The scarcity of transitional forms in the geological record was a problem concerning 19th-century transmutation species theories. According to Charles Robert Darwin (1809-1882), it was perhaps the most serious objection to his proposed theory in the several Editions of The Origin of Species, departing 1859. Although Darwin and other scholars proposed explanations, this problem persisted until the 20th century in the Modern Synthesis. In the 1970s, two American palaeontologists, Niles Eldredge and Stephen Jay Gould (1941-2002), presented the punctuated equilibrium hypothesis (...) as an alternative to the gradualism that Darwin and the Modern Synthesis admitted. This paper aims to discuss the proposal of the punctuated equilibrium. In addition, the foundation Gould and Eldredge gave and how the scientific community reacted to it. The analysis showed that punctuated equilibrium complemented Darwin's proposal and the Modern Synthesis. Thus, criticisms such as opposition to these ideas are unjustified. The authors sought to base their hypothesis on evidence from their and other authors' investigations. The reactions to the proposal varied during the period studied (1972-1993). Still, it got more accepted among palaeontologists and met with more significant restrictions among those who dedicated themselves to genetics, mainly to population genetics. (shrink)

Gottlob Frege criticized Kant's use of the term "representation" in a footnote in the Foundations of Arithmetics. According to Frege, Kant used the term "representation" for mental images, which are private and incommunicable, and also for objects and concepts. Kant thereby gave "a strongly subjectivistic and idealistic coloring" to his thought. The paper argues that Kant avoided the kind of subjectivism and idealism which Frege hints in his remark. For Kant, having "Vorstellungen" requires the capacity of synthesis, by virtue of (...) which the mind goes beyond its subjective states, and its modifications become presentations of an independent world. O artigo apresenta como princípio de sua fundamentação a possibilidade de compreender a filosofia de Platão como saber que intenciona, sobretudo, a formação e transformação do ser mesmo do homem, isto é, a alma mediante um processo terapêutico aplicado sobre si. Neste sentido será a partir da proposta interpretativa encontrada nas obras do helenista francês, Pierre Hadot, sobre a filosofia antiga, que inferir-se-á que em Platão há uma terapêutica da psyché, a qual, se fundamenta e se revela de maneira necessariamente (...) triádica: o cuidado de si, o conhecimento de si e o domínio sobre si, aqui denominados de “exercícios espirituais”, esta referida tríade, caracterizaria a filosofia platônica como um modo de vida, ou seja, uma proposta de ser abrangente que integre theoría e práxis. Por conseguinte, considera-se a existência de dois claros objetivos na filosofia como terapia da psyché que se justapõem: oferecer formação filosófico-espiritual à psyché e preparar ao bíos politiké. What are human rights? What makes a particular human rights claim ‘genuine’ or ‘valid’? These are difficult questions with which current philosophical literature on human rights is concerned. They are also the same kind of questions that legal philosophers asked about Law throughout the 20th century. Drawing from the similarities between the two fields, I attempt to do with the concept of human rights something similar to what Ronald Dworkin accomplished with that of Law in Law’s Empire. First, I offer (...) a critique of the two dominant perspectives on human rights—the Orthodox and Political views—that is similar in character to Dworkin’s Semantic Sting objection to Legal Positivism. Second, I sketch an alternative, Dworkinian-inspired framework that seeks to develop the notion of human rights as an interpretive concept. According to this framework, different accounts of human rights are to be understood as expressing different interpretations of the point (or purpose) of human rights practice. (shrink)

