El presente trabajo tiene como finalidad mostrar cómo la regla hermenéutica tal cual es descripta por Hans-Georg Gadamer en Wahrheit und Methode representa un sistema de significación que produce texto. Para ello se utilizará la semiótica de Iuri Lotman y la semiótica connotativa de Hjelmslev como cooperaciones teóricas que posibilitan describir con mayor analiticidad la regulación de la regla hermenéutica en el fenómeno de la comprensión.

This article is designed to form a question-focused cross-cultural dialogue, rather than compare Zhu Xi 朱熹 (1130–1200) with Meister Eckhart (1260–1328) in general terms. It will start with an analysis of the exegetical/hermeneutical rules that Zhu Xi and Eckhart set up for their own scriptural commentaries. The study of Eckhart will then be extended to Augustine, in order to explore how Eckhart resorts to Augustine in his commentary writings. Having explored Eckhart’s affinity with Augustine regarding their consensus about the multiplicity (...) of literal senses, as well as their emphasis on the renewal or the continuous growth of the meaning of scriptural texts, the discussion will come back to the starting point of this comparative model, and attempt to form a comparison between the two traditions, through the exemplars of Zhu Xi, Eckhart, and Augustine, with a focus on the implications of these hermeneutical rules. IRBs and REBs use specialized language. A process of definition and re-definition of the situation occurs. That process of interpretation can usefully be considered from the perspective of interpretive social science models involving Symbolic Interaction, Semiotics and Hermeneutics. Seven examples are provided to flesh out the nuances of contextual decision making and the “casuistic” aspects of a balanced approach to complex problems. While many decisions are relatively unproblematic and can follow a template, it is not possible simply to apply (...) a fixed and mechanical approach. Hence, a socialization process occurs in which committee members must learn the actual application of the rules as opposed to the formal requirements. A “tightrope” between overly rigid and overly lax interpretations must be crossed and the more we understand the process of semiosis and the semiotic context the more likely it will be that truly ethical decisions will be “accomplished.” The lack of adequate survey data makes it all the more important to have good theoretical understanding of process. The rule of law demands that the state's coercive power be used only according to settled general laws, applied impersonally. But an individualist theory of legal inter pretation cannot provide the shared understanding required. Gadamer appeals to the practical wisdom of judges and lawyers, who will agree on how to apply law to new cases. But this account is adequate only for very cohesive societies. Dworkin's account rests on propositional knowledge of a supposed best interpretation of an entire legal (...) system. This paper investigates how Schleiermacher’s universal hermeneutics can be considered as a better alternative to both, German rationalist aesthetics as pioneered by Christian Wolff, and Kant’s transcendental idealism, to the extent of overcoming the problematics of rule-following. A general account of the necessity of a universal hermeneutics and its meaning from historical practices of exegeses is given. This is then followed by the account of rule-following in the tradition of both German rationalist aesthetics and Kant’s transcendental (...) idealism with latter as expounded in Kant’s Critique of Pure Reason. At the heart of two recent theological traditions are hermeneutical principles which are not only consistent but are integrated in the hermeneutics of Augustine. According to the doctrine of biblical inerrancy as it has been recently articulated by Evangelicals, Scripture has an original meaning, and that meaning is not open to the possibility of error. According to some thinkers in postmodern theology, including Jean-Luc Marion, the meaning of Scripture transcends its original meaning. After examining postmodernism and inerrancy, I consider (...) their harmony in the writings of Augustine, who takes original meaning as a guide for understanding that biblical meaning which transcends it. An Augustinian hermeneutic consistent with inerrancy is thus an alternative to the more typical non-inerrantist postmodern theologies. (shrink)

Using a short excerpt from Anselm's Responsio as an example, this paper tries to present logical reconstruction as a special type of exegetical interpretation by paraphrase that is subject to (adapted) hermeneutic maxims and presumption rules that govern exegetical interpretation in general. As such, logical reconstruction will be distinguished from the non-interpretative enterprise of formalization and from the development of theories of logical form, which provide a framework in which formalization and reconstruction take place. Yet, even though logical reconstruction is (...) dependent on methods of formalization, it allows us to use formal methods for the analysis and assessment of natural language texts that are not readily formalizable and is thus an important tool when it comes to applying the concepts and methods of formal logic to such texts. Some aspects and patterns of Chan encounters may appear as rituals that serve either as a provisional means for common people or as an embodiment of enlightened behaviors. Routinized ritualization of Chan life, however, runs counter to the fundamental spirit of freedom and spontaneity of Chan way of life. Abstract There have been increasingly popular claims that hermeneutics provides an epistemology that is appropriate and sufficient for psychotherapy. The purpose of this paper is to evaluate and explain those claims. Hermeneutics proves to provide terms that legitimize aspects of clinical expertise that have been most ignored within the traditional empiricist epistemology; namely, hermeneutics articulates and provides standards for therapeutic interpretations about clients? idiosyncratic intentions and also for using clinical theories that defy empirical test. Nonetheless, hermeneutics (...) also proves to be limited in its account of clinical knowledge. That is, clinicians who advocate hermeneutics have ruled out any legitimate basis on which clinical expertise can be influenced by knowledge about non?intentional constraints on psychological life. Yet, therapists must use such knowledge, especially that which concerns the non?intentional constraints imposed by human development. Thus, to realize its potential, hermeneutics should be embedded within a more comprehensive epistemology that includes compatible standards for knowledge about development. Finally, this paper concludes by proposing an outline for such an inclusive approach to clinical knowledge. (shrink)

