Law as Art presents a radical new legal theory, the Law as Art Hypothesis, which conceives law, not as a system of rules, but as a distinctive kind of art work. Law is differentiated as art by the Law as Compound Artistic Type Hypothesis, which uses the heuristic metaphor of the Operatic Music Drama, the most elementally complex compound art form, to develop an idea of legal art as a distinctive empowered text, supported by the arts of drama, painting, sculpture, (...) dress-design, architecture, rhetoric and communication to form an elementally developed yet integrated unitary art work. Part I develops a new realist epistemology to support a contemporary action-type ontology of art, differentiated as art by virtue of its artistic value. Part II opens with a critical review of the arts in legal theory, before detailing the Law as Art and Law as Compound Artistic Type Hypothesis and locating them within contemporary scholarship. Prior research on ethics codes has suggested, but rarely tested, the effects of code design alternatives on the impact of codes. This study considers whether the presence of explanatory rationales and descriptions of sanctions in ethics codes affects recipients'' responses to a code. Theories of organizational justice and persuasive communication support an expectation that rationales and sanctions will be positively related to code recipients'' recall of code content and perceptions of organizational justice. Content recall is an obvious precondition of code (...) compliance; justice perceptions have multiple implications for the attitudes and actions of organizational members. Results show that explanatory rationales are associated with a statistically significant increase in perceptions of organizational procedural justice, but that rationales and sanctions generally show no relationship to distributive justice perceptions and accurate content recall. These results suggest that common prescriptions regarding ethics code design are of uncertain value apart from further research which unearths the relationships among the intended and perceived purposes of codes, the organizational settings in which they are applied, and a wide variety of code designs. In addition to the many easily observable differences between people, there are also differences in people's subjective experiences that are harder to observe, and which, as a consequence, remain hidden. For example, people vary widely in how much visual imagery they experience. But those who cannot see in their mind's eye, tend to assume everyone is like them. Those who can, assume everyone else can as well. We argue that a study of such hidden phenomenal differences has much to teach (...) cognitive science. Uncovering and describing this variation (a search for unknown unknowns) may help predict otherwise puzzling differences in human behavior. The very existence of certain differences can also act as a stress test for some cognitive theories. Finally, studying hidden phenomenal differences is the first step toward understanding what kinds of environments may mask or unmask links between phenomenal experience and observable behavior. Contemporary critical approaches to bioethics increasingly present themselves as “relational,” though the meaning of relationality and its implications for bioethics seem to be many and varying. I argue that this confusion is due to a multiplicity of relational approaches originating from distinct theoretical lineages. In this article, I identify four key differences among commonly referenced relational approaches: the scope and nature of relationships considered, the extent of the determining influence on individual selfhood, and the integrity of individual selfhood. Importantly, these (...) four differences carry consequences for the usage of relational approaches within academic and clinical bioethics. I show that these differences attach to multiple objects of critique within mainstream bioethics and imply distinct metaethical commitments. Although I issue a cautionary note about combining relational approaches from distinct lineages, I close by suggesting that many such approaches may have their use, drawing on Susan Sherwin's sense of bioethical theories as lenses. On January 30, 2020, the World Health Organization declared a Public Health Emergency of International Concern (PHEIC) over what would quickly become known as SARS-CoV- 2 or COVID- 19. This emergency status was officially ended in the United States in May 2023 amidst much dissent and debate. Although emergency conditions resulting from COVID- 19 will likely wax and wane over the coming years, there is good reason to think that the incidence of severe global pandemics will increase over the next (...) century, as will declarations of emergency. The declaration of an emergency calls for urgent action, but it just as urgently demands careful reflection. Official “emergency” status licenses unparalleled executive intervention, completely reorganizing the lives of those who live under its decree. Such official recognition, however, is heavily dependent on the social context in and from which the emergency arises. Highlighting which circumstances rise to the level of an official emergency clarifies our reigning assumptions about what threshold of active harm—and in relation to which groups of people—demands immediate intervention. In this essay, I want to explore one of the most ironic episodes in the history of propaganda, the attempt by various federal agencies to moderate American WWII anti-Japanese propaganda films. My texts will be four films, two produced by the military, and two by Hollywood: December 7th (1943), directed by Gregg Toland and revised by John Ford; Air Force (1943), directed Howard Hawks; Know Your Enemy: Japan (1945), directed by Frank Capra; and Betrayal for the East (1945), directed by (...) William Berke. As all of these films are readily available on YouTube, I will be brief in my description of them. Instead, I will focus on how they served to intensify racial hatred of Japanese in general and Japanese-Americans in particular, and how the federal government tried to control that propaganda—but was limited by its own policies regarding Japanese-Americans. The term ‘propaganda’ is normally taken in the pejorative sense of deceitful messaging. Propaganda is considered dubious if it is produced by a government agency, especially by a ministry of war or propaganda. In this article, I apply the theory of propaganda I sketched in a prior piece in these pages, under which propaganda is simply messaging intended to persuade others to do something or to support something. Under this theory, propaganda is reasonable if but only if it is evidence-based, (...) truthful, broadly logical, not coercive, targeted at mentally competent adults, and transparent—meaning that the audience should be aware that the message is intended to persuade them to do or support something. I then examine three WWII-era government propaganda films, one—A Defeated People (1946)—produced by the British military, and two—The Negro Soldier (1944) and Teamwork (1947)—produced by the American military. I explain first why I chose these particular films. I then analyze these films in some detail and show that while they were not perfectly rational, they all effectively conveyed the persuasive message that the respective militaries wanted to convey. And they did this by meeting all of the criteria for propaganda to be rational. (shrink)

