Since the enactment of the first Hong Kong bilingual ordinance in 1989, tremendous effort and resources have been put to translating English legal documents into Chinese. Long before the implementation of bilingual legislation, the provision of interpreting services has remained an entrenched practice in the courtrooms of Hong Kong. This study has adopted a corpora approach to re-examine what seems to be reasonable and routine practices of the bilingual, legal system, the impacts of bilingual legislation, translation, and interpretation on trial (...) proceedings. Results generated from the corpus show the problems of anglicized Chinese translation of the Sexual Offences Ordinance under the British Common Law system; and interpreters’ performance which is intricately bound by the discourse practices of the legal professionals as well as the ideology of the bilingual legal system in Hong Kong. This paper studies the relationship between organizational ethical climate and the forms of organizational citizenship behavior (OCB), including in-role and extra-role behaviors, and examines the mediating effect of employee loyalty. A sample of employees from a traditional Hong Kong-based company was used as a study group. The purpose of this study was to examine the causes and implications of how various ethical work climates affect employee performance. Based on a model proposed by Victor and Cullen, ethical climate is arranged from (...) lower levels to higher levels. The results suggest that lower levels of ethical climate (instrumentality and independence), characterizing a weak relational contract between employee and employer, are associated with negative extra-role behavior. In contrast, higher levels of ethical climate (caring and law-and-code), symbolic of a strong relational contract at work, are associated with positive extra-role behavior. Moreover, normative commitment mediated a positive relationship between caring and identification with the company, whereas attitudinal loyalty mediated the negative relationship between independence and altruism. In Heidegger’s Black Notebooks some ideas about political embodiment can be found, which have come under suspicion to justify the Third Reich’s race law. In the following article, the analysis and discussion of Heidegger’s political embodiment will firstly be traced back to the traditional understanding of the human as a “rational animal”, and will then look at how the “racial being” is subsequently developed and eventually transformed into political absolute subjectivism. Moreover, Heidegger’s in-depth explanation and critique on Nietzsche’s metaphysics, which (...) he views as having transformed human experiences to a metaphysical representation and thus misunderstanding human nature, will also be clarified. Through Heidegger’s critic on biologism, a profound disclosure which potentially imply an attack of the racism at his time can be shown. Furthermore, Heidegger’s thinking of Being as a kind of emancipation of European political embodiment will also be analyzed. Lastly, although Heidegger and Confucianism have different ideas of lived-body, both schools basically show the same fundamental understanding of human nature. In regard to this, their understanding of political embodiment, their similarities and divergences, will be elucidated. (shrink)

This essay attempts to approach the dispute over the conceptualist or non-conceptualist interpretation of Husserl’s conception of intentional experience from a specific question: Is the intuitive act essentially a carrier of meaning? In the sixth Investigation, Husserl apparently tries to show that intuition is no carrier of meaning and therefore must be unified with a meaning-conferring act in order to be meaningful. But it seems to me that the brief arguments given by Husserl here are far from conclusive and that (...) there are passages in the Logical Investigations which suggest otherwise. I will try to demonstrate that the sense conferred by the interpretation in perception is not different from linguistic meaning, and therefore perception is actually a synthetic act of fulfillment and is always meaningful. The conceptualist reading is no less convincing and no less susceptible to objections than the non-conceptualist one. (shrink)

Patients who are subject to compulsory care constitute a substantial proportion of the work-load of mental health professionals, particularly psychiatric nurses. This article examines the traditional ‘beneficence-autonomy’ approach to ethics in compulsory psychiatric care and evaluates it against the reality of daily practice. Risk to the public has always been an important but often unacknowledged consideration. Inequalities exist among ethnic and socio-economic groups and there is a lack of agreement on what constitutes mental disorder. Two major changes in compulsory psychiatric (...) care - community orders and care for patients with untreatable severe personality disorders - further challenge the traditional ethical approach. There are also important human rights implications. The simple patient-health professional relationship no longer provides an adequate framework for mental health professionals on which to base their ethical decisions. The public and organizations may have different perspectives and their interests are becoming increasingly important. Mental health professionals, particularly psychiatric nurses, may face ethical dilemmas because of these different perspectives. (shrink)

This article focuses on the two types of conception of time, namely, the time of history and the time of ethics. The former is a conception of time that one views or situates one’s lifetime in or with history, whereas the latter a time of our personal lifetime interrupted by the intervention of the other and the accompanied ethical significance. This article argues that Classical Confucianism has interesting specifications of these two conceptions of time. In particular, it shows a correspondence (...) and interaction between the two. Then, it is not difficult to catch up with what our tradition has been aiming at through ethical practices, and the tradition in turn prompts us to be ethical. (shrink)

It confirms previous findings in this area and adds on new dimensions. Therefore, practitioners and academics may further refine their knowledge in this subject.

