Hans Kelsen and Max Weber are conventionally understood as initiators not only of two distinct and opposing processes of concept formation, but also of two discrete and contrasting theoretical frameworks for the study of law. _The Foundation of the Juridical-Political: Concept Formation in Hans Kelsen and Max Weber _places the conventional understanding of the theoretical relationship between the work of Kelsen and Weber into question. Focusing on the theoretical foundations of Kelsen’s legal positivism and (...) class='Hi'>Weber’s sociology of law, and guided by the conceptual frame of the juridico-political, the contributors to this interdisciplinary volume explore convergences and divergences in the approach and stance of Kelsen and Weber to law, the State, political science, modernity, legal rationality, legal theory, sociology of law, authority, legitimacy and legality. Although it is well-recognized that Max Weber was of central importance to many of the emigre social scientists who fled Hitler, commentators have overlooked both Weber’s attempt to found a new dynamic political science that would test partisan commitments and the endeavors of emigre political scientists to develop this project. This article lays out this new Weberian political science and assesses the fate of the various attempts on the part of the emigres to translate it into their new (...) setting. It shows that Weber forged a notion of political science that combined an existential notion of politics as inexorable power struggle with a sociology of the business of politics that provided the setting in which that struggle was to take place. It also shows that the central purpose of this political science was to aid political partisans in clarifying the meaning of their political commitments by forcing them to view these commitments as they are shaped in the socio-political context that determines the struggle for power. I then show that Mannheim sought to radicalize this approach to political science by seeking to construct the political backdrop for the testing of political ideas out of a political field not out of parties, politicians, and state institutions but out of competing ideologies, each of which could be shown to have some insight into the dynamics of political conflict. For Mannheim we could now test political ideas against political reality by playing them off against each other. I call this project of testing political ideas against existential and sociological notions of the political field the Weber–Mannheim project. I then show how three emigre political scientists – Arnold Brecht, Hans Morgenthau, and Franz Neumann – sought to carry on the Weber–Mannheim project in their new setting. I argue that, of the three, Franz Neumann in his great work Behemoth, was most successful in staying true to that project. For he was able to find in his analysis of the Weimar Republic and the fascist regime a way of demonstrating the dynamics under which democracy and dictatorship fail or succeed while still maintaining openings for political will. Both Brecht and Morgenthau seem to have flattened the dynamic aspect of the Weberian and Mannheimian notions of a prudential political science – though it was Morgenthau who had the most successful reception in political science. Thus, the chapters collected in _The Reconstruction of the Juridico-Political _offer a comprehensive reconsideration of these affinities and divergences, through a comparison of their respective reconstruction of the notions of democracy, the State, legal rights and the character of law. From this reconsideration a more complex understanding of their theoretical relationship emerges combined with a renewed emphasis upon the continued contemporary relevance of the work of Kelsen and Weber. Giuseppe Franco hat mich mit süditalienischer Liebenswürdigkeit dazu eingeladen, einen kleinen Beitrag zum vorliegenden Hommage-Band zu schreiben, in dem ich von meiner „intellektuellen Beziehung“ zu Dir und „von der Bedeutung des Kritischen Rationalismus“ für meinen „eigenen Denkweg“ berichte. Kennengelernt haben wir einander vor inzwischen 53 Jahren kurz nach Deinem Dienstantritt an der Mannheimer Wirtschaftshochschule. Ich studierte damals in Wien, vor allem bei Bela Juhos, der in einer Art Dachkammer der Alten Universität seine Seminare, z. B. eines über „Wissenschaftstheorie und Quantenmechanik“ (...) mit maximal zehn älteren Studenten und bereits habilitierten Wissenschaftsphilosophen abhielt, sowie beim Altmeister Victor Kraft, dessen Privatissime-Veranstaltungen in seiner Wohnung in der Walfischgasse von noch weniger, handverlesenen Geistesschaffenden besucht wurden. In Popper's Logik der Forschung, a theoretical system is a set of sentences that describe a particular sub-area of science, in particular of empirical science. The goal of axiomatizing a theoretical system is to specify a small number of "axioms" describing all presuppositions of the sub-area under consideration, so that all other sentences of this system can be derived from them by means of logical or mathematical transformations. The paper discusses two philosophical interpretations of these proper axioms. First, proper axioms (...) stipulate the use of the signs for the basic concepts of the system. Consequently, the proper axioms turn out to be analytic relative to a class of interpretations of the underlying logic. Hence, they cannot be falsified by refuting their logical consequences because these consequences are analytic as well. Secondly, proper axioms are synthetic, falsifiable and uncertain sentences. Hence, they are not immunized against falsification by refuting their logical consequences. (shrink)

