It has been claimed that ‘virtuous structures’ can foster moral agency in organisations. We investigate this in the context of employee involvement in corporate philanthropy, an activity whose moral status has been disputed. Employing Alasdair MacIntyre’s account of moral agency, we analyse the results of eight focus groups with employees engaged in corporate philanthropy in an employee-owned retailer, the John Lewis Partnership. Within this organisational context, Employee–Partners’ moral agency was evidenced in narrative accounts of their engagement in philanthropic activities and (...) in their disputes about the moral status of corporate philanthropy. The doctrine of double effect, together with other moral principles that appeal to the intentions of moral agents, has come under attack from many directions in recent years, as have a variety of rationales that have been given in favor of it. In this paper, our aim is to develop, defend, and provide a new theoretical rationale for a secular version of the doctrine. Following Quinn (1989), we distinguish between Harmful Direct Agency and Harmful Indirect Agency. We propose the following (...) version of the doctrine: that in cases in which harm must come to some in order to achieve a good (and is the least costly of possible harms necessary), the agent foresees the harm, and all other things are equal, a stronger case is needed to justify Harmful Direct Agency than to justify Harmful Indirect Agency. We distinguish between two Kantian rationales that might be given for the doctrine, a “dependent right” rationale, defended by Quinn, and an “independent right” rationale, which we defend. We argue that the doctrine and the “independent right” rationale for it are not vulnerable to counterexamples or counterproposals, and conclude by drawing implications for the larger debate over whether agents' intentions are in any way relevant to permissibility and obligation. ‘Natural kind essentialism’—here defined as the view that (i) the existence of natural kinds is a mind- and theory-independent matter, (ii) their essences are intrinsic, and (iii) they have a hierarchical structure—is commonly thought to be justified by appeal to Kripke–Putnam semantics, according to which propositions like ‘water is H20’ are necessary a posteriori. This chapter argues that the Kripke–Putnam semantics is in fact compatible with the denial of each of the three tenets of natural kind essentialism. The basic argument (...) is that, assuming the range of natural kinds goes beyond those kinds for which we have vernacular names, deference to scientific theories is required in fixing the reference of natural kind terms. That those theories describe mind- and theory-independent reality, and that they do not admit a non-hierarchical structure for the categories they deploy, are theses that are independent of anything derivable from Kripke–Putnam semantics itself. ABSTRACT In this paper, I argue that having ‘leeway’ is part and parcel of what it is to be the agential source of an action, so that embracing source incompatibilism does not, by itself, absolve the incompatibilist of the need to find Frankfurtian agents to be possessors of alternate possibilities. I offer a response to Frankfurt-style counterexamples to the Principle of Alternate Possibilities, based on the idea that Frankfurt's Jones exercises the two-way power of agency when he acts – a (...) power whose exercise intrinsically implies the possibility of having done otherwise. I then show how to respond to the objection that the alternative possibility noted is not sufficiently ‘robust’ to ground his moral responsibility. I also distinguish my own argument for the claim that source incompatibilism is not truly independent of leeway incompatibilism from an argument for the same conclusion which has been offered previously by Kevin Timpe, and suggest that my own version has the dialectical advantage that it does not automatically assume from the outset that sourcehood requires indeterminism, and hence is in line with the traditional idea that the alternate possibilities requirement on moral responsibility is the common property of compatibilists and incompatibilists alike. In this paper I meditate on what it means to be well by interspersing my reflections on my time in an Intensive Care Unit with my sister, Bronzino’s 1560 painting of Noli me Tangere, along with Jean Luc Nancy’s book by this name, and Maurice Merleau-Ponty’s reflections on embodied movement. I conclude that wellness is a stance before death; love and joy belong to wellness but can neither be planned for nor made to happen. In keeping with the coloniality of (...) which the Western medical system is a part, the normative stance for caregiving in the ICU does not take into account the complexity and interconnectedness of communicative contact, or recognize that contact happens when unexpected. There is contact between bodies, but it is not about presence, about one body physically touching another; the contact happens elsewhere. (shrink)

