This chapter offers a close reading of a passage from the literary and philosophical work Minima Moralia that enacts Theodor W. Adorno's radical concept of nonpropositional truth content in philosophical aesthetics after Auschwitz. Readers of Adorno's texts, especially those devoted to philosophical aesthetics, can hardly fail to be struck by their chiastic structure. The aesthetic theory that Adorno develops constitutes not only a theory of the aesthetic but also a theory that is itself aesthetic, hence a theory of literature (...) that exhibits qualities associated with literary texts, and a theory of music that harbors within itself traces of musical composition. The rhetorically self-conscious tropes of his posthumous Aesthetic Theory, the stylized literary studies of his Notes to Literature, his musically inflected meditations on musicological questions from Ludwig van Beethoven to Arnold Schönberg, and so many of his other texts perform this provocative inversion in a variety of registers and conceptual modulations. The article discusses topics in the context of contemporary legal argumentation. It starts with a sketch of the development of topics from ancient times until the present day. Here the author focuses on the theory of the German legal philosopher Theodor Viehweg, which was most influential to legal argumentation in the 20th century. Then a modern concept of topics is introduced and finally the author discusses the role of topics in contemporary legal argumentation. In this part the distinction between topoi (...) in the weak sense (practically all argumentation schemes) and in the strong sense (specific legal topoi as listed by Gerhard Struck in 1971 is introduced. The author argues that Viehweg’s claim that topics plays an important role in legal argumentation is problematic, because topoi in the weak sense are certainly of high importance, but this is almost trivial. Topoi in the strong sense on the other hand are only of minor importance for legal practice. What characterises legal discourse much more is a set specific pragmatic discourse rules, discussed at the end of the paper. (shrink)

The article outlines the Multiple-Field-Approach ("Mehr-Felder-Ansatz") in Gestalt Theoretical Psychotherapy and in psychotherapy in general. This Gestalt theory based approach deals 1) with the conditions under which a secondary phenomenal field (containing a secondary phenomenal ego and a secondary phenomenal environment) segregates within the primary phenomenal field, 2) with the dynamic field interaction between primary and secondary field and their role in psychotherapy, 3) with psychotherapeutic techniques favouring the segregation and favouring the dissolution of a secondary field . Some of (...) these phenomena have been discussed as mind-wandering, daydreaming, or - in a pathological context - as dissociation. But it seems that the Gestalt psychological approach presented in this paper has to offer a more promising framework for these phenomena and their dynamics. (shrink)

The account of meta-induction (G. Schurz, Hume’s problem solved: the optimality of meta-induction, MIT Press, Cambridge, 2019) proposes a two-step solution to the problem of induction. Step 1 consists in a mathematical a priori justification of the predictive optimality of meta-induction, upon which step 2 builds a meta-inductive a posteriori justification of object-induction based on its superior track record (Sect. 1). Sterkenburg (Br J Philos Sci, forthcoming. 10.1086/717068/) challenged this account by arguing that meta-induction can only provide a (non-circular) justification (...) of inductive predictions for now and for the next future, but not a justification of inductive generalizations (Sect. 2). This paper develops a meta-inductive method that does provide an a posteriori justification of inductive generalizations, in the form of exchangeability conditions (Sect. 3). In Sect. 4, a limitation of the proposed method is worked out: while the method can justify weakly lawlike generalizations, the justification of strongly lawlike generalizations (claimed to hold for all eternity) requires epistemic principles going beyond meta-induction based on predictive success. The paper presents basic Gestalt psychological concepts of ego and self. They differ from other concepts in the way that they do not comprehend ego and self as fixed entities or as central controlling instances of the psyche, but as one specific organized unit in a psychological field in dynamic interrelation with the other organized units—the environment units—of this field. On this theme, well-known representatives of Gestalt theory have presented some general and special theories since the early days of this (...) approach that could partly be substantiated experimentally. They illuminate the relationship between ego and world in everyday life