To be human is to be autonomous, yet this is a trait that most of us lack. We are subject to forces external to our being. We are workers; we are citizens; we are needful creatures. Humanity-proper in these times of neoliberal omnipotence is defined differently. The key terms are familiar: personal betterment, personal responsibility, productivity, pleasantness. A forked tongue slithers in our conscience, tells us that these are the traits of the human condition. Through Bataille, this paper argues the (...) substrate of these oft repeated familiar mantras are other. Neoliberal subjects, propelled by need, understand themselves along the axis of the useful choice. The paper turns to myth to understand the interdependence of need and choice, and how this interdependence posits being as always in desire but never in pleasure. Revisiting Don Giovanni, a character central to Acéphalic thought, and the commentary of Søren Kierkegaard, we think in terms of non-abstraction, of pleasurably floating in change, rather than toiling in desire. For it is by grace in the form of chance, that at the very time of transgression, that we – in and for an instant – become human, become as the sacred in the flesh. (shrink)

The hypothesis of a theoretical unity between On Sophistical Refutations and Prior Analytics presents a major challenge to scholars attempting to unify the criteria of analysis. This paper examines this problem and proposes a middle ground between the perspectives of Woods and Boger to address this crucial question: If a unitary and coherent theory of deduction exists, why does not the technical apparatus of syllogistic modes for analyzing fallacies appear in SE? The concept of mindfulness within the contemporary mindfulness movement was the subject of a recent phenomenological critique. The present article confronts that critique in order to develop a phenomenologically viable interpretation of mindfulness that corresponds with how the word sati is used in the Pāli suttas. By clarifying the distinction between intentional objects and intentional acts, it can be shown that mindfulness was not originally conceived of as an exercise in focusing on a meditation object, but as reflexive self-awareness. Consequently, (...) it is wrong to describe mindfulness as ‘bare attention’. Mindfulness was originally a philosophical enterprise, an attitude that can be cultivated only when one is attending to things while remaining aware of the broader context. Furthermore, an ordinary person (puthujjana) cannot cultivate what the Buddha called ‘right mindfulness’ (sammāsati). This is the province of the noble ones who have acquired the right view and are accomplished in virtue. (shrink)

Once upon a time scholars assumed that the knowing subject in the disciplines is transparent, disincorporated from the known and untouched by the geo-political configuration of the world in which people are racially ranked and regions are racially configured. From a detached and neutral point of observation (that Colombian philosopher Santiago Castro-Gómez describes as the hubris of the zero point ), the knowing subject maps the world and its problems, classifies people and projects into what is good for them. Today (...) that assumption is no longer tenable, although there are still many believers. At stake is indeed the question of racism and epistemology. And once upon a time scholars assumed that if you ‘come’ from Latin America you have to ‘talk about’ Latin America; that in such a case you have to be a token of your culture. Such expectation will not arise if the author ‘comes’ from Germany, France, England or the US. As we know: the first world has knowledge, the third world has culture; Native Americans have wisdom, Anglo Americans have science. The need for political and epistemic de-linking here comes to the fore, as well as decolonializing and decolonial knowledges, necessary steps for imagining and building democratic, just, and nonimperial/colonial societies. As evaluation of practitioners’ competence is largely based on self-report, accuracy in practitioners’ self-assessment is essential for ensuring high quality treatment-delivery. The aim of this study was to assess the relationship between independent observers’ ratings and practitioners’ self-reported treatment integrity ratings of Motivational interviewing. Practitioners were randomized to two types of supervision [i.e., regular institutional group supervision, or individual telephone supervision based on the MI Treatment Integrity code]. The mean age was 43.2 years, and 62.7 percent were females. All (...) sessions were recorded and evaluated with the MITI, and the MI skills were self-assessed with a questionnaire over a period of 12 months. The associations between self-reported and objectively assessed MI skills were overall weak, but increased slightly from baseline to the 12-months assessment. However, the self-ratings from the group that received monthly objective feedback were not more accurate than those participating in regular group supervision. These results expand findings from previous studies and have important implications for assessment of practitioners’ treatment fidelity: Practitioners may learn to improve the accuracy of self-assessment of competence, but to ensure that patients receive intended care, adherence and competence should be assessed objectively. It is now well‐documented that several cellular functions depend on LINC complex formation, including cell differentiation and migration. Intriguingly, recent studies suggest that SUN proteins participate in cellular processes where their association with KASH proteins may not be required. Business Ethics: A European Review, EarlyView.

