This paper defends a version of the Simple View, the claim that someone intentionally φs only if the person intends to φ. To do this, I raise a problem for Bratman’s classic argument (1984, 1987) against it. The problem brings into focus an evaluative dimension behind the View, whose recognition allows for an improved version of it. With this improved version, I then go on to answer other criticisms that have been raised to it.

In this article, I examine recent debates concerning the existence and the nature of basic actions. The discussion is structured around four theses, with which Arthur Danto introduced basic actions to contemporary theorists. The theses concern (i) the relationship between agency and causality, (ii) the distinction between basic and complex actions, (iii) the regress argument for basic actions, and (iv) the structure of practical knowledge in the light of these actions.

Nature contact has associations with emotional ill-being and well-being. However, the mechanisms underlying these associations are not fully understood. We hypothesised that increased adaptive and decreased maladaptive emotion regulation strategies would be a pathway linking nature contact to ill-being and well-being. Using data from a survey of 600 U.S.-based adults administered online in 2022, we conducted structural equation modelling to test our hypotheses. We found that (1) frequency of nature contact was significantly associated with lesser emotional ill-being and greater emotional (...) well-being, (2) effective emotion regulation was significantly associated with lesser emotional ill-being and greater emotional well-being, and (3) the associations of higher frequency of nature contact with these benefits were partly explained via emotion regulation. Moreover, we found a nonlinear relationship for the associations of duration of nature contact with some outcomes, with a rise in benefits up to certain amounts of time, and a levelling off after these points. These findings support and extend previous work that demonstrates that the associations of nature contact with emotional ill-being and well-being may be partly explained by changes in emotion regulation. This paper argues that formal models of coherence are useful for constructing a legal epistemology. Two main formal approaches to coherence are examined: coherence-based models of belief revision and the theory of coherence as constraint satisfaction. It is shown that these approaches shed light on central aspects of a coherentist legal epistemology, such as the concept of coherence, the dynamics of coherentist justification in law, and the mechanisms whereby coherence may be built in the course of legal decision-making.

This is a draft of my chapter on Negligence for the forthcoming Oxford Handbook in Moral Psychology. It discusses philosophical, psychological, and legal approaches to the attribution of culpability in cases of negligent wrongdoing.

Philosophical accounts of moral responsibility are standardly framed by two platitudes. According to them, blame requires the presence of a moral defect in the agent and the absence of excuses. In this chapter, this kind of approach is challenged. It is argued that (a) people sometimes violate moral norms due to performance mistakes, (b) it often appears reasonable to hold them responsible for it, and (c) their mistakes cannot be traced to their moral qualities or to the presence of excuses. This paper argues for a coherentist theory of the justification of evidentiary judgments in law, according to which a hypothesis about the events being litigated is justified if and only if it is such that an epistemically responsible fact-finder might have accepted it as justified by virtue of its coherence in like circumstances. It claims that this version of coherentism has the resources to address a main problem facing coherence theories of evidence and legal proof, namely, the problem of the (...) coherence bias. The paper then develops an aretaic approach to the standards of epistemic responsibility which govern legal fact-finding. It concludes by exploring some implications of the proposed account of the justification of evidentiary judgments in law for the epistemology of legal proof. (shrink)

This paper articulates an egalitarian conception of judicial humility and justifies its value on the grounds that it importantly advances the legal and political ideal of fraternity. This account of the content and value of the virtue of humility stands in sharp contrast with the dominant view of judicial humility as deference or judicial restraint. The paper concludes by discussing some ways in which the account of humility and of its value provided in the paper furthers our understanding of the (...) judicial virtues and of the political implications of giving virtue a role in adjudication. Sobre ese fondo problemático, el presente artículo se despliega en dos partes. :In this essay, I present an account of forgiveness as a process of emotional distancing. The central claim is that, understood in these terms, forgiveness does not require a change in judgment. Rationally forgiving someone, in other words, does not require that one judges the significance of the wrongdoing differently or that one comes to the conclusion that the attitudes behind it have changed in a favorable way. The model shows in what sense forgiving is inherently social, shows why we (...) should be pluralists about it, and provides a basis for arguing against the existence of necessary conditions of forgiving. Most human actions are complex, but some of them are basic. Which are these? In this paper, I address this question by invoking slips, a common kind of mistake. The proposal is this: an action is basic if and only if it is not possible to slip in performing it. The argument discusses some well-established results from the psychology of language production in the context of a philosophical theory of action. This paper examines the concept of coherence and its role in legal reasoning. First, it identifies some problem areas confronting coherence theories of legal reasoning about both disputed questions of fact and disputed questions of law. Second, with a view to solving these problems, it proposes a coherence model of legal reasoning. The main tenet of this coherence model is that a belief about the law and the facts under dispute is justified if it is “optimally coherent,” that is, if (...) it is such that an epistemically responsible legal decision-maker would have accepted it as justified by virtue of its coherence in like circumstances. Last, looking beyond the coherence theory, the paper explores the implications of the version of legal coherentism proposed for a general theory of legal reasoning and rationality. (shrink)