In this article, I set forth a theory of propaganda explaining what it is, how it relates to marketing, and the nature and types of ideology. I discuss the criteria by which we can judge the rationality or deceitfulness of propaganda. I defend the view that while propaganda can be perfectly rational, it rarely is, and I explain why that is the case. I finish by explaining why the question of the rationality or deceitfulness of propaganda is different from the (...) question of the morality of propaganda. I give two quick examples of how an ethicist might argue that deceptive propaganda might be ethical to use, and perfectly rational propaganda might be immoral to use. I conclude with the notion that the question of the ethics of marketing and propaganda is complex, and should be handled in a separate paper. (shrink)

In his recent essay on moral pluralism in environmental ethics, J. Baird Callicott exaggerates the advantages of monism, ignoring the environmentally unsound implications of Leopold’s holism. In addition, he fails to see that Leopold’s view requires the same kind of intellectual schitzophrenia for which he criticizes the version of moral pluralism advocated by Christopher D. Stone in Earth and Other Ethics. If itis plausible to say that holistic entities like ecosystems are directly morally considerable-and that is a very big if-it (...) must be for a very different reason than is usually given for saying that individual human beings are directly morally considerable. Browning and Kilmister review the nature and possibility of critical political economy in the light of recent post-modern and cultural theory. They provide an historical understanding of critical political economy, focusing on the development of the critical perspectives on capitalism of Hegel and Marx. They then review post-Marxist, post-structuralist, ecological and feminist standpoints that challenge notions of critical political economy sustained in the Hegelian-Marxist tradition. ‘Linguistic meaning must be public’ – for Quine, here is not a statement to rest with, whether it be reckoned true or reckoned false. It calls for explication. When we do, using Quine’s words to piece together what he thought, we find that much too much is concealed by the original statement. Yes, Quine said ‘Language is a social art’; yes, he accepts behaviourism so far as linguistic meaning is concerned; yes, he broadly agrees with Wittgenstein’s anti-privacy stricture. But precisely (...) what is being said by the original statement to be public, and what does calling it ‘public’ amount to? Pressing such questions complicates the picture enormously, partly though by no means entirely aligning Quine with linguistic internalism vis-à-vis Chomsky. (shrink)

Faculty continue to address academic dishonesty in their classes. In this follow-up to an earlier study on general perceived faculty student cheating, using a sample of business school faculty, we compared three levels of faculty classification: full-time non-tenure track, full-time tenured/tenure-track, and part-time adjuncts. Results showed that NTTs perceived higher levels for three different types of student cheating, i.e., paper-based, forbidden teamwork, and hiring someone to take an exam. In addition, NTTs were more likely to report a student for cheating. (...) NTTs reported a higher course load and average class size, and average class size was positively related to all five types of cheating measured. Given the predicted increase in NTTs across all disciplines, making sure that all faculty,, have the resources needed to deter student cheating is important. All faculty have an obligation to hold students accountable for their behavior. Individual integrity is paramount; and it is what employers expect. Regardless of the chosen field or discipline, an employer’s expectations, in terms of character, is to hire individuals who possess a level of honesty that is above reproach. Addressing cheating is an obligation that all faculty need to address purposefully. Providing resources to help faculty address cheating is critical. Resources might include conflict resolution training to provide instructors with the necessary guidance so that they can better handle these difficult situations. This is important not only for the student while in school, but also for a university/college’s reputation. (shrink)

The Objective Threshold/Strategic Model proposes that strong, qualitative inferences of unconscious perception can be made if the relationship between perceptual sensitivity and stimulus visibility is nonlinear and nonmonotonic. The model proposes a nadir in priming effects at the objective identification threshold . These predictions were tested with masked semantic priming and repetition priming of a lexical decision task. The visibility of the prime stimuli was systematically varied above and below the objective identification threshold. The obtained relationship between prime visibility and (...) priming facilitation was nonlinear, but the results failed to confirm a nadir in priming effects at the objective identification threshold. We conclude that the objective identification threshold does not necessarily indicate the point where presumably unconscious priming effects might be inhibited by conscious cognitive processes.
