There is a fine balance between civil liberties and protection of the public’s health.Legislators, especially those in the western United States, are concerned about selling the Model State Act because of the loss of civil liberties. State constitutions give governors broad powers, such as declaring martial law and giving public health leaders the authority to act. State laws should consider issues such as property rights; taking of businesses and supplies; quarantine and isolation; due process; coordination among states, counties and cities; (...) communication systems; conscription of doctors and nurses; and compensation. The discretionary powers of welfare state professionals are in tension with the requirements of the democratic Rechtsstaat. Extensive use of discretion can threaten the principles of the rule of law and relinquish democratic control over the implementation of laws and policies. These two tensions are in principle ineradicable. But does this also mean that they are impossible to come to grips with? Are there measures that may ease these tensions? We introduce an understanding of discretion that adds an epistemic dimension (...) (discretion as a mode of reasoning) to the common structural understanding of discretion (an area of judgment and decision). Accordingly we distinguish between structural and epistemic measures of accountability. The aim of the former is to constrain discretionary spaces or the behaviour within them while the aim of the latter is to improve the quality of discretionary reasoning. The focus in this article is on epistemic measures that are internally related to the main characteristic of accountability, namely justified use of discretionary power. (shrink)

Mental and neural states are related to one another by vertical interlevel relations and by horizontal intralevel relations. For particular choices of such relations, problems arise if causal efficacy is ascribed to mental states. In a series of influential papers and books, Kim has presented his much discussed “supervenience argument,” which ultimately amounts to the dilemma that mental states either are causally inefficacious or they hold the threat of overdetermining neural states. Forced by this disjunction, Kim votes in favor of (...) overdetermination and, ultimately, reduction. We propose a perspective on mental causation that dissolves the assumption of a tension between horizontal and vertical determination. For mental states to be causally efficacious, they must be dynamically stable. This important requirement can be implemented by combining a key idea of supervenience, multiple realization, with the recently introduced vertical interlevel relation of contextual emergence. Recent research on agricultural innovation has outlined social networks’ role in diffusing agricultural knowledge; however, so far, it has broadly neglected the socio-spatial dimensions of innovation processes. Against this backdrop, we apply a spatially explicit translocal network perspective in order to investigate the role of migration-related translocal networks for adaptive change in a small-scale farming community in Northeast Thailand. By means of formal social network analysis we map the socio-spatial patterns of advice sharing regarding changes in sugarcane and rice farming (...) over a period of five years. We find that, in translocally connected and mobile rural communities, a substantial share of advice originates from translocal levels. Translocal advice is dominantly provided through weak and formal ties with extension agencies and shared by few highly central larger-scale farmers within sparse local networks. This draws the picture of top-down translocal innovation flows driven by extension agencies and brokered through elite farmers. A closer look on institutional context and key actors of particular changes, however, suggests the potential of migration-related translocal networks and migration experience in fostering bottom-up innovations. Migration-related innovations transfers can promote adaptive capacity also among less favorably connected actors, especially if changes are geared towards limited household resources and are compatible with social practices of small-scale farming. We conclude that a translocal network perspective is instructive for research and extension interested in leveraging more inclusive agricultural innovation. (shrink)

A curious feature of Belnap’s “useful four-valued logic”, also known as first-degree entailment (FDE), is that the overdetermined value B (both true and false) is treated as a designated value. Although there are good theoretical reasons for this, it seems prima facie more plausible to have only one of the four values designated, namely T (exactly true). This paper follows this route and investigates the resulting logic, which we call Exactly True Logic.