The search for the extensions of sentences can be guided by Frege’s “principle of compositionality of extension”, according to which the extension of a composed expression depends only on its logical form and the extensions of its parts capable of having extensions. By means of this principle, a strict criterion for the admissibility of objects as extensions of sentences can be derived: every object is admissible as the extension of a sentence that is preserved under the substitution of co-extensional expressions. (...) The question is: what are the extensions of elementary sentences containing empty singular terms, like ‘Vulcan rotates’. It can be demonstrated that in such sentences, states of affairs as structured objects (but not truth-values) are preserved under the substitution of co-extensional expressions. Hans Peter Riegel zählt zu den wenigen Künstlern, die gleichzeitig als Autor tätig sind. Empty individual expressions are needed to reconstruct the actual use of scientific language as well as to make logic free from existence assumptions. According to Quine, a language must be extensional to be adequate for the purposes of science. By means of Lambert's non-extensionality argument it can be demonstrated that a language containing empty individual expressions cannot be extensional as long as truth-values are the extensions of sentences. This book investigates the soundness of Lambert's argument and examines the question of (...) whether and how extensionality of a language for free logic can be secured. To achieve these aims, the notion of extensionality is thoroughly analyzed and two new semantic approaches to free logic are developed in which states of affairs, but not truth-values, are the extensions of sentences. These two semantic approaches are defended against the slingshot argument. In this way, two possible solutions to the problem of extensionality arise which use non-existent objects in two different ways: whereas in dual domain semantics non-existent objects serve as referents of empty singular terms, in single domain semantics they serve as hole marker objects that mark the holes in states of affairs where an object is missing due to an irreferental individual expression. This book is an introduction to the philosophical ideas of Plato, Rene Descartes, Baruch Spinoza, and Immanuel Kant on the role of reason which have contributed to the evolution of sociological thought. Reason, according to Rickman, has a relevance to sociology that has not been explored. Because he is interested in the philosophical reflections which proved influential for understanding the social world, he deals systematically with the four philosophers' central arguments and one or more of their most important and easily (...) available texts. This volume presents a selection of Professor Rickman's essays published over a period of 40 years. They reflect his view of philosophy and defend it against attacks on two fronts. On one side the assault comes from a substantial proportion of professional philosophers particularly in the Anglo-Saxon world, who treat philosophy as a purely academic, highly technical subject, dealing merely with the clarification of concepts, the solving of logical puzzles and the refutation of similarly abstruse theories of fellow philosophers. On (...) the other side there is the widespread popular view of philosophy as dealing with abstract problems remote from everyday life and invented by philosophers in their ivory towers. IntroductionAlthough a few studies suggest that young overweight to obese children and adolescents may have impaired postural control compared to young normal-weight peers, little information exists about how these two groups differ in the quality of the underlying balance strategies employed. Hence, the aim of the present study was a first comprehensive examination of the structural complexity of postural sways in these two cohorts during quiet bilateral standing.MethodsNineteen YO secondary school students were carefully matched to YN controls for age, sex, (...) height, and school. Mediolateral and anteriorposterior acceleration signals were recorded with an inertial measurement unit positioned at the trunk while standing barefoot in two conditions: firm and foam support surface. The magnitude of postural fluctuations was obtained using the root mean square. The temporal structure of the signals was analyzed via sample entropy, largest Lyapunov exponent, and detrended fluctuation analysis algorithm. Reliability was assessed using a test–retest design.ResultsIn both groups, foam standing caused higher postural fluctuations and reduced structural complexity. In comparison to YN, YO exhibited a higher RMSAP. Especially in ML direction, the acceleration signals of the YO had higher repeatability, greater long-range correlations, and lower local stability. However, these observations were largely independent of the task difficulty. Except for α-DFAAP, the IMU approach proved reliable to characterize posture control.DiscussionOur outcomes confirm postural control deficits in YO compared to their YN peers and indicate impaired regulatory mechanisms reflected as rigidity. Such less complex patterns usually reflect diverse pathologies, are detrimental to compensate for internal or external perturbations, and are attributed to lower adaptability and task performance. Without targeted balance stimuli, YO likely end in a lifelong vicious circle of mutually dependent poor balance regulation and low physical activity. (shrink)

In the first part the text specifies Hannah Arendt's philosophical approach in three dimensions: a) She used Max Scheler's new phenomenology of living beings . b) She transformed Karl Jaspers' extraordinary limit situations of human conduct into anthropological conditions. c) Such conditions are questions that do need answers in forms of "vita active" and of "vita contemplative". Arendt moved from Max Scheler's Philosophical Anthropology to her own historical conception of the human condition inside the heterogeneity of our Occidental tradition. The (...) second part of this paper gives an overview about her network of concepts that enables a comparison of Occidental cultures via the change of dominance in relations of vita active and vita contemplative. The third part situates her approach between those of Michel Foucault and Charles Taylor in a debate that is needed at present. Her historic-phenomenological anthropology allows her a critique of modernity without a hermeneutic circle and without an anthropological circle. (shrink)