This paper reports the first case in which a linguist served as an expert witness in Hong Kong, a former British colony that has operated as a special administrative region of the People’s Republic of China (PRC) since 1997. The dispute was on the meaning of the political slogan “Liberate Hong Kong, Revolution of Our Times”, which was widely adopted during the 2019–2020 protests. The keywords “liberate” and “revolution” are smoking gun evidence for the prosecution in a large cluster of (...) cases that involve sedition law and national security offences. Section I of the paper provides background information about a case the author was involved in, which was concerned with whether the slogan was seditious. Section II describes the analysis conducted, which concludes that the slogan as a whole refers to a need to rectify a problem and to return to the original, a more desirable state of affairs for Hong Kong, without specifying what problem there is and what the desirable state of affairs looks like. Section III highlights some critical issues in the analysis, discussing challenges faced and ethical questions for the expert witness. In this paper we investigate nonnormal modal systems in the vicinity of the Lewis system S1. It might be claimed that Lewis's modal systems (S1, S2, S3, S4, and S5) are the starting point of modern modal logics. However, our interests in the Lewis systems and their relatives are not (merely) historical. They possess certain syntactical features and their frames certain structural properties that are of interest to us. Our starting point is not S1, but a weaker logic S1 (S1 (...) without the schema [T]). We extend it to S1D, which can be considered as a deontic counterpart of the alethic S1. Soundness and completeness of these systems are then demonstrated within a prenormal idiom. We conclude with some philosophical remarks on the interpretation of our deontic logic. (shrink)

This article offers a reading of Plato in light of the recent debates concerning the unique ‘ontology’ of International Relations (IR) as an academic discipline. In particular, this article suggests that Plato’s metaphysical account of the integral connection between human individual, the domestic state, and world order can offer IR an alternative outlook to the ‘political scientific’ schema of ‘levels of analysis’. This article argues that Plato’s metaphysical conception of world order can not only provide IR theory with a way (...) to re-imagine the relation between the human, the state, and world order. Moreover, Plato’s outlook can highlight or even call into question the post-metaphysical presuppositions of contemporary IR theory in its ‘borrowed ontology’ from modern social science, which can in turn facilitate IR’s re-interpretation of its own ‘ontology’ as well as its distinct contributions to the understanding of the various aspects of the social world and human life. This article considers how the notions of ‘word’ and ‘conversation’ can contribute to contemporary developments in theological metaphysics by drawing on Christoph Schwöbel’s ontological rendition of Martin Luther’s theology. By way of reading Schwöbel’s theological ontology of conversation with reference to John Milbank’s theology of the gift, this article shows that Schwöbel’s conception of the Trinity as an eternal ‘conversation’ can be understood as an ontology of ‘word-exchange’ in a fashion similar to Milbank’s account of trinitarian ‘gift-exchange’. Moreover, the article (...) argues that Schwöbel’s Lutheran construal of creation as God’s ‘created words’ (verba creata) can present a transcendental account of ‘word’ or verbum which complements Milbank’s ontology of the gift or donum. By bringing to light these perhaps surprising convergences between Schwöbel’s Lutheran theology of ‘the word’ and Milbank’s Christian Neo-Platonic theology of ‘the gift’, this article highlights some of the often-overlooked metaphysical insights in Luther’s theology of the word, which can contribute not only to ecumenical theological dialogue, but also foster new perspectives and conversations for contemporary developments and discussions in theological metaphysics. Obstetric ultrasound is the well-recognized prenatal test used to visualize and determine the condition of a pregnant woman and her fetus. Apart from the clinical application, some businesses have started promoting the use of fetal ultrasound machines for nonmedical reasons. Non-medical fetal ultrasound (also known as ‘keepsake’ ultrasound) is defined as using ultrasound to view, take a picture, or determine the sex of a fetus without a medical indication. Notwithstanding the guidelines and warnings regarding ultrasound safety issued by governments and (...) professional bodies, the absence of scientifically proven physical harm to fetuses from this procedure seems to provide these businesses with grounds for rapid expansion. However, this argument is too simplistic because current epidemiological evidence is not synchronous with advancing ultrasound technology. As non-medical fetal ultrasound has aroused very significant public attention, a thorough ethical analysis of this topic is essential. Using a multifaceted approach, we analyse the ethical perspective of non-medical fetal ultrasound in terms of the expectant mother, the fetus and health professionals. After applying four major theories of ethics and principles (the precautionary principle; theories of consequentialism and impartiality; duty-based theory; and rights-based theories), we conclude that obstetric ultrasound practice is ethically justifiable only if the indication for its use is based on medical evidence. Non-medical fetal ultrasound can be considered ethically unjustifiable. Nevertheless, the ethical analysis of this issue is time dependent owing to rapid advancements in ultrasound technology and the safety issue. The role of health professionals in ensuring that obstetric ultrasound is an ethically justifiable practice is also discussed. (shrink)