Ultimately hermeneutics became a means for the self-understanding for Dasein. But in a letter to his student, Engelbert Krebs, Heidegger also emphasizes the historical character of cognition. We understand from our situation in history, and our understanding is structured by historically shaped concepts and even our language. Dilthey, too, emphasized the historical matrix for understanding in his hermeneutics, and Heidegger took this up from Dilthey. Heidegger defined hermeneutics in the opening lines of the lectures as "the unified manner of the engaging, approaching, accessing, interrogating, and explication of facticity." Hermeneutics as interpretation is not just understanding as a passive process of cognition but an active engaging, interrogating, and accessing. Facticity itself is interpretive in that it sees what something is through question and answer. Heidegger is stepping back into the factors that precondition our understanding, the "forestructure" of understanding. This forehaving, he says, belongs to the very nature of knowing and understanding. We see something "as "something, and we see it in a specific historical situation. Furthermore, we see it in an existential horizon of expectation, a horizon haunted by uncertainty, by the" fundamental questionability of the future, that is of "possible being," of what is possible for this particular being at this particular time and place. Contemporary Europe is peculiar in none of these forms being lost or having emerged victorious. The characteristic manifestation of the life form upward is Christianity. The life form forward is typical of capitalistic ideas with the predominance of history and economical development, the main categories being progress, more and more. The majority of people in contemporary Europe live leaning forward, be a citizen and workforce. Man is perceived as a functional totality, pragmatism arepredominant in societies. Things tend to rule over man, ideals turn into ideologies. That certainly strengthens the technological and military might, but it does not form the common idea of Europe. The form on the surface finds manifestation in post-modernism, which spread up around the world. A question arises: can there appear a fourth form of contemporary life – perhaps we might call it a dimension of depth, which comes from the dialogue between civilizations? (shrink)

To have a theory of religion before studying religion would make the study superfluous unless there is openness for change, openness for new horizons emerging. However, we need to understand that contextual meaningfulness is not the same as relativism. The search for a common framework presupposes the reality of and possibility of the same. Men can determine the rules of a particular language-game; but, they cannot create the laws of logic. The Space Act of 1958 begins, “The Congress hereby declares that it is the policy of the United States that activities in space should be devoted to peaceful purposes for the benefit of all mankind.” In March 1982, a Defense Department official commented on the statute: “We interpret the right to use space for peaceful purposes to include military uses of space to promote peace in the world.”1 The absurdity of this willful misinterpretation amazed me on first reading, and months (...) later it readily came to mind when I was looking for an effective way to illustrate the politics of interpretation. With just the right touch of moral indignation, I offered my literary criticism class this example of militaristic ideology blatantly misreading an antimilitaristic text.“But … the Defense Department is right!” objected the first student to speak. Somewhat amused, I spent the next ten minutes trying, with decreasing amusement, to show this student that the Reagan administration’s reading was clearly, obviously, painfully wrong. I pointed to the text. I cited the traditional interpretation. I noted the class consensus, which supported me. All to no avail. It was at this point that I felt that “theoretical urge”: the overwhelming desire for a hermeneutic account to which I could appeal to prove my student wrong. What I wanted was a general theory of interpretation that could supply rules outlawing my student’s misreading.This little hermeneutic fable introduces the three topics of my essay. One topic is the theoretical moment that concludes the narrative; another is the simple plot, a brief rhetorical exchange; and finally there’s the institutional setting in which the exchange takes place. No overall history of the philosophical dialogue has appeared since Rudolf Hirzel's two-volume study was published in 1895. In The Philosophical Dialogue: A Poetics and a Hermeneutics, Vittorio Hösle covers the development of the genre from its beginning with Plato to the late twentieth-century work of Iris Murdoch and Paul Feyerabend. Hösle presents a taxonomy and a doctrine of categories for the complex literary genre of the philosophical dialogue, focusing on the poetical laws that structure the genre, and develops (...) hermeneutical rules for its correct interpretation. Following an introduction that employs the categories of subjectivity and intersubjectivity to classify philosophy's modes of expression, Hösle's book is structured by the classical triad of the production, inner structure, and reception of the literary dialogue. To explain what is meant by "philosophical dialogue," Hösle first deals with the specific traits of philosophical dialogue in contrast to other literary forms of philosophy and its special status among them. Second, he distinguishes the philosophical dialogue as a literary genre from actual philosophical conversation, and as a philosophical literary genre from nonphilosophical literary dialogues. Finally, he takes up the connection between literary form and philosophical content in the philosophical dialogue. Numerous authors of dialogues are discussed, with a special focus on Plato, Cicero, Augustine, Hume, and Diderot. Originally published in Germany as Der philosophische Dialog: Eine Poetik und Hermeneutik, this book not only contributes to the philosophical discussion of dialogue but to a great extent defines it. This fine translation will prove useful to both philosophers and literary critics in the English-speaking world. First, it makes it possible to reconcile the Misesian, Rothbardian, and hermeneutical approaches to methodology; second, it provides a way of defending a stateless legal order against the charge that such an order lacks, yet needs, a final arbiter.