Wenige Themen begleiten das menschliche Denken so bestandig wie die Frage nach dem Unendlichen. Die Arbeit geht ihr in Schellings fruhen Schriften nach, indem sie die unendliche Sphare als Raum des absoluten Ichs mithilfe geometrischer Konzeptionen konturiert, die Konstruktion der Naturprodukte in Schellings Naturphilosophie mittels mathematischer Reihen prazisiert und die komplizierten Verhaltnisse der Identitatsphilosophie durch die Mathematik des Unendlichen erhellt.Die Studie verdeutlicht aber auch, wie bedeutsam die Philosophie fur die Mathematik ist. Nach wie vor scheidet die in der Antike bekannte (...) und fruhneuzeitlich heftig debattierte Frage nach der Existenz einer aktualen Unendlichkeit die Geister. Die Studie untersucht das Unendliche als unabschliessbaren Prozess und geschlossene Gesamtheit. Der Anspruch von Systemtheorien, bundige Erklarungsmodelle vorzulegen, ist offensichtlich nur unter der Annahme einer aktualen Unendlichkeit einlosbar. (shrink)

John McDowell argues for minimal empiricism via using the notion of second nature of human beings. I should like to invite him to discuss Helmuth Plessner's Philosophical Anthropology in order to elaborate a more substantial conception of second nature. McDowell seems to think that it is adequate for his more epistemological aim to remind us of second nature as though it were to be taken for granted. But I think, following Plessner, that this right reminder needs a therapeutic elaboration in (...) Kant's sense of propaedeutics. What had been called our second nature found itself being questioned in order to limit the range of ways of treating the self we can authorize. (shrink)

In classical physics, the world is considered as a matter-based reality, the arrangement of whose parts in time is uniquely determined by certain dynamic laws. By contrast, modern quantum physics reveals that matter is not composed of matter, but reality is merely potentiality. The world has a holistic structure, which is based on fundamental relations and not material objects, admitting more open, indeterministic developments. In this more flexible causal framework, inanimate and animate matter are not to be considered as fundamentally (...) different but as different order structures of the same immaterial entity. In a stable configuration, effectively all the uncertainties are statistically averaged out, thus the unique and deterministic behavior of ordinary inanimate matter is exhibited; whereas in the case of statically unstable but dynamically stable configurations, the “lively” features of the underlying quantum structure have a chance to surface to the mesocopic level and to be connected with what we observe as the phenomenon of life. This supposition can be more explicitly treated and clarified by identifying the electric dipole moment of biomolecules as the ordering parameter of the corresponding macroquantum system. This has important consequences for biology and medicine. In particular, it suggests the existence of a quantum-based “software,” essential perhaps for the logistics of biological processes, which are hidden behind the matter/energy-based “hardware” that alone is considered in the conventional approach. In medicine it opens an opportunity to build bridges between conventional medicine based essentially on the classical paradigm, and the various forms of complementary medicine, which have strong affinities with the new features of the modern holistic worldview. Alle Beiträge nehmen Stellung zur Theorie rationalen Wahlhandelns, die James Coleman zur Fundierung seiner Handlungssystemanalysen (...) benutzt und die in jüngster Zeit zunehmend Raum und Beachtung gewinnt. Johann Georg Heinrich Feder (1740–1821) zählte zu den prägenden Philosophen und Publizisten der europäischen Aufklärung zwischen 1770 und 1800, und zwar sowohl innerhalb weiter Teilbereiche der Fach- und Schulphilosophie als auch im Zusammenhang literarischer und popularphilosophischer Diskurse der sich entwickelnden Öffentlichkeit. Feder nahm entscheidenden Einfluss auf wichtige Debatten, Kontroversen und Forschungsentwicklungen seiner Zeit.

Johann Heinrich Lambert (1728–1777) galt schon den Zeitgenossen als Universalgenie von europäischem Rang. Tatsächlich forschte und publizierte Lambert als Mathematiker und Philosoph, und zwar vor allem zur Logik und Metaphysik, zur Erkenntnis- und Sprachtheorie, als Astronom und Physiker. Seinem Aufklärungsverständnis gemäß wirkte er nicht nur mit einer Vielzahl von Publikationen in die Wissenschaften, sondern als Popularphilosoph darüber hinaus auch in die sich ent- wickelnde Gesellschaft und den Staat der Aufklärung hinein. Dass Lambert vor dem Hintergrund dieses Selbstverständnisses als Aufklärer auch (...) Gedichte verfasste, überrascht dabei nicht. Der Band versammelt erstmals Studien zu allen Werkteilen des Berliner Gelehrten. (shrink)