This paper explores the relationship between a person's claim right not to be harmed and the duties this claim confers on others. I argue that we should reject Jonathan Quong's evidence-based account of this relationship, which holds that an agent A's possession of a claim against B is partly determined by whether it would be reasonable for A to demand B's compliance with a correlative duty. When B's evidence is that demanding compliance would not be reasonable, A cannot have a (...) claim against B. I suggest that some of the putatively problematic cases that Quong identifies can be resolved by plausibly narrowing the scope of the right not to be harmed. I also argue that Quong's view leads to implausible conclusions, and that his account of what happens to A's claim in the face of lesser-evil justifications is inconsistent with his broader view. I then defend the view that agents are required, and not merely permitted, to act on lesser-evil justifications. I further argue that A may not defend herself against the infliction of harms that are justified on lesser-evil grounds. However, she may defend herself in cases where B is only evidentially, and not objectively, justified in harming her. (shrink)

Live coding is an embodied, sensorial and live technological–human relationship that is recursively iterated through sonic and visual outputs based on what we argue are kinship relations between and through bodies and technology. At the same time, and in a familiar moment of déjà vu for feminist scholars, live coding is most often discussed not in relation to the lived and sensory human–technology kinship, but in terms of fetishised code or software, output and agency. As feminist scholars have long argued, (...) emphasising and fetishising code or software, and celebrating output and agency are normatively masculine, white and Western conceptions of technology that feed into the growing valorisation of accelerationist logic whilst also negating embodied, not to mention other (non-white, Western, masculine) bodies, expertise or histories per se. In this article, we want to redress this by drawing on our empirical material on live coding to focus on human–technology kinship and, in so doing, think about failure, slowness and embodiment and about human–technology relations that are more akin to what Alison Kafer (drawing on the work of Donna Haraway) has termed ‘becoming with’ or ‘making kin’. This, we argue, has the potential to shift the focus from the potentialities of technologies on or through the body, towards the generative capacities of mediation (including failure), which are caught up in lived experiences. The question is not only about how the relations of bodies and technologies are played out in certain circumstances but about what might be played out if we reconceptualise these relations in these terms. The advent of Artificial Intelligence (AI) and other digital technologies is touted as ushering in the fourth industrial revolution (4IR). 4IR, also known as ‘Industry 4.0,’ pertains to the burning internet connectivity, sophisticated analytics and production, and automation’s transformative impacts on the world. The surge of change in the production arena started in the second half of 2010 and has continued to increase astronomically, with a remarkable probability of shaping the future of manufacturing and humanity. The 4IR is thus heralding (...) areas such as digitalisation, artificial intelligence, cloud computing, robotics, and 3D technologies amidst many other innovative digital technologies following the first, second and third industrial revolutions. The problem this paper addresses is the role of Arts and humanities (A&H) in the era of AI. Should A&H imbibe the empirical science methodology to stay relevant? How does A&H contribute to 4IR? Leveraging on philosophical tools of arguments and reconstruction of ideas, this paper argues for the significance of Kant’s thoughts in The Contest of the Faculties and that Arts and humanities are instrumental to humanising science and technology, helping to shape interdisciplinary collaboration and fostering understanding of the ethical, social and cultural dimensions of AI. Adil Ahmad Haque argues that civilians who contribute to unjust lethal threats in war, but who do not directly participate in the war, are not liable to defensive killing. His argument rests on two central claims: first, that the extent of a person’s liability to defensive harm in virtue of contributing to an unjust threat is limited to the cost that she is initially required to bear in order to avoid contributing, and, second, that civilians need not bear lethal costs (...) in order to avoid indirectly contributing to unjust lethal threats. Miriam Solomon's social empiricism is marked by emphasis on community level rationality in science and the refusal to impose a distinction between the epistemic and the non-epistemic character of factors ("decision vectors") that incline scientists for or against a theory. While she attempts to derive some norms from the analysis of cases, her insistent naturalism undermines her effort to articulate norms for the (appropriate) distribution of decision vectors.

