This article examines the municipal ID card programs in New Haven and San Francisco. With a municipal ID card, undocumented immigrants can access basic city services and identify themselves with police and other city officials. The article draws on twenty-eight interviews with key stakeholders to show that city officials navigated the conflicting demands of ID card supporters and opponents to create a local membership policy focused on improving city administration, not expanding the rights of undocumented immigrants. In (...) capitalizing on their discretionary administrative powers to develop programs that safeguard the health, safety, and welfare of all city residents, officials in New Haven and San Francisco managed to promote the integration of undocumented immigrants into city affairs without upsetting the federal monopoly over immigration and citizenship powers. This new form of local bureaucratic membership has implications for the urban citizenship literature and illustrates that city officials have some freedom to develop programs that benefit undocumented immigrants. This paper describes the introduction of a new electronic identity card including an electronic identity (EID) for local physical and online authentication in 2006. The most significant difference to any European country is the decentralized issuing at 256 police stations employing an automatic printing machine. This is the most visible element in a high degree continuation, as the previous paper based ID cards were also personalized and issued at the police stations. Similarly the attributes defining the identity and the (...) legal framework were not changed either. While there was some delay in the planning phase, the role-out of the new eID cards was rather smooth. At the end of 2009, approx. 13 Mio Spanish citizens out of more than 46.5 Mio inhabitants (www.ine.es) were in possession of an eID card. But this does not necessarily mean that they are using the eID function for online authentication. The reasons for this application gap will be discussed with reference to online tax declaration, where the eID so far covers less than one percent of all online declarations while authentication by software certificates still make up for 98 percent. This chapter describes the introduction and diffusion of the Finnish Electronic Identity Card (FINEID card). FINEID establishes an electronic identity (eID), based on the civil registry and placed on an identity chip card issued by Finnish government to Finnish citizens and permanent residents from age 18 and older. It is a non-mandatory electronic identity card introduced in 1999 in order to replace the older citizen ID card. It serves as a travel document and is intended (...) to facilitate access to eGovernment services as well as offering a possibility to sign electronically. Therefore the chip contains two certificates: one for authentication purposes, and one for qualified signatures. The eID function had to compete with the already existing PIN/TAN based TUPAS standard for online authentication for eBanking, eCommerce and eGovernment applications, and has lost this battle by reaching less than one percent of all online authentications. The history, actor constellation, time line and barriers will be described and a few communalities and differences to other countries under study in this special issue will be highlighted. (shrink)

National electronic identity (e-ID) card schemes and electronic identity management systems (e-IDMS) in Europe are characterised by considerable diversity. This contribution analyses the creation of a national e-IDMS in Austria with the aim of improving our understanding of the reasons behind the genesis of particular designs of national e-IDMS. It seeks to explain how the system’s specific design evolved and which factors shaped its appearance. Being part of a comparative four country study, a common theoretical framework is employed to (...) allow for a comparison of national e-IDMS in Austria, Belgium, Germany and Spain. It combines the approach of actor-centred institutionalism and the concept of path dependence in order to analyse the innovation process and to explain resulting key characteristics of the e-IDMS in Austria: a technology-neutral system with multiple tokens; an ID model based on the Central Register of Residents; a privacy concept using sector-specific personal identifiers. It is shown that innovation process and outcome are not only shaped by specific actor constellations dominated by strategic e-government bodies, but also by path dependence at three levels: technological, institutional and organisational. This chapter provides an analysis of the long process of introducing an electronic identity for online authentication in Germany. This process is described as a multi-facet innovation, involving actors from different policy fields shifting over time. The eID process started in the late ‘90s in the context of eGovernment and eCommerce with the legislation on e-signatures, which were supposed to allow for online authentication of citizens. When after 5 years it was recognized that this was not the case, a new (...) digital ID card, which had meanwhile been announced, was chosen as token for the eID. This process was dominated by the concerns for visual inspection and border