Withholding or withdrawing life-saving ventilators can become necessary when resources are insufficient. In the USA, such rationing has unique social justice dimensions. Structural elements of dominant allocation frameworks simultaneously advantage white communities, and disadvantage Black communities—who already experience a disproportionate burden of COVID-19-related job losses, hospitalisations and mortality. Using the example of New Jersey’s Crisis Standard of Care policy, we describe how dominant rationing guidance compounds for many Black patients prior unfair structural disadvantage, chiefly due to the way creatinine and (...) life expectancy are typically considered.We outline six possible policy options towards a more just approach: improving diversity in decision processes, adjusting creatinine scores, replacing creatinine, dropping creatinine, finding alternative measures, adding equity weights and rejecting the dominant model altogether. We also contrast these options with making no changes, which is not a neutral default, but in separate need of justification, despite a prominent claim that it is simply based on ‘objective medical knowledge’. In the regrettable absence of fair federal guidance, hospital and state-level policymakers should reflect on which of these, or further options, seem feasible and justifiable.Irrespective of which approach is taken, all guidance should be supplemented with a monitoring and reporting requirement on possible disparate impacts. The hope that we will be able to continue to avoid rationing ventilators must not stand in the way of revising guidance in a way that better promotes health equity and racial justice, both to be prepared, and given the significant expressive value of ventilator guidance. This essay argues that Oscar Wilde noticeably contributed to the emerging discourse about world literature, even though his views in this regard have to be unearthed from the margins of his works, from his early and unpublished American lectures and ‘between the lines’ of his major critical essays. Wilde’s implicit ideas around world literature can be understood as being closely related to his broader endeavour of redirecting and revaluing the pejorative discourse around ‘decadence’ in art and literature. More specifically, the (...) arch-aesthete preferred to use the word ‘romance’ rather than ‘decadence’ (a term he hardly used at all in his writings), signalling a sensitivity attuned to what he called the ‘love of things impossible’. This reconceptualization of the decadent outlook was to inspire a critical ideal of literature which relied on creatively activating the other as Other, culminating in a vision of intersubjective, transcultural and unlimited literary communication. Wilde’s thought can be more specifically understood as anticipating central tenets of Gayatri Chakravorty Spivak’s evocations of the planetary, thus preparing the way for an alterity-oriented understanding of literary cosmopolitanism. If Harr emphasizes that things become social objects only within particular storylines, Pietz makes the reverse point about the essential materiality of social relationships, especially contractual ones, e.g. as expressed in the legal history of the `material consideration'. Departing from a similar conception of the performative micro-reproduction of social order and the communicative objectification of social facts, he argues that a theory of forensic objects as social facts disrupts not only capitalist presumptions about economic objects as the sole origin (...) of monetary value but also enlightenment conceptions of society as a sphere of consequential human action distinct from nature as the sphere of material causality. The material consideration is one such forensic object. A `material consideration' refers to an obscure but important social object that embodies the power to transform subjective promises into objective obligations and thereby establishes the social fact of legal liability. The failed attempt of liberal philosophers and jurists since the eighteenth century to conceive considerations as mere symbolic evidence of subjective moral intent rather as real enactments of social power demonstrates how difficult it is for modern social theory to articulate the idea of social materiality found in social facts such as considerations, at least as long as it sustains a strict separation between society and nature or between the intentional action of humans and the physical causality of material objects. The Covid‐19 pandemic needs to be considered from two perspectives simultaneously. First, there are questions about which policies are most effective and fair in the here and now, as the pandemic unfolds. These polices concern, for example, who should receive priority in being tested, how to implement contact tracing, or how to decide who should get ventilators or vaccines when not all can. Second, it is imperative to anticipate the medium‐ and longer‐term consequences that these policies have. The case of (...) vaccine rationing is particularly instructive. Ethical, epidemiological, and economic reasons demand that rationing approaches give priority to groups who have been structurally and historically disadvantaged, even if this means that overall life years gained may be lower. Don Ihde has recently launched a sweeping attack against Husserl’s late philosophy of science. Ihde takes particular exception to Husserl’s portrayal of Galileo and to the results Husserl draws from his understanding of Galilean science. Ihde’s main point is that Husserl paints an overly intellectualistic picture of the “father of modern science”, neglecting Galileo’s engagement with scientific instruments such as, most notably, the telescope. According to Ihde, this omission is not merely a historiographical shortcoming. On Ihde’s view, it is only (...) on the basis of a distorted picture of Galileo that Husserl can “create“ the division between Lifeworld and the “world of science“, a division that is indeed fundamental for Husserl’s overall position. Hence, if successful, Ihde’s argument effectively undermines Husserl’s late philosophy of science. The aim of this paper is to show that Ihde’s criticism does not stand up to closer historical or philosophical scrutiny. (shrink)

