Research that is initiated, designed or funded by sponsor agencies based in countries with relatively high social and economic development, and conducted in countries that are relatively less developed, gives rise to many important ethical challenges. Although clinical trials of HIV vaccines began ten years ago in the US and Europe, an increasing number of trials are now being conducted or planned in other countries, including several that are considered “developing” countries. Safeguarding the rights and welfare of individuals participating as (...) research subjects in developing countries is a priority. In September, 1997, the Joint United Nations Programme on HIV/AIDS embarked on a process of international consultation; its purpose was further to define the important ethical issues and to formulate guidance that might facilitate the ethical design and conduct of HIV vaccine trials in international contexts. Making good decisions in extremely complex and difficult processes and situations has always been both a key task as well as a challenge in the clinic and has led to a large amount of clinical, legal and ethical routines, protocols and reflections in order to guarantee fair, participatory and up-to-date pathways for clinical decision-making. Nevertheless, the complexity of processes and physical phenomena, time as well as economic constraints and not least further endeavours as well as achievements in medicine and healthcare (...) continuously raise the need to evaluate and to improve clinical decision-making. This article scrutinises if and how clinical decision-making processes are challenged by the rise of so-called artificial intelligence-driven decision support systems (AI-DSS). In a first step, this article analyses how the rise of AI-DSS will affect and transform the modes of interaction between different agents in the clinic. In a second step, we point out how these changing modes of interaction also imply shifts in the conditions of trustworthiness, epistemic challenges regarding transparency, the underlying normative concepts of agency and its embedding into concrete contexts of deployment and, finally, the consequences for (possible) ascriptions of responsibility. Third, we draw first conclusions for further steps regarding a ‘meaningful human control’ of clinical AI-DSS. (shrink)

The paper is a critical discussion of scholarship on the "Critique of Pure Reason" published during the past ten years. The emphasis is on Anglo-American authors. I identify and discuss three main trends in the field: a shift from the general discussion of transcendental arguments to the analysis and evaluation of particular proofs in Kant; a renewed interest in the doctrine of transcendental idealism and the distinction between things in themselves and appearances; and the emergence of an entire body of (...) literature on Kant's philosophy of mind, centered around the idea of a "transcendental psychology." Many competent speakers initially judge that (i) is true and (ii) isfalse, though they know that (iii) is true. (i) Superman leaps more tallbuildings than Clark Kent. (ii) Superman leaps more tall buildings thanSuperman. (iii) Superman is identical with Clark Kent. Semanticexplanations of these intuitions say that (i) and (ii) really can differin truth-value. Pragmatic explanations deny this, and say that theintuitions are due to misleading implicatures. This paper argues thatboth explanations are incorrect. As Husserl already noticed, artworks themselves have a phenomenological character. This means, however, that to experience artworks as phenomena no “epoché” and no “phenomenological reduction” is necessary. The leading question of my essay is whether, and possibly how, this observation can be methodologically generalized for understanding phenomena. I discuss if, and possibly how, a phenomenological reflection on art allows and even demands a general conception of phenomenology that nevertheless does not confuse artworks with phenomena in general. My intention is to (...) show that and how phenomenality can be clarified with reference to its spatial character. Accordingly, works of architecture that are artworks will play a decisive role in my argument. (shrink)

