This article offers an alternative reading of the Abbé Sieyès and the modern ‘nation-state’ problématique. I argue that the subject/object that is constituted in the early days of modernity is the incomplete society: an impossible-possibility ideal of congruency of population, authority and space. I suggest reading this ideal of congruency as a fantasy in that it offers a certain ‘fullness to come’, the promise of jouissance that can never be attained and is thus constantly re-envisioned and reinvoked. Drawing on discourse-analytical (...) and psychoanalytical tools I explain the logic of fantasy before analysing Sieyès’ What is the Third Estate?, as I show how he critiques and fragments the old model of the state and how his reading of the nation is fantasmatic, a continuous project towards impossible congruency. The Principles of Fair Information Practice are almost three decades old and need to be broadened to take account of new technologies for collecting personal information such as drug testing, video cameras, electronic location monitoring and the internet. I argue that the ethics of surveillance activity must be judged according to the means, the context and conditions of data collection and the uses/goals and suggest 29 questions related to this. The more one can answer these questions in a way that (...) affirms the underlying principle the more ethical the use of a tactic is likely to be. Four conditions are identified which, when breached, are likely to violate an individual's reasonable expectation of privacy. Respect for the dignity of the person is a central factor and emphasis is put on the avoidance of harm, validity, trust, notice and permission when crossing personal borders. (shrink)

The corporate glass ceiling continues to be a challenge for many organizations. However, women executives may be facing a second pane of obstruction – an expatriate glass ceiling – that prevents them from receiving the foreign management assignments and experience that is becoming increasing critical for promotion to upper management. The responsibility to break the expatriate glass ceiling lies with both female managers and the multinational corporations that utilize expatriates. My concern in this paper will be to explore and develop a version of nonsocratic skepticism about weakness of will. In my view, socratism is incorrect, but like Socrates, I think that the common understanding of weakness of will raises serious problems. Contrary to socratism, it is possible for a person knowingly to act contrary to his or her better judgment. But this description does not exhaust the common view of weakness. Also implicit in this view is the belief that (...) actions which are contrary to one's better judgment are free in the sense that the agent could have done otherwise. To take seriously the possibility of acting contrary to one's better judgment is at the same time to raise problems about the distinction between weakness and compulsion. I argue that the common view, according to which the differentiating feature is that the weak are able to conform their behavior to their practical judgments, is unjustified. Instead, I have proposed that weakness of will involves the failure to develop certain normal capacities of self-control, whereas compulsion involves desires which even the possession of such capacities would not enable one to resist. Is capitalist production unjust? It is easy to think, upon first reading Marx, that he answers this question in the affirmative. And I shall argue that this naive reading is correct. This needs to be argued, however, for a more careful scrutiny of Marx's writings reveals passages in which he seems to call capitalist production just or fair. Relying upon these passages, Robert Tucker and Allen W. Wood have urged that, in Wood's words,it is simply not the case that Marx's (...) condemnation of capitalism rests on some conception of justice, and those who attempt to reconstruct a “Marxian idea of justice” from Marx's manifold charges against capitalism are at best only translating Marx's critique of capitalism, or some aspect of it, into what Marx himself would have consistently regarded as a false, ideological, or “mystified” form.What Marx regarded as false and mystified, however, is not the practice of assessing social institutions as just or unjust, but rather the picture of those institutions, and especially of capitalist production, to be found in bourgeois ideology. An account of scientific explanation is presented according to which (1) scientific explanation consists in solving “insight” problems (Metcalfe and Wiebe 1984) and (2) understanding is the result of solving such problems. The theory is pragmatic; it draws upon van Fraassen’s (1977, 1980) insights, avoids the objections to pragmatic accounts offered by Kitcher and Salmon (1987), and relates scientific explanation directly to understanding. The theory also accommodates cases of explanatory asymmetry and intuitively legitimate rejections of explanation requests.