No decorrer do debate sobre o realismo científico, alguns antirrealistas, tal como Leo Tolstói e Larry Laudan, criaram um desafio cético para os realistas, questionando, com base na história da ciência, a crença realista de continuidade entre as teorias do passado, atuais e futuras. Stathis Psillos ofereceu uma réplica que ficou conhecida como realismo seletivo ou divide et impera, alegando que, através de um minucioso exame, podemos encontrar elementos teóricos de continuidade entre teorias passadas e atuais, assegurando, por analogia, que (...) as teorias futuras também possuirão elementos de continuidade com as atuais. A estratégia de Psillos, se bem empregada, pode evidenciar que a leitura realista de história da ciência também possui suas virtudes e deve ser considerada. Todavia, no presente artigo, argumentamos que mesmo que o realismo seletivo de Psillos se mostre aplicável, ele deve ser considerado como uma crítica a concepções descontinuístas em história da ciência e não necessariamente ao antirrealismo científico em geral, posto que o empirismo construtivo de Bas van Fraassen, por exemplo, admite a continuidade teórica na ciência. O argumento da abdução de Charles Peirce, ou raciocínio abdutivo, frequentemente foi identificado na literatura de Filosofia da Ciência com o argumento da inferência da melhor explicação (IBE) de Gilbert Harman. Essa identificação, embora muito comum, foi esclarecida como um equívoco, visto que enquanto a abdução descreve um processo gerativo de teorias, a IBE de Harman trata de um processo seletivo entre alternativas teóricas rivais. Todavia, Peter Lipton, buscando desenvolver IBE, apresentou uma estrutura muito similar à abdução peirciana com a (...) finalidade de oferecer um modelo capaz de descrever tanto os momentos de geração, quanto de seleção de teorias. O objetivo deste artigo é o de mostrar que as duas diferentes concepções de IBE (a de Harman e de Lipton) implicam diferentes concepções sobre a própria noção de aceitação: enquanto Harman deixa a aceitação para uma etapa avaliatória final, Lipton coloca a aceitação no interior do processo de geração de uma produção científica. USO MEDICINAL DA MACONHA: UMA ALTERNATIVA AO DIREITO À SAÚDE.

O objetivo do presente texto é explanar e correlacionar duas interpretações do conceito de consciência infeliz [conscience malhereuse], desenvolvido por Hegel na Phänomenologie des Geistes: a de Jean Wahl, introduzida em Le malheur de la conscience dans la philosophie de Hegel, de 1929; e a de Gilles Deleuze, apresentada em Nietzsche et la philosophie, de 1962. Antes de tudo, expomos a interpretação de Wahl, que, marcada pela defesa da centralidade da noção de consciência infeliz no interior da obra hegeliana, foi (...) determinante para a recepção de Hegel na filosofia francesa do século XX, antes das célebres palestras de Kojève. A seguir, descrevemos de que maneira Deleuze, em Nietzsche et la philosophie, articula uma leitura crítica do hegelianismo, em que também subscreve à centralidade da consciência infeliz, mas associando-a, à sua maneira, ao conceito nietzschiano de má consciência, a ser também tipificado. Por fim, relacionamos as duas leituras apresentadas, o que deve elucidar a maneira pela qual Deleuze retoma as concepções de Wahl no contexto de sua própria crítica a Hegel como, segundo a caracterização deleuziana, filósofo da representação e do ressentimento. O artigo se propôs a compreender o tema das notícias falsas como tópico que aglutina em torno de si, questões que são de caráter eminentemente ético e epistêmico, educacional e político. Desse modo utilizou-se do diálogo Górgias, de Platão, para que mediante as suas problematizações como a oposição entre opinião e conhecimento e entre a racionalidade