to as his “versatility”—demands that we follow the changes of the very terms of the problems that his basic commitment bound him to confront. From the 1980s, when his work dealt with technoscientific progress, to the years of his growing concern with political ecology, and finally to his recognition of the oncoming climate chaos, dizzying leaps were entailed by his resistance to the temptation of judging. Involved in, but never the cause of, various of his leaps, Stengers describes her friend as responding, perforce, to changing times, rather than as behaving like a theorist thinking mainly of his image, reputation, and career. It is a well-known fact that the Śaiva nondualistic philosopher Utpaladeva (fl. c. 925–975) adopted the Sāṃkhya principle according to which the effect must exist in some way before the operation of its cause (satkāryavāda). Johannes Bronkhorst has highlighted the paradox inherent in this appropriation: Utpaladeva is a staunch supporter of the satkāryavāda, but whereas Sāṃkhya authors consider it as a means of proving the existence of an unconscious matter, the Śaiva exploits it so as to establish his monistic idealism, (...) in perfect contradiction with the Sāṃkhya dualism of matter and consciousness. How does Utpaladeva achieve this complete reversal of meaning of the satkāryavāda? The present article argues that the elliptical verses of the Īśvarapratyabhijñākārikā dealing with this issue have been partly misunderstood so far due to the loss of Utpaladeva’s own detailed commentary (Vivr̥ti) on this passage: Abhinavagupta’s two commentaries, however terse in this respect, clearly show that a crucial part of Utpaladeva’s reasoning remains implicit in the verses. The article therefore attempts to reconstruct the gist of Utpaladeva’s strategy by having recourse to various other Śaiva sources, including Somānanda’s Śivadr̥ṣṭi and Utpaladeva’s own commentary thereon. This examination shows that Utpaladeva’s appropriation of the satkāryavāda rests on a profound transformation of the Sāṃkhya notions of manifestation (abhivyakti) and potentiality (śakti), and that his criticism of the Sāṃkhya understanding of causality might target the Śaiva dualists as well as Sāṃkhya authors. Several answers are plausible : Laertius leaves out some Crates’ writings on purpose, in order to avoid repetitions in his book as a whole ; since he holds Antisthenes to be the founder of Cynicism, Laertius deliberately passes over some Crates’ writings which could bring their author closer to Diogenes and so highlight (...) the latter’s prominent role in the Cynic movement ; finally, since his aim is to write a work of history of philosophy, Laertius deliberately disregards sources foreign to this field. Participation of the Public in Science: Towards a New Kind of Scientific Practice Participation of the public in science has been the object of an increasing number of social and political philosophical studies, but there is still hardly any epistemological study of the topic. While it has been objected that involvement of the public is a threat to the integrity of science, the apparent indifference of philosophers of science seems to testify to its lack of relevance to conceptions of scientific (...) activity. I argue both that it is not a threat to science and that it is relevant to philosophy of science by showing that it constitutes a new kind of epistemic practice. Two main objections to the idea that the involvement of non-scientists, with their situated perspective and contextual values, can form an epistemic practice will be addressed: the first bears on the epistemic potentialities of the cooperation between scientist and non-scientists; the second on the possibility that this cooperation takes the form of a practice. We examined liking for happy- and sad-sounding music as a function of exposure, which varied both in quantity (number of exposures) and in quality (focused or incidental listening). Liking ratings were higher for happy than for sad music after focused listening, but similar after incidental listening. In the incidental condition, liking ratings increased linearly as a function of exposure. In the focused condition, liking ratings were an inverted U-shaped function of exposure, with initial increases in liking (after 2 exposures) followed (...) by decreases (after 8 or 32 exposures). The results documented that: (1) sad music is liked as much as happy music in some instances; (2) frequency of exposure causes both familiarity (positive) and over-familiarity (negative) effects; and (3) effects of exposure on liking differ for focused and incidental listening. Bien plus, le pays supposé du lait et du miel est une terre hostile, où la vie est difficile pour tous et que beaucoup quittent, par l’émigration ou le suicide… À travers ces textes, l’imagerie qui entoure l’expérience sioniste en Palestine se trouve profondément ébranlée. Cet article analyse la mise en place et l’évolution des règles de la succession ab intestat dans les statuts florentins entre 1325 et 1415. L’ample extension généalogique de l’exclusion des filles dotées de la succession du père et des agnats mâles et le classement des héritiers de la mère, qui laisse les filles hériter seulement en l’absence de leurs frères, neveux ex fratre et autres descendants mâles, déterminent un mode de transmission des biens fortement patrilinéaire qui constitue la clef de (...) voûte du système lignager florentin. Au lendemain de la peste noire et jusqu’en 1415, le durcissement des normes qui disciplinent la transmission des héritages aux femmes et leurs droits de propriété sur ces biens non dotaux révèle une remarquable capacité de réaction des législateurs face aux conséquences successorales de la crise démographique.
