I would like to write a novel in which the main character would be a man who got a pair of glasses, one lens of which reduced images as powerfully as an oxyhydrogen microscope, and the other of which magnified on the same scale, so that he perceived everything relatively. A flight of fancy by an aspiring science fiction writer? While it may sound as such, this wistful musing is one of the little-discussed personal reflections of nineteenth-century philosopher Søren Kierkegaard, (...) whose remarkable journals and notebooks, unpublished during his lifetime, are presented here. The first of an eleven-volume series produced by Copenhagen's Søren Kierkegaard Research Centre, this volume is the first English translation and commentary of Kierkegaard's journals based on up-to-date scholarship. It offers new insight into Kierkegaard's inner life. In addition to early drafts of his published works, the journals contain his thoughts on current events and philosophical and theological matters, notes on books he was reading, miscellaneous jottings, and ideas for future literary projects. Kierkegaard wrote his journals in a two-column format, one for his initial entries and the second for the marginal comments he added later. The new edition of the journals reproduces this format and contains photographs of original manuscript pages, as well as extensive scholarly commentary. It has been known for 20 years that the ribosomal protein S6 is rapidly phosphorylated when cells are stimulated to grow or divide. Furthermore, numerous studies have documented that there is a strong correlation between increases in S6 phosphorylation and protein synthesis, leading to the idea that S6 phosphorylation is involved in up‐regulating translation. In an attempt to define a mechanism by which S6 phosphorylation exerts translational control, other studies have focused on characterizing the sites of phosphorylation of this protein (...) and its location within the ribosome. Recent data show that S6 is a protein which may have diverse cellular functions and is essential for normal development, and that it may be involved in the translational regulation of a specific class of messages. We describe the case of an eighty‐four‐year‐old man with disseminated lung cancer who had been receiving palliative care in the hospital and was found by nursing staff unresponsive, with clinically obvious signs of death, including rigor mortis. Because there was no documentation to the contrary, the nurses commenced cardiopulmonary resuscitation and called a code blue, resulting in resuscitative efforts that continued for around twenty minutes. In discussion with the hospital ethicist, senior nurses justified these actions, mainly citing disciplinary and medicolegal (...) concerns. We argue that moral harms arise from CPR performed on a corpse and that legal concerns about failing to perform it are unfounded. We contend that such efforts are an unintended consequence of managerialist policies mandating do‐not‐resuscitate orders and advance care plans and of defensive practices that can value the interests of institutions and practitioners over those of patients. Health management teaching should include managerialism and its pitfalls, while clinician training should prioritize ethical reasoning and legal knowledge over defensive practice. (shrink)

Australian prisons are overpopulated with people suffering from numerous health problems. COVID-19 presents a significant threat to prisoner health. This article examines the current regulatory responses from Australian state and territory governments to COVID-19 and a recent case which tested the human rights of prisoners during a pandemic.

The doctrine of consent is built upon presumptions of mental capacity. Those presumptions must be tested according to legal rules that may be difficult to apply to COVID-19 patients during emergency presentations. We examine the principles of mental capacity and make recommendations on how to assess the capacity of COVID-19 patients to consent to emergency medical treatment. We term this the CARD approach.

BackgroundSocio-cultural perceptions surrounding death have profoundly changed since the 1950s with development of modern intensive care and progress in solid organ transplantation. Despite broad support for organ transplantation, many fundamental concepts and practices including brain death, organ donation after circulatory death, and some antemortem interventions to prepare for transplantation continue to be challenged. Attitudes toward the ethical issues surrounding death and organ donation may influence support for and participation in organ donation but differences between and among diverse populations have not (...) been studied.ObjectivesIn order to clarify attitudes toward brain death, organ donation after circulatory death and antemortem interventions in the context of organ donation, we conducted a scoping review of international English-language quantitative surveys in various populations.Study appraisalA search of literature up to October 2020 was performed, using multiple databases. After screening, 45 studies were found to meet pre-specified inclusion criteria.Results32 studies examined attitudes to brain death, predominantly in healthcare professionals. In most, around 75% of respondents accepted brain death as equivalent to death of the person. Less common perspectives included equating death with irreversible coma and willingness to undertake organ donation even if it caused death. 14 studies examined attitudes to organ donation following circulatory death. Around half of respondents in most studies accepted that death could be confidently diagnosed after only 5 min of cardiorespiratory arrest. The predominant reason was lack of confidence in doctors or diagnostic procedures. Only 6 studies examined attitudes towards antemortem interventions in prospective organ donors. Most respondents supported minimally invasive procedures and only where specific consent was obtained.ConclusionsOur review suggests a considerable proportion of people, including healthcare professionals, have doubts about the medical and ethical validity of modern determinations of death. The prognosis of brain injury was a more common concern in the context of organ donation decision-making than certainty of death. (shrink)