This article compares Kant and Fichte from the double stand- point of identity and difference with regard to two thinkers who were at first united by a master-student relation but who later on drifted apart from each other due to mutual defamation. At the center of the present discussion stands the relationship between spirit of freedom and system’s form which binds Kant and Fichte beyond methodological divergences and doctrinal differ- ences. The critical comparison between Kant and Fichte will be developed (...) in four steps: it will start with the general positioning of Kant within German Idealism, and then move on to Kant’s double critical enterprise of grounding an aprioristic doctrine of principles of nature and freedom; it will later on address the conception championed by Fichte of having pre- sented the “first system of freedom”, and from there it will focus on the manifestations of freedom within Fichte’s philosophical system, with Kant’s position as contrast. Die Studie untersucht die Entstehung der modernen Philosophiegeschichte, wie sie sich im Übergang vom Barock zur Aufklärung als philosophische Disziplin innerhalb des gelehrten Diskurses der historia literaria konstituierte. Die Auffassung, daß Philosophie ein Produkt menschlicher Verstandestätigkeit sei und mit dem Denken der Griechen beginne, erweist sich dabei als Resultat eines Traditionsbruchs, mit dem die entstehende Aufklärung sich vom christlichen Aristotelismus der Schulphilosophie sowie von den platonisch-hermetischen Spekulationen der Schwärmer und Pansophen absetzte. In der Umbruchphase zwischen Barock und Aufklärung entsteht so (...) der moderne philosophiegeschichtliche Kanon, der sich fundamental von der zuvor gültigen historischen Logik der Wissenschaftsgeschichte unterscheidet. Die Geschichte der Philosophie wird nun nicht länger als Sammelbecken unterschiedlich perfekter Ausformulierungen einer archetypischen Weisheit verstanden, sondern im Kontext der 'Entdeckung der geschichtlichen Welt' als ein kontingenter temporaler Prozeß menschlicher Wissenschaftsentwicklung begriffen. Wie es zu dieser Entdeckung der Philosophiegeschichte kam und worin ihre wissenschaftsgeschichtlichen Implikationen bestehen, ist Gegenstand der Darstellung, die gegenüber der bisherigen Forschung verstärkt die Interdependenzen zwischen theologischem, philosophischem, rechts- und literärgeschichtlichem Diskurs berücksichtigt. Scientific exploration and thus our knowledge about the outside world is subject to the conditions of our experience.These conditions are condensed here into an interface model which,besides being physical,has an additional interface structure not reducible to physics. We suggest that this structure can dynamically be characterized by separate modes.Their selection and operation presupposes free will and a rudimentary concept of time and space. Based on some analogies with quantum networks it is argued that the 'observed' gets 'dressed'as a consequence of (...) the observing. L’interactivité est communément perçue comme la marque caractéristique des technologies digitales et, par extension, de différentes formes de fictions, de médias ou d’œuvres numériques – de la littérature hypertextuelle et des jeux vidéo au net art. On peut toutefois s’interroger sur le sens précis qu’il convient de donner à cette notion, ainsi que sur les promesses auxquelles elle est souvent associée. À défaut de pouvoir cerner un concept unique et maxi-englobant d’interactivité, nous suggérons qu’il est plus profitable de tenter d’identifier (...) des types et des degrés d’interactivité. Nous tentons de montrer pourquoi cette théorie pluraliste et gradualiste est plus attrayante que d’autres approches développées dans la littérature récente. Nous mettons enfin cette conception à l’épreuve du jeu vidéo, en montrant qu’elle permet de réévaluer le rôle que joue l’interactivité dans ce médium, mais qu’elle met aussi au jour les limitations inhérentes des fictions interactives que l’on y trouve. In this paper, I present a new semantics for demonstratives. Now some may think that David Kaplan (1989a,b) has already given a more than satisfactory semantics for demonstratives, and that there is no need for a new one. But I argue below that Kaplan's theory fails to describe the linguistic meanings of 'that' and other true demonstratives. My argument for this conclusion has nothing to do with cognitive value, belief sentences, or other such contentious matters in semantics and the philosophy (...) of mind. Rather, it appeals to the obvious fact that there can be true utterances of certain sentences containing several occurrences of the same demonstrative (for instance, 'That is taller than that'). My argument can be answered by making a fairly modest revision in Kaplan's theory. But I believe that the resulting revised version of Kaplan's theory ignores or distorts various important semantic features of 'that'. Thus I ultimately argue in favor of a more substantial departure from Kaplan's theory. Perhaps the most remarkable feature of the theory I favor is that it ascribes three distinct sorts of meanings to demonstratives. (shrink)