control, including the storage of digital fingerprints. Under the leadership of the Ministry of the Interior (BMI) and technical guidance of the Federal Agency for Information Security (BSI), technical specifications have to a large extent been adopted from the electronic passport, which had been smoothly introduced 2 years before. However, in the legislative process some concern regarding digital fingerprints on the eID card was raised and led to an opt-in solution. In 2009, a bill on the new ID card was passed which regulates the eID function for online authentication as well. This is characterized as a radical innovation by introducing a double-sided, mutual authentication of the citizen and the service provider and implementing the principle of proportionality regarding the access of service providers to data on the chip. At the time of writing, field tests are conducted. Roll-out of the new eID card is to start in November 2010. Therefore no figures about adoption can be provided here. (shrink)

The issue of identity cards is hotly debated in many countries, but it often seems to be an oddly backward-looking debate that presumes outdated “Orwellian” architectures. In the modern world, surely we should be debating the requirements for national identity management schemes, in which identity cards may or may not be a useful implementation, before we move on to architecture. If so, then, what should a U.K. national identity management scheme for the 21st century look like? Can we assemble a (...) set of requirements understandable to politicians, professionals and the public? We’ve certainly had some difficulty to date. One reason might be that we lack a compelling, narrative vision. As a result, we’re constructing a legacy system that will subvert the rational goals of worthwhile scheme. We’re not aiming high enough. The technology, I will argue, can deliver far more than the politicians, professionals and public imagine: In particular, it can deliver the apparently paradoxical result of more security and more privacy by exploiting smart cards, biometrics and cryptography. In this paper, I will set out a high-level vision of what a forward-looking national identity management and identity “card” scheme should look like: Dr. Who’s psychic paper. Not only is this a simple, clear vision that is familiar to the expert and layperson alike, but it’s a very useful artistic representation of the capabilities of the technology. I will further suggest that a utility implementation of identity infrastructure can deliver the on this vision in a practical way, and that all of the technology needed to create an ID scheme for the future already exists. The concept of privacy as a basic human right which has to be protected by law is a recently adopted concept in Thailand, as the protection of human rights was only legally recognized by the National Human Rights Act in 1999. Moreover, along with other drafted legislation on computer crime, the law on privacy protection has not yet been enacted. The political reform and the influences of globalization have speeded up the process of westernization of the urban, educated middle-class professionals. (...) However, the strength of traditional Thai culture means that a mass awareness of the concept of privacy rights remains scarce. This paper explicates the Thai cultural perspective on privacy and discusses the influence of Buddhism on privacy rights, including the impacts of globalization and the influence of Western values on the country’s political and legal developments. The paper also discusses the legal provisions regarding privacy protection, and the debates on the smart ID cards policy and SIM cards registration for national security. (shrink)

In the first controlled, non-self-report studies to show an influence of university-level ethical instruction on everyday behavior, Schwitzgebel et al. (2020) and Jalil et al. (2020) found that students purchase less meat after exposure to material on the ethics of eating meat. We sought to extend and conceptually replicate this research. Seven hundred thirty students in three large philosophy classes read James Rachels’ (2004) “Basic Argument for Vegetarianism”, followed by 50-min small-group discussions. Half also viewed a vegetarianism advocacy video containing (...) factory farm footage. A few days after instruction, 54% of students agreed that “eating the meat of factory farmed animals is unethical”, compared to 37% before instruction, with no difference between the film and non-film conditions. Also, 39% of students anonymously pledged to avoid eating factory farmed meat for 24 h, again with no statistically detectable difference between conditions. Finally, we obtained 2828 campus food purchase receipts for 113 of the enrolled students who used their Student ID cards for purchases on campus, which we compared with 5033 purchases from a group of 226 students who did not receive the instruction. Meat purchases remained constant in the comparison group and declined among the students exposed to the material, falling from 30% to 23% of purchases overall and from 51% to 42% of purchases of $4.99 or more, with the effect possibly larger in the film condition. We present the design of a secure and privacy preserving e-petition system that we have implemented as a proof-of-concept