Ontology, the ideas we have about the nature of reality, and epistemology, our concepts about how to gain knowledge about the world, are interdependent. Currently, the dominant ontology in science is a materialist model, and associated with it an empiricist epistemology. Historically speaking, there was a more comprehensive notion at the cradle of modern science in the middle ages. Then “experience” meant both inner, or first person, and outer, or third person, experience. With the historical development, experience has come to (...) mean only sense experience of outer reality. This has become associated with the ontology that matter is the most important substance in the universe, everything else—consciousness, mind, values, etc., —being derived thereof or reducible to it. This ontology is insufficient to explain the phenomena we are living with—consciousness, as a precondition of this idea, or anomalous cognitions. These have a robust empirical grounding, although we do not understand them sufficiently. The phenomenology, though, demands some sort of non-local model of the world and one in which consciousness is not derivative of, but coprimary with matter. I propose such a complementarist dual aspect model of consciousness and brain, or mind and matter. This then also entails a different epistemology. For if consciousness is coprimary with matter, then we can also use a deeper exploration of consciousness as happens in contemplative practice to reach an understanding of the deep structure of the world, for instance in mathematical or theoretical intuition, and perhaps also in other areas such as in ethics. This would entail a kind of contemplative science that would also complement our current experiential mode that is exclusively directed to the outside aspect of our world. Such an epistemology might help us with various issues, such as good theoretical and other intuitions. (shrink)

It is widely accepted that consciousness or, more generally, mental activity is in some way correlated to the behavior of the material brain. Since quantum theory is the most fundamental theory of matter that is currently available, it is a legitimate question to ask whether quantum theory can help us to understand consciousness. Several approaches answering this question affirmatively, proposed in recent decades, will be surveyed. It will be pointed out that they make different epistemological assumptions, refer to different neurophysiological (...) levels of description, and use quantum theory in different ways. The paper provides a series of responses to the papers published in Vol. 37, No. 3, of this journal that explored the ideas in Harald Wohlrapp’s The Concept of Argument, where arguing is understood as the theoretical or theory-forming activity that can be found in research of all kinds. Thus, the approach taken focuses on the validity of theses. This approach is clarified further as the author considers points raised by his commentators and provides answers and, where necessary, corrections.

Dual-aspect monism and neutral monism offer interesting alternatives to mainstream positions concerning the mind-matter problem. Both assume a domain underlying the mind-matter distinction, but they also differ in definitive ways. In the twentieth century, variants of both positions have been advanced by a number of protagonists. One of these variants, the dual-aspect monism due toWolfgang Pauli and Carl Gustav Jung, will be described and commented on in detail. As a unique feature in the Pauli-Jung conception, the duality of mental and (...) material aspects is specified in terms of a complementarity. This sounds innocent, but entails a number of peculiarities distinguishing their conjecture from other approaches. (shrink)

The success of medicine in the treatment of patients brings with it new challenges. More people live on to suffer from functional, chronic or multifactorial diseases, and this has led to calls for more complex analyses of the causal determinants of health and illness. Philosophical analysis of background assumptions of the current paradigmatic model. While these factors do not require a radical paradigm shift, they do give us cause to develop a new narrative, to add to existing narratives that frame (...) our thinking about medical care. In this paper we argue that the increased focus on lifestyle and shared decision making requires a new narrative of agency, to supplement the narrative of “the patient”. This narrative is conceptually linked to the developing philosophy of person-centred care. If patients are seen also as “agents” this will result in a substantial shift in practical decisions: The development and adoption of this narrative will help practitioners work with patients to their mutual benefit, harnessing the patients’ motivation, shifting the focus from treatment to prevention and preventing unnecessary and harmful treatments that can come out of our preoccupation with the patient narrative. It will also help to shift research efforts, conceptual and empirical, from “treating” and “battling” diseases and their purported “mechanisms” to understanding complex contributing factors and their interplay. Philosophical discourse traditionally distinguishes between ontology and epistemology and generally enforces this distinction by keeping the two subject areas separated. However, the relationship between the two areas is of central importance to physics and philosophy of physics. For instance, many measurement-related problems force us to consider both our knowledge of the states and observables of a system and its states and observables independent of such knowledge. This applies to quantum systems in particular. This contribution presents an example showing the importance (...) of distinguishing between ontic and epistemic levels of description even for classical systems. Corresponding conceptions of ontic and epistemic states and their evolution are introduced and discussed with respect to aspects of stability and information flow. These aspects show why the ontic/epistemic distinction is particularly important for systems exhibiting deterministic chaos. Moreover, this distinction provides some understanding of the relationships between determinism, causation, predictability, randomness, and stochasticity. (shrink)

