The Association Henri Capitant des Amis de la Culture Juridique Française and the Société de législation comparée joined the academic network on European Contract Law in 2005 to work on the elaboration of a "common terminology" and on "guiding principles" as well as to propose a revised version of the Principles of European Contract Law. The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by (...) sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law. (shrink)

Several years in the making, the volume was edited by Patrick Henry, director of the Institute for Ecumenical and Cultural Research at St. John's Abbey (...) in Collegeville, Minnesota. It contains the reflections of four Buddhist authors—Norman Fischer, Joseph Goldstein, Judith Simmer-Brown, and Yifa—on selected parts of the Rule of Saint Benedict and has already met with such success that plans are underway to have it translated into several foreign languages.To coincide with the publication of the book, the Monastic Interreligious Dialogue (MID) board decided to hold a conference at Our Lady of Grace Monastery in Beech Grove, Indiana, from September 21-23, 2001. Originally all four of the Buddhist authors had intended to come, but in light of the terrorist attacks of September 11, Norman Fischer and Joseph Goldstein felt it was more important that they remain with their own communities during those days. However, Judith Simmer-Brown and Yifa did attend, along with more than a hundred other persons. The attendees included Father Patrick Barry, the former abbot of Ampleforth Abbey in England, who is currently residing at St. Louis Abbey in Missouri. His sensitive translation of the Rule of Saint Benedict is included as an appendix to Benedict's Dharma.On the opening evening, Father William Skudlarek, OSB, the chair of the MID board, extended a warm welcome to those attending and then introduced Patrick Henry, who served as moderator of the entire conference. Brother David Steindl-Rast, OSB, who had worked closely on the project from its inception and had written an afterword to the book, spoke on the Rule of Benedict as a "trellis," which is the root meaning of the Latin and Greek words translated as "rule." Just as a trellis in a garden provides a structure for the plant climbing on it, so does the Rule of Saint Benedict establish a framework on which a life can grow. Brother David's talk was followed by the assigning of "dyads," groups of two participants each; the pairs would use allotted times during the conference for dialogue about matters raised in the general sessions.The next day, Saturday, September 22, began with sitting meditation in the monastery chapel, followed by the service of Morning Praise with the resident community of Benedictine sisters. Those attending the conference again joined the resident community for vespers in the monastery chapel and then, after dinner, heard Father James Wiseman, OSB, of Saint Anselm's Abbey in Washington, D.C., speak on the themes of "leadership and humility" as these had been treated by the Buddhist authors in the last section of the book.The Sunday schedule began in a way similar to that of Saturday, with morning talks by the Buddhist scholar the Venerable Heng Sure and the MID chair Father Skudlarek. New York: Riverhead Books, 2001. xvi + 222 pp. When Buddhist and Christian monastics meet, they recognize each other as brothers and sisters engaged (...) in a similar quest, despite their doctrinal differences. The nature of this quest is explored in Benedict's Dharma, in which four Buddhists (Norman Fischer, Joseph Goldstein, Judith Simmer-Brown, and Yifa, representing the Zen, Theravadin, Tibetan, and Chinese Buddhist traditions) ruminate on their fraternal and sororal feelings.Venerable Yifa, a nun of the prominent Taiwanese monastery Fo Guang Shan, is the only one of the four in monastic vows, and the reader may wonder what the three non-monastics could offer to a discussion on the monastic life. This is not a new problem. One of Brother David's books was to be called, he told me, The Monk in Us, "us" meaning laypeople, but the title had an odd sound and was dropped. So, what is the monastic dimension? Brother David suggests that it is mindfulness, and he comes close to saying that wherever there is mindfulness, there is monasticism. "If mindfulness is all that matters, the monastery is merely a most convenient environment for this kind of life, but it can be lived anywhere, by anyone" (126). He goes on to discuss the phenomenon of monasteries shrinking in size at the same time as the number of long- and short-term visitors to monasteries grows, and proposes that we are moving toward a new understanding of the terms "contemplative," "monastic," and "lay."This insight may point to the most important contribution of this book. It is not about monasticism per se, and it is not a comparative study of the Rule and the Vinaya, with practical suggestions for their mutual reform; rather, it is a meditation on how anyone, monastic or lay, might live the contemplative or mindful life. Throughout the history of the Church and the sangha, laypeople have been in the majority, but attention has been focused on the priests and monastics. Pope Pius X [End Page 159] put it bluntly: the laypeople are the sheep who are to be led, and the clergy are the shepherds who lead. The Church, he added, is not a democracy. I do not know of a Buddhist who has been quite this straightforward, but many have come close, and the history of Buddhism is not that of a democracy. Occasionally, lay movements in both traditions have arisen, basing themselves on the doctrine of the priesthood of all believers or on the teaching of universal Buddha-nature, but they have quickly been co-opted by leaders who proclaimed themselves to be more equal than their fellows. The tragedy for