In February 2012, the Obama White House endorsed a Privacy Bill of Rights, comprising seven principles. The third, “Respect for Context,” is explained as the expectation that “companies will collect, use, and disclose personal data in ways that are consistent with the context in which consumers provide the data.” One can anticipate the contested interpretations of this principle as parties representing diverse interests vie to make theirs the authoritative one. In the paper I will discuss three possibilities and explain why (...) each does not take us far beyond the status quo, which, regulators in the United States, Europe, and beyond have found problematic. I will argue that contextual integrity offers the best way forward for protecting privacy in a world where information increasingly mediates our significant activities and relationships. Although an important goal is to influence policy, this paper aims less to stipulate explicit rules than to present an underlying justificatory, or normative rationale. Along the way, it will review key ideas in the theory of contextual integrity, its differences from existing approaches, and its harmony with basic intuition about information sharing practices and norms. The paper offers the outlines of a response to the often-made suggestion that it is impossible to see how indeterminism could possibly provide us with anything that we might want in the way of freedom, anything that could really amount to control, as opposed merely to an openness in the flow of reality that would constitute the injection of chance, or randomness, into the unfolding of the processes which underlie our activity. It is suggested that the best first move for (...) the libertarian is to make a number of important concessions to the compatibilist. It should be conceded, in particular, that certain sorts of alternative possibilities are neither truly available to real, worldly agents nor required in order that those agents act freely; and it should be admitted also that it is the compatibilist who tends to give the most plausible sorts of analyses of many of the 'can' and 'could have' statements which seem to need to be assertible of those agents we regard as free. But these concessions do not bring compatibilism itself in their wake. The most promising version of libertarianism, it is argued, is based on the idea that agency itself (and not merely some special instances of it which we might designate with the honorific appellation 'free') is inconsistent with determinism. This version of libertarianism, it is claimed, can avoid the objection that indeterminism is as difficult to square with true agential control as determinism can sometimes seem to be. (shrink)

What is the thesis of determinism? Though it is obvious that in principle there is more than one possible thesis that might be given this name, it seems to be the case that philosophers working on the free will problem have gradually gravitated towards a more-or-less standard definition, minor variations on which can now be found widely scattered through the free will literature. I call it the ‘entailment definition’ and it states, roughly, that determinism is the thesis that for any (...) given time, a complete statement of the facts about that time, together with a complete statement of the laws of nature, entails every truth as to what happens after that time. In this paper, I argue that acceptance of the entailment definition has been a mistake—and that we need a definition of determinism which, by contrast with the entailment definition, makes explicit mention of the notion of natural necessity. In the late 1930s networks of amateur observers across Britain were collecting data on birds , aircraft and society itself . This paper concentrates on birdwatching practice in the period 1930–1955. Through an examination of the construction of birdwatching's subjects, the Observers, and their objects, birds, it is argued that amateur strategies of scientific observation and record reflected, and were part-constitutive of, particular versions of ecological, national and social identity in this period. The paper examines how conflicts between a rural, (...) organicist Britishness and a modern, planner-preservationist Britishness were elaborated and contained within the figure of the birdwatcher and within the institutional epistemologies of the Royal Society for the Protection of Birds and the British Trust for Ornithology. Such conflicts are shown to be embedded in the structuring of visual perception in different strategies of bird and aircraft identification, particularly between analytic and gestalt methods; the paper examines, using the related ‘field-science’ of aircraft recognition, the importance of identificatory processes in the construction of the Observer, and concludes by examining whether tensions between organicist and scientific discourses were in any sense resolved by the end of this period. In this article, I discuss the structural domination of whiteness as it intersects with the potential of individual critique and reflexivity. I reflect on my positioning as a white nurse researcher while researching international nurse migration. I draw on two large qualitative studies and one small focus group study to discuss my reactions as a white researcher to evidence of institutional racism in the British health services and my growing awareness of how racism is reproduced in the British nursing profession.

Artificially intelligent systems (AISs) are being created by software developing companies (SDCs) to influence clinical decision‐making. Historically, clinicians have led healthcare decision‐making, and the introduction of AISs makes SDCs novel actors in the clinical decision‐making space. Although these AISs are intended to influence a clinician's decision‐making, SDCs have been clear that clinicians are in fact the final decision‐makers in clinical care, and that AISs can only inform their decisions. As such, the default position is that clinicians should hold responsibility for (...) the outcomes of the use of AISs. This is not the case when an AIS has influenced a clinician's judgement and their subsequent decision. In this paper, we argue that this is an imbalanced and unjust position, and that careful thought needs to go into how personal moral responsibility for the use of AISs in clinical decision‐making should be attributed. This paper employs and examines the difference between prospective and retrospective responsibility and considers foreseeability as key in determining how personal moral responsibility can be justly attributed. This leads us to the view that moral responsibility for the outcomes of using AISs in healthcare ought to be shared by the clinical users and SDCs. (shrink)