The aim of this paper is to show that scientific thought experiments and works of science fiction are highly suitable tools for facilitating and increasing understanding of science. After comparing one of Einstein’s most famous thought experiments with the science fiction novel “The Forever War”, I shall argue that both proceed similarly in making some of the more outlandish consequences of special relativity theory intelligible. However, as I will also point out, understanding in thought experiments and understanding in science fiction (...) differ in one important respect: While the former aim at what I shall call “physical understanding”, science fiction novels typically have “existential understanding” as their target. Much in Responsible Research and Innovation (RRI) is part of a participatory turn within the Technology Assessment (TA) and Science and Technology Studies (STS) community. This has an influence also on the evaluation of Climate Engineering (CE) options, as it will be shown by reference to the SPICE project. The SPICE example and the call for democratisation of science and innovation raise some interesting concerns for the normative evaluation of CE options that will be addressed in the paper. It is (...) by far not clear, or so it will be argued, how much of the innovation process of CE technologies should be put in the hands of social actors and the wider public. This is due not only to special features about CE technologies but also to some more principle concerns against some features of participatory RRI approaches. Still, this does by no way mean that ethical and societal issues in the context of CE technologies should be ignored. Rather, the paper will argue that one can take a step back to expert TA linked to the evolution of approaches of ethical impact analysis in this area. This does not only lead to reconsider the emphasis on participation and democratisation of research and innovation, but also opens up for an alternative evaluative framework for CE technologies developed in the last part of the paper. The emergence of mental states from neural states by partitioning the neural phase space is analyzed in terms of symbolic dynamics. Well-defined mental states provide contexts inducing a criterion of structural stability for the neurodynamics that can be implemented by particular partitions. This leads to distinguished subshifts of finite type that are either cyclic or irreducible. Cyclic shifts correspond to asymptotically stable fixed points or limit tori whereas irreducible shifts are obtained from generating partitions of mixing hyperbolic systems. These stability (...) criteria are applied to the discussion of neural correlates of consiousness, to the definition of macroscopic neural states, and to aspects of the symbol grounding problem. In particular, it is shown that compatible mental descriptions, topologically equivalent to the neurodynamical description, emerge if the partition of the neural phase space is generating. If this is not the case, mental descriptions are incompatible or complementary. Consequences of this result for an integration or unification of cognitive science or psychology, respectively, will be indicated. (shrink)

Scientific progress is achieved not only by continuous accumulation of knowledge but also by paradigm shifts. These shifts are often necessitated by anomalous findings that cannot be incorporated in accepted models. Two important methodological principles regulate this process and complement each other: Ockham's Razor as the principle of parsimony and Plato's Life Boat as the principle of the necessity to 'save the appearances' and thus incorporate conflicting phenomenological data into theories. We review empirical data which are in conflict with some (...) presuppositions of accepted mainstream science: Clinical and experimental effects of prayer and healing intention, data from telepathy, psychokinesis experiments and precognition, and anecdotal reports of macro-psychokinesis. Taken together, the now well documented possibility of these events suggests that such phenomena are anomalies that challenge some widely held beliefs in mainstream science. On the other hand, scientists often fear that by accepting the reality of these phenomena they also have to subscribe to world-models invoking ontological dualism or idealism. We suggest accepting the phenomena as real, but without questionable ontologies commonly associated with them. We outline how this might work. (shrink)

The internationally renowned physicist Harald Fritzsch deftly explains the meaning and far-flung implications of the general theory of relativity and other mysteries of modern physics by presenting an imaginary conversation among Newton, Einstein, and a fictitious contemporary particle physicist named Adrian Haller--the same device Fritzsch employed to great acclaim in his earlier book An Equation That Changed the World, which focused on the special theory of relativity. Einstein's theory of gravitation, his general theory of relativity, touches on basic questions (...) of our existence. Matter, according to Einstein, has no existence independent of space and time. It is even capable of bending the structure of space and changing the course of time--it introduces a "curvature." Gravity emerges not as an actual physical force but as a consequence of space-time geometry. Even the apple that drops from the tree follows the curvature of time and space. In this entertaining and involving account of relativity, Newton serves as the skeptic and asks the questions a modern reader might ask. Einstein himself does the explaining, while Haller explains the new developments that have occurred since the general theory was proposed. The result is an intellectual roller-coaster ride in which concepts that have entered the vernacular become clear for the first time: the Big Bang, "black holes," elementary particles, and much more.