discursiva da filosofia e a retórica sofística, fosse então possível a problematização de um tópico contemporâneo a partir de uma contextualização filosófica clássica. Nesse sentido (...) evidenciou-se que tanto a retórica como as fake news possuem a mesma finalidade, isto é, meramente persuadir, portanto, levar a crer sem considerar a distinção entre simples opinião e conhecimento. Do mesmo modo o artigo apresentou como possibilidade de enfrentamento aos danos causados pelas notícias falsas uma perspectiva filosófico-educacional fundamentada nos conceitos complementares de Paideia e de Bildung, demonstrando-se assim que a causa primária de criação e propagação de fake news é, em verdade, originaria de falhas formativas à educação da pessoa humana. Assim, sugestiona-se que a formação humana em sentido racional e ético, condicionada na aquisição de virtude ou excelência (arete) na alma (psyche), bem como uma formação direcionada ao autodesenvolvimento da pessoa, são imprescindíveis para atenuar, de modo profícuo, as inverdades e injustiças provindas das notícias falsas que, invariavelmente, ocasionam prejuízos diversos aos indivíduos, às sociedades e às democracias. O artigo apresenta e desenvolve duas questões: as aulas de filosofia no ensino médio brasileiro e a filosofia de Platão. A primeira questão é trabalhada mais como consequência prática profissional, todavia, não abstendo-se de significativas contribuições teóricas. A segunda questão, ou seja, a filosofia de Platão, resulta de pesquisa acerca do filósofo ateniense, no que pode-se encontrar em sua extensa produção, e que venha diretamente a contribuir com a prática docente de profissionais de filosofia, que atuam, sobretudo, no magistério de (...) educação básica. Apresentamos uma reconstrução da argumentação de Campos a favor da distinção entre abdução e inferência da melhor explicação, enfatizando a interpretação de Campos sobre inferência da melhor explicação na perspectiva de Peter Lipton. Em contraposição a Campos, que defende uma distinção parcial entre abdução e a inferência da melhor explicação, neste artigo sugerimos uma distinção (...) completa entre as formas de raciocínio. O objetivo do artigo é apresentar e analisar o que é a Doutrina da Essência. Por que a essência é a esfera de mediação entre a lógica objetiva e a lógica subjetiva, e sendo a própria essência incluída na lógica objetiva? Essa é a questão que nos guia. Para isso, é claro, será necessário expor de modo geral o significado de cada um dos momentos da lógica de Hegel e como eles se relacionam. Ou seja, o que são e como (...) se relacionam as duas subdivisões da lógica (lógica objetiva e lógica subjetiva), o que são e como se relacionam os três momentos da lógico (ser, essência e conceito), e como se relacionam as duas subdivisões da lógica (lógica objetiva e lógica subjetiva) com os três momentos do lógico (ser, essência e conceito). De acordo com a concepção socioconstrutivista, uma compreensão da ciência deve levar em conta não apenas a própria ciência, mas também uma compreensão da sociedade. Contemporaneamente, isto se torna mais claro quando se leva em conta exemplos reais, tal como o problema da tragédia (futura ou já em andamento) do aquecimento global. O objetivo deste artigo é mostrar que situações como a do aquecimento global não são compreendidas apenas a partir da ciência ou da sociedade isoladamente, senão que por meio (...) da relação entre ambas. A tradução que se segue é baseada na seção dedicada à filosofia de Friedrich Heinrich Jacobi (1743–1819), presente nas Lições sobre a história da filosofia (Vorlesungen über die Geschichte der Philosophie) de Georg Wilhelm Friedrich Hegel (1770–1831). O recorte em questão encontra-se no vigésimo volume (Band 20) da edição Theorie Werkausgabe (TWA), organizada por Karl Markus Michel e Eva Moldenhauer, e publicada pela editora alemã Suhrkamp em 1986.