both Buddhism and Christianity is that the contemplative or mindful life has become restricted to a group of professionals, with the attendant belief that such a life is unattainable by most Buddhists and Christians. What unites Joseph Ratzinger / Benedict XVI to the French is ressourcement, a controversial movement that initiated a brilliant reorientation of Catholic thought and teaching in the twentieth and twenty-first centuries. In the light of the significant work that has already been done on Ratzinger’s original contribution to Vatican II, the objectives of the present paper are, first, to situate him as theologian and Christian humanist at the heart of the ressourcement movement and to evaluate his work for peace (...) and harmony in the confines between past and present. It attempts to illuminate a way forward for the Church, based on the anthropological, philosophical, and spiritual foundations of the new Christian humanism of the ressourcement project, championed by the French and their German allies. Secondly, the paper seeks to document the influence of notable, twentieth-century, French Catholic thinkers, theologians and philosophers, on Ratzinger’s thought and future contribution to Church and culture on a global stage, with particular attention to Yves Congar, Henri de Lubac, Jean Daniélou (1905-74), and Jacques Maritain (1882-1973). Thirdly, it presents a fresh consideration of his vision of the Church, his contribution to the ecclesiology of the Second Vatican Council, and of the turbulent post-conciliar period. The key goals in this domain are, therefore, to articulate Ratzinger’s spirituality and his preponderant contribution to theological anthropology, using the lens of Vatican II. This is a point of some considerable importance and fills a critical lacuna in Catholic theology. As a pertinent comment of Congar’s makes clear. “For there is little awareness of the values of anthropology; we have created an ecclesiology without any anthropology”. Like Congar, Ratzinger sought to construct a theological anthropology concerned to serve the pastoral needs of the Church but without neglecting its cultural and social elements. Spirituality and anthropology are then, unsurprisingly, as luminous, intricately interwoven threads that permeate and fortify his entire theological edifice. (shrink)

ABSTRACT The midday demon, who attacked the solitary monk with vicious temptations – above all, that of acedia – is a conventional motif in late antique and medieval ascetic literature. At the noon hour, the demonic assault was vigorous and ranging. But medieval spiritual writers like Bernard of Clairvaux (d. 1153) and Richard of Saint Victor (d. 1173) also described noontime as the high point of mystical experience. Both notions hark back to biblical statements made in the Psalms and Song (...) of Songs and were elaborated by medieval thinkers through exegetical rumination. This paper studies the propinquity of these two notions in the symbolism and vocabulary of medieval spiritual writers, and in so doing documents the biblical and monastic contribution to unfolding ideas about melancholy. As examined in Saturn and Melancholy pathological melancholy would traditionally refer to the complex of symptoms associated with sloth and sadness that beleaguered the uprooted and antisocial ascetic. But after the introduction of the Aristotelian problem to Latin writers, a contrasting view appeared in the early thirteenth century, which held melancholy for a benediction of mystical or theophanic frenzy. This paper unmoors melancholy from its classical sources and, beginning from the ambivalence of the noonday motif, argues that the traditional literature of mystics and ascetics prepared for this remarkable shift. Here I discuss the basic elements, major stages, and completion of progressive evolution. The cosmic world of self-realization is based on extensive self-development within a closed contour: temporal counter-transitions of spatial counter-elements (energy bonds and media and, basically, substance structures) form of local worlds within it through evolution of informational structures. The organic world of reproduction develops through the open informational path: the initial substance, through energy exchange and metabolism, reproduces similar substance; the latter interacts with the environment and, subsequently, (...) reproduces its like, and so on. The animal world of self-regulation builds up a closed informational contour in the environment through the informational input and command output. The human world of self-cognition forms the intensive type of development within the internal closed informational contour of cognition. Counter-transitions of ideal images and signs relate to their real prototypes. In the course of cognition, abstractive thinking develops and brings man to the possibility of reflection of the initial world in its integrity (thus, elevates man to the infinite, by Hegel). The way of science is to try to deduce the answer to many such questions from a few well defined assumptions. Much about nature can be explained in terms of the principles of classical mechanics. The assumptions, in this explanatory scheme, are that the world is composed exclusively of particles and fields governed (...) by specified mathematical laws that refer neither to any individual person, nor to anyone’s experiences. These physical laws are supposed to be such that particles and fields, acting in concert, can form causally efficacious real functional entities such as driveshafts and propellers. Similarly, surges of electrical and mechanical activity in appropriately designed material substrates, composed of particles and fields acting in concert, could implement, in the world of matter, complex functional structures and long sequences of logical operations.