as well as in the case of mental disorders. Not only the spatial extension of the phenomenal ego is subject to situational changes, but also its place in the world, its functional fitting in this world, its internal differentiation, its permeability to the environment, and much more. The German Gestalt psychologist Wolfgang Metzger emphasizes the significant functional role that this dynamic plasticity of the phenomenal world and its continuously changing segregation of ego and environment have for human life by designating the phenomenal world as a “Central Steering Mechanism.” In this article, ego and self as part of this field in their interrelation with the total psychological field will be illuminated from the perspective of the thinking of the Gestalt psychologists Max Wertheimer, Kurt Koffka, Wolfgang Köhler, Kurt Lewin, Wolfgang Metzger, Mary Henle, Edwin Rausch, and Giuseppe Galli. Among the methodological rules of the social sciences we find the principles of value-neutrality and the principle of criticism. Both principles are of vital importance in the social sciences, but both seem to conflict with one another. The principle of criticism excludes value-judgments from the social sciences, because they cannot be empirically tested. Hence, criticism methodologically implies value-neutrality. Yet there is the opposing view that it is precisely the critical social researcher who looks beyond mere 'social facts' taking into account (...) the value framework of the society. Thus, criticism does not lead to value-freedom, but points to the value impact of the so-called social facts. In this paper, the two principles are stated. Then it is shown how and why they are incompatible. Finally, several suggestions are discussed to resolve this methodological conflict. (shrink)

Emergent quantum mechanics (EmQM) explores the possibility of an ontology for quantum mechanics. The resurgence of interest in realist approaches to quantum mechanics challenges the standard textbook view, which represents an operationalist approach. The possibility of an ontological, i.e., realist, quantum mechanics was first introduced with the original de Broglie-Bohm theory, which has also been developed in another context as Bohmian mechanics. This Editorial introduces a Special Issue featuring contributions which were invited as part of the David Bohm Centennial symposium (...) of the EmQM conference series (www.emqm17.org). Questions directing the EmQM research agenda are: Is reality intrinsically random or fundamentally interconnected? Is the universe local or nonlocal? Might a radically new conception of reality include a form of quantum causality or quantum ontology? What is the role of the experimenter agent in ontological quantum mechanics? The Special Issue also includes research examining ontological propositions that are not based on the Bohm-type nonlocality. These include, for example, local, yet time-symmetric, ontologies, such as quantum models based upon retrocausality. In lieu of an abstract, here is a brief excerpt of the content:Religion a Threat to Morality: An Attempt to Throw Some New Light on Hume's Philosophy of Religion* Gerhard Streminger At the beginning ofhis Natural History ofReligion Hume writes that two questions in particular... challenge our attention, to wit, that concerning its foundation in reason, and that concerning its origin in human nature. The first challenge is taken up by Hume in the Dialogues ConcerningNatural Religion, and the second (...) in hisNatural History ofReligion. In this paper I will try to show that there is a third fundamental problem discussed by Hume with regard to religion, namely its relationship to and influence on morality. Although he never wrote on this topic in as systematic a way as on the above-mentioned two questions inparticular, I am convinced that his thoughts about it were not just casual. The passages in Hume relevant to this third central question about religion are to be found in "Of Superstition and Enthusiasm," in Essays Moral, Political, and Literary; in section 11 ofAn Enquiry Concerning Human Understanding; in Appendix 4 and "A Dialogue," in An Enquiry Concerning the Principles ofMorals; in the History ofEngland; in Part XII of the Dialogues Concerning Natural Religion ; and, in particular, in the Natural History ofReligion. Why Hume never wrote about the relationship between religion and morality in a more systematic way is not entirely clear. He may have decided not to provoke the orthodox any further than he already had. That Hume changed the title ofsection 11 ofhis first Enquiry from the original "Of the Practical Consequences of Natural Religion" to the rather non-committal "Of a Particular Providence and of a Future State" may support this conjecture. Before going into more detail as to Hume's view on the relationship between religion and