Research shows that the physician’s personal attributes and social characteristics have a strong association with their end-of-life decision making. Despite efforts to increase patient, family and surrogate input into EOL decision making, research shows the physician’s input to be dominant. Our research finds that physician’s social values, independent of religiosity, have a significant association with physician’s tendency to withhold or withdraw life sustaining, EOL treatments. It is suggested that physicians employ personal social values in their EOL medical coping, because they (...) have to cope with existential dilemmas posed by the mystery of death, and left unresolved by medical decision making mechanisms such as advanced directives and hospital ethics committees. The main aim of this paper is to disentangle three senses in which we can say that a model represents a system—denotation epistemic representation, and successful epistemic representation--and to individuate what questions arise from each sense of the notion of representation as used in this context. Also, I argue that a model is an epistemic representation of a system only if a user adopts a general interpretation of the model in terms of a system. In the process, I hope to (...) clarify where those who, following Craig Callander and Jonathan Cohen, claim that there is no special problem about scientific representation go wrong. In the terminology adopted here, even if scientific representation is only an instance of epistemic representation, scientific representation should not be confounded with denotation. (shrink)

Sociological propositions about the workings of cognition are rarely specified or tested, but are of central relevance to studies of culture, social judgment, and social movements. This paper draws out lessons of recent work from sociological theory, cognitive science, psychology, and neuroscience on the embodied nature of knowledge and thought, and develops implications of these lessons for cultural and cognitive sociology. Knowledge ought to be conceived of as fundamentally embodied, because sensory information is a fundamental component of experience as it (...) is stored in long-term memory, and because bodily responses and intuitions often precede reflexive or strategic thought. I argue that the challenge of embodied knowledge for cultural sociology is threefold: to develop cultural theories of motivation; to specify the ways in which the body structures discourses endogenously; and to specify how embodied motivations and embodied discourses interact. In these writings by one of our most creative legal philosophers, Meir Dan-Cohen explores the nature of the self and its response to legal commands and mounts a challenge to some prevailing tenets of legal theory and the neighboring moral, political, and economic thought. The result is an insider's critique of liberalism that extends contemporary liberalism's Kantian strand, combining it with postmodernist ideas about the contingent and socially constructed self to build a thoroughly original perspective on some of the (...) most vital concerns of legal and moral theory.Dan-Cohen looks first at the ubiquity of legal coercion and considers its decisive impact on the nature of legal discourse and communication, on law's normative aspirations and claim to obedience, and on the ideal of the rule of law. He moves on to discuss basic values, stressing the preeminence of individual identity and human dignity over the more traditional liberal preoccupations with preference-based choice and experiential harm. Dan-Cohen then focuses more directly on the normative ramifications of the socially constructed self. Fundamental concepts such as responsibility and ownership are reinterpreted to take account of the constitutive role that social practices--particularly law and morality--play in the formation of the self.Throughout, Dan-Cohen draws on a uniquely productive mix of philosophical traditions and subjects, blending the methods of analytic philosophy with the concerns of Continental philosophers to reconceive the self and its relation to ethics and the law. There has recently been much debate about the idea of levying a tax on particular transactions on international financial markets. Economists have argued about how much revenue such an international financial transaction tax would raise and they disagree about what effects it would have on trade volumes, financial stability, and overall growth. Politicians have argued about the feasibility of introducing such a tax internationally and they disagree on its adequacy as a policy response to the current financial and economic crisis. (...) This article contributes to the debate about international financial transaction taxation by bringing the perspective of political philosophy to bear on the politicians’ and economists’ arguments about policy. I shall outline a framework for thinking about justice in finance, and defend the idea of an international financial transaction tax as an instrument for making the international financial system more just. Economic theory teaches that it is in every country’s interest to trade. Trade is a voluntary activity among consenting parties. On this view, considerations of justice have little bearing on trade, and political philosophers concerned with global justice should stay largely silent on trade. According to a very different view that has recently gained prominence, international trade can only occur before the background of an international market reliance practice shaped by states. Trade is a shared activity among states, and all (...) participating states have in principle equal claims to gains from trade. Trade then becomes a central topic for political philosophers. Both views are problematic. A third view about the role of trade in a theory of global justice is then presented, which gives pride of place to a notion of exploitation. Humans, animals, and the environment face a universal crisis: antimicrobial resistance. Addressing AR and its multi-disciplinary causes across many sectors including in human and veterinary medicine remains underdeveloped. One barrier to AR efforts is an inconsistent process to incorporate the plenitude of stakeholders about what AR is and how to stifle its development and spread—especially stakeholders from the animal agriculture sector, one of the largest purchasers of antimicrobial drugs. In 2019, The Wellcome Trust released Reframing Resistance: How to communicate about (...) antimicrobial resistance effectively, which proposed the need to establish a consistent and harmonized messaging effort that describes the AR crisis and its global implications for health and wellbeing across all stakeholders. Yet, Reframing Resistance does not specifically engage the animal agriculture community. This study investigates the gap between two principles recommended by Reframing Resistance and animal agriculture stakeholders. For this analysis, the research group conducted 31 semi-structured interviews with a diverse group of United States animal agriculture stakeholders. Participants reported attitudes, beliefs, and practices about a variety of issues, including how they defined AR and what entities the AR crisis impacts most. Exploration of Reframing Resistance’s Principle 2, “explain the fundamentals succinctly” and Principle 3, “emphasis that this is universal issue; it can affect anyone, including you” reveals disagreement in both the fundamentals of AR and consensus of “who” the AR crisis impacts. Principle 2 may do better to acknowledge that animal agriculture stakeholders espouse a complex array of perspectives that cannot be summed up in a single perspective or principle. As a primary tool to combat AR, behavior change must be accomplished first through outreach to stakeholder groups and understanding their perspectives. (shrink)