The purpose of this paper is to compare disagreement in two different WhatsApp groups: one for members of the same family, and another for work colleagues. After the analysis, 427 instances of disagreement were identified in the family group, and 161 in the interactions between work colleagues. The most common strategy in both corpora is ‘Giving opposite opinions’. Nevertheless, the rest of the results present very significant dissimilarities, most notably the higher presence of disagreement in the family WhatsApp group. This (...) higher tolerance for disagreement is corroborated by the choice of linguistic strategies made. Whereas the family members tended to give emotional or personal reasons for disagreement, as well as negative comments on the topic, the colleagues preferred to express their disagreement with mitigating expressions and token agreement. Thus, in the corpora studied, the expression of disagreement seems to be less face threatening for family members than for work colleagues. (shrink)

The university that Alasdair MacIntyre defines as liberal is that which rejects the tradition as something pre-modern and with an impediment for the progress, including the pedagogic one. This university model has been extended in all instances, giving priority to the technical education in a pragmatic way. Thus, the global and sapiential vision of the university has been relegated. This last approach is the key for unifying the knowledge and to pass it onto other people and, therefore, to educate and (...) mold intellectually and morally. However, the professionalization of the philosophy and the criteria of the modern liberalism seem to dominate and inspire most universities in the present day. This situation has plainly shown an inability to become aware of their incompetence to properly educate professors and students alike, in a sapiential and moral manner, threfore deceiving themselves with a naive rhetoric. Philosophers of perception are familiar with the argument from illusion, at least since Hume formulated it to challenge a naïve form of realism. In this paper, I present an analogous argument but in the domain of action. It focuses on slips, a common kind of mistake. But, otherwise, it is structurally similar. The argument challenges some contemporary views about the nature of action inspired by Wittgenstein. The discussion shows how thinking about these common mistakes helps illuminate aspects of human agency (...) that tend to be overlooked whenever too much emphasis is placed on the rationality of human actions. The fourteen essays in Thinking, Language, and Experience -- half of them written expressly for this volume -- demonstrate the breadth and richness of his recent work on the unitary structure of human experience.A comprehensive, unified study of phenomena at the intersection between experience, thinking, (...) language, and reality, this book focuses on singular reference -- that is, reference to individuals insofar as they are thought of as individuals: indicators, quasi-indicators, proper names, singular descriptions. Castañeda establishes a large number of new facts -- linguistic, semantic, psychological, and sociological -- about the workings of language in human experience, and from them develops a network of new theories, all grounded in his comprehensive Guise Theory.These theories offer a systematic account for: the structure of human experience and the world at large; the mental powers required to think of the world and to undergo experiences; self-consciousness; the language for thinking of other minds; perception and the interaction between indexical reference and perceptual fields; and the role of subjectivity in perception and intentional action. The aim of this essay is to develop a coherence theory for the justification of evidentiary judgments in law. The main claim of the coherence theory proposed in this article is that a belief about the events being litigated is justified if and only if it is a belief that an epistemically responsible fact finder might hold by virtue of its coherence in like circumstances. The article argues that this coherentist approach to evidence and legal proof has the resources to (...) meet some of the main objections that may be addressed against attempts to analyze the justification of evidentiary judgments in law in coherentist terms. El presente artículo presenta una serie de apuntes que buscan una aproximación a la dimensión política del concepto de ritornelo en Deleuze, por ello, no posee un carácter concluyente sino que su única pretensión es mostrar una problemática implícita, nos parece, en el ritornelo y su dimensión política, es decir, la expresión de la dimensión política en la relación del ritornelo con el cuerpo, dicha relación, nos mostraría al acto de resistencia como una alternativa política. Para ello; en el primer (...) apartado se revisan algunas características del ritornelo que, a nuestro criterio, son imprescindibles para comprender su dimensión política. En el segundo apartado presentamos una serie de apuntes que permiten aproximarnos a su dimensión política y al modo como ésta se relaciona con la creación de un Cuerpo sin Órganos problematizando dicha relación y mostrando que ésta se articula a partir de la resistencia como una alternativa política. Este recorrido nos permitirá mostrar en la conclusión que efectivamente existe una relación entre el ritornelo y el cuerpo sin órganos y que es solo a partir de su manifestación en el cuerpo que puede expresarse su dimensión política. This paper argues that habits, just like beliefs, can guide intentional action. To do this, a variety of real-life cases where a person acts habitually but contrary to her beliefs are discussed. The cases serve as dissociations showing that intentional agency is possible without doxastic guidance. The upshot is a model for thinking about the rationality of habitual action and the rationalizing role that habits can play in it. La cultura jurídica latinoamericana no es, en este sentido, una excepción: hay actualmente un vigoroso grupo de juristas en la región que se ha ocupado de estudiar problemas relativos a los procesos probatorios en el Derecho...