The use of artificial intelligence (AI) to aid legal decision making has become prominent. This paper investigates the use of AI in a critical issue in employment law, the determination of a worker’s status—employee vs. independent contractor—in two common law countries (the U.S. and Canada). This legal question has been a contentious labor issue insofar as independent contractors are not eligible for the same benefits as employees. It has become an important societal issue due to the ubiquity of (...) the gig economy and the recent disruptions in employment arrangements. To address this problem, we collected, annotated, and structured the data for all Canadian and Californian court cases related to this legal question between 2002 and 2021, resulting in 538 Canadian cases and 217 U.S. cases. In contrast to legal literature focusing on complex and correlated characteristics of the employment relationship, our statistical analyses of the data show very strong correlations between the worker’s status and a small subset of quantifiable characteristics of the employment relationship. In fact, despite the variety of situations in the case law, we show that simple, off-the-shelf AI models classify the cases with an out-of-sample accuracy of more than 90%. Interestingly, the analysis of misclassified cases reveals consistent misclassification patterns by most algorithms. Legal analyses of these cases led us to identify how equity is ensured by judges in ambiguous situations. Finally, our findings have practical implications for access to legal advice and justice. We deployed our AI model via the open-access platform, https://MyOpenCourt.org/, to help users answer employment legal questions. This platform has already assisted many Canadian users, and we hope it will help democratize access to legal advice to large crowds. (shrink)

I argue that our general disposition to make moral judgments and our core moral intuitions are likely the product of social selection—a kind of gene–culture coevolution driven by the enforcement of collectively agreed-upon rules. Social selection could potentially track mind-independent moral truth by a process that I term realist social selection: our ancestors could have acquired moral knowledge via reason and enforced rules based on that knowledge, thereby creating selection pressures that drove the evolution of our moral psychology. Given (...) anthropological evidence that early humans designed rules with the conscious aim of preserving individual autonomy and advancing their collective interests, the theory of realist social selection appears to be attractive for moral realists. The goal of evolutionary debunking arguments should be to show not that our moral beliefs are the product of natural selection, but that realist social selection did not occur. (shrink)

Intuitively, a speaker who uses slurs to refer to people is doing something morally objectionable even if no one is measurably affected by their speech. Perhaps they are only talking to themselves, or they are speaking with bigots who are already as vicious as they can be. This paper distinguishes between slurring as an expressive act and slurring as the act of causing a psychological effect. It then develops an expression-focused ethical account in order to explain the intuition that slurring (...) involves an effect-independent moral wrong. The core idea is that the act of expressing a morally defective attitude is itselfpro tantomorally objectionable. Unlike theories that focus only on problematic effects, this view is able to shift the moral burden of proof away from victims of slurring acts and onto speakers. A seemingly new response to this argument has emerged, the so-called “dependence response,” which involves, among other things, abandoning FP for an alternative principle, the principle of the “Fixity of the Independent”. The paper argues that an ethical firm has cause to realize and to respect, in good faith, the decision of workers regarding labor unions, and proceeds along the following lines. First, the employer is due appropriate deference the bounds of which should be determined in conjunction with employees, as they are the most closely affected party. Second, employee preferences for defining the employment relation and appropriate deference are best reflected through autonomous voice. Third, autonomous voice is assured by the right (...) to free association and generally achieved through labor unions. Fourth, because employment is so important to a dignified existence, an economically just system of employment requires respect for workers’ choice regarding labor unions. And fifth, there are concerns and contradictions that arise from labor union operations, but they do not justify impeding a morally valid prerogative. (shrink)

Levins and Lewontin have contributed significantly to our philosophical understanding of the structures, processes, and purposes of biological mathematical theorizing and modeling. Here I explore their separate and joint pleas to avoid making abstract and ideal scientific models ontologically independent by confusing or conflating our scientific models and the world. I differentiate two views of theorizing and modeling, orthodox and dialectical, in order to examine Levins and Lewontin’s, among others, advocacy of the latter view. I compare the positions of (...) these two views with respect to four points regarding ontological assumptions: (1) the origin of ontological assumptions, (2) the relation of such assumptions to the formal models of the same theory, (3) their use in integrating and negotiating different formal models of distinct theories, and (4) their employment in explanatory activity. Dialectical is here used in both its Hegelian–Marxist sense of opposition and tension between alternative positions and in its Platonic sense of dialogue between advocates of distinct theories. I investigate three case studies, from Levins and Lewontin as well as from a recent paper of mine, that show the relevance and power of the dialectical understanding of theorizing and modeling. There is currently no consensus regarding what measures are most valid to demonstrate perceptual processing without awareness. Likewise, whether conscious perception and unconscious processing rely on independent mechanisms or lie on a continuum remains a matter of debate. Here, we addressed these issues by comparing the time courses of subjective reports, objective discrimination performance and response priming during meta-contrast masking, under similar attentional demands. We found these to be strikingly similar, suggesting that conscious perception and unconscious processing cannot be (...) dissociated by their time course. Our results also demonstrate that unconscious processing, indexed by response priming, occurs, and that objective discrimination performance indexes the same conscious processes as subjective visibility reports. Finally, our results underscore the role of attention by showing that how much attention the stimulus receives relative to the mask, rather than whether processing is measured by conscious discrimination or by priming, determines the time course of meta-contrast masking. David Enoch has recently proposed that the deliberative indispensability of irreducibly normative facts suffices to support their inclusion in our ontology, even if they are not necessary for the explanation of any observable phenomena. He challenges dissenters to point to a relevant asymmetry between explanation and deliberation that shows why explanatory indispensability, but not deliberative indispensability, is a legitimate guide to ontology. In this paper, I aim to do just that. Given that an entity figures in the actual explanation of (...) some phenomenon, it is not an open question whether that entity exists. Thus, if you can manage to find actual explanations, you can find answers to ontological questions. In contrast, even if some entity is indispensable to deliberation, it still might not exist. For example, even if some form of libertarian free will is deliberatively indispensable, we still might not have libertarian free will. So even if you manage to discover the indispensable commitments of deliberation, there is still more work to do to get to the bottom of things. That additional work is explanatory work, and so deliberative indispensability is not an independent guide to what there is. (shrink)