Medication error is the most common and consistent type of error occurring in hospitals. This article attempts to explore the ethical issues relating to the nursing management of medication errors in clinical areas in Macau, China. A qualitative approach was adopted. Seven registered nurses who were involved in medication errors were recruited for in-depth interviews. The interviews were transcribed and analyzed using content analysis. Regarding the management of patients, the nurses acknowledged the mistakes but did not disclose the incidents to (...) patients and relatives. Concerning management of the nurses involved by senior staff, most participants experienced fairness, comfort and understanding during the process of reporting and investigation. The ethical issues relating to the incidents were discussed, particularly in the Chinese context. There is a need for further study relating to the disclosure of medication incidents to patients and some suggestions were made. (shrink)

This study examines whether community social capital in US counties, as captured by strength of civic norms and density of social networks in the counties, affects corporate social responsibility of resident corporations headquartered in the counties. Analyses of longitudinal data from 3688 unique US firms between 1997 and 2009 provide strong empirical support for the propositions that community social capital facilitates positive CSR activities that benefit non-shareholder stakeholders and constrains negative CSR activities that are detrimental to non-shareholder stakeholders. Additionally, we (...) explore the effects of institutional logics arising from community isomorphism on positive and negative CSR activities, respectively. And, we explore the respective effects of corporate engagement in positive and negative CSR activities on corporate financial performance. Firms undertake more positive CSR activities when such activities are more prevalent among other local corporations headquartered in the same county. But, there is no systematic relationship between negative CSR activities and the community-level corporate engagement in negative CSR activities. Positive CSR activities enhance a firm’s future financial performance, and the positive effect is more prominent among firms headquartered in counties with high community social capital. However, negative CSR activities only reduce a firm’s future financial performance among firms headquartered in counties with high community social capital; negative CSR activities do not affect performance among firms headquartered in counties with lower levels of community social capital. Collectively, these results highlight the distinct effects of local social institutions, namely community social capital, on positive CSR activities and negative CSR activities, respectively. Previous studies on parenting adult children with ASD were scarce, and their intervention protocols mainly were derived from established work with children. Development of an applicable adult-oriented protocol and demonstration of its effectiveness is warranted. The present study outlined the development and evaluation of Core Autism Parenting Skills, which targets to enhance parenting self-efficacy intervention for adult children with ASD by addressing two intervention goals in parallel: acquisition of parenting skills and cultivating positive attributes. In CAPS, PSE is operationalised into (...) four parent roles: to observe, reinforce, empathise, and accompany, each with requisite attributes, skills, and prescribed training. Twenty-seven parents with adult children with ASD were recruited. They completed measures assessing their PSE, competence in the four parent roles, and emotional well-being at pre-training, post-training and 2-month follow-up. The intervention was well-received by the participants and reported significant improvements in PSE, parent role competence at post-training and 2-month follow-up. The applicability of PSE and parent role competence in constructing effective parenting intervention for adult children with ASD was supported. (shrink)

This article offers a philosophical reading of Elena Ferrante’s Neapolitan Novels by bringing the tetralogy into conversation with Jean-Paul Sartre’s phenomenological ontology. In addition to highlighting the striking similarities between Ferrante’s notion of smarginatura (‘dissolving margins’) and Sartre’s depiction of the existential sensation of nausea, this article argues that the two main characters of Ferrante’s tetralogy, Lila Cerullo and Elena Greco, respectively exemplify Sartre’s ontological categories of ‘being-for-oneself’ and ‘being-for-others’ in his phenomenological account of human existence. However, Ferrante—like Simone de (...) Beauvoir before her—goes beyond Sartre in her ability to offer an account of the imperfect existential freedom of women, who remain constrained in their pursuit of authenticity by social and cultural factors. Drawing on Ferrante’s assertion that readers ‘are both Elena and Lila’ as well as her recent claim that there are within her two kinds of writing (broadly equated to the ‘compliant’ Elena and ‘impetuous’ Lila), we establish Ferrante’s exploration of the ambivalent features of human subjectivity as a consummate philosophical and literary project. An accessible introduction to Confucian moral philosophy.

