This paper aims to provide a mathematically tractable background against which to model both modal cognitivism and modal expressivism. I argue that epistemic modal algebras comprise a materially adequate fragment of the language of thought. I demonstrate, then, how modal expressivism can be regimented by modal coalgebraic automata, to which the above epistemic modal algebras are dual. I examine, in particular, the virtues unique to the modal expressivist approach here proffered in the setting of the foundations of mathematics, by contrast (...) to competing approaches based upon both the inferentialist approach to concept-individuation and the codification of speech acts via intensional semantics. Die Logik, einst Grundbestand der Philosophie, hat sich in unserem J ahrhundert zu einer selbstandigen Wissenschaft ent 1 wickelt. Sie wird zur Abgrenzung gegeniiber friiheren Gestalten "neue Logik" oder "moderne Logik" genannt; auch sind Be zeichnungen wie "theoretische Logik", "mathematische Logik", "symbolische Logik", "formale Logik", "Logistik" gebrauch 2 lich, urn die Eigenart der grundlegenden Methoden anzudeuten. Die genannten Benennungen werden in dieser Arbeit gleichbe rechtigt gebraucht. Mit 1. M. BOCHENSKI und A. MENNE kann man unter Logistik in weiterem Sinne "die (...) Lehre vom Logikkalkiil, seinen Voraus 3 setzungen und Anwendungen" verstehen. According to Islamic law, there are rules and prohibitions that Muslims must follow in their actions and transactions. The prohibition of interest has been decisive in many actions, especially in debt. Accordingly, Muslims cannot put forward a condition of interest in their debt, nor can they take any transactions under this condition. Many jurists viewed interest not only as an excess of the debt but also as any benefit that the creditor would receive from the debtor other than the amount (...) of the loan, and they evaluated it within the scope of interest. Since the lender of “qard”, which is generally used to define the debt, should not receive anything in return and should expect its reward from Allah, this was called “qard al-hasen”, quoting the relevant verses of the Qur’an, and Muslims tried to meet their credit needs through qard al-hasen. However, in some cases, people had difficulty obtaining the credit they needed, and especially in the modern period, the need for credit has increased both individually and institutionally. Therefore, Muslims tried to meet their need for qard by resorting to different ways within the limits of the Shariʽah. While applications based on transactions such as sukuk, mudaraba and murabaha and those based on intermediary transactions such as the purchase and sale of goods or partnerships were developed, applications based on direct debt without resorting to such transactions remained almost non-existent. However, from the expressions in the books of classical fiqh, it is understood that the juʽalah, which is defined as “promising a reward in return for an action”, can be used for obtaining qard under certain conditions. In this type of juʽalah, which can be named as juʽalah ala al-iqtirad, a person in need of qard promises a certain reward from third parties to the person who provides him qard. Considering that there is a qard in question in this transaction and that the debtor pays more than the qard he has received, it is necessary to examine the opinions about this transaction's relationship with interest and its validity. The main focus of the research will be answers to questions such as the conditions that the aforementioned juʽalah transaction must meet to be valid, in what ways this transaction differs from interest-bearing transactions, and within which limits. Bu makalede Basra Muʿtezilesi kelâmcılarından Kādî Abdülcebbâr’ın “Tanrı’yı bilmeye götüren nazar vâciptir” önermesine ilişkin sunduğu epistemolojik çerçeve ele alınacaktır. Kādî Abdülcebbâr’ı bu sorunu tartışmaya iten şey, bir taraftan Tanrı’yı bilmenin bütün dinî hükümlerin dayanağı olması ve bu nedenle kelâmın kurucu ilkesi olması, öte yandan ashâbü’l-maʿârif olarak bilinen Câhız, Ali el-Esvârî, Sümâme b. Eşres gibi Muʿtezile kelâm geleneğine bağlı bazı düşünürlerin Tanrı’yı biliş tarzımızın zorunlu olduğunu ileri sürmeleri ve Ebü’l-Kāsım el-Belhî el-Kaʿbî’nin Tanrı’nın bu dünyada olduğu gibi ahirette de istidlâlî olarak bilineceğini (...) iddia etmesidir. Kādî Abdülcebbâr el-Muğnî külliyatının on ikinci cildi olan