There are several branches of ethics. Clinical ethics, the one closest to medical decisionmaking, can be seen as a branch of medicine itself. In this view, clinical ethics is a unitary hermeneutics. Its rule is a guideline for unifying other theories of ethics in conjunction with the clinical context. Put another way, clinical ethics interprets the clinical situation in light of a balance of other values that, while guiding the decisionmaking process, also contributes to the very weighting of (...) those values. The case itself originates ideas, not only about which value ought to predominate in its resolution, but also provides the origin of clinical rules that can be used in other cases. No overall history of the philosophical dialogue has appeared since Rudolf Hirzel's two-volume study was published in 1895. In _The Philosophical Dialogue: A Poetics and a Hermeneutics_, Vittorio Hösle covers the development of the genre from its beginning with Plato to the late twentieth-century work of Iris Murdoch and Paul Feyerabend. Hösle presents a taxonomy and a doctrine of categories for the complex literary genre of the philosophical dialogue, focusing on the poetical laws that structure the genre, and develops hermeneutical (...) rules for its correct interpretation. Following an introduction that employs the categories of subjectivity and intersubjectivity to classify philosophy's modes of expression, Hösle's book is structured by the classical triad of the production, inner structure, and reception of the literary dialogue. To explain what is meant by "philosophical dialogue," Hösle first deals with the specific traits of philosophical dialogue in contrast to other literary forms of philosophy and its special status among them. Second, he distinguishes the philosophical dialogue as a literary genre from actual philosophical conversation, and as a philosophical literary genre from nonphilosophical literary dialogues. Finally, he takes up the connection between literary form and philosophical content in the philosophical dialogue. Numerous authors of dialogues are discussed, with a special focus on Plato, Cicero, Augustine, Hume, and Diderot. Originally published in Germany as _Der philosophische Dialog: Eine Poetik und Hermeneutik_, this book not only contributes to the philosophical discussion of dialogue but to a great extent defines it. This fine translation will prove useful to both philosophers and literary critics in the English-speaking world. Tyconius’ Liber regularum is a late fourth century treatise, often dubbed as “the first (extant) Latin treatise on hermeneutics.” This article investigates the following issue: What does Liber regularum as an introductio to hermeneutics amount to in the context of the other introductiones mentioned in Cassiodorus, Inst. 1.10? What has been presupposed by the author, what exactly is contended, and why has his treatise been called “the first Latin treatise on hermeneutics” when it is not limited to (...) interpretative matters and discusses only a few selected hermeneutical issues? Indeed, the topic Tyconius almost exclusively focuses on is the unannounced change of reference within a sentence. He advises to recognize the seven compositional regulae mysticae in-built in scripture and, with the help of these, to determine the ever-changing references. In fact, this is what justifies calling his treatise a hermeneutical introductio. The compositional rules become hermeneutical rules and are immensely helpful for eliminating seeming contradictions in scripture. Particular attention is given to Augustine’s critical reception of Tyconius’ rules which mattered so much, in turn, for the reception of Tyconius. (shrink)

What I hope to do in this paper is to see whether Laudan’s normative naturalism may suggest a third alternative to normativism-naturalism dilemma in the analytical philosophy of science. In criticizing the view that all methodological rules are to be specified in the form of hypothetical imperatives, I offer the idea that a theory of scientific rationality (including its normative dimension) must go beyond the usual analytical format of “rational reconstruction”. It is precisely this idea that opens the door for (...) a hermeneutic alternative to normative naturalism. On this alternative, one has to pay attention to the contextual normativity of doing scientific research, if one wants to give an account of the articulation of methodological rules and norms. Sports reflection is rather locked into a binary view of narrow and broad internalists. Narrow internalists, or formalists, argue that sports are solely constituted by their rules: the ‘autotelic’ stance. Broad internalists, or interpretivists, on the other hand, reason that sport is more than just a lusory end in itself. This paper will revitalize reflection on sports as a locus of the human condition by breaking through this binary opposition. It will focus on the positive aspects of the concept of (...) ‘agon’. As an ‘agonal’ or competitive social practice, sport may be a means to a ‘heterotelic’ end that surpasses the concept of sport as self-referential play: seeking knowledge, understanding the human condition and cultivating virtue. As such, self-improvement through repetitive practice has always been a key theme of human existence. Our ‘ascetic planet’ is inhabited by individuals who are constantly and relentlessly training themselves for the better. This may be self-focused, but it may also have a broader scope: we train ourselves to become better