The late 20th century saw a remarkable flourishing of philosophy in France. The work of French philosophers is wide ranging, historically informed, often reaching out beyond the boundaries of philosophy; they are public intellectuals, taken seriously as contributors to debates outside the academy. Gary Gutting tells the story of the development of a distinctively French philosophy in the last four decades of the 20th century. His aim is to arrive at an account of what it was to 'do philosophy' (...) in France, what this sort of philosophizing was able to achieve, and how it differs from the analytic philosophy dominant in Anglophone countries. -/- His initial focus is on the three most important philosophers who came to prominence in the 1960s: Michel Foucault, Gilles Deleuze, and Jacques Derrida. He sets out the educational and cultural context of their work, as a basis for a detailed treatment of how they formulated and began to carry out their philosophical projects in the 1960s and 1970s. He gives a fresh assessment of their responses to the key influences of Hegel and Heidegger, and the fraught relationship of the new generation to their father-figure Sartre. He concludes that Foucault, Derrida, and Deleuze can all be seen as developing their fundamental philosophical stances out of distinctive readings of Nietzsche. The second part of the book considers topics and philosophers that became prominent in the 1980s and 1990s, such as the revival of ethics in Levinas, Derrida, and Foucault, the return to phenomenology and its use to revive religious experience as a philosophical topic, and Alain Badiou's new ontology of the event. Finally Gutting brings to the fore the meta-philosophical theme of the book, that French philosophy since the 1960s has been primarily concerned with thinking the impossible. (shrink)

The first part of the essay explores the relations between the will and practical reason or judgement. The second part takes up decision in the realm of belief, i.e. deciding that such and such is so. This phenomenon raises two questions. Since we decide that as well as to, should we speak of a doxastic will? Secondly, should we regard ourselves as active in the formation of our judgements as in the formation of our intentions? The author's answer to these (...) two further questions is ‘no’ and ‘yes’, respectively: the boundaries between the active and the passive are not marked by the will. (shrink)

Philosophical discussions of psychopathy have been framed primarily in terms of psychopaths' conspicuous moral shortcomings. But despite their vaunted ‘egocentricity’, another prominent trait in the standard psychopathic profile is a characteristic failure to look after themselves; in an important way, psychopaths appear to be as careless of themselves as they are of others. Assuming that the standard profile is largely correct, the question is how these moral and prudential deficits are related. Are they linked in some non‐accidental way? This paper (...) is a sympathetic exploration and articulation of the hypothesis that psychopathy involves an incapacity for critical distance from from one's own impulses and inclinations, an incapacity that would explain the lack of both prudential and moral regard. Davidson's paratactic account of indirect quotation preserves the apparent relational structure of indirect speech but without assuming, in the Fregean manner, that the thing said by a sayer is a proposition. I argue that this is a mistake. As has been recognised by some critics, Davidson's account suffers from analytical shortcomings which can be overcome by redeploying the paratactic strategy as a means of referring to propositions. I offer a quick and comprehensive survey of these difficulties and a concise propositional (...) solution. Further, I argue that Davidson's more general philosophical commitments provide no reason not to embrace the propositional strategy: despite appearances, to invoke propositions in the way suggested is consistent with Davidson's holism and consequent doctrine of semantic indeterminacy. Gary Chartier elaborates a particular version of economic justice rooted in the natural law tradition, explaining how it is relevant to economic issues and developing natural law accounts of property, work, and economic security. He examines a range of case studies related to ownership, production, distribution, and consumption, using natural law theory as a basis for staking positions on a number of contested issues related to economic life and highlighting the potentially progressive and emancipatory dimension of natural law theory.