morality, I want to make a few remarks about Hume's opinion of religion in general. Hume made a distinction between one 'true' and two forms of 'false' religion. His most explicit description of true religion is to be found in a preface to the second volume of his History ofEngland: Volume XV Number 2 277 GERHARD STREMINGER Theproper Office ofReligion, Hume wrote in terms which have a Quakerish flavour, is to reform Men's Lives, to purify their Hearts, to inforce all moralDuties, & to secure Obedience to the Laws & civil Magistrate. While it pursues these useful Purposes, its Operations, tho' infinitely valuable, are secret & silent; andseldom come under the Cognizance ofHistory... The Idea ofan Infinite Mind, the Author ofthe Universe seems... to require a Worship absolutely pure, simple, unadorned; without Rites, Institutions, Ceremonies; even without Temples, Priests, or verbal Prayer & Supplication. This preface, however, was not printed in the words quoted above. Instead it was reduced by Hume to a footnote at the end of the second volume of his History of England in a shortened and toned-down version. Even this footnote was removed in later editions ofthe History ofEngland. But in the Dialogues Hume repeated his idea of the effect of true religion on morality almost verbatim: The proper office of religion is to regulate the heart of men, humanize their conduct, infuse the spirit oftemperance, order, and obedience; and as its operation is silent, and only enforces the motives of mortality and justice, it is in danger of being overlooked, and confounded with these other motives. This form ofreligion, however, although without anypernicious consequences with regard to society (D 223), is extremely rare. Religion, as it has commonly been found in the world (D 223), is a threat to morality. The corruptions of true religion, namely superstition and enthusiasm, are the popular forms of religious worship. Whenever Hume talks about religion without qualifications, he has this false religion in mind. Coming back to my original thesis, Hume, I think, sees three main negative influences of false religion: (1) The clergy has an interest in setting bounds to human knowledge; (2) The God offalse religion is no moral authority; (3) False religion corrupts the natural moral sentiments and promotes an 'artificial, affected' life. Hume's opposition to religion is even more far-reaching than I had acknowledged, since there is "no evidence" that any form of 'true religion' is to be found in Hume. According to Ellin, the discussion on 'religion and morality' in the second halfofPart XII ofthe Dialogues is (...) "not about true religion at all," since by using the term 'true religion' Philo means nothing but philosophy ("being whatever reason can tell us about the question ofthe originofthe universe") and morality("being the set ofprinciples ultimately founded on inclination and the natural motives of justice and benevolence"). Therefore, "there are not four things: philosophy, morality, true religion, and false religion; but only three," and my remarks on 'true religion' are "a distortion of Hume's views, based on a misreading of Hume's text." I will try to show that there are slightly more things in Hume than 'empirical philosophy, morality and false religion' by collecting some relevant passages in Part XII ofthe Dialogues.1 Philo: But in proportion to my veneration for true religion, is my abhorrence ofvulgar superstitions. Dieses seit langem angekündigte, in drei Bänden geplante Handbuch, das sein Erscheinen mit dem zweiten Band über das byzantinische Hochmittelalter und die nachbyzantinische Epoche eröffnet, könnte mit seinen betont lapidaren Titel den Eindruck erwecken, erstmalig eine breite oder gar erschöpfende Darstellung der byzantinischen Theologie zu bieten; doch im Unterschied zu H.-G.Becks Klassiker „Kirche und theologische Literatur in byzantinischen Reich“ (München 1959, 1977), in dem ein lückenloser Überblick über die Gesamtheit der theologischen Produktion in Byzanz(330 bzw. Mitte des 6. Jahrhunderts – (...) 1453) angestrebt ist, setzt sich das vorliegende Werk das Ziel, eine Reihe herausragender Theologen eingehend in Biographie und Werkanalyse darzustellen; dabei nehmen die Bearbeiter, wie im Vorwort J. Norets (S. 3f.) betont, an der „Clavis Patrum Graecorum“ Maß, so daß erstmalig alle echten, unechten und zweifelhaften Werke eines Autors dieser Epochen eine feste Nummer tragen, der dann noch Angaben zu den Handschriften, evtl. Editionen und Übersetzungen folgen. Als weiteres Neuheitsmerkmal ist eine umfassende, internationale Bibliographie zu jedem behandelten Autor beigegeben. Diese immense Arbeitsleistung konnte nur auf möglichst viele Mitarbeiter und Berater, besonders aus dem Forschungspersonal der „Ecole pratique des Hautes Etudes“ und des „Centre National de la Recherche Scientifique“, verteilt