humans, contributing to a just and sustainable society. Paradoxically, however, this will only work when we become aware of our exercises as forms of life that engage the practising person. A hermeneutics of endurance cycling can enrich our understanding of this sports activity as a form of asceticism. As such, it will elaborate a view on cycling as an upwardly oriented ‘spiral’ that can contribute not only to self-knowledge and self-improvement on the individual level, but also to an ‘ecosophical renaissance’ on the collective level. The present paper describes an alternative mode of doing teacher observation meant to overcome the limitations of the common approach in use today. To this end, the paper first draws upon the hermeneutic theory of perception developed by Graeme Nicholson and establishes the fundamental principle that ought to govern didactic observation and the conditions of possibility of this endeavor. Subsequently, taking Lester Embree’s description of phenomenological observation as model, the paper describes the basic rules to be followed. This essay considers the foundations of reasonable evaluation in the arts. These we argue concern the relations that constitute our experience of art, and the ontology of the art work itself. The being of the artwork, the experience and the interpretation of it all involve over-lapping modes of part–whole relations. The experience of meaningfulness is not an experience of a singular object or framework of meaning as closed and complete but an experience of relational meaning whereby exposure to one set (...) of meaningful relations transforms another in an on-going and open manner. This suggests that the experience of art itself provides the norms for reasonableness of evaluation. These norms are not rules in the sense of offering a method. They are characteristic of the features of an experience of meaningfulness itself. The essay suggests that the reasonableness of a response to a work can be considered in terms of its appropriacy relative to the context of its own horizon and the horizon surrounding the production of the work; its plausibility, that is, its internal coherence and consistency as a reading; whether the structure of the response is consistent with, supplements, or expands the intelligible content of the work; and whether it gives a sense of the latent possibilities still held within a work and intimates where the movement of a work’s subject-matter might. Wittgenstein's `language-games' constitute a forceful post-Cartesian, anti-foundationalist account of linguistic activity with meaning sustained across a network of customary practices or forms of life. This is a fertile picture of language but it depends upon a rigid, synchronic notion of linguistic rules and fails to account for the developmental and transformative dimensions to language. I suggest that Wittgenstein is unable to connect past to present language-games. Despite an obvious proximity of Gadamer to Wittgenstein (on the pragmatics of language) I argue (...) that Gadamer's work on tradition, with its hermeneutical understanding of the indeterminacy of linguistic rules, exposes Wittgenstein's apparent blindness to the historical aspect of language. With his theory of sympathy in the Treatise of Human Nature, Hume has been interpreted as anticipating later hermeneutic theories of understanding. It is argued in the present article that Hume has good reasons to consider a hermeneutic theory of empathetic understanding, that such a theory avoids a serious difficulty in Hume’s “official,” positivist theory of sympathy, that it is compatible with the complex and subtle form of positivism, or naturalism, developed in Book 1 of the Treatise, and that his (...) analysis of sympathy provides valuable methodological rules for empathetic interpreters. Against the interpretation of James Farr in “Hume, Hermeneutics, and History,” it is maintained that Hume’s theory does not support a hermeneutics of nonempathetic Verstehen. (shrink)

The Mīmā ṃ sā school of Indian philosophy elaborated complex ways of interpreting the prescriptive portions of the Vedic sacred texts. The present article is the result of the collaboration of a group of scholars of logic, computer science, European philosophy and Indian philosophy and aims at the individuation and analysis of the deontic system which is applied but never explicitly discussed in Mīmā ṃ sā texts. The article outlines the basic distinction between three sorts of principles —hermeneutic, linguistic and (...) deontic. It proposes a mathematical formalization of the deontic principles and uses it to discuss a well-known example of seemingly conflicting statements, namely the prescription to undertake the malefic Śyena sacrifice and the prohibition to perform any harm. Siguiendo esta lógica hermenéutica actual, propongo una lectura de la RB a través de la lente de la Filosofía de la Liberación de Enrique Dussel, con el objetivo de explorar su potencial para ofrecer una crítica y una alternativa a los modelos de desarrollo imperantes de la Modernidad. En este (...) marco, distingo un primer momento poiético (naturaleza-cultura), centrado en el análisis de la revolución tecnológica y civilizatoria subyacente a la RB; y un segundo momento praxístico (cultura-cultura), en el que se destaca el opus benedictino como un ejemplo paradigmático de la “Nueva Política Económica de Liberación”, es decir, como una propuesta alternativa de organización social y cultural, capaz de superar las limitaciones del Capitalismo