Three negative affective dispositions—anger, anxiety, and depression—are hypothesized to increase physical disease risk and have been the subject of epidemiological studies. However, the overlap among the major negative affective dispositions, and the superordinate construct of trait negative affectivity are only beginning to be tested. Presented here is a narrative review of recent prospective studies that simultaneously tested anger, anxiety, depression, and trait NA as risk factors for cardiac outcomes. Anxiety and depression emerged as independent risk factors for premature heart (...) disease in population studies of persons nominally healthy at baseline, and for recurrence/mortality among patients with existing heart disease. We prove an institutional version of A. Robinson ’s Consistency Theorem. This result is then appliedto the institution of many-sorted first-order predicate logic and to two of its variations, infinitary and partial, obtaining very general syntactic criteria sufficient for a signature square in order to satisfy the Robinson consistency and Craig interpolation properties.

Using an international sample of firms from 32 countries, we study the relation between media independence and corporate tax aggressiveness. We measure media independence by the extent of private ownership and competition in the media industry. Using an indicator variable for tax aggressiveness when the firm’s corporate tax avoidance measure is within the top quartile of each country-industry combination, we find strong evidence that media independence is associated with a lower likelihood of tax aggressiveness, after controlling for other institutional determinants, (...) including home-country tax system characteristics. We also find that the effect of media independence is more pronounced when the legal environment is weaker, and when the information environment is less transparent. We contribute to the business ethics literature by documenting the role of independent media as an external monitoring mechanism in constraining corporate tax aggressiveness. (shrink)

The ethical frameworks of consequentialism and formalism predict moral awareness and behavior in individuals, but current measures either do not treat these frameworks as independent or lack sufficient theoretical underpinnings and statistical dependability. This paper presents the development and validation of a new scale to measure consequentialism and formalism that is well grounded in prior research. The Ethical Standards of Judgement Questionnaire is validated via six studies. Measurement items are developed in the first three studies, which also confirm the (...) need to eliminate a unidimensional measure and evaluate these frameworks separately. The fourth study addresses discriminant validity and the two remaining studies provide insight into how consequentialism and formalism predict the degree to which behaviors are deemed acceptable by individuals in the context of consumer beliefs and religious beliefs. Suggested uses for the scale in both academia and organizations are presented. (shrink)

In recent years, philosophical inquiry into individual welfare has blossomed into something of a cottage industry, and this literature has provided the conceptual foundations for an equally voluminous literature on aggregate social welfare. In this essay, I argue that substantial portions of both bodies of literature ought to be viewed as philosophical manifestations of a characteristically modern illusion—the illusion, in particular, that there is a special kind of goodness that is irreducibly person-relative. Theories that are built upon this idea suffer (...) from a recurring defect. Such theories relativize welfare to subjective states that are wholly unsuited to settling deliberative questions concerning what it would be good for us to do, because they themselves are subjective outlooks on value and their dependability is itself fair game for deliberative review. They are unstable, then, in the course of first-person deliberation, which is precisely where they are supposed to have their primary application. The idea of an irreducibly person-relative kind of goodness is of modern vintage, and its rise has distorted prevailing interpretations of pre-modern alternatives, including the appealing alternative found in Plato and Aristotle. A further objective of this essay is to recover this alternative, bring out its appeal, and answer some possible objections to it. (shrink)

We study expansions of an algebraically closed field K or a real closed field R with a linearly independent subgroup G of the multiplicative group of the field or the unit circle group \\), satisfying a density/codensity condition. Since the set G is neither algebraically closed nor algebraically independent, the expansion can be viewed as “intermediate” between the two other types of dense/codense expansions of geometric theories: lovely pairs and H-structures. We show that in both the algebraically closed (...) field and real closed field cases, the resulting theory is near model complete and the expansion preserves many nice model theoretic conditions related to the complexity of definable sets such as stability and NIP.