The Russell–Myhill theorem threatens a familiar structured conception of propositions according to which two sentences express the same proposition only if they share the same syntactic structure and their corresponding syntactic constituents share the same semantic value. Given the role of the principle of universal instantiation in the derivation of the theorem in simple type theory, one may hope to rehabilitate the core of the structured view of propositions in ramified type theory, where the principle is systematically restricted. We suggest (...) otherwise. The ramified core of the structured theory of propositions remains inconsistent in ramified type theory augmented with axioms of reducibility. This is significant because reducibility has been thought to be perfectly consistent with the ramified approach to the intensional antinomies. Nor is the addition of reducibility to ramified type theory sufficient to restore other intensional puzzles such as Prior’s paradox or Kripke’s puzzle about time and thought. (shrink)

In this paper I set out what I call a ‘conquest’ conception of Hume's experimental science of man. It is notable, I claim, that Hume regards what he calls the ‘capital’ of the sciences – ‘the science of MAN’ – as occupied territory, and that he views his ‘direct’ method of approach upon the science of human nature as a ‘conquest’. I expand upon such statements by leveraging the comparison that Hume draws between experimental moral philosophy and the experimental tradition (...) in natural philosophy inaugurated by Francis Bacon. Overall, I suggest that Hume's decision to ground his science of human nature upon experience and observation is as much about overthrowing the epistemic authority of speculative dogmas as it is about establishing a secure foundation for his system of the sciences, and I contend that Hume's application of his hypotheses to animals is central to this conception of his philosophical project in the Treatise. Antropología y ética de José Gómez Caffarena es el título de la obra en la que realizo una lectura del pensamiento del autor madrileño desde las problemáticas contemporáneas al ponerlo en diálogo con las filosofías más representativas del siglo XX-XXI, como: el posmodernismo, el estructuralismo o el neo-positivismo. El presente artículo da una visión genérica, aunque esperamos lo suficientemente profunda y comprensible, del proyecto ético que encierra la compleja filosofía caffareniana. (shrink)