Nesta investigação, propomo-nos demonstrar que Jesus foi um verdadeiro contador de histórias. A narrativa lucana conhecida tradicionalmente por parábola do Filho pródigo não é propriamente uma parábola, pois assume os contornos formais de um conto, podendo-se nela encontrar as caraterística centrais do género literário “o conto”. Nela encontramos propriedades configuradoras da sua individualização como género: a conclusão moralizante de uma história fechada, com princípio, meio e fim; a concentração de espaço, tempo e reduzido número de personagens; a curta extensão sintagmática, (...) mas sempre extensa comparada com a das parábolas. Em suma, concluímos que estamos perante um verdadeiro e extraordinário conto. Há, no entanto, outras narrativas evangélicas que pelas suas características se assemelham à do Filho pródigo. Podemos assim identificar a do Administrador infiel, a narrativa dos Vinhateiros homicidas, a das Moedas de ouro e respetivos paralelos de Mt, que se revestem de característica muito semelhantes às do Filho pródigo, apesar de muito menos desenvolvidas e que, no fundo, as consideramos como sendo embriões de contos. O segundo, por sua vez, é fruto de uma conferência de abertura ministrada por Fritz Berolzheimer na ocasião do III Kongress der Internationalen Vereinigung für Rechts- und Wirtschaftsphilosophie, realizado entre os dias 02 e 05 de junho de 1914 na Akademie für Sozial- und Handelswissenschaften em Frankfurt am (...) Main. A abertura do congresso realizada por Berolzheimer, assim como outras conferências proferidas ao longo do mesmo, foi publicada em Stuttgart pela Franz Steiner Verlag no mês seguinte à realização do congresso, isto é, em julho de 1914 no volume 7, número 4, da ARWP. Este artigo, um recorte de pesquisa de Doutorado, objetiva desvelar as percepções de 208 professores de filosofia do Paraná no sentido de buscar evidenciar quais seriam as especificidades da disciplina de filosofia em relação a outras disciplinas do currículo. Inicialmente, disserta-se sobre a intermitência da disciplina de Filosofia no currículo da Educação Básica, com base em Deleuze e Guattari (2010), os quais demarcam o entendimento da filosofia como criação de conceitos. Em seguida, fundamentado em Rodrigues e Gelamo (2019), entre (...) outros autores, reflete-se sobre o modo de compreender a filosofia, que pode oscilar entre uma compreensão enciclopédica com base na memorização dos sistemas filosóficos e experiência filosófica. Por fim, por meio da análise de conteúdo de Bardin (2016), a seguinte questão de um questionário que envolvia outras dez foi analisada: “Você acredita que a filosofia proporciona espaços ou momentos diferenciados em relação aos das outras disciplinas? Se sim, no que ela se diferencia?”. Das respostas dos 208 docentes, emergiram as seguintes categorias: criar conceitos, espaço para o debate/reflexão de ideias, possibilidade da experiência filosófica e superar o senso comum. Os resultados apontam, assim, em um sentido de que a disciplina de filosofia não deve limitar-se a um conhecimento enciclopédico, mas, sim, trata-se de um conhecimento que se relaciona com o cotidiano de seus interlocutores. Faz-se necessário, porém, um saber valorizar adequadamente a história da filosofia, pois, ao valorizar demais a história da filosofia, pode-se incorrer a um ensino meramente descritivista; contudo, ao não valorizar a história da filosofia, pode-se debruçar em discussões sem conteúdo filosófico. The so-called Trolley Problem was first discussed by Philippa Foot in 1967 as a way to test moral intuitions regarding the doctrine of double effect, Kantian principles and utilitarianism. Ever since, a great number of philosophers and psychologists have come up with alternative scenarios to further test intuitions and the relevance of conventional moral doctrines. Given that physicians routinely face moral decisions regarding life and death, the Trolley Problem should be considered of great importance in medical ethics. In this article, (...) five “classic” trolley scenarios are discussed: the driver diverting the trolley, a bystander pulling a lever to divert the trolley, a fat man being thrown from a bridge to stop the trolley, a bystander pulling a lever to divert a trolley so that a fat man may be run over, and a bystander pulling a lever so that a fat man falls off from a bridge to stop the trolley. As these scenarios are discussed, relevant moral differences amongst them are addressed, and some of the applications in medical ethics are discussed. The article concludes that Trolley scenarios are not the ultimate criterion to make ethical decisions in difficult ethical challenges in medicine cases but they do serve as an initial intuitive guide. El artículo gira en torno a la pregunta de si la filosofía de la ciencia no habrá llegado a su fin en la medida en que sigue siendo planteada como un programa de investigación que no aborda el problema hermenéutico fundamental, a la hora de intentar resolver el problema de la carga de teoría de la base empírica. Para ello, se repasa la historia del problema, tanto en sus aspectos metodológicos como fi losóficos; se reseña la filosofía de la ciencia (...) posterior a Feyerabend (que nosotros llamamos post-popperiana), y se pone peculiar atención al “nuevo experimentalismo” y a la noción de “teoría” que está en juego en el debate. Allí es donde introducimos la importancia del giro hermenéutico y una propuesta conceptual y terminológica para el famoso “testeo empírico”. Aclaramos luego que el realismo en la filosofía de la ciencia es una cuestión filosófica, no metodológica, para concluir finalmente en lo que se quería demostrar. (shrink)