The purpose of this paper is to propose a framework of ethics education that promotes the structured learning of ethics in the accounting discipline. The Ethics Education Framework (EEF) is based on three key inter-related components that includes: Rest’s (1986) Four-Component Model of ethical decision-making and behaviour; the key cognitive and behavioural objectives of ethics education; and the discrete and pervasive approaches to delivering content. The EEF providesuniversity students and professional accountants a structure to learn to identify, analyse, and resolve (...) ethical issues to the point of action. The EEF is a four-stage learning continuum represented as a set of building blocks which introduces ethical concepts and then reinforces and develops new levels of understanding with progressive stages. This paper describes the EEF, and includes a discussion of how it compares with other ethics education models, and an analysis of the support through responses by professional organisations (based on an Exposure Draft issued by the International Federation of Accountants (IFAC), as the initial International Education Practice Statement). The IFAC has now revised its International Education Standard (IES 4) in relation to ethics, with a commentary period till July 2011. (shrink)

Spitale, Germani, and Biller-Andorno’s (2024) PHERCC matrix sets out a useful and systematic framework for risk and crisis communication in public health emergencies. A problem in ensuring effective messaging is the extent to which the messaging environment is *quiet* or *noisy*: in other words, whether or not a message has to *compete with other messages* at the same time. I use the example of the UK’s experience during COVID-19, which was marked by tensions between the devolved regional governments—and consequently divergent (...) policy responses—which sowed confusion among the populace. More generally, if policymakers try to account for the needs of competing publics simultaneously (in order to meet the inclusivity and understandability principles), this may increase the noise problem and so actually undermine effective public health messaging. The issue of noisy messaging environments reveals a tradeoff between inclusivity and understandability versus effectiveness in risk and crisis communication. (shrink)

We consider a setting where a decision maker’s uncertainty is represented by a set of probability measures, rather than a single measure. Measure-by-measure updating of such a set of measures upon acquiring new information is well known to suffer from problems. To deal with these problems, we propose using weighted sets of probabilities: a representation where each measure is associated with a weight, which denotes its significance. We describe a natural approach to updating in such a situation and a natural (...) approach to determining the weights. We then show how this representation can be used in decision making, by modifying a standard approach to decision making—minimizing expected regret—to obtain minimax weighted expected regret. We provide an axiomatization that characterizes preferences induced by MWER both in the static and dynamic case. (shrink)

This article offers a critical interpretation of Artificial Intelligence (AI) as a philosophical notion which exemplifies a secular conception of thinking. One way in which AI notably differs from the conventional understanding of “thinking” is that, according to AI, “intelligence” or “thinking” does not necessarily require “life” as a precondition: that it is possible to have “thinking without life.” Building on Charles Taylor’s critical account of secularity as well as Hubert Dreyfus’ influential critique of AI, this article offers a theological (...) analysis of AI’s “lifeless” picture of thinking in relation to the Augustinian conception of God as “Life itself.” Following this critical theological analysis, this article argues that AI’s notion of thinking promotes a societal privilege of certain rationalistic or calculative ways of thought over more existential or spiritual ways of thinking, and thereby fosters a secularization or de-spiritualization of thinking as an ethical human practice. Abstract Objective Intuitive inquiry meditation is a unique form of Buddhist Zen/Chan practice in which individuals actively and intuitively utilize the cognitive functions to cultivate doubt and explore the concept of the self. This event-related potential (ERP) study aimed to investigate the neural correlates by which long-term practice of intuitive inquiry meditation induces flexibility in self-schema processing, highlighting the role of doubt and belief processes in this exploration. Methods Twenty experienced and eighteen beginner meditators in intuitive inquiry meditation were recruited (...) for this ERP study. The interactions of doubt and belief processes with concepts of the self and Buddha were investigated. A 128-channel electroencephalography (EEG) system was used to collect EEG data. The ERP data were processed and analyzed using EEGLAB. Results The data showed a double dissociation between beginners and experienced meditators (monks) in the concepts of the self and Buddha: intuitive inquiry meditation reduced the brain activity of beginners when viewing Buddha image but not when viewing a picture of themselves. However, in experienced meditators, intuitive inquiry meditation reduced brain activity when they viewed images of themselves but not when they viewed Buddha image. Further event-related spectral perturbation (ERSP) analysis revealed that experienced meditators had a greater theta spectral power and higher intertrial coherence (ITC), indicating that they could more flexibly modulate ongoing cognitive processes than beginner meditators. Conclusion Intuitive inquiry meditation could help beginner meditators detach from the concept of Buddha but not from that of the self. However, in experienced meditators, the opposite was true. ERSP analysis showed that only experienced meditators exhibited significant alterations in brain activity dynamics during intuitive inquiry meditation, which might enable these practitioners to become spontaneously detached from the concept of the self. These findings revealed the neural mechanism by which long-term practice of intuitive inquiry meditation can influence the doubting process and its effect on self-schema processing. (shrink)