en-Nazar ve’l-meʿârif’i bu soruna ayırmış, buradaki düşünceleri öğrencisi Mankdîm tarafından Talik alâ Şerhi’l-Usûli’l-hamse’nin giriş bölümünde yeniden sunulmuştur. Kādî Abdülcebbâr Allah’ın kişiye yüklediği ilk sorumluluğun O’nu bilmeye götüren akıl yürütme olduğunu yazar. Bu önerme iki hususu içermektedir: Birincisi akıl yürütmenin gerekliliği, ikincisi ise Tanrı’yı biliş tarzımızın nazarî oluşu. Kādî Abdülcebbâr ilk olarak Tanrı’yı bilmenin neden gerekli olduğunu temellendirmeye girişir ve bunun için öncelikle vâcibi tanımlar ve kısımlarını açıklar. Ona göre akıl yürütmenin gerekliliği, Tanrı’yı bilmenin akıl yürütme dışında başka bir yolu olmamasından kaynaklanmaktadır. Gerçekte kişinin bilmesi gereken ilk şey Tanrı’dır. Dolayısıyla asl olan Tanrı’yı bilmektir. Bunun nedeni Tanrı’yı bilmenin dışında kalan konuların, Tanrı’yı bilmeye dayanmasıdır. Kādî Abdülcebbâr bunu, söz ve fiil türünden bütün dinî hükümlerin (şerâiʿ), ancak Tanrı’yı bildikten sonra hasen olacağını dile getirerek izah eder. Tanrı’yı bilmek, kendisini ihlal etmenin caiz olmadığı vâciplerdendir. Çünkü Tanrı’yı bilmeyi terk etmek kötüdür. Kötü olan şeylerden sakınmanın gerekliliği aklen sabittir. O hâlde Tanrı’yı bilmeyi terk etme kötülüğünden sakınmak, Tanrı’yı bilmekle mümkün olacağı için Tanrı’yı bilmek gereklidir. Tanrı’yı bilmek akıl yürütmeyle gerçekleştiği için de akıl yürütme, Tanrı’nın bilinmesi gereken ilk şey oluşundan bir pay alarak ilk konuma yükselmektedir. Buradan çıkan ilk sonuç, kişinin mükellef olduğu ilk şeyin Tanrı’yı bilmeye götüren akıl yürütme olduğudur. Kādî Abdülcebbâr, Tanrı’ya ilişkin bilginin nazarîliğini ise Tanrı’nın ne zarurî olarak ne de müşahede ile bilinemeyeceğini göstererek temellendirmeye çalışmaktadır. Bu bağlamda o bilginin neliğini ve türlerini tartışmaya açar. Kādî Abdülcebbâr’ın farklı kelâm eserlerinde yaptığı bilgi tanımlarında ortak olan şey, bilginin “gerekçelendirilmiş doğru inanç” şeklindeki tanımıdır. Bilginin inanç türünden olduğunu düşünen Kādî Abdülcebbâr, aynı zamanda bu inancın doğru olması gerektiğini ve kişinin bu inancına yönelik nefsinin sâkin olması gerektiğini ifade eder. Ardından zorunlu bilgi ve zorunlu bilginin türlerini ele alan Kādî Abdülcebbâr, burada insanın bilme imkanlarıyla uyumlu olarak onun biliş tarzları üzerinden Tanrı’yı bilmenin neden nazarla mümkün olduğunu, bilgilerimizin bütün türlerini ya da biliş tarzlarımızın tamamını söz konusu ederek Tanrı’yı bilmenin bunlardan hangisine dâhil olacağını soruşturur. Zorunlu bilginin ardından müşahede bilgisine yer veren Kādî Abdülcebbâr’a göre Tanrı’ya ilişkin bilgi ne zorunlu bilgiler türüne ne de müşahedeye dayalı bilgiler türüne girmemektedir. Kādî Abdülcebbâr son olarak Tanrı’nın nasıl bilineceği ya da Tanrı’ya ilişkin bilginin hangi bilgi türüne dahil edileceği meselesinin kelâmcılar arasında tartışmalı bir konu olduğunu ve Tanrı’nın teklif devam ederken bu dünyada zarurî olarak bilinmeyeceğini ifade eder. Ancak bu hususta Muʿtezile içerisinden biri Câhız ve Ali el-Esvârî gibi ashâbü’l-maârifin, diğeri Ebü’l-Kāsım el-Belhî el-Kaʿbî’nin muhalefetine yer vererek her iki yaklaşımı sırasıyla hem Tanrı’ya ilişkin bilginin neden zorunlu olamayacağını hem de Tanrı’nın ahirette neden istidlâlî olarak bilinmeyeceğini göstererek yanıtlar. İşte bu makalede Kādî Abdülcebbâr’ın Tanrı’yı biliş tarzımızın epistemolojik statüsüne ilişkin söz konusu görüşlerini analiz ederek, onun Tanrı’ya ilişkin bilginin çıkarımsallığı görüşünün dayandığı epistemolojik temeli ortaya koymaya çalışacağız. Konvansiyonel finans kurumları bu ihtiyaçlarının büyük kısmını repo-ters repo işlemleri ile karşılarken katılım finans kurumları ise faiz şüphesi nedeniyle repo-ters repo katılım bankacılığı ilkelerine uymadığı için bu ihtiyaçları karşılama konusunda problemler yaşamaktadır. Bu durum konvansiyonel finans kurumları ile rekabet halindeki katılım finans kurumları aleyhine işlemektedir. Bu makale repo işlemini ana hatlarıyla açıklayıp fıkhi boyutunu izah ettikten sonra Malezya’daki geri alım vaadi ile satım, Türkiye’deki (...) geri alım vaadi ile satım, organize teverruk, menkul kıymet rehinli karz sözleşmesi ve puantaj sistemi ile tekaruz anlaşması gibi halihazırda İslam dünyasında katılım finans kurumlarının repoya alternatif olarak uyguladıkları işlemleri ele almaktadır. Öte yandan bu çalışma kira sertifikalarının geri alım vaadi ile satımı, yatırım fonları, kira sertifikalarının alım satımı ile teverruk işlemi için