Fichte, for a science to possess systematic form the science must begin with a first principle known with certainty and each proposition within the science must be validly connected to the first principle. The content of the Wissenschaftslehre consists of essentially one kind of content, what he calls “the acts of the human mind” He also holds that the Wissenschaftslehre provides each science its own first principle, thus making up part of its content. Following his first (...) publications, F. W. J. Schelling began to simultaneously develop a philosophy of nature, or Naturphilosophie, and to systematize his view of transcendental philosophy. His Ideas for a Philosophy of Nature and First Outline of a System of the Philosophy of Nature were followed by the System of Transcendental Idealism. Where Spinoza attempted to provide a model of the unconditional as a self‐causing substance, Schelling conceives of the unconditional as the absolute or self‐positing. (shrink)

In the genomics era, bioinformatic analysis, especially in non‐model species, facilitates the identification and naming of numerous new proteins, the function of which is then inferred through homology searches. Here, we question certain aspects of these approaches. What are the criteria that permit such a determination? What are their limits? Naming is classifying. We review the different criteria that are used to name a protein and discuss their constraints. We observe that the name given to a protein often introduces a (...) bias for further functional analyses, a bias that is not often taken into account when analysing results. Last but not least, the heterogeneity of criteria used for naming proteins leads to self‐inconsistent or contradictory protein classification that is potentially misleading. This paper offers a new version of a historically influential, yet today unpopular, neglected, and on the whole insufficiently developed argument for socialism: socialism makes it possible for people to really act together. This idea of socialist action, combining the claims that there is a particularly valuable form of joint action and that socialism is about making such action possible, played an important role in the history of the labor movement, going back to the early Marx and running through various (...) strands of socialist thought. I shall argue that socialist action should be seen as central to the socialist project, its critique of capitalism, and the institutional alternatives envisaged by it. (shrink)

In this paper I examine the relation between modern transhumanism and Nietzsche’s philosophy of the superhuman. Following Loeb, I argue that transhumanists cannot claim affinity to Nietzsche’s philosophy until they incorporate the doctrine of eternal recurrence to their project of technological enhancement. This doctrine liberates us from resentment against time by teaching us reconciliation with time and something higher than all reconciliation. Unlike Loeb, however, I claim that this “something higher” is not a new skill (prospective memory), but rather a (...) love for the past in the form of loving that aspect of it that is still with us, namely, the will to power itself, which is the engine of all life. Love of the past is thus equivalent to love of life. Since human beings are conscious incarnations of the will to power, in our case, love of life manifests itself as love of our humanity or love for that aspect of ourselves that connects us to each other, for we recognize it to be the same in all of us. Thus, learning this kind of love enables us to joyfully coordinate our wills in the pursuit of Zarathustra’s superhuman ideal without turning it into a destructive mockery of itself. While learning this kind of love would facilitate a joyful version of transhumanism, I conclude by suggesting that it is unlikely to be achieved through technological interventions of the sort envisioned by transhumanists. Instead, it requires the kind of participatory pedagogical program that Nietzsche thought his Zarathustra would fulfill. (shrink)

Although stakeholder theory is widely accepted in environmental disclosure research, empirical evidence about the role of stakeholders in firms’ disclosure is still scarce. The authors address this issue for a setting of carbon disclosure. Our international sample comprises the Carbon Disclosure Project Global 500, S&P 500, and FTSE 350 reports from 2008 to 2011, resulting in a total of 1,120 firms with 3,631 firm-year observations. The authors apply Tobit regressions to analyze the relationship between carbon disclosure and the relevance of (...) the following stakeholder groups: government, general public, media, employees, and customers. Our results confirm that in addition to carbon performance, all stakeholders are associated with carbon disclosure. Only one stakeholder group acts as a moderator for the relationship between carbon performance and carbon disclosure. Furthermore, the authors find that carbon performance but not the affiliation to a carbon-intensive industry acts as a moderator between stakeholder relevance and carbon disclosure. (shrink)

In this essay, we focus on Max Weber’s concept of rationalization to understand and make sense of the rise of bureaucratic, corporate governance and online learning in higher education. We reveal the distinct disconnect between human interaction and online platforms and how such disconnection is antithetical to higher learning. We also show how Weber’s analysis helps us recognize the uniquely crass commercialism embedded in the very rationalization that makes online learning in universities thinkable and actionable. Our use of online learning (...) is only one illustration of Weber’s concept of rationalization, but it provides an important understanding of the nefarious effects rationalization has on human interaction. The nexus of marketization, technology, and higher education represents, on our view, a juggernaut against faculty autonomy, academic freedom, and humane learning and should be directly challenged. One difficulty this challenge faces is the degree to which online learning has become ubiquitous and taken-for-granted. It has, as Weber clarifies, been rationalized. (shrink)