The paper emerges from an Editors' Collective, a small New Zealand-based organisation comprised of editors and reviewers of academic journals mostly in the fields of education and philosophy. Professor Parkinson in his lecture on ‘The Translation Theory of Understanding’ discusses two stages in the development of a false but influential tradition which he finds common to Locke's Essay Concerning Human Understanding and Professor George Steiner's After Babel. He is not, of course, alleging any direct historical influence of the one on the other; neither is he principally addressing Steiner's book as a whole, but rather the account of understanding upon which it appears to be founded. I should (...) like to take his paper as the starting-point for my own, but begin from a somewhat broader view than he does of the legacy of Locke. The present study explored psychological predictors of response to a series of three 25 second inhalations of 20% carbon dioxide-enriched air in 60 nonclinical participants. Multiple regression analyses indicated that only anxiety sensitivity physical concerns predicted self-reported fear, whereas both physical anxiety sensitivity concerns and behavioural inhibition sensitivity independently predicted affective ratings of emotional arousal. In contrast, the psychological concerns anxiety sensitivity dimension predicted ratings of emotional displeasure (valence), and both psychological anxiety sensitivity concerns and behavioural inhibition sensitivity independently predicted (...) emotional dyscontrol. No variables significantly predicted heart rate. These data are in accord with current models of emotional reactivity that highlight the role of cognitive variables in the production of anxious and fearful responding to somatic perturbation, and help further clarify the particular predictors of anxiety-related responding to biological challenge. Students of Kierkegaard are familiar with his dogged polemic against Hegelianism, his critique of Friedrich von Schlegel's Romantic irony, and his visit to Schelling's lectures in Berlin. However, these are only a few well-known examples of a deep relationship that Kierkegaard had with German culture. In Faust, Romantic Irony, and System, Jon Stewart maps out the many ways in which German thinkers and writers inspired and influenced the Danish philosopher. Kierkegaard's famous criticisms of the Hegelians, Schlegel, and Schelling has (...) led many to view him as anti-German. As Stewart shows, however, he offered high praise for other German thinkers, including Johann Georg Hamann, Gotthold Lessing, and Friedrich Adolf Trendelenburg. Stewart traces the many points of contact between Kierkegaard and a range of German thinkers, and ultimately he argues convincingly that were it not for the influence of German culture, Kierkegaard would have been a very different, and less lasting, philosopher. Recalling a public lecture that Georg Simmel gave in Berlin in 1910, Paul Fechter described him as `philosophizing with his whole body'. This article focuses on the role of the communicative body in the production, reproduction and reception of sociological ideas by investigating the dissemination of Simmel's sociological thought through the medium of the lecture. It utilizes contemporary reports of Simmel's lecturing style as observational data, and his own writings on the `Sociology of the Senses' and the `Aesthetic Importance of (...) the Face' as a theoretical framework. This examination of Simmel's lectures, focusing on both physiognomic expression and perception, reveals that the lecture as a complex communicative event is structured on a dialectic of closeness and distance. We examine George Boolos's proposed abstraction principle for extensions based on the limitation-of-size conception, New V, from several perspectives. Crispin Wright once suggested that New V could serve as part of a neo-logicist development of real analysis. We show that it fails both of the conservativeness criteria for abstraction principles that Wright proposes. Thus, we support Boolos against Wright. We also show that, when combined with the axioms for Boolos's iterative notion of set, New V yields a system equivalent (...) to full Zermelo-Fraenkel set theory with a principle of global choice. This advances Boolos's longstanding interest in the foundations of set theory. (shrink)