katılım finans ilkelerine uygun bir pazar kurulması ve devlet destekli karz-ı hasen fonlarının kurulması gibi katılım finans kurumları adına repoya alternatif olarak düşünülen öneriler üzerinde yoğunlaşmaktadır. Muhyiddîn el-Kâfiyecî (öl. 879/1474), on beşinci yüzyıl Saruhanoğulları, Osmanlı ve Memlüklü alimlerindendir. Yüzden çok eser yazmıştır. Makale Kâfiyeci’nin hayatı ve eserlerini araştırır. Yazdığı eserler, onun, Arap dili, Arap grameri, belagat, tarih metodolojisi, hadis ve usulü, tefsir ve usulü, fıkıh ve usulü, kelâm, tasavvuf, dil felsefesi, semantik, metafizik meseleler, geometri, optik ve astronomi gibi konularda uzmanlaştığını göstermektedir. Kâfiyeci en önemli eserlerini Arap dili ve mantık sahalarında yazmıştır. Eserleri içerisinde yaptığı linguistik çözümlemeler, onun yetkin bir dil alimi olduğunu göstermektedir. Kâfiyeci eserlerini yazarken (...) linguistik, mantıki, ilmi ve felsefi bir yöntem kullanmıştır. Araştırmada, Kâfiyeci’nin, hayatı boyunca en az yüz on iki eser yazdığı tespit edilmiştir. Ḥadīths have been preserved and recorded in various ways since the Companions. These activities continued dur-ing the Tābiīn (the successors of the Companions) Period. So much so that these methods have formed the infra-structure of other methods that will emerge later. In this context, before the 70's (A.H.), works named al-Aṭrāf appeared. However, these first works consisted of the notes that they wrote some of the ḥadīths before coming to the science assemblies to help students remember in ḥadīth learning. Ḥadīth (...) scholars have adopted and applied this method in a very short time. Thus, this method also provided the opportunity for the formation of the first written ḥadīth documents. In addition, with the writing of ḥadīth works, it has turned into a system of al-Taṣnīf and al-Takhrīj in order to make maximum use of these books and to reach the source of a narration that is tried to be found. As a result, al-Aṭrāf literature, which can be evaluated as index, has emerged. As a matter of fact, the first examples of this literature, arranged alphabetically according to the names of the Companions or ḥadīth texts, started to be given since the 4th (A.H.) century. In this way, the way to quickly benefit from the accumulation of the ḥadīth area has been opened. This article focuses on the historical adventure of al-Aṭrāf and their contributions to the ḥadīth field, as well as literature knowledge of the works of al-Aṭrāf which are of great importance for both al-Kitābah, al-Taṣnīf and al-Takhrīj.Summary: In order to understand and practice the religion of Islām, great efforts have been made both in the past and later periods in order to convey the words, verbs, interpretations and qualifications of the Prophet to the next genera-tions as they are protected from all kinds of falsification and changes. This process, which started with memoriza-tion and partly writing at the beginning, has gained momentum with the use of other methods since the period of Tābiīn. In this context, the method of aṭrāf was started to be used to facilitate memorization, to be a reminder, and to transmit the ḥadīth through the hearing of the ḥadīth sheikh. The first examples of this method were seen by Muḥammad b. Sīrīn during his participation of his teacher Abīde/Ubayda Salmān in the scholarly assembly. At this stage, the relevant method was manifested as writing a passage from the beginning of the ḥadīth. Thus, the aforementioned method, which had great contributions in recording and memorizing ḥadīths in accordance with the original, has gained widespreadness and application among the ḥadīth scholars like Ubeydullaḥ b. Omar, Shu’bah b. al-Ḥajjāj, Sufyān as-Sawrī, Mālik b. Anas, Ismāīl b. Ayyāş and Vakī b. Jarrāḥ in a very short time. In this context, Yazīd b. Zuray’ stated that he went to his teacher without his aṭrāf work of ḥadīths which he transmitted from Shu’bah and listened to ḥadīth in this way. Therefore, this mentioned event is important in terms of putting forth that Shu’bah allowed the aṭrāf method in his assemblies. The method was used by Aḥmad b. Ḥanbal, who traveled to Madīnah to convey the reports recorded with the mentioned method of his teacher Abū Alḳama al-Farawī and at the same time listen to the related transfers from him, but who could not reach his goal. Therefore, the related narrations show that aṭrāf method was used effectively by ḥadīth scholars to remember