Considerar el Derecho como" objeto de estudio" no parece comportar ninguna novedad, sobre todo si nos ubicamos en un ambiente académico. De hecho, se da por sentado que, en efecto, el Derecho puede ser ese "objeto" por todos aquellos que escogen como área de formación profesional lo jurídico. El ejercicio que se lleva a cabo sobre él se torna casi siempre repetitivo y memorístico, pero pronto se aprende que, en la práctica, el resultado de erudición que ello produce rendirá buenos (...) frutos mañana. El estudiante "aprende derecho" apropiándose una terminología y adquiriendo la habilidad de ponerla en acto cuando sea el momento oportuno, haciendo así uso de una técnica que, sin embargo, no siempre producirá los resultados esperados. Una "técnica" cargada de albur. Las más de las veces, el ya profesional del derecho se consuela de sus tropiezos y fracasos "reconociendo" que "no siempre se tiene la razón" -en el mejor de los casos-, o acusando a propios y extraños de hacer un uso manipulativo o injusto de la herramienta. Se sabe que, además de lo competido que es el campo, se encuentra plagado de incertidumbres por la enorme carga de "subjetividad" que supone no solo su aplicación, sino la creación misma de sus componentes. The present article aims at postulating cannibalism as a fundamental axis for the analysis of the processes of subjectivation of Spanish America since the 15th century. The hypothesis is that this process has gone through three stages, which allow for the delimitation of the differences of what I shall refer to, for now, as regimes of cannibalism understood as subjectivation processes:(i) Anthropophagic or of ritual war.(ii) Mimetic or of colonial incorporation(iii) Iconic or of mediatic absorption, at a global level.In order (...) to construct the regimes of cannibalism as a concept I have chosen to use two perspectives: the one which speaks of the ritual experimentation of anthropophagy from the inside and the one which moves through the variants of that double desire for the other’s desire that makes every process of colonization possible; in the known forms of territorial annexation, incorporation (productive, spiritual, institutional) and absorption by the global system of mediatization. En este artículo se sostiene que existe una primacía de la práctica y la acción sobre el conocimiento intelectual y la contemplación. Si esta tesis fuese falsa, no resulta comprensible por qué la prudencia y el hombre prudente son la virtud suprema y el modelo de la vida buena en Aristóteles. La cuestión inicial es 1) ¿Cómo entender la racionalidad del deseo o qué significa deseo razonado?, y esto implica dos cuestiones adicionales: 2) ¿Qué es el silogismo práctico y qué (...) relación tiene con la recta razón? y 3) ¿cuál es la relación entre el razonamiento práctico, la prudencia y el hombre prudente? Estas cuestiones son analizadas para establecer algunas de las semejanzas y diferencias entre el silogismo práctico , los diversos tipos de inferencias prácticas y otros tipos de razonamientos, tratando de mostrar la relación que existe entre la formación del carácter o modo de ser, la recta razón y el silogismo práctico. Some concepts widely used in science are fundamental keys in the work of Mariano Artigas. Words like ‘order’, ‘dynamism’, ‘activity’, ‘chaos’, ‘randomness’, ‘patterns’, ‘structure’, ‘emergence’ or ‘complexity’, which are also used in other fields of thinking, have been used to build M. Artigas’ worldview. From this point of view, he presents the existence of philosophical bridges to overcome the methodological gaps between science and religion. Since the years in which Artigas wrote his work up to now, the scientific meanings of (...) many of these concepts have evolved until reaching today a better level of accuracy, maturity and stability. This article discusses the concept of worldview in M. Artigas related to some notions he used. It is important to remark that the change in the meaning of some words does not affect the general framework introduced by M. Artigas. His understanding of the relations between science and religion still preserves both validity and profit. (shrink)

Detecting intrusions in large networks is a highly demanding task. In order to reduce the computation demand of analysing every single packet travelling along one of such networks, some years ago flows were proposed as a way of summarizing traffic information. Very few research works have addressed intrusion detection in flows from a visualizations perspective. In order to bridge this gap, the present paper proposes the application of a novel projection method (Beta Hebbian Learning) under this framework. With the aim (...) to validate this method, 8 traffic segments, containing many flows, have been analysed by means of this projection method. The promising results obtained for these segments, extracted from the University of Twente dataset, validate the proposed application. (shrink)

This study explores the efficacy of a specific tool – the articulation of the ideal self – in job engagement, psychological well-being, and organizational citizenship behavior. We hypothesized that employees who can visualize their jobs as part of their ideal self – in particular how it helps in its development and realization – would feel higher levels of engagement and fulfillment in their lives, as well as engage in greater amounts of helping and voice OCB. A total of 239 full (...) time employees from five companies in Costa Rica filled out the ideal self questionnaire, the job engagement, and psychological well-being surveys, and were evaluated by their peers on task behavior and helping and voice OCB. Results of the SEM model showed that the ideal self was positively related to job engagement, psychological well-being and helping and voice. These findings contribute to the research on the impact and importance for organizations to help employees find meaningfulness in their work. (shrink)