y el Socialismo Real del s. XX, ya que logra propiciar la reproducción de la vida material bajo parámetros éticos. Abstract: The Rule of Saint Benedict (RB) has undergone a revitalization in the contemporary intelectual landscape, transcending its monastic origin to become a reference point for various social and philosophical movements. By following this current hermeneutic logic, I propose a reading of RB through the lens of Enrique Dussel’s Philosophy of Liberation, with the aim of exploring its potential to offer a critique and an alternative to the prevailing development models of Modernity. In this framework, I distinguish a first poietic moment (nature-culture), focused on the analysis of the technological and civilizational revolution underlying RB; and a second praxistic moment (culture-culture), in which the Benedictine opus is highlighted as a paradigmatic example of the “New Economic Politics of Liberation”, that is, as an alternative proposal of social and cultural organization, capable of overcoming the limitations of Capitalism and Real Socialism of the 20th century, since it succeeds in fostering the reproduction of material life under ethical parameters. Among the four reading-levels, the textual and exegetical levels of Zhuangzi ’s Hundun-story are problem-free, and so we focus expository-wise on its conspicuous hospitality with nine implications. Then, hermeneutically, we see Hundun instructing us against clarity toward unclarity—cosmological, self-composing, cognitive, and communal—of kindly humus, in cosmic confusion, sleep and idleness, mist and pond-dragonfly, and non-ruling people-sovereignty. Pan-hospitality is our Emperor Hundun’s non-arbitrary imperative to nurture life.

Reacting against the turn to transcendence that heavily characterized the medieval worldview, the modern worldview is fundamentally exemplified by a threefold turn to immanence, consisting of a subjective turn, a linguistic turn and an experiential turn. Language plays a pivotal role here since it mediates between the subjective and the experiential. Ricoeur’s treatment of metaphor, significantly laid out in his The Rule of Metaphor, is crucial in bringing about this linguistic turn that mediates the subject and its experience of (...) the world. Through an analysis of “seeing as” as a poietic reconfiguration of reality in the subject’s experience, language transforms and founds the world as a “being as.” What is disclosed in this interpretative transformation of reality is not simply an hermeneutical ontology but possibly—also through language—an hermeneutical axiology. Much has been said about Confucius’ negative formulation of the Golden Rule. Most discussions center on explaining why this formulation, while negative, does not differ at all in intention from the positive formulation. It is my view that such attempts may have the effect of blurring the essential point behind the specifically negative formulation, a point which I hope to elucidate in this essay. It is my first contention that such a negative formulation is consonant with other basic implicit (...) Confucian attitudes such as modesty and the belief in the inherent goodness of human nature. My second contention is that this negative formulation has the intent and/or effect of promoting growth and, more importantly, preventing moral harm. My broader thesis is that the negative version of the Golden Rule does differ significantly from the positive version and that the difference that exists might well have been intended by Confucius to highlight the nature of his most basic moral principle. Even though there is an ineluctable abyss between Analytic and Continental Philosophy, it is not hard to argue that in his later works Ludwig Wittgenstein draws a closer philosophical attitude to the latter in terms of that the notions developed by him, such as language-games, family resemblances, meaning-in-use or rule-following, apart from his earlier nomological approach to language, leave room for various understandings and uncertainty in language. In the present work, my primary task is to concentrate on the close (...) relationship between the Wittgenstein’s notion of family resemblances and Gadamer’s idea of the fusion of horizons. But both philosophers, coincide in criticizing the authority of the Cartesian subject and private language and in allowing different understandings and uncertainty in language. Starting from this point of view, the linguistic turn, I will turn my remarks on the question how we learn color concepts since the structure of these concepts radically differs from the words that are able to subject to ostensive definitions. This last section will also offer a hermeneutical reading of Wittgenstein’s notion of family resemblances. (shrink)

There is a large and growing literature on communal interpretive resources: the concepts, theories, narratives, and so on that a community draws on in interpreting its members and their world. (They're also called “hermeneutical resources” in some places and “epistemic resources” in others.) Several recent contributions to this literature have concerned dominant and resistant interpretive resources and how they affect concrete lived interactions. In this article, I note that “using” interpretive resources—applying them to parts of the world in conversation with (...) others—is “a rule‐governed activity”; and I propose that in oppressive systems, these rules are influenced by the rules of oppression. Section I clarifies some rules governing the use of resources. Section II draws on work by Gaile Pohlhaus, Jr. and others to suggest that according to the present rules of our oppressive system, it is permissible for dominantly situated speakers to dismiss interpretive resources developed in marginalized communities. Section III appeals to Charles Mills's work on White ignorance to propose, further, that our system's rules make it impermissible and deserving of punishment to use resistant resources. The conclusion enumerates several further points about such rules governing the use of interpretive resources, their social effects, and some philosophical literatures. (shrink)