Based on an analysis of a landmark case Lim Mey Lee Susan v Singapore Medical Council in Singapore where a doctor was professionally disciplined for over-charging a wealthy patient, a judgement upheld by the Singapore High Court, this paper will discuss the notion of an ‘ethical price’ (EP) and its determination with respect to the provision of healthcare services. It will first examine the limitations of a legal approach for setting an ethical limit to pricing. From there, it will argue (...) that Confucian philosophy provides a useful ethical framework to explore EP, with focus on the context of Singapore. The following question is addressed: What is an ethical pricing standard for medical practice from a Confucian perspective? The strengths and limitations of a Confucian value base as regards the determination of an objective EP will be analysed through an examination of the shortcomings of the doctor’s behaviour in the Susan Lim case as well as other case scenarios. The paper will conclude with some practical suggestions on how Confucian-based ideas can be applied to decision-making on pricing and the importance of this for medical professionalism and ethics teaching. Corporations perform actions that can inflict harm with different levels of intensity, from death to material loss, to both companies’ internal and external stakeholders. Research has analysed corporate harm using the notions of corporate social irresponsibility and corporate crime. Critical management studies have been subjecting management and organizational practices and knowledge to critical analysis, and corporate harm has been one of the main concerns of CMS. However, CMS has rarely been deployed to analyse CSIR and corporate crime. Thus, the aim (...) of this paper is to critically analyse the perspectives of CSIR and corporate crimes on corporate harm via CMS in general and postcolonial studies in particular. The paper contributes by arguing that research on CSIR and corporate crime could be perceived as producing research that does not challenge the essence of contemporary corporation profit-seeking activities that ultimately produces corporate harm. We argue that CSIR and corporate crime are ideologies that assist in disguising the contradiction between producing shareholder value and the social good that is at the heart of the modern corporation system and the current economic system. Furthermore, the postcolonial view of CSIR and corporate crime highlights how they are based on a Western-centric view of corporate harm that ignores the realities and perspectives of the Global South, especially in situations where corporate harm leads to death in the Global South. In recent years, many disciplines have become interested in the scientific study of morality. However, a conceptual framework for this work is still lacking. In The Moral Background, Gabriel Abend develops just such a framework and uses it to investigate the history of business ethics in the United States from the 1850s to the 1930s. According to Abend, morality consists of three levels: moral and immoral behavior, or the behavioral level; moral understandings and norms, or the normative level; and (...) the moral background, which includes what moral concepts exist in a society, what moral methods can be used, what reasons can be given, and what objects can be morally evaluated at all. This background underlies the behavioral and normative levels; it supports, facilitates, and enables them. Through this perspective, Abend historically examines the work of numerous business ethicists and organizations--such as Protestant ministers, business associations, and business schools--and identifies two types of moral background. "Standards of Practice" is characterized by its scientific worldview, moral relativism, and emphasis on individuals' actions and decisions. The "Christian Merchant" type is characterized by its Christian worldview, moral objectivism, and conception of a person's life as a unity. The Moral Background offers both an original account of the history of business ethics and a novel framework for understanding and investigating morality in general. (shrink)