Some laws cannot yet be entirely abrogated in a current political situation, though permitting grave injustices against some individuals; for example, unborn and/or disabled individuals. In supporting the passing of new ‘imperfect’ laws that protect only some of those who now lack protection, do we ourselves discriminate unjustly against those remaining unprotected? Or does that depend on factors such as our intentions – including what we intend that others intend? How may we collaborate with colleagues who intend, and perhaps explicitly (...) defend, the continuation of remaining, closely-related injustices, although they are willing to join us in trying to improve some aspects of the status quo? This paper explores the moral constraints on our attempts to extend the law’s protection to some, but not to all, of those individuals currently deprived of such ­protection and at risk of serious harm. In 1776, the first living giant anteater to reach Europe arrived in Madrid from Buenos Aires. It survived 6 months in the Real Sitio del Buen Retiro before being transferred to the newly founded Real Gabinete de Historia Natural. In 1853, 77 years later, a second anteater was brought to London by two German showmen and exhibited at a shop in Bloomsbury, where it was visited by the novelist Charles Dickens. The animal was subsequently purchased by the Zoological Society of (...) London, which classed it as one of the most important additions to the menagerie since its formation in 1828. Drawing on recent work in animal biography, this article assesses the reception of the two anteaters and considers their cultural and scientific significance. I examine the logistics of the exotic animal trade and trace the transatlantic networks that permitted anteaters-and knowledge about them-to move between continents. I also study the modes of representation, from painting to taxidermy, that enabled the anteaters to reach new audiences. By focusing in detail on the lives of two exceptional anteaters, the article illuminates understandings of the species more broadly and shows how different spaces and places shaped the creation and dissemination of zoological knowledge. I emphasise, in particular, the tensions that emerged between imperial and colonial science and the competing knowledge regimes of the natural history museum, the menagerie, and the field. (shrink)

Quantitative risk assessment suffers from a variety of problems--some internal and others external. Dale Hattis proposes that the problems of risk assessment can be cured by the development of risk assessment theory. I agree that theory can help address some of the internal problems, such as the failure to date to take the interaction of hazardous substances with other substances in the environment into account. I argue that the external problems such as the manipulation of inherent uncertainties by the politically (...) and socially interested, however, are less amenable to rectification by theory and require political solutions. It is commonplace to observe that explanations of human behavior diverge from explanations of other sorts, though it is far from commonplace to articulate exactly what this divergence amounts to. One very obvious and rather marvelous fact about explanations in the human sciences is that the subject matter talks and sometimes literally explains itself. This dissertation is an essay about what sort of difference language participation makes to explaining what language participants do. ;Currently, action theorists are recruiting insights from philosophy (...) of natural language to shed light on the relation between actions and the reason-giving statements that explain them. The four contemporary action theorists studied here maintain that certain types of thought do cause actions. And further, they maintain that from a true reason-giving statement one can infer the particular thoughts that caused an individual action. ;In Chapter I, I show how a standard model of explanation fails to reveal how reason-giving statements convey causal thoughts. In Chapter II, I try to pinpoint how a special mode of description reserved for action can be distinguished from other ways of describing occurrences. ;Different action theorists focus on different linguistic facts from which they draw their conclusions about the nature and structure of actions themselves. In Chapter III, I examine how the difference between claims of Donald Davidson and Alvin Goldman regarding individuation of actions may be traced back to their respective ways of construing the data of talk about actions. ;In Chapter IV, I examine Jennifer Hornsby's thesis that a special form of entailment follows exclusively from sentences about actions, based on their grammatical or 'surface' form. ;In Chapter V, I study the way Donald Davidson and John Searle apply 'holistic' theories of meaning to the problem of analyzing action explanations. ;Overall the results here go a modest way, only to demonstrate that we know less today than might be supposed about reasons and actions. A violência doméstica contra a mulher é um dos mais graves problemas que a sociedade enfrenta. É uma forma de violência que não conhece fronteiras, nem obedece princípios ou leis. Ocorre diariamente em Moçambique, apesar de existir um quadro constitucional e legal que introduziu vários mecanismos de protecção aos direitos da mulher. É neste contexto que surge o presente trabalho intitulado A violência doméstica praticada contra a mulher em tempos da COVID-19, na cidade de Maputo, o caso do bairro de (...) Xipamanine, que visa compreender a violência doméstica praticada contra a mulher, bem como os seus impactos com o surgimento da pandemia COVID-19. O trabalho é importante na medida em que vai demonstrar que o caso de violência doméstica contra a mulher tem se agravado a cada ano que passa, tendo atingido níveis mais alarmantes com as medidas de combate a COVID-19. Vai dar também a conhecer a sociedade em geral, a mulher e aos infractores principalmente que a integridade física, moral, psicológica, patrimonial e sexual da mulher esta sendo protegida. O objectivo da realização desta pesquisa não só é para fornecer informações acima mencionadas, mas também incentivar as vítimas que denunciem, não fiquem caladas, não se intimidem, de forma que este mal seja combatido.