the ḥadīths in the 1st and 2nd centuries, so sections from the narrations were written during the preparatory stage before coming to the scholarly assembly. Ultimately, the importance of these works, which manifest in different ways and offer great contributions to writing, is an undeniable reality for the history of ḥadīth.Aṭrāf, the plural form of taraf that literally means the side and edge of something, mean a section, phrase or first part that indicates the whole of the ḥadīth. This method, along with the formation of ḥadīth literature, has been started to be given as a name to the works organized alphabetically according to the name of the Companions or ḥadīth texts by mentioning some of the ḥadīths with the 4th century. In this sense, aṭrāf has started to become a unique literature in a sort of taṣnīf and takhrīj method in order to make use of the ḥadīth writing easier.Aṭrāf studies may aim to bring together the isnāḍs (chains of transmitters) in all books, or they can be limited to the chains in certain books. Aṭrāf books contain the ḥadīths in the Ṣaḥīḥān or Kutub al-Sittah and are written in alphabetical form based on the name of the companions or according to the texts of ḥadīth. The first of these, which has the attribute of the musnad in a sense, is arranged in alphabetical order according to the name of the Companion, and if there are many people who narrate from him, according to the names of the tābiīn and taba-i tābiīn (successors of the tābiīn). Accordingly, the narrations of each companion were determined and listed in al-phabetical order in aṭrāfs in musnad-type, and a passage was written from the ḥadīths and marked as books/chapters in the places of relevant narration. On the other hand, the second type of aṭrāf books were ar-ranged by giving a few words from a section that allows remembering the head or all of the ḥadīths without in-cluding chains, and then placing these texts in alphabetical order.The type of aṭrāf offers the opportunity to see different chains of narrations together and provides many facilities for the ḥadīth researchers. Therefore, ḥadīth researchers show great interest in this genre. Aṭrāfs provide many benefits for both ḥadīth chain and text. In this respect, it is possible to talk about many advantages of the ḥadīth to its transmister such as the determination of mutawātīr, garīb, azīz, mashhūr, mutābī or the testimony of ḥadīth; to provide facility to make a reputation research of a riwāyah (narration), to provide an opportunity to determine the location of the narrations in the primary sources; to detect the link or any blackout in the chain, to reach the nu-merical knowledge of ḥadīth narrated by a companion or other narrators, to obtain information about narrators whose identity is not explicitly stated, to know the first narrator, to provide the protection of the ḥadīths from taḥrīf or alteration, to give the opportunity to identify the subject they contain, to be able to obtain text integrity by getting various chains, the detection of the sabab al-wurūd (the context of ḥadīth).Due to the contributions we have mentioned above, many books on aṭrāf literature that started with Abu’l-Ḥasen Ali b. Omar ad-Dārakutnī have been published. Among them Aṭrāfu’s-ṣaḥīḥayn/el-Jem`u bayna’s-ṣaḥīḥayn by Abū Mas`ūd Ibrāhīm b. Muḥammad b. Ubayd ad-Dimashkī, Aṭrāfu’s-ṣaḥīḥayn by Abū Muḥammad Ḥalaf b. Muḥammad b. Ali al-Vasiṭī, Zaḫāiru’l-mavārīs fi’d-dalālati alā mavāzi`i’l-hadīs by Abdülganī b. İsmāīl en-Nāblūsī and Tuḥfatu’l-ashrāf bi ma`rifati’l-aṭrāf by Abu’l-Ḥajjāj Yūsuf b. Abdurrahman el-Mizzī can be mentioned. Some of the related works are arranged in musnad style while others are arranged according to the first word of ḥadīth texts. As a result, the method of aṭrāf has become a kind of indexer in order to facilitate reaching the source of the re-ports and make the highest level of use required by the classification and bookings of the ḥadīths in the 3rd centu-ry. These works, arranged alphabetically in the name of the Companions or according to the texts of the ḥadīth, have taken their place in the history of the ḥadīth with their many examples, both in the form of taṣnīf and the method of takhrīj by mentioning a part of the ḥadīth by the head. It is well-known that Ibn al-Salāh al-Shahrazūrī (d. 643/1245) has an important place in the field of hadith methodology. In this context, it is possible to see Ibn-al Salah’s influence in a large