The use of genomic testing in pregnancy is increasing, giving rise to questions over how the information that is generated should be offered and returned in clinical practice. While these tests provide important information for prenatal decision-making, they can also generate information of uncertain significance. This paper critically examines three models for approaching the disclosure of variants of uncertain significance (VUS), which can arise from forms of genomic testing such as prenatal chromosomal microarray analysis (CMA). Contrary to prevailing arguments, we (...) argue that respect for reproductive autonomy does not justify adopting a model on which an offer to disclose VUS is a routine part of genetic counselling. Instead, we contend that a commitment both to solidarity between healthcare providers and pregnant women and to the acceptance of a novel principle of caution under normative uncertainty means that we should instead adopt a model of VUS disclosure that imposes a strong presumption against offering to disclose VUS. The upshot of this is that it should be standard practice to only offer to disclose VUS when this is requested by the woman undergoing CMA. We defend our position against claims that arise from an alleged right to such information and that a presumption against an offer will lead to inequity. (shrink)

Act Three of Gabriel Marcel’s play, The Emissary, is presented here in English for the first time. The introductory essay introduces Marcel and several of his best known themes, especially the distinctions between problem and mystery, and primary and secondary reflection. Focusing on the relationship between experience and conceptual knowledge, it discusses Marcel’s attempt to argue philosophically for a return to ordinary experience. The role of drama and art in the recovery of the realm of mystery is also highlighted. (...) The play illustrates these themes at the concrete level as it raises many of the challenging situations and moral dilemmas that emerged from the occupation of France by a brutal enemy during World War II. The realities of deceit, betrayal and blackmail are all in the air, as are real worries about reprisals, violence, and irreparable loss. In a moving, gripping drama, Marcel portrays the occupation as an occasion for deep soul-searching among the characters, in the midst of great suffering and loss, and, rather than passing easy judgment, he suggests a journey toward healing, one inspired by compassion, honesty, courage, and faith. David Kaplan observed in Kaplan that the principle \\) cannot be verified at a world in a standard possible worlds model for a quantified bimodal propositional language. This raises a puzzle for certain interpretations of the operator Q: it seems that some proposition p is such that is not possible to query p, and p alone. On the other hand, Arthur Prior had observed in Prior that on pain of contradiction, ∀p is Q only if one true proposition is Q (...) and one false proposition is Q. The two observations are related: ∀p is elusive in that it is not possible for the proposition to be uniquely Q. Kaplan based his model-theoretic observation on Cantor’s theorem, but there is a less well-known link between this simple set-theoretic observation and Prior’s remark. We generalize the link to develop a heuristic designed to move from Cantor’s theorem to the observation that a variety of sentences of the bimodal language express propositions that cannot be Q uniquely. We highlight the analogy between some of these results and some set-theoretic antinomies and suggest that the phenomenon is richer than one may have anticipated. (shrink)

I will present a short overview of Hintikka’s main ideas in logic, starting with his early work on constituents and model sets, continuing with his contributions to epistemic logic, up to his later work in game-theoretical semantics and the Interrogative Model of Inquiry.

Moral repair is an important way for firms to heal moral relationships with stakeholders following a transgression. The concept is rooted in recognition theory, which is often used to develop normative perspectives and prescriptions, but the same theory has also propelled a view of moral repair as premised on negotiation between offender and victim(s), which involves the complex social construction of the transgression and the appropriate amends. The tension between normative principles and socioconstructivist implementation begs the question how offending firms (...) should approach moral repair. Addressing this question, we develop a two-level conceptualization of moral repair, distinguishing between procedural and substantive levels of practice, which accommodate normativity and socioconstructivism, respectively. In so doing, we enrich the literature by 1) promoting conceptual clarity, 2) refining understanding of the moral repair process, and 3) suggesting the use of a unified, configurational approach to studying (nonlinear) relations between amends and moral outcomes.