There are two attitudes regarding the historical situation of understanding commonly held today. On the one hand, we believe that we only achieve a real, worthwhile understanding of a topic when our thinking manages to break free from the dogmas of the past. We believe that this transcendence of the historical situation of thought is both possible and desirable. We applaud those whose thought appears to us to proceed unhinged by traditional dogmas, whether those dogmas be old habits of scientific (...) thought or traditional ideas about social life. We celebrate as epistemic heroes those who discover their own way of thinking. On the other hand, many are quick to accept as a general rule that one’s understanding is inevitably bound to one’s particular historical and cultural situation. Nobody understands things in a historical vacuum. Accordingly, we believe that there is no transcending the historicity of the understanding and thus no epistemic heroes to applaud. This chapter examines Gadamer's argument in “The Elevation of the Historicity of Understanding" (a central section in "Truth and Method") as a critique of both of these alternatives -- alternatives that can be traced back to the historical epochs of the Enlightenment and Romanticism. I argue that, for Gadamer, both of these historical models of understanding misconstrue the way that understanding is grounded in historical consciousness. (shrink)

Unfortunately, the translator, Joel Weinsheimer (himself the translator of Gadamer and general editor of the series) has not added English translations to the bibliography, though he does cite from English translations. The index is inadequate—especially for a quasi-textbook.Grondin sets out to revise and correct the standard view of the development of philosophical hermeneutics: that it began with the formulation of fragmentary hermeneutic rules in the classical and patristic period, was refined with the systematic hermeneutics of Protestant theologians, then broadened into a universal methodology of the human sciences by Schleiermacher and Dilthey, culminating in Hans Georg Gadamer’s philosophical hermeneutics, which extended its reach into a critique of ideology, theory of science, and practical philosophy (p. 3).In place of this story, Grondin presents a single aperçu, “the ancient and perhaps antiquated doctrine of the verbum interius: the ‘inner word’ that is never spoken but nevertheless resounds in everything that is said,” and which he traces to the Stoics via St. Augustine (p. 119). Grondin reveals in his preface that he learned of the centrality of the inner word from Gadamer himself in a Heidelberg pub in the fall of 1988 while he was working on this book (pp. xiii–xiv). Gadamer told him that the claim to universality of philosophical hermeneutics is founded on the recognition of the primordiality of the inner word, to which the uttered word must strive to be adequate (pp. xiv and 123). This interior meaning can never be fully grasped, but it nonetheless provides a prophylactic against relativism. As Grondin puts it in a happy phrase, “original meaning... remains at best the asymptote of understanding, the telos that the interpreter is trying to reach behind the words” (p. 127). In this way philosophical hermeneutics turns philosophy away from epistemology—the concern with the outside, that to which language points, its propositional content—toward hermeneutics—the concern with that from which language emerges, “the conversation of the soul with itself” (p. 139), and the question (p. 119). In “Against Theory” we argued that a text means what its author intends it to mean. We argued further that all attempts to found a method of interpretation on a general account of language involve imagining that a text can mean something other than what its author intends. Therefore, we concluded, all such attempts are bound to fail; there can be no method of interpretation. But the attempt to imagine that a text can mean something other than what its author (...) intends is not restricted to writers interested in interpretive method. In fact, the denial that meaning is determined by intention is central to projects as indifferent to method as hermeneutics and deconstruction. For hermeneutics, a text means that its author intends but also necessarily means more, acquiring new meanings as readers apply it to new situations. For deconstruction, an author can never succeed in determining the meaning of a text; every text participates in a code that necessarily eludes authorial control. Since both these projects are committed to the view that a text from mean something other than what its author intends, they are also committed to the view that a text derives its identity from something other than authorial intention. The text is what it is, no matter what meaning is assigned to it by its author and no matter how that meaning is revised by its readers.What