Past life regression therapy is used by some physicians in cases with some mental diseases. Anxiety disorders, mood disorders, and gender dysphoria have all been treated using life regression therapy by some doctors on the assumption that they reflect problems in past lives. Although it is not supported by psychiatric associations, few medical associations have actually condemned it as unethical. In this article, I argue that past life regression therapy is unethical for two basic reasons. First, it is not evidence-based. (...) Past life regression is based on the reincarnation hypothesis, but this hypothesis is not supported by evidence, and in fact, it faces some insurmountable conceptual problems. If patients are not fully informed about these problems, they cannot provide an informed consent, and hence, the principle of autonomy is violated. Second, past life regression therapy has the great risk of implanting false memories in patients, and thus, causing significant harm. This is a violation of the principle of non-malfeasance, which is surely the most important principle in medical ethics. (shrink)

A Crítica da faculdade de julgar foi recebida com entusiasmo pelos filósofos do idealismo alemão. No caso de Friedrich Schelling, as duas partes da obra foram influentes, de modo que não só a estética kantiana, mas também a teleologia foi marcante em sua trajetória filosófica. Observaremos como o filósofo de Leonberg acolhe, na Introdução às Ideias para uma filosofia da natureza, a noção kantiana de organismo como dotado de autocausalidade, mas pensa-a nos quadros de uma filosofia pós-kantiana, buscando prescindir das (...) noções de juízo reflexionante e também da ideia de “natureza como arte” para se pensar o organismo. Como Schelling vincula essa noção com a proposta de se pensar a unidade entre natureza e espírito a partir do próprio sujeito, e não de algo exterior a ele? Como Kant reagiria a tal proposta? The Critique of Judgment was enthusiastically received by the German Idealists. In the case of Friedrich Schelling, both divisions of the work were influent, thus resulting that not only Kantian aesthetics, but also the teleology was a landmark in his philosophical itinerary. We attempt to observe how the philosopher of Leonberg receives, in the Introduction to the Ideas for a Philosophy of Nature, the Kantian conception of organism as endowed with self-causality, but at the same time thinks it within the frame of a post-Kantian philosophy, leaving aside the reflective judgment and also the idea of nature as a product of art in order to think the organism. How does Schelling connect this notion with the proposal to think the unity between nature and spirit based on the own subject, and not on something external to it? How would Kant react to such a proposal? (shrink)

We study a partial order on countably complete ultrafilters introduced by Ketonen [2] as a generalization of the Mitchell order. The following are our main results: the order is wellfounded; its linearity is equivalent to the Ultrapower Axiom, a principle introduced in the author’s dissertation [1]; finally, assuming the Ultrapower Axiom, the Ketonen order coincides with Lipschitz reducibility in the sense of generalized descriptive set theory.