Standard treatments of responsibility have been preoccupied with issues of blame and punishment, and concerns about free will. In contrast, Raz is concerned with problems about responsibility that arise from the “puzzle of moral luck,” puzzles that lead to misguided skepticism about negligence. We are responsible not only for conduct that is successfully guided by what we take to be our reasons for action, but also for misexercises of our rational capacities that escape our rational control. To deny this is (...) to lose sight of the ways “moral luck” is an inescapable feature of our agential engagement in the world. The present essay attempts to set out Raz’s argument as sympathetically as possible. Raz’s shift of focus is a powerful counter to current tendencies and points us in new and promising directions. Nonetheless, as it stands, it may just relocate skepticism about negligence to a different place. (shrink)

This work is a substantial contribution to the history of philosophy. Its subject, the ninth-century philosopher John Scottus Eriugena, developed a form of idealism that owed as much to the Greek Neoplatonic tradition as to the Latin fathers and anticipated the priority of the subject in its modern, most radical statement: German idealism. Moran has written the most comprehensive study yet of Eriugena's philosophy, tracing the sources of his thinking and analyzing his most important text, the Periphyseon. This book develops and defends a conception of commitment and explores its limits. Gary Chartier shows how commitment serves to resolve conflicts between ordinary moral intuitions and the reality that the basic aspects of human well-being are incommensurable. He outlines a variety of overlapping and mutually reinforcing rationales for making commitments, explores the relationship between commitment and vocation and the relevance of commitment to love, and notes some reasons why it might make sense to disregard one’s commitments. The Logic (...) of Commitment will appeal to ethicists interested in the connection between commitment and personal well-being, and to anyone who wonders why and when it might make sense to make or keep commitments. The apparent very close similarity between the learning of the past tense by Adam and the Plunkett and Marchman model is exaggerated by several misleading comparisons--including arbitrary, unexplained changes in how graphs were plotted. The model's development differs from Adam's in three important ways: Children show a U-shaped sequence of development which does not depend on abrupt changes in input; U-shaped development in the simulation occurs only after an abrupt change in training regimen. Children overregularize vowel-change verbs more than no-change (...) verbs; the simulation overregularizes vowel-change verbs less often than no-change verbs. Children, including Adam, overregularize more than they irregularize; the simulation overregularized less than it irregularized. Interestingly, the RM model--widely criticized as being inadequate--does somewhat better, correctly overregularizing vowel-change verbs more often than no-change verbs, and overregularizing more often than it irregularizes. Although Plunkett and Marchman's (1993) state of the art model incorporated hidden layers and back-propagation, used a more realistic phonological coding scheme, and explored a broader range of parameters than Rumelhart and McClelland's model, their results are farther from psychological reality. It is unknown whether any connectionist model can mimic a child's performance without resorting to unrealistic exogenous changes in the training or input, but it is clear that adding a hidden-layer and back-propagation does not ensure a solution. In Chapter 4 of [2] Grünbaum sets out to refute Einstein's philosophy of physical geometry. The latter's theory is seen as lying within the tradition of "anti-empiricist conventionalism" of Duhem and Quine as opposed to the "qualified empiricism" of Poincaré, Carnap and Reichenbach. Consequently Grünbaum sets the stage for his critique of Einstein by discussing certain of the views of these other thinkers. But in these preliminary discussions the various theses are confused and misrepresented in such a way as to (...) make it almost impossible to evaluate Grünbaum's final treatment of Einstein's thesis. For this reason I will deal only with those parts of this chapter in which the roots of Grünbaum's confusion are to be found. This will involve analyses of two theories which are not clearly distinguished by Grünbaum. The first is Duhem's denial of the "crucial experiment" in physics; the second is Quine's version of "pragmatism.". (shrink)

According to the naive theory of belief reports, our intuition that “Lois believes that Kent flies” is false results from our mistakenly identifying what this sentence implicates, which is false, with what it says, which is true. Whatever the merits of this proposal, it is here argued that the naive theory’s analysis of negative belief reports—sentences such as “Lois doesn't believe that Kent flies”—gives rise to equally problematic clashes with intuition, but that in this case no “pragmatic” explanation is available. In particular, it is argued that there are situations at which, although “Lois believes that Superman flies” and “Lois doesn't believe that Kent flies” appear consistent, a speaker must contradict himself when he utters both. It is also argued that the hidden-indexical theory of belief reports—which otherwise respects our ordinary intuitions regarding belief reports—similarly fails to explain this intuition. (shrink)