Jarīr al-Ṭabarī is known to posterity primarily as a historian and commentator on the Qurʾan, his most creative work may have been in the law, and Ibn al-Nadim places his main entry on al-Ṭabarī in Book VI of the Fihrist, on law. Unfortunately, most of his legal works have been lost. Building on and revising George Makdisi’s analysis of the relationship between the ṭabaqāt genre and the theoretical justification of the legal madhhabs, this (...) study argues that one of these lost books, Marātib al-ʿulamāʾ “Degrees of the Scholars,” was devoted to the generations of jurists and intended to provide a theoretical basis for the authority of the Jarīrī madhhab, one among a number of pieces of evidence that suggest al-Ṭabarī was consciously designing and creating his own legal madhhab, in contrast to earlier jurists, such as Abū Ḥanīfah and al-Shāfiʿī, whose legal madhhabs were created by subsequent generations of students. Jon Stewart's study is a major re-evaluation of the complex relations between the philosophies of Kierkegaard and Hegel. The standard view on the subject is that Kierkegaard defined himself as explicitly anti-Hegelian, indeed that he viewed Hegel's philosophy with disdain. Jon Stewart shows convincingly that Kierkegaard's criticism was not of Hegel but of a number of contemporary Danish Hegelians. Kierkegaard's own view of Hegel was in fact much more positive to the point where he was directly influenced by (...) some of Hegel's work. Any scholar working in the tradition of Continental philosophy will find this an insightful and provocative book with implications for the subsequent history of philosophy in the twentieth century. Danish novelists and critics from the Modern Breakthrough movement in the 1870s were among the first to make extensive use of his writings. We here examine the expressive power of first order logic with generalized quantifiers over finite ordered structures. In particular, we address the following problem: Given a family Q of generalized quantifiers expressing a complexity class C, what is the expressive power of first order logic FO(Q) extended by the quantifiers in Q? From previously studied examples, one would expect that FO(Q) captures L C , i.e., logarithmic space relativized to an oracle in C. We show that this is not always (...) true. However, after studying the problem from a general point of view, we derive sufficient conditions on C such that FO(Q) captures L C . These conditions are fulfilled by a large number of relevant complexity classes, in particular, for example, by NP. As an application of this result, it follows that first order logic extended by Henkin quantifiers captures L NP . This answers a question raised by Blass and Gurevich [Ann. Pure Appl. Logic, vol. 32, 1986]. Furthermore we show that for many families Q of generalized quantifiers (including the family of Henkin quantifiers), each FO(Q)-formula can be replaced by an equivalent FO(Q)-formula with only two occurrences of generalized quantifiers. Resnik and Stewart Shapiro: because the method itself involves logical notions, it can neither be specified in a logic-neutral way nor can it allow logical pluralism. To analyse and answer these claims, an explicit distinction is introduced between judgements held prior to the process of mutual adjustments and judgements in agreement with the systematic principles, which result from the process. It is then (...) argued that from the presystematic perspective, the method of reflective equilibrium permits developing and justifying rival logics, and hence it allows reasonable disagreement about logics; but such pluralism is no longer available from the perspective of fully developed logical systems. Commentators generally neglect Hegel’s analyses of the religions of Asia, presumably for fear of being charged with Eurocentrism, racism or colonialism. Hegel’s engagement with these religions, however, occurs during the time when the birth of fields such as Egyptology and Indology gave rise to increased scholarly interest in Asia. Hegel supported the work of Georg Friedrich Creuzer, whose book on symbolism showed the debt that the Greek and Roman religions owed to Egypt, Persia and India. Structuralism, the view that mathematics is the science of structures, can be characterized as a philosophical response to a general structural turn in modern mathematics. Structuralists aim to understand the ontological, epistemological, and semantical implications of this structural approach in mathematics. Theories of structuralism began to develop following the publication of Paul Benacerraf’s paper ‘What numbers could not be’ in 1965. These theories include non-eliminative approaches, formulated in a background ontology of sui generis structures, such as Stewart Shapiro’s ante (...) rem structuralism and Michael Resnik’s pattern structuralism. In contrast, there are also eliminativist accounts of structuralism, such as Geoffrey Hellman’s modal structuralism, which avoids sui generis structures. These research projects have guided a more systematic focus on philosophical topics related to mathematical structuralism, including the identity criteria for objects in structures, dependence relations between objects and structures, and also, more recently, structural abstraction principles. Parallel to these developments are approaches that describe mathematical structure in category-theoretic terms. Category-theoretic approaches have been further developed using tools from homotopy type theory. Here we find a strong relationship between mathematical structuralism and the univalent foundations project, an approach to the foundations of mathematics based on higher category theory. (shrink)

Friedrich Schleiermacher is known as the theologian who said that the essence of Christian faith is a state of mind called 'the feeling of absolute dependence'. In this respect, Schleiermacher's reputation owes much to the influential translation of his dogmatics prepared by Mackintosh, Stewart and others. I argue that the translation is misleading precisely as to the terms which Schleiermacher uses in order to refer to the religious state of mind. I also show that the translation obscures a problem (...) of some substantive depth regarding what Schleiermacher thought to be the nature of pious feeling. (shrink)