werden, die neben den ausländischen Kollegen in den Einführungen und Danksagungen (S. 1–6) erwähnt werden. Andererseits besitzen die seitenlangen bibliographischen Listen leider nicht den Charakter einer „Bibliographie raisonnée“, insofern wichtige und unwichtige Titel gleichberechtigt nebeneinanderstehen; nur in Einzelfällen sind auch kritische Rezensionen mitberücksichtigt. Das Verdienst dieses Buches besteht darin, einen bisher unedierten Text der byzantinischen Theologie des 14. Jahrhunderts in einer kritischen Edition samt französischer Übersetzung zugänglich zu machen. Der Autor, Erzbischof Neilos Kabasilas von Thessalonike (Juli 1361–März 1363), gehört nicht zu den großen, eigenständigen Persönlichkeiten in Byzanz, bewegt sich vielmehr auf der von den Patriarchen Photios, Gregorios II. Kyprios sowie seinem Amtsvorgänger, Gregorios Palamas, vorgegebenen Ausrichtung der Pneumatologie. Zwar zeigte er in seiner Jugend eine gewisse Sympathie für die damals neuen Übersetzungen aus (...) der lateinischen Scholastik, insbesondere des Thomas von Aquin, aber anders als seine beiden wichtigsten Schüler (Demetrios Kydones und sein eigener Neffe, Nikolaos Kabasilas) maß er ihnen keine systematische Bedeutung bei. Letztlich blieb ihm der Palamismus definitives Kriterium einer authentischen Theologie. Deshalb ist das Urteil des Herausgebers, der sich bedingungslos an die Deutung J. Meyendorffs anschließt (die deutsche Forschung scheint ihm schon sprachlich unzugänglich geblieben zu sein), Neilos sei „einer der größten Humanisten seiner Epoche“ (S. 59), absolut irreführend. Nirgendwo wird übrigens der Unterschied zwischen humanistischer und palamitischer Theologie näher definiert. (shrink)

La théorie de l’organisme social était une approche foncièrement et largement répandue au début du 20ème siècle, qui était acceptée par de nombreuses orientations théoriques dans la sociologie et l’économie. L’approche de Rudolf Steiner s’y rapportant est bien connue. La théorie de Gerhard Stolzmann ne l’est pas autant. Ce dernier était un représentant de ce qu’on appelle le « mouvement des droits sociaux de l’économie politique » et au plan philosophique, il défendait le néo-kantisme (école de Marburg, de l’Allemagne (...) du sud-ouest). Stolzmann a connu et cité les écrits de Steiner sur l’organisme social, comme on peut le prouver. Dans cet essai, on va mettre au jour les communautés et tendances dans le concept de l’organisme social chez Stolzmann et Steiner. Tous deux ont mis en exergue l’importance du spirituel et en conséquence de la sphère du droit, pour la société et l’économie dans leur théorie. Mais Steiner eut essentiellement une amorce plus pratique. Son concept d’organisme social est plus une proposition de réforme pour l’économie et la société, alors que Stolzmann fait ressortir la signification théorique générale toujours valable de sa théorie. In diesem Streit - ausgelöst durch Emil Du Bois-Reymonds Vortrag 'Über die Grenzen des Naturerkennens '(1872) - ging es nicht mehr um die Abgrenzung der Erklärungskompetenzen von Religion, Philosophie und Naturwissenschaft, sondern um die Frage, ob der so erfolgreichen Naturwissenschaft ebenfalls Erkenntnisgrenzen gesetzt seien: an den Problemen der Erkennbarkeit des Wesens der Materie und der Rückführbarkeit der subjektiven Qualitäten menschlichen Empfindens und Denkens auf materielle Zustände. Die Behauptung, es gebe Bereiche, die der Wissenschaft nicht nur mit den damaligen Mitteln, sondern (...) prinzipiell verschlossen blieben, schien ihren universalen Erklärungsanspruch zu unterminieren. Diese Debatte hat auch heute nichts an Brisanz verloren, auch wenn sie zumeist nicht mehr im direkten Rückgriff auf die damalige ausgetragen wird. (shrink)

In light of the phenomenon of the “coexistence of the non-contemporaneous” [Gleichzeitigkeit des Ungleichzeitigen] every periodic division is problematic, for usually the old exists simultaneously with the new, that which looks to the past exists beside that which points to the future. This is also true for the beginning of “modern times”: Beside the first modern attempts to define the fundamentals of moral conduct without recourse to metaphysical assumptions, the “old dictates” remained in effect for whose truth divine revelation was (...) claimed. Some theoreticians of modernity held a conciliatory position in which they clung to God’s existence, but they no longer looked to infer His attributes from the Book of Books but, rather, out of creation — from the book of nature. Nevertheless the project of the Enlightenment, to find a secular foundation for morality, was worked on more and more self-consciously, and the greatest radicals even went a step further: They held the traditional form of religion, under which in the following is always meant: the Christian-theistic form of religion, to be morally threatening.