demonstrator. We use the Belgian e-ID card as source of authentication, and then proceed to issue an anonymous credential that is used to sign petitions. Our system ensures that duplicate signatures are detectable, while preserving the anonymity of petition signers. We analyze the privacy and security requirements of our application, present an overview of its architecture, and discuss the applicability of (...) data protection legislation to our system. The present paper summarizes the development of the national electronic Identity Management System (eIDMS) in Estonia according to a conceptual framework developed in an European comparative research project outlined in the first chapter of this special issue. Its main function is to amend the picture of the European eIDMS landscape by presenting a case with high involvement of the private sector and thereby checking the generalizations from the comparisons of Austria, Belgium, Germany and Spain, presented by Kubicek and Noack in (...) the previous chapter of this special issue. Starting with a short introduction into the historical background of identity documents in Estonia the national population register, the passport as well as the bank ID are described as the main pillars of the Estonian eIDMS, on which the national ID card builds on, which has been introduced in 2002. The technical features of the eID and the ID card are described in Section two as well as the areas of application and the processes for production and distribution. Section three presents the actors constellation, Section four the time line of the development process, starting from 1997. Section five deals with the diffusion and promotion of the ID card and the eID authentication function. After a very low and slow take up during the first 5 years due to a cooperation agreement between major banks, telecom operators and the government usage has increased. But still the authentication by Internet banks, which provides authentication services to third parties, including government, is the biggest competitor for the eID function on the national eID card. Only recently the major banks have announced to slowly fade out the password cards and PIN calculators as alternative modes of bank authentication. (shrink)

This paper compares the four national electronic Identity Management Systems (eIDMS), which have been described in the previous chapters. The section Similarities and differences between four national eIDMS will highlight the differences between these systems conceived as socio-technical systems with regard to the eID itself, the eID cards as tokens, the authentication processes as well as the procedures for distribution and personalisation, the support provided for installing the technology and any provider-related regulation. The section A three-fold path dependency , according (...) to the conceptual framework presented in the introductory chapter to this special issue, compares the new electronic systems with the previous ones in each country, in order to assess the continuation or changes with regard to the organisational, technological and regulatory path of development. The following sections explain the differences between the paths chosen and the path-related changes by analysing the actor constellation of the institutional actors, in particular the policy field and the power structure, as well as the context in which the policy makers made their choices, looking at privacy and Staatsverständnis in particular. Finally the diffusion and usage of the eID function will be compared and analysed, discussing to what extent the new institution has made a contribution to solving the policy problem it was developed for, e.g. providing a stronger authentication in order to meet security concerns regarding e-government and e-commerce transactions and avoiding new privacy infringements. Using grounded theory, the explanations provided have the status of generalisations derived from the four cases. They have to be considered as hypotheses, which will be checked for other countries in the following papers of this special issue. The comparison of the four cases in this article shows a high degree of path dependency. Most of the differences between the new systems are just a continuation of differences between the previous systems although they are to solve the same problem and can draw on the same technologies. But most astonishing is the finding that these differences between the systems do not influence diffusion and use of the eID function in the respective countries. (shrink)