Based on an analysis of a landmark case Lim Mey Lee Susan v Singapore Medical Council in Singapore where a doctor was professionally disciplined for over-charging a wealthy patient, a judgement upheld by the Singapore High Court, this paper will discuss the notion of an ‘ethical price’ (EP) and its determination with respect to the provision of healthcare services. It will first examine the limitations of a legal approach for setting an ethical limit to pricing. From there, it will argue (...) that Confucian philosophy provides a useful ethical framework to explore EP, with focus on the context of Singapore. The following question is addressed: What is an ethical pricing standard for medical practice from a Confucian perspective? The strengths and limitations of a Confucian value base as regards the determination of an objective EP will be analysed through an examination of the shortcomings of the doctor’s behaviour in the Susan Lim case as well as other case scenarios. The paper will conclude with some practical suggestions on how Confucian-based ideas can be applied to decision-making on pricing and the importance of this for medical professionalism and ethics teaching. This paper interprets the relation between sovereignty and guilt in Nietzsche's Genealogy. I argue that, contrary to received opinion, Nietzsche was not opposed to the moral concept of guilt. I analyse Nietzsche's account of the emergence of the guilty conscience out of a pre-moral bad conscience. Drawing attention to Nietzsche's references to many different forms of conscience and analogizing to his account of punishment, I propose that we distinguish between the enduring and the fluid elements of a ‘conscience’, defining the (...) enduring element as the practice of forming self-conceptions. I show that for Nietzsche, the moralization of the bad conscience results from mixing it with the material concepts of guilt and duty, a process effected by prehistoric religious institutions by way of the concept of god. This moralization furnishes a new conception of oneself as a responsible agent and holds the promise of sovereignty by giving us a freedom unknown to other creatures, but at the price of our becoming subject to moral guilt. According to Nietzsche, however, the very forces that made it possible have spoiled this promise and, under the pressures of the ascetic ideal, a harmful notion of responsibility understood in terms of sin now dominates our lives. Thus, to fully realize our sovereignty, we must liberate ourselves from this sinful conscience. (shrink)

Participation trophies in youth sports have become controversial in the so-called “culture wars” of recent years in Western countries. Conservative professional athletes and media pundits deride participation trophies, as they perceive them as akin to equality of outcome and Communist ideology. However, this is a mischaracterization of participation trophies, as liberalism can also provide a philosophical basis for a defense of these trophies. In this article, I rely on John Rawls’ contractual theory to build a defense of participation trophies. These (...) prizes can serve as educational resources to teach young athletes about the dignity of losers in sports, and the need for taxation in order to sustain a safety net in society at large. O conceito de acontecimento é um dos temas centrais do pensamento de Heidegger e oferece um fio condutor para a compreensão de sua obra. Este artigo mostra como a gênese deste conceito está diretamente relacionada à transformação da fenomenologia empreendida por Heidegger ao longo de suas primeiras preleções em Freiburg e fornece algumas indicações sobre a importância deste tópico para o desenvolvimento da ontologia fundamental em Ser e tempo. Nossa análise se divide em três partes. Em primeiro lugar, abordamos a (...) relação entre a intencionalidade e mundo. O nexo do mundo é o espaço de constituição primário da experiência intencional. Essa relação aponta para a crítica de Heidegger à abstração da ontologia formal e para a estrutura do acontecimento como o modo em que se dá a experiência do eu concreto e histórico. A seguir, analisamos o conceito de fenômeno em Heidegger para distinguir sua filosofia da fenomenologia transcendental de Husserl. O elemento central dessa diferença reside na introdução da dimensão de acontecimento e situação no fenômeno, que não se encontra presente no modelo husserliano da intencionalidade. Por fim, apresentamos uma interpretação da relação entre vida fática, acontecimento e situação, para apontar algumas consequências da introdução do problema da história na fenomenologia. (shrink)

We study a case that applies hermeneutics to social sciences, in particular to the Austrian School of economics. We argue that an inaccurate treatment of hermeneutics contributed to an epistemological downgrade of the Austrian School in the economic scientific community. We discuss hoe this shortcoming can be fixed and how a proper hermeneutic application to the Austrian school explains why this school of thought is neither positivist nor postmodern.

Purpose: The article explores Paul’s model of mediation with a focus on the principles and applications that can inform effective conflict resolution in the contemporary church. Apostle Paul’s letter to Philemon offers valuable insights into conflict resolution and mediation, particularly in respect to conflict management amidst church members. Materials and Methods: Using the method of critical examination and hermeneutical assessment of Paul’s epistle to Philemon, this article identifies and analyses the essential elements of Paul’s mediation model. Findings: It is discovered (...) that Paul’s mediation model as a reconciliatory model of conflict management has the following attributes: establishing authority and rapport, appealing to shared values, reframing the relationship, advocating for the vulnerable party, offering reparation and appealing to conscience rather than coercion. Implications to Theory, Practice and Policy: This article recommends the adaptation of Paul’s mediation model to conflicts arising in the contemporary church. (shrink)