gives a text its autonomous identity? On most accounts, the answer is linguistic conventions—the semantic and syntactic rules of the language in which the text is written. One of our aims in the present essay is to criticize the particular notions of textual identity advanced by hermeneutics and deconstruction, but our more general target is the notion that there can be any plausible criteria of textual identity that can function independent of authorial intention. Because there can be no such criteria, nonmethodological versions of interpretive theory are as incoherent as methodological ones and, like the methodological ones, should be abandoned. The omission is curious for, although there were few advances in biblical scholarship during the Restoration and (...) eighteenth century, modern literary criticism begins in this century with Dryden and Johnson, modern aesthetics with Shaftesbury and the Scottish school of taste, and modern theories of art with Reynolds and writers on the picturesque. Joel Weinsheimer’s treatment of this topic, then, instantly possesses originality, not only from a lack of serious competition but because of its approach to [End Page 365] hermeneutics. He “does not offer a historical narrative” of what happened in hermeneutics in eighteenth-century England (p. xi). Rather, Weinsheimer prefers to see hermeneutics as a series of snapshots of how various writers, of whom only a few are conventional exegetes, deal with matters of interpreting texts. In all, the book treats eight major figures (Swift, Locke, Toland, Bolingbroke, Hume, Reid, Blackstone, and Burke), devoting a chapter to each.The method in each one is approximately the same: Weinsheimer produces a reading not of a single work alone but of all, or almost all that an author writes about interpretation. In the case of Swift, for instance, his principal contribution on exegesis, A Tale of a Tub, is a satire on styles of exegesis Swift considered ridiculous. This chapter adds little to what we know of Swift but, in relation to Weinsheimer’s analysis of Sir William Blackstone, we can see that there is a legal background to parts of the debate among the three brothers on the meaning of Scripture. Locke (pp. 23–45) also dealt with the Bible extensively, but his tendency to prefer the doctrine of “sola scriptura” limits what an author can say about his hermeneutics. John Toland (pp. 46–71), in his Christianity Not Mysterious, proposes radical notions of biblical exegesis, and Weinsheimer gives us a lucid reading of the first English skeptical exegete. All the other figures he studies, however, had little interest in traditional literary exegesis. Weinsheimer sees Bolingbroke (pp. 72–102) as a philosopher of history who tried to generate a theory of decoding the past, but he does not clearly distinguish Bolingbroke’s rules for writing history. Hume (pp. 103–34) wrote extensively on exegetical topics without actually being an exegete; although this is one of Weinsheimer’s more opaque chapters, it does succeed in showing the diversity of Hume and his inability to reason conclusively on matters of interpretation. Hume basically did not think that there is any problem in understanding others, so his theories of exegesis are not coherent. So, too, Thomas Reid (pp. 135–65) considered language, properly used, as lacking in opacity; hence elaborate theories of interpretation have little use for him.However, with Blackstone and Edmund Burke, Weinsheimer contributes his two most interesting chapters. The law, as Blackstone conceived of it, is extremely difficult to understand, so his Commentaries on the Laws of England is an attempt to read legal texts “in the context of general literacy” (p. 168); Bentham would later imitate him. Burke, Weinsheimer argues, started as an aesthetician and ended applying principles of good and bad taste to political behavior, always one of the weaknesses of reactionary politics.In a brief epilogue (pp. 226–33), Weinsheimer speculates on the effort of eighteenth-century hermeneutics to understand historical reason, but he does not comment on the failure of the period to produce a single important hermeneuticist. His own choice to avoid major exegetes such as Samuel Johnson and Joshua Reynolds abridges his results dramatically, but a study based on scholarly snapshots always courts this risk. Hilbert arithmetic in a wide sense, including Hilbert arithmetic in a narrow sense consisting by two dual and anti-isometric Peano arithmetics, on the one hand, and the qubit Hilbert space (originating for the standard separable complex Hilbert space of quantum mechanics), on the other hand, allows for an arithmetic version of Gentzen’s cut elimination and quantum measurement to be described uniformy as two processes occurring accordingly in those two branches. A philosophical reflection also justifying that unity by quantum neo-Pythagoreanism links (...) it to the opposition of propositional logic, to which Gentzen’s cut rule refers immediately, on the one hand, and the linguistic and mathematical theory of metaphor therefore sharing the same structure borrowed from Hilbert arithmetic in a wide sense. An example by hermeneutical circle modeled as a dual pair of a syllogism (accomplishable also by a Turing machine) and a relevant metaphor (being a formal and logical mistake and thus fundamentally inaccessible to any Turing machine) visualizes human understanding corresponding also to Gentzen’s cut elimination and the Gödel dichotomy about the relation of arithmetic to set theory: either incompleteness or contradiction. The metaphor as the complementing “half” of any understanding of hermeneutical circle is what allows for that Gödel-like incompleteness to be overcome in human thought. (shrink)