proportion of the hadith terminology. The fact that the term ḥasan was not substantially included in the hadith method studies before Ibn-al Salah and that this concept became widely known in the field after him led to study the contributions of al Salah on the subject of ḥasan (...) hadith and in this regard, his effect on the term ḥasan. As result it was found that authorities such as Shāfiʿī (d. 204/820), ʿAlī b. al-Madīnī (d. 234/848-49), Ahmad b. Hanbal (d. 241/855) used the concept of ḥasan in various meanings before al-Tirmidhī (d. 279/892) who, according to general acceptance, made the term ḥasan famous for its terminological use. However, it is possible to say that ʿAlī b. al-Madīnī was the first to use the terminological meaning of the concept ḥasan. Actually, the fact that Shafii’ used the term ḥasan isnād for an authentic hadith that al-Bukhārī (d. 256/870) and Muslim b. Ḥajjāj (d. 261/875) would later unanimously narrate, and Ahmad b. Hanbal used ḥasan as gharib, is evidence for the unsystematic use of the term in the early periods. Even though, thanks to al-Tirmidhī, an important place was opened for the concept in riwāya literature, there was no serious mention of the term in later hadith methodology. Therefore, it has been seen that hadith scholars considered the term ḥasan within the scope of ṣaḥīḥ or ḍaʻīf hadith, since they accepted the term as an intermediate concept, and for this reason they did not include the term ḥasan among the subjects of hadith methodology until Ibn al-Salāh. An examination of the argument, that one can act upon a ḍaʻīf hadith, would show that ḥasan hadith might have been interpreted within the scope of ḍaʻīf hadith. On the other hand, the fact that some scholars such as Mughulṭāy b. Qilīj (d. 762/1361) state that a hadith would be called ṣaḥīḥ if it is maqbūl with any presumption, and that there is no point in calling such a hadith ḥasan shows that the ḥasan hadith is considered within the scope of ṣaḥīḥ hadith. The fact that hadith methodology scholars did not mention ḥasan hadith before Ibn al-Salāh stems from the ambiguity of the subject. Contrary to his predecessors, Ibn al-Salāh tried to save the term ḥasan from its ambiguity by combining the different specifications put forward by al-Tirmidhī, al-Khaṭṭābī (d. 388/998), and Ibn al-Jawzī (d. 597/1201). The specifications and interpretations of the term presented by Ibn al-Salāh via his meticulous efforts, have also been adopted by his successors. The term ḥasan hadith has gained an important place in the literature of hadith methodology thanks to the views and definitions built on the descriptions and interpretations of Ibn al-Salāh. In this context, while there are those who agree with Ibn al-Salāh’s descriptions and evaluations of the term, there are also those who criticize his remarks on the subject. However, it has been seen that those who criticize Ibn al-Salāh, along with those who follow him, criticized him by following the path drawn by Ibn al-Salāh. Based on this and similar situations, it was concluded that not only the descriptions and comments that Ibn al-Salāh made, but also his style and methods of handling the subject gave direction to the studies on hadith methodology. In addition, it has been observed that the most compact description of the term ḥasan is put forward by Ibn Hajar and today’s studies are predicated on his description. Within this framework, after emphasizing that there are four degrees of maqbūl hadiths, Ibn Hajar defined the two fields, which were covered by two different descriptions of Ibn al-Salāh, as ḥasan li-zatih and lighairih by Ibn al-Ḥajar. (d. 852/1449) By doing so Ibn al-Ḥajar gave the final shape to the ḥasan hadith terms. He also captured the fundamental point where ḥasan hadith differs from the ṣaḥīḥ hadith because the basic point in question, which was not directly stated before, is a slight flaw in the narrator’s grip. At the end of the study, it was concluded that -as al-Dhahabi (d. 748/1348) also stated- it does not seem possible to determine a comprehensive rule that gathers ḥasan hadiths under a single description. Considering the historical context of the term ḥasan, it has been observed that the most effective description of the ḥasan hadith are the terms ḥasan li-zatih and ḥasan lighairih, which were put forward by Ibn Hajar by transforming the dual division mentioned by Ibn al-Salāh into a more understandable form.