In this discussion piece we address how the UK government has attempted to manage public expectations of a proposed biometric identity scheme by focussing attention on the handheld, i.e., the ID card. We suggest that this strategy of expectations management seeks to downplay the complexity and uncertainty surrounding this high-technological initiative, necessitating the selective use of expertise for the purpose of furthering government objectives. In this process, government often relegates counterexpertise, if not dismissing it outright, thereby greatly politicizing the (...) policy deliberation process. We argue that this manoeuvring by government spells trouble for both democratic deliberation on the issue of biometric identification in the UK and, more generally, expertise-based policy making in related technological ventures. Citizen identification systems (known also as ‘ID card systems’, or ‘national identity management systems’, even though those definitions are not identical) are receiving a mixed acceptance, with their privacy, security and usability being criticised, specifically in the UK. This paper investigates whether it is possible to improve social acceptance of such systems in cases where they are incompatible with the perceived value of privacy, but without significantly changing their original architecture. The paper analyses requirements using four different scenarios that (...) address long-term privacy issues. There is increasing concern about “surveillance capitalism,” whereby for-profit companies generate value from data, while individuals are unable to resist (Zuboff 2019). Non-profits using data-enabled surveillance receive less attention. Higher education institutions (HEIs) have embraced data analytics, but the wide latitude that private, profit-oriented enterprises have to collect data is inappropriate. HEIs have a fiduciary relationship to students, not a narrowly transactional one (see Jones et al, forthcoming). They are responsible for facets of student life beyond education. In addition to (...) classrooms, learning management systems, and libraries, HEIs manage dormitories, gyms, dining halls, health facilities, career advising, police departments, and student employment. HEIs collect and use student data in all of these domains, ostensibly to understand learner behaviors and contexts, improve learning outcomes, and increase institutional efficiency through “learning analytics” (LA). ID card swipes and Wi-Fi log-ins can track student location, class attendance, use of campus facilities, eating habits, and friend groups. Course management systems capture how students interact with readings, video lectures, and discussion boards. Application materials provide demographic information. These data are used to identify students needing support, predict enrollment demands, and target recruiting efforts. These are laudable aims. However, current LA practices may be inconsistent with HEIs’ fiduciary responsibilities. HEIs often justify LA as advancing student interests, but some projects advance primarily organizational welfare and institutional interests. Moreover, LA advances a narrow conception of student interests while discounting privacy and autonomy. Students are generally unaware of the information collected, do not provide meaningful consent, and express discomfort and resigned acceptance about HEI data practices, especially for non-academic data (see Jones et al. forthcoming). The breadth and depth of student information available, combined with their fiduciary responsibility, create a duty that HEIs exercise substantial restraint and rigorous evaluation in data collection and use. This paper introduces the objectives and basic approach of a collaborative comparative research project on the introduction of national electronic Identity Management Systems (eIDMS) in Member States of the European Union. Altogether eight country case studies have been produced in two waves by researchers in the respective countries, which will be presented in the following articles in this special issue. The studies adopt a common conceptual framework and use the same terminology, which will be presented in this introduction, just as (...) the reasoning for the selection of the particular countries under investigation. The conceptual framework combines elements of actor centred institutionalism with path analysis, looking for path continuation, change or creation in the transition from the previous IDMS to an electronic one and explaining this as choices of actors in certain contexts. Information on the reasons for these choices in the first four cases has been collected from in depth interviews with key actors and in the four other cases from official documents. As the subject of this research is the transition of national identity management systems only countries have been included in which a national ID and a civil registry already exist before the introduction of the electronic elements, thus excluding the UK. The opportunities to become a good person are not the same for everyone. Modern European ethical theory, especially Kantian ethics, assumes the same virtues are accessible to all who are capable of rational choice. Character development, however, is affected by circumstances, such as those of wealth and socially constructed categories of gender, race, and sexual orientation, which introduce factors beyond the control of individuals. Implications of these influences for morality have, since the work of Williams and Nagel in the seventies, (...) raised questions in philosophy about the concept of moral luck. In The Unnatural Lottery, Claudia Card examines how luck enters into moral character and considers how some of those who are oppressed can develop responsibility. Luck is often best appreciated by those who have known relatively bad luck and have been unable to escape steady comparison of their lot with those of others. The author takes as her paradigms the luck of middle and lower classes of women who face violence and exploitation, of lesbians who face continuing pressure