My main claim in this article is that lawyers should make less use of the hermeneutical method than they do. The reasons that I will adduce to support this claim are the following: law is first and foremost an answer to the question of how to act and, more in particular, the question of which rules to enforce by collective means. As such, law does not coincide with positive law. Nevertheless, positive law determines the content of the law to a (...) large extent. It does so for two reasons. The first reason is that positive law contributes to legal certainty and that legal certainty is very important for the question concerning which rules should be enforced by collective means. The second reason is that respect for positive law, which was created by democratic bodies, implies respect for democracy. However, positive law can only contribute to legal certainty if its application is predictable. If positive law can be interpreted in more than one way, its application will not be predictable. In that case, positive law is not relevant for the content of the law tout court. Theories about the interpretation of positive law are particularly relevant where positive law can be interpreted in different ways, that is where positive law is not relevant for the content of the law tout court. Therefore, hermeneutical theories are not relevant for the content of the law and lawyers should not waste their time on them. A similar argument can be given for the democratic legitimation of positive law. (shrink)

In this article I apply the insights of hermeneutic realism to a practical-theological ethics that addresses the international crisis of families and women’s rights. Hermeneutic realism affirms the hermeneutic philosophy of Hans-Georg Gadamer but enriches it with the dialectic of participation and distanciation developed by Paul Ricoeur. This approach finds a place for sciences such as evolutionary psychology within a hermeneutically informed ethic. It also points to a multidimensional model of practical reason that views it as implicitly or explicitly involving (...) five levels---background metaphysical visions, some principle of obligation, assumptions about pervasive human tendencies and needs, assumptions about constraining social and natural environments, and assumed acceptable rules of conduct. The fruitfulness of this multidimensional view of practical reason is then demonstrated by applying it to practical-theological ethics and the analysis of four theorists of women’s rights---Martha Nussbaum, Susan Moller Okin, Lisa Cahill, and Mary Ann Glendon. Finally, I illustrate the importance and limits of the visional dimension of practical reason by discussing the concept of “Africanity‘ in relation to the family and AIDS crisis of Eastern Africa. The Communicational Theory of Law (CTL) usually differentiates between Legal Sociology and Legal Theory, in the sense that Legal Sociology is concerned with the social validity of the rules and Legal Theory with the formal or legal validity of the rules. It can be argued that both disciplines are two different perspectives of the same empirical reality (legal rules). Also, legal System and social milieu are two closely linked realities; they cannot be separated because they need each other. The Law (...) is the form or order that the social milieu takes, and, at the same time, the social environment provides the ideas, collective representations and other matters that need a legal regulation. For this reason, the epistemological separation between Sociology and Legal Theory must be overcome when the theoretical perspective comes to legal decisions. Thus, the decisional moment becomes the meeting point between the legal System and the social milieu. This is where the concept of the legal System fulfils its main function, as it allows for the dynamism and adaptability of the legal order. The hermeneutic re-elaboration of the normative texts will be the channel through which the social facts and other material elements can inform the meaning or possible interpretations of the rules and institutions of the legal order. This happens primarily by influencing theoretical and doctrinal works of an expository and didactic nature; and secondarily by influencing the decisions of legal operators and courts. This study seeks to explain how the social context influences legal decisions and the formation of the legal System, from a communicational perspective of Law. In order to do so, it will be necessary to set out two epistemological premises of CTL: the semiotic tripartition of the Theory of Law and the legal Order-legal System distinction. (shrink)

There is a striking parallel between w v o quine's 'indeterminacy of translation' thesis and k o apel's 'indeterminacy of textual interpretation thesis. both arguments are based on what is essentially the same 'sceptical dilemma'. the key to resolving these 'hermeneutic problems' is to recognize that such a 'sceptical problem' is unintelligible. this is precisely the point of wittgenstein's discussions of rule-following. many have misunderstood this, however, for they have misconstrued what was intended to be read as a "reductio (...) ad absurdum" establishing the "unintelligibility" of the dilemma, as a sceptical attack on the possibility of our ever solving the problem.