The interplay of academics and judges is highly relevant for the law-making process in civil law countries. The intention of this article is to provide a brief account of the present-day relationship between academics and judges in Italy, while also taking account of the continental historical experience. In addressing this theme, the article will take its cue from developments in England—during the past three decades—where the monologue of academics and judges has been slowly developing into an ever more intensive and (...) transparent dialogue. RÉSUMÉCet article est une défense de la position exposée par Nelson Goodman dans Langages de l'art. Goodman affirme que les images fonctionnent dans des systèmes symboliques denses. La différence entre texte et image ne se situe pas là où nous l'aurions spontanément cherchée : dans l'expérience perceptuelle que nous avons des images. Une telle théorie de la dépiction peut sembler iconoclaste, voire complètement fausse, et ce, parce que nous y voyons à tort une explication de la représentation picturale. Elle offre (...) cependant, rapportée à d'autres intuitions philosophiques qui essaiment ailleurs dans l’œuvre de Goodman, une meilleure compréhension du fonctionnement des images.ABSTRACTIn this paper, I draw unexpected conclusions from Nelson Goodman's views on depiction. Faithful to the symbolic turn of aesthetics in the twentieth century, Goodman argues that pictures are as conventional and natural as scripts. Unlike scripts, however, pictures work in dense symbolic systems. The difference between image and script cannot be found where we would have spontaneously looked: in our perceptual experience of pictures. Obviously, the structural approach which is at stake in Languages of Art is iconoclast; we often consider it surprising, or even absolutely misleading, perhaps because we do not connect the analyses Goodman conducts in his essay with the experience we ordinarily have of pictures. I argue that Goodman's position becomes clearer when it is reduced to a much more modest philosophical purpose: to offer a criterion for discrimination between scripts and pictures. Pictures, unlike scripts, are dense. Of course, that does not explain depiction. However, my account of Goodman's view, when connected to intuitions about cognitive processes that have spread elsewhere in his work, sheds light on the way pictures are connected with the objects they depict. This paper provides an overview of the development of Jewish studies in Germany since reunification. After a brief historical review of the subject in the nineteenth century with the development of modern Reform Judaism and the science of Judaism created by Jewish religious and secular scholars, it focuses on the development of the past thirty years, in which not only the Jewish community but also Jewish studies have increased in importance. The growth of the Jewish community was largely due to (...) immigration from the Soviet Union, but also partly to young Israelis who moved to Berlin. In line with these different backgrounds, a new interest in diaspora research emerged. The paper also deals with the difference between German Jewish studies and those of most other countries, where Jewish studies are mainly designed by Jewish scholars. (shrink)

This article assesses the recently renewed interest in the just war criterion of sovereign authority from a Thomistic perspective. It contrasts the classical conceptualisation of authority as found in the work of St Thomas Aquinas with the argument made by today’s revisionist just war thinkers. The article points out that the two approaches start from fundamentally different units of moral analysis. While the Thomistic just war emphasises the common good of the political community revisionists advocate the perspective of moral individualism. (...) As a result, for Thomism, only those entrusted with the responsibility for the common good of the political community are entitled to wage war while, in contrast, revisionists argue that any individual has the right to wage war. The latter side’s position, the article criticises, is problematic from a moral point of view as it runs counter to the just war tradition’s concern about restraint in the employment of force. Les gens font les mondes dans lesquels ils interagissent et habitent et ils les font en utilisant des outils représentationnels. Si l’abandon du point de vue du spectateur suppose que nous œuvrons, en tant que locuteurs et producteurs d’outils symboliques, à la forme du monde que nous habitons, et si l’amélioration de ces outils (...) est à notre portée, il s’agit d’imaginer des améliorations qui conduisent à des transformations efficaces, à la fois cognitivement et politiquement. Cet article entraîne la théorie goodmanienne du worldmaking du côté de l’ingénierie conceptuelle. En dernière analyse, il entreprend de montrer ce que l’ingénierie conceptuelle aurait à gagner à redéployer la théorie goodmanienne de la projectibilité (degrés de projectibilité, implantation, projectibilité héritée).