to hide or self-destruct, of culturally Christian whites who have ethnic privilege, and of adult survivors of child abuse. How have such people been affected by luck in who they are and can become, the good lives available to them, the evils they may be liable to embody? Other philosophers have explored the luck of those who begin from privileged positions and then suffer reversals of fortune. Claudia Card focuses on the more common cases of those who begin from socially disadvantaged positions, and she considers some who find their good luck troubling when its source is the unnatural lottery of social injustice. Rather than focusing on political and legal debates surrounding attempts to determine if and when genocidal rape has taken place in a particular setting, this essay turns instead to a crucial, yet neglected area of inquiry: the moral significance of genocidal rape, and more specifically, the nature of the harms that constitute the culpable wrongdoing that genocidal rape represents. In contrast to standard philosophical accounts, which tend to employ an individualistic framework, this essay offers a situated understanding of harm that (...) features the importance of interdependence and relationality and that conceptualizes harms as embodied and contextual. The paper ultimately reveals what is distinctive about this particular crime of sexual violence by exploring the logic of genocidal rape: genocidal rape involves the harm of forced self-betrayal unleashed relationally, causing victims as representatives of their group to participate inadvertently in the destruction of that group. For years, mainstream feminist ethics focused criticism on male supremacy. Feminist philosophers in this volume adopt a less male-focused stance to look closely at oppression's impact on women's agency and on women's relations with women. In this contribution to philosophical ethics, Claudia Card revisits the theory of evil developed in her earlier book The Atrocity Paradigm, and expands it to consider collectively perpetrated and collectively suffered atrocities. Redefining evil as a secular concept and focusing on the inexcusability - rather than the culpability - of atrocities, Card examines the tension between responding to evils and preserving humanitarian values. This essay argues that current advocacy of lesbian and gay rights to legal marriage and parenthood insufficiently criticizes both marriage and motherhood as they are currently practiced and structured by Northern legal institutions. Instead we would do better not to let the State define our intimate unions and parenting would be improved if the power presently concentrated in the hands of one or two guardians were diluted and distributed through an appropriately concerned community.

The situationist challenge to global character traits claims that on the basis of findings in social psychology, we should only accept at most the existence of local or context-sensitive traits. In this article I explore a neglected area of J. S. Mill's work to outline an account of context-sensitive traits. This account of traits, coupled with a sophisticated consequentialist ethical framework, suggests an interesting view on which persons govern the circumstances of their actions in order to best promote overall well-being.

Rule-consequentialism is frequently regarded as problematic since it faces the following powerful dilemma: either rule-consequentialism collapses into act-consequentialism or rule-consequentialism is inconsistent. Recent defenders of this theory such as Brad Hooker provide a careful response to this objection. By explicating the nature and theoretical commitments of rule-consequentialism, I contend that these maneuvers are not successful by offering a new way of viewing the dilemma which retains its force even in light of these recent discussions. The central idea is that even (...) the most well-developed contemporary form of the view is ensnared in the following dilemma: as an agent-neutral consequentialist theory, rule-consequentialism is either inconsistent or it is desperately unmotivated as a form of consequentialism since it is committed to a non-consequentialist form of ultimate moral value. Thinking of the evils of homophobia and what is needed to survive them requires acknowledging a new category of evil besides the evils of individual deeds, social practices and social structures. That further category is evil social environments. Building on the work of Jeremy Waldron on the harm in hate speech, this chapter extends that account to certain hate crimes that, like the written word, send a lingering social message. The cases of four women survivors of homophobia are then examined (...) in relation to such harm. Two who wrote memoirs had been targeted for murder, one in an evil environment, the other in a more positively responsive environment. The remaining two survival stories are less dramatic. But they are important in how they illustrate ordinary challenges faced successfully by lesbians and gay men in emotionally toxic environments, and how, in this sense, those not directly threatened with murder might still be justly regarded as survivors. The chapter concludes with reflections on the meanings of survival and some of the costs of surviving an evil homophobic environment. (shrink)
